All right. I'd like to call to order the town of East Planning Commission for the month of May.

Uh let the record show that all the commissioners are present and welcome back Ben. Um how we work is uh what we'll do is we'll have the applicant come up, make their presentation, let us know what they're looking for. We would the board will ask questions of the applicant, any kind of clarification we would like. We would pause for a small group discussion amongst the board members and then we would open up to the audience if anybody in the audience like to speak in favor of the proposal or if anybody would like to speak against the proposal and then if necessary a small rebuttal from the applicant. At that point we would uh you know have further discussion and uh if we have enough information to make our decision we'll make our decision tonight. Okay. First item on the agenda is to rem review and approve the planning commission minutes from uh May sorry March 18th. Make a motion to approve. I have a motion to approve. Do we have a second?

I opposed. Motion carries. Next item on the agenda is the uh setback variance W2173 Dan and Lane parcel PA 2025 0000003 uh Michael Marks. Yes. All right. Uh thank you everybody for meeting with us tonight. Um so we are looking to build a um an out building on our property on Dan and Lane and due to some constraints of how the property right ofway easements were drawn up is limiting the buildable location um for my barn. And so we are looking to um get a variance on the setback easement of 25 ft to 9.8 ft. Um so I've got a few different things um kind of showing the proposed layout and the constraints that um we are having. Um so this is a copy of the survey here. Um so the right of way easement is drawn at 138.14 ft wide. Um as you all know normal right ofway easements are about 66 ft wide. Um, and because of that, um, it's making it to where we would have to set back even further back here. And on, uh, this sheet here, um, shows where it would have to be if it was, um, if we went with the 25 ft. And then there's

the underground electric that would run under the corner of that building. Um, so would make it very not cost effective and we'd have to try to tear up the electrical and have that re um reestablished in a different location. Um, so we are asking for a variance of 9.8 ft due to that extremely wide um, rightway easement. Um my proposal is is based on even if we did 33 feet from the edge of the culde-sac um instead of the center line, I would still be set back 47 ft from that mark to where the barn would start and it would have no um issues with the underground electric or any access to the road or anything based on the location of the building. Um, I also have in here letters from each of the other four families that live on the on the um private road. um you know stating the the size of the building um and the issues that we're having due to the underground utilities um and that everything will remain separated from the travel portion of the road. Nothing will impede any any travel or anything on on our private road. Um, and one thing that I would note is the the the main person that would be affected by it, um, is Gail Jensen. Um, and she's the one

her house is right here, right out of right to the west of where we're proposing to build the barn. And you know, we've taken a lot of consideration with her and had many conversations with her, even you know, talking about the position of the building, the colors of the building to make sure that she's going to be okay with it because we don't we're new to the neighborhood and we didn't want to come in and tick everybody off by building a barn and, you know, have it affect them. Um, and your sideyard setback is conforming, too.

Correct. Um, and so like I said, we're we're looking to to get that variance in order to be able to build the barn in a location that's um requested. The barn will be used for storing, you know, we've got a camper, boats, UTV, you know, toys. Um, and you know, we we've got valuable things that we want to protect from the the elements of our, you know, Wisconsin weather, um, to help make them last as long as possible. Um, so see if you have anything else you wanted to add on. Um, yeah, so like I said, we're we're looking for the consideration on um the approval of that variance. um so that we'd be able to enjoy our property to its fullest and you know like I said not impact anybody else uh and you know with it being on a private road it has no impact to public at all. Um so we're hoping for your approval on that.

Can you clarify that the the 138t rightway is it really like if you take that east west strip and just carry it all the way over to the western edge of the property is that what the county states is the rightway. Yep. So, what they told me is that

this corner right here um is basically I have to draw an imaginary line all the way across to the west line. And where that meets is where the right of way is even though my parcel is this and that entire thing because the the the road itself is on our parcel. Okay. And then I you you rattled off a few numbers, but so how far off of the paved culde-sac with the building be approximately as as you had it about 80 ft. 80 ft. Mhm. Okay.

Yeah. So it's 33 ft to to here. So I was proposing a 33 ft setback and then um we would be 47 feet back from that. So a total of 80 ft. Yeah. So if this were a public road with many many properties accessing off that culde-sac, you know, the standard would be a 60 foot radius. It'd be 120 ft, you know, from north to south. And you're you're still I I I'd have to crunch the numbers, but you you'd still be within a a setback of a if this were a dedicated public road with an improved culde-sac. You'd be conforming. Yeah. Conforming. Yeah. Right.

So, I mean, like I said, it from from my knowledge, um I I spoke to the previous owner and they when they parcled off cuz his family used to own all of that property on Dan and Lane and his words were, "It just made it easier." and they weren't taking into consideration ever anybody ever building anything on it, you know, and you know, I don't think they even planned on ever moving from there. Sure. So,

yeah, I would uh agree to that knowing the apartments and how they developed that property. That's they just made it easy for themselves and laid it out and that was going to be their property forever. Sure.

All right, just quick discussion again. 80 ft from that road again and Ben's in your description, it's technically conforming, but because of a weird line, it's not. So, it seems like it's a reasonable ask for for whatever it's worth. Any other discussion amongst commissioners? At this point, I would open it up to the audience.
