Good evening everybody. It's August 27th. The time is 6:32 p.m. I'd like to call this town board regular meeting to order by asking everybody to please rise for the pledge to the flag. Go ahead, commander. I pledge allegiance to the flag of the United States of America and to the republic for which it stands, one nation under God, indivisible, with liberty and justice for all. Following our agenda, as you can see, at this time, I'd like to make a motion to go into an executive session. We have our special counsel here tonight to discuss a litigation case that we are involved in. Do I have a second?

Anybody else? Seeing nobody approach the podium. We're going to continue a discussion on a draft for new zoning code section named planned community. Um I have some notes here. I read through it. I discussed had a discussion with the with the uh committee secretary and planning secretary today. They have taken the suggestions that we we forwarded on to them as well as planning board and zoning board comments. So I believe the committee was going to put them in and in and put them in with it make changes. So that's in the process now. I believe we just met last week.

We know there's some people that wanted to have some questions about it both within our within our town hall and within our uh planning and everything else. I'm going to I'm going to read since my memory is not what it used to be. just state who you are and where you live, please.

I'm going to do it. My name is Tony Pascal. Uh we live on 171 Old Pauling Road in Dover. Um so I just say good evening, supervisor, uh members of the town board, and thank you all for the opportunity to speak tonight. Uh I'm joined by my wife Amy and some of our neighbors. Um we've owned a home in Dover for the past 10 years. Uh, and in the time since that the two of us and our three kids and our two dogs, we've fallen in love with this town and this area. And I probably don't need to tell you all why. Um, but for us, it's the environment and it's the forests and it's the farms and it's the quiet and it's the stars and it's the game and it's our neighbors. Uh, and there's no jerks. Um, and I should say up front, um, thank you for all the time that all of you volunteered to make this town a better place. Um, I took a look at the zoning code from the town's comprehensive plan in 2022, and it's clear how much time and effort you all put into this. So, again, thank you. Um, the reason we're here tonight is because some of the proposed reg revisions to the land use regulations, which I think were amended last week, uh, are written in a way that we think could forever change the town of Dover and not necessarily in a good way. Uh, I am not a lawyer, not even close. Um, but we went through the land use regulations and there are a few uh, specific areas of concerns. Um, I'll also say I don't think any of this was done with the intention uh uh on the board. Um, but I think when we look really closely at these, we need to do so when thinking about the future planning boards and future developers. And so I'll give you a few specifics. Um, the first point, paragraph C, I think this is allowable uses. I think this is too broad and it really

doesn't protect the town from future development. And the the problem is there aren't any real boundaries or limits because there's too many loopholes. Uh so for example, while it limits the number of occupants at an outdoor entertainment venue like an amphitheater, it actually doesn't limit the number of entertainment venues on a single property. A second point, there are a number of limits that can be waved by a future planning board. So, for example, it allows a planning board to wave the requirements of the stream corridor overlay district. Again, I'm no lawyer. I'm certainly not a geologist, but I reckon the only reason that's there is to prevent a future developer from building too closely to our town water sources. Uh next point, these uh proposed regulations, they allow a future planning board to wave the maximum building height of 50 feet. It also allows for a future planning board to wave a 200 foot setback for large commercial buildings along the highways, many of which are right off of the town's back roads. Bear with me. Just two more. Uh the requirement for a contiguous 400 acre should not allow for an intersection of a state or county road. Otherwise, we're not talking about self-contained developments that are tucked away in the hills. We're talking about pieces spread out all alongside the town's roads. Finally, this planned community zoning is for the rural districts and the resource conservation districts, but we only have so much open space and farmland left. If in the future, say five more developers come in and use this exact code, which they will

be able to do so because it will be the town's new zoning law, there's no provision to say no. and that 5,000 acres of land in town that is still considered a land will be at risk. Okay. Next, there is a discussion on American Red Cross request for a temporary shelter agreement using the town facilities. So, this was sent on to our town clerk um then forwarded on to me um about an agreement that was done by my predecessor. We're still we we're still searching for that agreement. Um, but we are going to be working with the Red Cross to come up with a plan to come up with a location that meets the needs that they have sent on to us in a description of what they need, what they would require, what we would be responsible for, as well as themselves. Okay. So, what I'd like to do is because we need to look into this and research this and work with them, I'd like to form a committee. I've already spoken to the person that I'd like to have head this committee up along with myself. So, Council Councilwoman Jackson, if you would, I'd like you to take the lead on this along with me.

Um, so I'd like to incorporate them as well as well as uh I guess I got a list of names we can reach out to as well as you can come up with some names as also. Okay. Hi, I'm Julie Monty from Dover Recreation. So, for coming up the next month, we have a lot going on. We have the Dover Community Day, which is on Saturday, September 20th. Um, it's coming up fast. So, if anybody would like to be a vendor, uh, be in our parade, make a donation, uh, please call the recreation office at 845832-9168. Um, or you can go online and register as well, um, over at uh, docreation.com. Um, we step off at 11:30 a.m. All vendors are asked to be there at 10:00 a.m. so they can get all their stuff under the tent or on their own tent. Um, and be in by the time the parade starts because we shut down the road. The parade starts at 12. Um, and then we end the day with fireworks, which is around 7:30. Um, next, our fall winter sports and events programs um will be going out to the schools in the next few weeks. Um, as well as out to the community as best as we can. Uh, we're still working on some details for that. Um, but I do have some dates. Uh, our trunk or treat, believe it or not, is coming up um on Saturday, October 25th. Uh, that'll be at 1:00 in the afternoon. Um, we also have our tree lighting and holiday fest which is also coming up uh on Saturday, December 6th. Uh, more details for that. It's usually around 5:30 p.m. for that. Um, we will start registering for our youth uh basketball program which starts in November, but all registrations are free this year uh because of the grant that we received from Duchess County and the New York State Office of Children and Family Services. Uh so registration will be starting on September 3rd. Uh it'll be open to everybody to register if anybody would like to coach. Uh we do need some coaches. Uh so if anybody

would like to coach for the season, um it starts in November, ends in March. Our games start in January, uh go into March. Uh there it's not every Saturday because, you know, conflict with the schools. We can get in when we can get on, but there's usually seven or eight games, hopefully eight games this season. Um, but we would start registering for that and if anybody wants to coach, they can also call the recreation office and we'll put you down on a list um, and give you all the information that you would need for that. Um, and that's it I got for that. I didn't know if you wanted to talk about the other grant that we got. I don't know if that's public yet for the seniors. Is that It's on the agenda, I believe, at the end.

Um, we have to email again and find out uh what we what our next step is. Okay. If we can just go and do it and then they reimbur I don't know how that works. So, we'll have to figure that out. All right. If we have to lay the money out, I believe we're still out the bid.

We just can't get somebody to do it. Correct. I don't know that with the insurance because the insurance pays them and we don't. So, I really don't under I don't know any of that yet. I mean, I do I did send the estimates. Um, the gate guy who is basically the the company's called the gate guy. He's the one who installed it and he's the one who gave us the quote for the gate itself and all the electrical that got taken out. But then there's the other electric that needs to be done by an electrician. Uh because our sign is also it feeds the sign. Yep. It feeds both of them. So uh there's different things that we need to talk about. But estimations did go into excuse me to the insurance company. So they do have an estimate of what the total cost would be. Okay. All right.

Um I talked to two parents uh last weekend and they wanted to commend you and your staff on the great job that you did during summer camp. Um we are going to be having a job fair table there this year. Uh we have two positions open. So we're trying to get a lot of local interest in getting somebody to come to us uh to get employed. So if anybody out there knows of anybody who wants to come to work for the town highway, please let them know that we have two openings for heavy motor equipment operators. Uh the next thing is I'd like to thank Amy from the library who came and did story time with us at the highway department and it was a great success. Uh I think actually the parents had more fun this year than the kids did because they were in the equipment and everything else too. Uh we also have been replacing pipes at different places. One was Brazier Road uh which is our farthest point away in Amenia and it's actually a town road of dovers but it's in the town of Amenia. Um we put a new br we put a new pipe in and redid that and put millings down on the road so we don't have to go there and grade it off anymore. Uh the second round of mowing uh is still in progress. Uh which should come to an end here within the next few weeks. Uh we also started cutting back brush and trees along some of the roads and we just have to get back to those where they're hanging into the road. Uh it's been a really big summer I guess for stuff growing into the road. So we're trying to cut it back as much as we can. Uh and we've had a couple breakdowns on our equipment. So I'd like to thank my mechanic for all the work he's been doing to keep everything running. Uh, and I like to thank all my guys for their dedication, their hard work. That's it.

Good evening, everyone. Uh I have two things. Uh first off, the uh the Boyce Park Fountain is coming along um uh according to schedule, according to my schedule, and um you'll see it there soon. Thank you. Um also, uh the digital sign at the library, American Legion, had a little glitch, and uh it'll hopefully be repaired within a week or two. And that's all I got.

Okay. Thank you, Councilwoman Jackson. um talking to the Dober Plains Library. They're having a seminar on the introduction to Medicare information session on September 13th and other programs. So, contact the library if you're interested. School starts up again on September 4th uh next Thursday. We're reminding people please that the students are not allowed to have internet accessible devices belltobell and that parents can contact the school directly through parent square or by phone to contact their students. And please be mindful of the school buses out there. You will see them. They're going to be a little slow the first couple of days picking up the kids. Please make sure you stop for the red lights and the signs. It is the law.

Deputy Supervisor Murphy. So, real small report and Sue kind of jumped on it. Um, good luck to the 25 26 uh kids in school. It's sad. Summer's almost over. You know, it is what it is, but just again like Susan said, be careful and pay attention. So, that's my report for this month. Okay. A lot of stuff that I had was talked about already. I want to thank Julie. Another good concert series this past summer. I missed a couple in July due to obligations, but I was there the last four weeks. So, uh, very good. Another good year. Um, to some questions that were brought to me while I was there relaxing and listening to the entertainment. Uh, the pond work is still a work in progress. Um, yes, the grass did grow in on itself, but once again, as we have stated, the county had planned to come and do a hydro seed for us and they have yet to get there to do it. So, it did grow in naturally. So, we had to start maintaining it. So, that's why it wasn't done by the county because they didn't get here to do it. So, just, you know, I said it last month, that's the county for you and I work for them. So the other thing is as uh Councilman Maludic went to the fountain, the trench has been dug. All the preparations are being made. All this time and all this work is being donated by Councilman Muda. So it is on schedule to his schedule. It will be getting done.

Do day is coming. I'd like everybody that's available to be there for Julie and support her and her staff for that community day. And last but not least, uh we as I stated last month, we would be starting well I am now officially kneedeep in the budget process. Um we sat today. I've had the pencil sharpener out, the eraser a lot of times. Uh but again, we are kneedeep in it. Meetings start next Wednesday with all department heads and we were uh we'll go at it. It's going to be a tough year. We've already gotten some uh preliminary estimates for liability, medical, retirement, uh health, and fuel. And as always and as we always see in our in our own houses, there's nothing going down. So, we'll do what we can. We'll do the good job that we always do, my me and my staff as well as these board members and department heads throughout the town. And we will I will present the best budget that I possibly can. I present it by law. It will be at the meeting on September 24th. I will present it to the town clerk that day. She will then present it on my behalf to the board as per law on the regular meeting of September 24th. They will receive the tenative budget. First special meeting will be October 15th where we will we'll all discuss the tenative budget page by page. I will take all the ideas and all the thoughts, questions and statements that are made. I'll take that back to my office to my financial staff and then October 29th at the next regular meeting in October we will discuss everything. We will see the changes that are made if any and then we will adopt the tenative budget and adopt it as our preliminary

budget. Then once that is adopted, we'll have a special meeting November 5th, the day after election day for a public hearing on that preliminary budget where you, the residents, the public can come. You my preliminary tenative and preliminary will be online. Well, before that, you'll be able to see it. So then you can come to your questions with your questions or statements or opinions and come to that podium and give them to me at that public hearing on November 5th. Then by law we will have another special meeting in November and we have to be a week early because by law I have to have it adopted and approved by November 20th. Our regular meeting night would be the night before Thanksgiving. So we will be meeting the night be the week before which is actually November 19th a day early before the 20th of November which has to be adopted and approved. Okay. So that is the schedule from this point on. Starting September 24th, it is budget time board members. All right. Any questions? Authorize the payment of abstract number 8 of 2025 in the amount of $778,000 59 $778,59.99. Accept the minutes of the town board meeting of July 30th, 2025. Approve the town clerk's report for July of 2025. Approve the town supervisor's financial report for July of 2025. Accept unanticipated revenue, authorized budget transfers, budget amendments, and payment of offabract purchase orders as prepared and submitted by the town's bookkeeper and accept the resignation of the recreation commission member. Whereas the town of Dover entered into a three-year agreement for electronic agenda and meeting management subscription with Escribe Software Ltd on December 1st of 2022 that requires notice of termination of the contract at least 90 days in advance of renewal. Whereas the contract expires by December 1st, 2025 and the town board desires to execute an agreement with another vendor that will be cost-saving and offer improved functionality. Now therefore be it resolved that the recommendation of the town clerk who has researched cost-saving options the town board of the town of Dover hereby authorizes the termination of the current agenda and meeting management software agreement at the conclusion of its terms and be be it further resolved authorizes the town clerk to notify the escribe software Ltd of the town board decision to terminate the contract as per the terms of the agreement. Whereas the town of Dover Town Hall wheelchair lift is not available for public use due to mechanical problems and following a service call was deemed obsolete to repair due to age and new technology. And whereas the town of Dover has received a state and municipal SAM facilities through Assemblyman Grant through Assemblyman BPAN's office for its replacement. And whereas the lowest possible responsible bidder for this project, Northstar Lifts LLC requires a one-third down payment of $6,762 before the project may begin. Now therefore, be it resolved that the town board of the town of Dover hereby authorizes the down payment of $6,762 to Northstar Lifts LLC of Tully, New York and progressive payment progressive payment of the balance of the contract cost of $22,540 as the project progresses. Now, therefore, be it resolved that the town board of the town of Dover hereby accepts the $20,000 grant award and authorizes the town supervisor to execute the grant contract with Duchess County and authorizes the town's recreation director to coordinate grant related purchases in compliance with the Duchess counties and town of Dover's purchasing and procurement requirements. Okay. So, we put in for this grant. Um, and the grant gave us the opportunity to acquire tables, uh, new tables, new chairs. Uh, a smartboard for the seniors to learn and to use and to do different activities that they can, uh, work on with that. uh a storage shed that will go outside the Legion Hall so that we could um we have uh mats that they use for their exercise um um uh um I'm sorry, exercise balls that they also use as well as the new tables and chairs that we would put in there. Um and some of the other things that we would like to put in there to just um take some of the stuff out of Legion Hall um because their storage that they have there is very tight between us and them. So, and we're very appreciative that they let us use their uh storage room, but uh this way will less it up a little bit over there. Um it would also upgrade the heating and ventilation and air conditioning units at the senior center which is located at the American Legion. So, that's what we plan to spend the money on.
