5:46 – 6:370

Second. Joe. Okay. Um, this is in regards to the property is located at 156 Leather Hill Road. Area variance 145-11B. Minimum sideyard is 30 foot setback. um received a um they received a permit for 18 ft but was uh when the asbuilt was done the garage was only 8.4 four from four feet from the property line parcel number 715900622816 um and the applicant is here would you like to speak have anything else to add or

6:33 – 7:160

I don't I think the letter was received I was asked to get a letter uh from the preserve yes we did receive that okay I don't have anything else you don't have anything else does anybody here have any questions for him? No. Okay. Okay. Yes, I received the letter. Um, um, what about the shed? You're with withdrawing the shed. I with I figured we had enough on our plate with the other things that we need to do. It's probably just in our best interest. Okay. So, you'll come come back for an applica an application at another time. Yes. Okay.

7:14 – 7:550

Can I just clarify something? You said we already had a We haven't had any variance on the property to this date. Okay. I didn't I don't think you said you had a building permit, correct? Yeah, that's correct. Okay. Yeah. Um and no one's here from the public to speak. Um does any board me, you don't have any more questions? Um okay. So, I'm going to read the variance parameters. Um and the meeting. Oh, I have to close the meeting. Um, do I have a motion to close the meeting? So, moved. Second.

7:56 – 9:210

Yes. Close the public hearing, but okay. So I'm going to read the parameters for the an area variance and um anybody jump in if you have any other um information that you want to add. Okay. The first one is if a variance is granted the applicant will have the following benefit. Um if the variance is granted the applicant will will have the benefit of a garage accessory to the existing residence. Anybody want to add any more? Okay. There will be an undesirable change in the character of the neighborhood or detriment to nearby properties because the property exceeds 10 acres and the adjacent parcel is restricted by conservation easement for only for open space only. So I say no. Um the the applicant cannot obtain the benefit of having the variance by any other method. um they cannot purchase uh neighbors property because of the property is restricted conservation easement and that abuts where the garage was built with the permit. The garage was built too close to the property line in the future. Um I suggest you get um a survey and stake whatever if you're going to build anything else.

9:200

Absolutely. I don't want to do this again. This could have been a really bad thing. You could have built your garage on the neighbor's property. Correct.

9:26 – 10:220

Possibly, you know, since it was only 8.4 feet. Um, anybody any No. Okay. Um, I'll keep going. The proposed variance will not have an adverse effect or impact on a physical or environmental conditions in the neighborhood or district because the proposed variance will not have an as in uh effect on the physical environment conditions of the neighborhood or district as the garage was constructed pursuit to a permit and the asbuilt survey uh identified a setback deficiency with the with the structure located 8.4t 4 feet from the property line where an 18 ft setback was approved and no um observable adverse impacts have resulted. Okay. Anybody else want to say anything else? So should we vote

10:21 – 10:580

Debbie? Yeah. Uh you missed the variance request. It is not substantial. Okay. Um number three. Number three. Okay. Oh, because there is five. I knew I missed one. Okay. Um, the variance requested is not sub is not substantial because I think you kind of added it into I know I kind of edited in um because the structure is already there. It's already there. It's adjacent to a property,

10:55 – 11:400

right? Okay. So, now we can vote. Um, let me find that other piece. No. Okay. I'm going to say um for the area variance of 21.6 ft to permit the garage 8.4t from the property line where 35 where 30 30 feet is required. Um we are going to grant this um variance. Um do I get a motion? So move the variance. Jacob

11:39 – 12:240

second. And Joe. All in favor? Joe. Joe. All in favor? I I I Okay. Marilyn, can you call the role? Um member Joerger. Yes. Member TR. Yes. Member Torsack. Yes. Member Holder. Yes. Member Coffman. I bring all the paperwork to you, five sets of plans. Right. Okay. But it'll tell you how many sets and with the planning board. Just make sure that you have where your well, your septic, uh if there's any wetlands or anything like that involved, okay?
