All right. Uh the calling of the role indicating that there is a quorum present to discuss business. We'd like to recognize our visit tour. I guess looks like we've had one. Item number one is the preliminary plat of Shelton Road Estates tax 76 parcel 4.05 6.05 acres Shelton Road Charlotte Tennessee A1 agriculture first district. Mr. Haves. This was surveyed by L surveying creating four new building lots as you can see by the aerials we all surrounding properties have previously tended to.
Does anyone have discussion about item one the plinary plat of Shelton Road Estates? We don't have a rep from the first district, but uh what is the will of the commission? Does anyone have a problem if we approve of this? Now's the time to speak. I think it's typical for the area. So, I'll make a motion to pass.
Moved by Commissioner Amanda Berry that uh the uh preliminary plat road estates be accepted. Is there a second? Second. Jeff has a second. So, Mr. Chairman, if I may, Miss Harrington could be here tonight provides. Okay. Let's let's hear let's hear Miss Herring's comments into the approval. So, okay. for planning commission approval of plat certificates from the preliminary plat.
Yeah. I think that just got fixed up. He'll correct that back. They'll just say that. Please include sight distance in both directions along any existing roads at any point where a driveway or a new road is proposed. Uh and forget convention from approving that just needs to be included on a preliminary plat included into the final. In in the case of this, all site distances in question would be on Shelton Road and the other drive the driveways into the other other lots. Okay. Yeah, I I understand you.
Yeah, I was going to say I think that's straight and flat enough that sight distance isn't going to be a real problem. But noted. Yeah, we we duly noted. Okay. All right. It's been properly moved and seconded that uh the uh preliminary plan of uh Shelton Road uh states be approved. This can we can do on a voice vote. Any opposed say no. Opinion of the chair the preliminary plan of Shelton Road Estates is approved. Item number two on tonight's agenda is the final plat of Danielson Hollow subdivision tax map 109 parcel 6.0 122.78 acres furnace hollow road Dixon Tennessee A1 agriculture second district Mr. Nice. This final plaid ended up with 12 lots after soils match crafts five and six for both over 25 agencies and would be served by a private drive maintained by HOA.
Right. And I assume this one of these instruments we have is the HOA covenants and the other one is the HOA bylaws. Correct. Okay. Has anyone has everyone had time to look at the these documents and does anyone have discussion on those? Chairman, if I may, I'll just provide a little bit of if you would take this up. So, typically per Dixon County resolution and subdivision regulations, you have to have a 50 foot wide easement in your property to get a building. only one lot can use that and get a building to come up.

If you have two or more, you're going to have to bring that road up to county standards. It's what typically you see with the subdivision. You got two or more lots bring that road or an existing public road. There's one exception in the subdivision regulations where you don't have to bring it under county standards that several lots can use just a permanent easement road. If each lot's over 25 acres, they also have to create an HOA to own and maintain that permanent easement so that it doesn't fall on one lot of an entity to maintain it and own it. That's why you have all these HOA documents with you. I've reviewed them. We had one like this about a year ago.

So I have no issue with it will of this body to approve it but should be approving the final plat and the HOA documents that require file through the final plan and the HOA documents and time rest. Does anyone care to address what council just said? I I think most of us were here when we did this sort of thing before and it is it is legal what they're doing and all the documentation is here. So the chair would entertain a motion that would be for the approval of the final plan of Danielson Hall subdivision at this time.

State no. opinion the chair the eyes have it and final plat of Danielson Hall subdivision is approved other business yes this time we have a little bit uh there's a issue about road dedication of Brook Holla court Mr. Can you enlighten us a little about Brook Hall sub is located off the main road and road in county. Mhm.
It has been in the burden for about 20 years. It has finally been built out with the road being completed to county standards. Mr. Cunningham would like to dedicate it to the county and has provided the required maintenance bond set by the highway department. A yes vote would be to recommend the county commission accept it as a county bank county road. So does everybody understand the motion is that the highway department will accept this road as a Dixon County road and there'll be a bond in place is it for 12 months after they accept it? Yes. To Okay.
To the Yeah. All right. So that is what's on the floor. or does anyone here to approve this? That's down one of you all's way. I know. I can't tell you right off hand what district it's in. It's It's in one of the southern ones. I'll make the move to approve. Okay, we got a motion to approve. Is there a second? There's a second by Commissioner Barry to approve the acceptance of Brook Hollow Court onto the Dixon County Highway map. Yes, sir.
Can we incorporate that as part of this motion? pay for like to reduce it from the maintenance bond 10,000 uh a reason why $40,000 performance bond you typically go to 25% of that amount for one year for the maintenance period if there's any issues and then in a year from now it'll come back for you to release that fund so if I may Mr. Lindsy, uh, would you mind amending your motion to, uh, make the maintenance fund about 15,000? I didn't think we had to do this. As far as the 10%

Well, I'll in the motion be that was it's it's what we've done is is we've tried to get them out from under the expense of having that big road bond once the once it's in and the highway departments looked at it and they think it's all right. Of course, basically they're just they're sort of gambling that if anything comes up, it's only going to be up to 25% of what the road bond was. in that first year and after that it's going to be sound.
Road department sets the original bond amount the uh the way the regs work is is reduces to 25% and you're making a recommendation you're not actually doing I like that.
