FIRST READING

AN ORDINANCE AUTHORIZING A TASK FORCE AGREEMENT FOR SHARED PERSONNEL WITH VARIOUS JURISDICTIONS COMPRISING THE MULTI-AREA NARCOTICS UNIT AND DECLARING AN EMERGENCY

WHEREAS, the City is a member of the Multi-Area Narcotics Unit (“M.A.N. Unit”) task force comprising of at least nine political subdivisions for the purpose of combatting drug trafficking and associated criminal activity; and, WHEREAS, the City is willing to provide one of its Police Division employees to command the M.A.N. Unit in exchange for a full reimbursement of the employee’s salary and benefits; and, WHEREAS, Council finds the proposed agreement to be fair and equitable and in furtherance of its goals of identifying the sources of the illegal narcotics trade and unleashing unlimited punitive measures on those involved; Now therefore, be it enacted by the Council of the Municipality of Defiance, Ohio, that: Section 1: Council hereby ratifies and approves the proposed Task Force Agreement for Shared Personnel attached to this Ordinance and marked “Exhibit A” and directs the City Administrator to execute the same. Section 2: This Agreement shall take retroactive effect from July 1, 2025 through June 30, 2026 and shall automatically renew year-over-year thereafter. Section 3: It is found and determined that all legislative actions pertaining to the adoption of this Ordinance were taken in Public Session and that all deliberations that affected or influenced any such legislative act, including all deliberations in Committee, were conducted in Public Session or in Executive Session duly convened in accordance with law. Section 4: This Ordinance is declared to be an emergency measure necessary to preserve the health, safety, or welfare of the community for the reason that Council desires immediate entry into this Agreement to show its commitment to the task force and its goals. As such, this Ordinance shall be effective immediately upon passage by an affirmative vote of not less than five (5) Members of Council and approval of the Mayor.

AN ORDINANCE AUTHORIZING THE PURCHASE OF A GAS MEMBRANE REPLACEMENT FOR THE WATER POLLUTION CONTROL PLANT AND DECLARING AN EMERGENCY

WHEREAS, the Water Pollution Control Division uses a Dystor membrane system to contain the volume of methane gas produced from the decomposition of sludge; and, WHEREAS, the outer membrane of this system collapsed in September 2025 and requires a full replacement; and, WHEREAS, WesTech submitted a quote in the amount of $183,600.00 for the replacement membrane; and, WHEREAS, Section 2.12 of the City Charter provides Council with the authority to “fix the number of employees in the various departments of the City and fix the rate of their compensation. This assignment to the task force will require the City to hire an additional police officer in order to maintain its level of service for residents; and, WHEREAS, Council finds that this vendor is a sole source supplier of this item and that the only viable competitor is exiting the market, thereby eliminating with the competitive bidding requirements; Now therefore, be it enacted by the Council of the Municipality of Defiance, Ohio, that: Section 1: The City Administrator is directed to enter into a contract for the purchase of a replacement gas membrane for the outer south digester at the Water Pollution Control Plant according to the quote provided by WesTech on file with the Water Pollution Control Superintendent and in the amount of $183,600.00. Section 2: The Finance Director is authorized to pay the contract price from Section 1 from appropriated funds allocated by expenditure from Line 590-540-52-980880 of the 2026 annual budget. Section 3: It is found and determined that all legislative actions pertaining to the adoption of this Ordinance were taken in Public Session and that all deliberations that affected or influenced any such legislative act, including all deliberations in Committee, were conducted in Public Session or in Executive Session duly convened in accordance with law. Section 4: This Ordinance is declared to be an emergency measure necessary to preserve the health, safety, or welfare of the community for the reason that swift replacement of this membrane is necessary to avoid the risk of release of methane gas into the atmosphere. As such, this Ordinance shall be effective immediately upon passage by an affirmative vote of not less than five (5) Members of Council and approval of the Mayor.
