I'd like to open this board of adjustment meeting. Madam secretary, would you read the first notice?

1:11 – 2:36Speaker 1

Yes. Ignacio Ramirez for a seven foot variance to the height of an accessory structure to be constructed at 2040 Oklahoma Avenue, Lisa Bucher for a 14 foot variance to the width of a driveway to be constructed at 718 Princeton Lane, Jose Guerrero for a two foot variance to the length of a parking space requirement pertaining to a new parking lot to be constructed at 5114 Railroad Street. Jose Guerrero for a point one zero acre feet per acre detention rate variance for a new parking lot to be constructed at 5114 Railroad Street. Frank Preston for a 24% rear yard lot coverage overage variance to be construct to construct a accessory structure at 1201 East Pasadena Boulevard, and Frank Preston for a 15 foot variance to the height of an accessory structure to be constructed at 1201 East Pasadena Boulevard.

2:36 – 3:07Speaker 2

Perfect. Thank you. We'll call these up one at a time. Was that me? Okay, thanks. And what we'll do is we'll give three calls for those wishing to speak in favor of the request and then three calls for those wishing to speak against the request. Well, we'll hear what you have to say and then when we open the meeting later on, we'll vote on that. That's the way we'll do it. So the first hearing, Mr. Ramirez, are you here?

3:07 – 3:38Speaker 2

Yes, I'm here. Okay. Can you come up to the microphone, give us your name and address and let us know what you're proposing. Any questions?

3:39 – 3:58Speaker 3

I do. I went up, drove by the property. I noticed from your drawing it's gonna be at the very back of the property. And I didn't drive back there but I noticed there was another home that was fairly close to the back of that fence. Guess it's probably on Louisiana. Do you know how far that house is behind the fence line right there?

4:02Speaker 2

Probably, I would say 80 feet.

4:07Speaker 3

It's a pool in here,

4:09 – 4:45Speaker 2

you know, right in the house. Are you building the structure yourself or have it done? I'm gonna order the building and I'm gonna have somebody do it. Okay. Any other questions? Thank you. Thank you. Second call for those wishing to speak for the request. Third and final call for those wishing to speak for the request. Like to open the floor to those wishing to speak against the request.

4:47 – 5:02Speaker 2

Second call for those wishing to speak against. Third final call for those who wish to speak against request. Hearing none, we'll move on to item two, Lisa Butcher.

5:04Speaker 4

Commissioner she has not made it. I tried to call her and no response. I told her this morning about it. I reminded her she said she'd be here so I'm not sure what's going on.

5:15Speaker 2

Madam Secretary, do we handle this one since someone's here not to present it? Or do we do we carry on with the meeting even though she's not here?

5:25 – 5:38Speaker 1

Yes sir, you can carry on with the meeting utilizing the information that she provided in her application. You just will not have the opportunity to ask her any questions but you can still take the information and decide at the later meeting.

5:38 – 6:23Speaker 2

Thank you. Okay. We'd like to open the floor to those wishing to speak for this request. Second call for those wishing to speak for the request. And this is the one for the driveway at 718 Princeton Lane. Third and final call for those wishing to speak for. Like to open the floor for anyone wishing to speak against the request on Princeton. Second call for those wishing to speak against. Third and final call for those wishing to speak against. Hearing none, we'll move on. Jose Guerrero is requesting a two foot variance on the length of a parking space requirements. Jose, are you here? Yes, sir. Okay.

6:25 – 6:37Speaker 1

Please come forward. Let's have your name and address and let us know what you're looking to do. Yes,

7:41 – 7:53Speaker 2

Just to reiterate the exist, the ones that are there now are nine by 18. Yes sir. And what the code says is nine by 24? I think 9 by 20. 9 By 20. So you're looking for two foot variance.

7:53 – 8:06Speaker 2

Okay. Any questions? Thank you. We'll have you back up in a few minutes. Second call for those wishing to speak for this request, please come forward.

10:03 – 10:21Speaker 2

Thank you. Appreciate it. Another call for those wishing to speak for the request. Third and final call for those wishing to speak for. I'd to open the floor to those wishing to speak against the request.

10:24 – 10:41Speaker 2

Second call for those wishing to speak against the request. Third and final call. Hearing none, we'll move forward. Jose again, you're looking for a variance on detention. Can you give us the information on that, please?

12:41 – 14:54Speaker 2

So kind of in layman's terms since we're not engineers, can you kind of describe the detention as far as length and width and depth that should be there and then what you're proposing? So it's not open detention. It's underground detention in pipes.

14:56Speaker 2

Okay. Well that makes it less easy to understand, doesn't it? Okay. Any questions?

15:05 – 15:43Speaker 5

I've got a question. I mean, not quite understanding, you're saying you feel confident that you're not going to be adversely affecting the drainage in the area. Is that correct? Yes. For going from what the ordinance asked for to going down to 0.1 acre foot. How do we know that? Is it just the math that you've done? I mean, I don't want to approve something and then we find out that area floods every time it rains.

16:25Speaker 2

Greg, do you have an opinion on this?

16:30 – 16:53Speaker 4

We had a pre development meeting on this and that's why Delcy is here this evening to help me on this. This is something that was decided in the pre development meeting to help the business owner come as close as they can to the meeting the ordinance. It's just something we couldn't approve without a variance.

16:53Speaker 2

Right. Well it makes sense if our ordinance addresses an acre then this is a

16:59Speaker 4

small Under an acre, that's

17:00Speaker 2

And then it would make sense that we don't need that much. Just don't know what would be specified. That's why we have to rely engineer.

17:08Speaker 4

We have other businesses in the area that have like Whataburger here on Center Street. They have underneath the parking lot the same system.

17:17Speaker 2

I can assure you we're providing Okay.

17:30Speaker 3

Greg, y'all do feel that's adequate. You feel like that's good enough?

17:38 – 17:51Speaker 4

Overall, when we get the set of plans, we haven't received a set of plans yet. Once we get the set of plans, it will be reviewed by the engineering department. And if there needs to be changes made at that time, they will be required to be made.

17:53 – 20:32Speaker 2

Thank you, sir. Appreciate it. Second call for those who wish to speak for this request. Any questions fellas, ladies? Thank you.

20:32 – 20:54Speaker 2

Next call for those wishing to speak for request. Hearing none, we'd like to open the floor to those wishing to speak against the request. Second call for those wishing to speak against the request. Third and final call for those who wish to speak against the request. Hearing none, we'll move on to item five.

20:54 – 22:00Speaker 2

Frank Preston is requesting a 24% rear rear yard lot coverage overage variance to construct an accessory structure at 1201 East Pasadena Boulevard. Frank, are you here? Greg, I'm not sure we've ever had this type of variance come up before. Do you mind explaining what we're looking at here?

22:00 – 22:23Speaker 4

Yes, sir. I believe this is our first one that I can find record of. So the ordinance says that you cannot occupy more than 30% of the rear yard. And so that's why he's asking for this variance because that's the intent. With this size building, he has to ask for this variance.

22:23Speaker 2

Okay, gotcha. So

22:28 – 22:46Speaker 3

the building that you're building, there's one on the property adjacent to your property. Is it going be similar to that? Would it be coming out to I don't have it right here for me. Would it be coming out to about as close to the road? Oh, no. It's a 100 and let's put it away from the road

22:46Speaker 5

behind the house.

22:47 – 23:15Speaker 3

Behind the house. Okay. So Greg, I was going to ask you, what's the difference in square foot from that 24% to the 30%?

23:16Speaker 4

Well right now if this building was approved you'd be at 54.6% coverage.

23:22Speaker 3

Say that one more time.

23:23 – 23:44Speaker 4

54.6%. So asking for 24% overage. 30% is all that we can permit on a regular permit. So he wants to go 54.6% coverage in the backyard on the rear.

23:50Speaker 5

How big is the building again?

24:08 – 26:17Speaker 2

Any other questions? Thank you. Second call for anyone wishing to speak for the request. Okay. Any questions?

26:22 – 26:34Speaker 1

Chairperson, we'll need to recess the public hearing so we can open our board of adjustments. If you'll wait just one moment, if you'll recess and then give me a moment and let me open the other one.

26:34 – 26:48Speaker 2

Okay, I'd to recess this this meeting and return to our other hearing. So back to the hearing. We're on item five. Six. I'm

26:49Speaker 1

sorry, we're on item five, yes. Yeah. Sorry.

26:51Speaker 2

I don't believe we have any questions. Thank you. Third and final call for those questions. Do you have a question? I'm sorry. I'm sorry, guys. I'm sorry.

27:00 – 27:40Speaker 5

You said it's 37 by 60 square feet, is that correct? That's the footprint? Yes. So that's 22, 20 square feet? I'm trying to figure out how you've got 33, 57 square feet. So Yeah. You're adding flat work to it. Okay. Never mind.

27:54Speaker 3

So I'd like to ask our help to the left, Greg.

28:01Speaker 3

With us not doing this, does this opened up some changes that we're going have to consider doing more often by doing this?

28:12 – 28:40Speaker 4

I would say in the last couple of years we've had, on the rear coverage we haven't had no request. It's mostly the height. It's mostly what? The height requirement because our accessory structure is maximum height is 15 feet. So we've had several in the last couple of years on the height question but this is the first I've ever received on an overage on the rear yard. I've never received one before that would take up this much other rear yard.

28:41 – 28:53Speaker 2

Let me just add to that. I predate you quite a bit. Yes sir. We haven't had that. So as far as the coverage concerned, this is probably the first time.

28:53Speaker 3

Is this that openness to need to look at address that more often, I guess is my question.

28:58 – 29:50Speaker 2

Well I mean if it comes up, we have to address it. But I don't know that it sets any sort of precedent. Okay. Anything else? Okay, thank you.

29:51Speaker 2

Okay, third and final call for those wishing to speak for this request. Like to open the floor to those wishing to speak?

30:02 – 31:07Speaker 2

Turn my head too quick. Thank you. Appreciate that. Next call for those wishing to speak for the request. Hearing none, all those.

31:08 – 31:29Speaker 2

Anybody would like to speak against the request. Second call for those who wish to speak against. Third and final call for those wish to speak against the request. Okay, we'll move on to item six. Frank Preston is requesting a 15 foot variance on the height of the accessory structure to be constructed at 1201 East Pasadena Boulevard.

31:29 – 33:40Speaker 2

So can you address us again and tell us what you're wanting to do there, please? Thank you. Second call for those wishing to speak for. You. Sir, thank you.

33:42 – 34:42Speaker 2

Third and final call for those wishing to speak four. You. Appreciate that. Anyone else wanting wishing to speak for the request? Hope we'd like to open the floor to those wishing to speak against the request.

34:45 – 36:22Speaker 2

Second call for those wishing to speak against, please come forward. Could we have your name and address, please? Are you able to see that from your house? Any questions? Thank you sir, appreciate it.

36:24Speaker 2

I'd to make a second call for those who wish to speak against. Third and final call for those who wish to speak against the request. Hearing none, I'd like to close these hearings and reopen
