All right. Our first item tonight is a proclamation for fair housing month. Whereas the Congress of the United States passed the Civil Rights Act of 1968, of which title 8 declared that the law of the land would now guarantee the rights of equal housing opportunity. And whereas the city of Dodto is committed to the mission and intent of Congress to provide fair and equal housing opportunities for all. And whereas vigorous efforts of fair housing groups along with the US Department of Housing and Urban Development serve to combat housing discrimination. And whereas equal housing opportunity is a condition of life in Dodto that can and should be achieved. Now therefore in pursuit of the shared goal and responsibility of providing equal housing opportunities for all residents. I, Rick Walker, mayor of the city of Dotto, Kansas, do hereby join the national celebration by proclaiming the month of April 2026 as fair housing month in Dodto and express the hope that this year's observance will promote fair housing practices throughout Dodto. Our next item tonight is our consent agenda. Tonight on the consent agenda, we have item A, approve minutes from the March 19th city council meeting. Item B, approve pay ordinance number 1016. Item C, approve donation request from the C Valley Sportsman's Association. Item D, approve donation request from the Dodto Historical Society. Item E, approve donation request from the Dodto Arts Council. Item F, approve temporary use permit for the Caw Valley Wine Rally. And item G, approve resolution number 2091 authorizing the consumption and sale of alcohol at Riverfest Park for the C Valley Wine Rally. I do have some handouts about the topic I'm talking about tonight. There's five copies there. So, good evening again. My name is Michael Propes. I live at 34290 West 84th Terrace. I'm here regard regarding a code compliance matter related to my chicken coupe placement. The couplave was originally constructed in 2016 approximately four years prior to the current adoption of the ordinance in 2020. It has remained at that same location since that time. This is not a temporary structure. It includes electrical service that was installed in 2018 and a permanent predator protection system that is underground. relocating it would require significant excavation, electrical work, and reconstruction. Additionally, I have contacted the adjacent property owner that owns a property boarding the coupe to the south, west, and east, and he has expressed no concerns with the location, use, or maintenance. I've made every effort to comply with ordinances, including submitting my permit application and correcting the fence height issue that was identified. I'm respectfully asking the council to consider allowing the existing coup location to remain in its remain as a lawful pre-existing condition given its history, permanent nature, and lack of impact for surrounding properties. Thank you for your consideration.

I have uh after much uh uh search and discussion and meetings uh found a person to fill that uh position and I I um would ask for your consent to appoint Lindseay McCracken to that uh council vacancy. Um, there's a memo in the packet uh that describes our procedure in the code section that it applies to. Any questions regarding the memo or my request uh to appoint Lindsay?

So, thank you. All right. Item four, I got my pages out of order here. Sorry. Consider task item 4 A. Consider task order number 11 with GBA for the Riverfest baseball and softball field project. All right. Good evening. Uh what you have before you tonight uh is a recommendation to uh sign a contract with GBA for design services for the uh uh fields at River Baseball softball fields and amenities at Riverfest Park. Uh if you'll recall just historywise, um we have the two fields that Sunflower, the ball fields out there. It's actually county owned property. Um we've leased those. That was prior to me even being here um from the county. And um with SRL and the city's interest in extending Edertton Road, those fields are are going to go away. So these would be replacements for those. Um, so Mike has talked with um Sunflower Redevelopment Group and they're willing to reimburse the city um for expenses for that uh baseball softball field project uh up to I think it was $1.8 million. Um so it might give us the go-ahhead um to uh talk to GBA uh about working with them to provide
um a design build approach for this project. We worked with GBA on if you'll remember on the soccer field portion of it as well. So it's a good fit for everybody. They're familiar with the property. um what we've already started um with the soccer field project, the baseball and softball fields will be just to the we're planning for them to be just to the south of the uh soccer fields. Um in terms of what GBA will be doing, preparing 30% plans uh for layout key elements and then full design uh of the water and sewer connections, assisting in bidding process, develop procurement documents and support the project during construction. Um base fee for these services 132820. Um, trying to think what else I need to tell you. Jim Shusler is here with GBA. Uh, if you have any any questions for him or for myself. Um, the design will be paid out of existing funds as I mentioned. Um, field construction is expected to be reimbursed by Sunflower Redevelopment Group. Um some other elements they're in on this project um include um a playground and some other supporting um amenities. Those are uh playground equipment which is program for 2026 um for Riverfest Park. Um we would like to use that money to add some playground equipment adjacent to those sports fields. And then also in the 27 uh 2027 CIP, uh there's money outlined for a concession restroom uh facility, too. So, in this design, we're going to design for all of those. Uh see where we're at financially. Obviously, the
major amenities we need are the baseball and softball fields themselves, and then kind of see where we're at financially, and hopefully we can get it all all done. But if not, we would at least have it all planned out, the layout, everything like that that would allow us to move forward in the future. So, if you have any questions, I can try to answer questions for Jay or the consultant. I have two questions. One, this is grass, not turf. Correct. Correct. Grass. And then, um, I saw there's two buildings, a storage building and then the restroom concessions. Is that one building closer to between the soccer and baseball? And then
well we haven't finalized that. Um we're we're using our the master plan that we did uh with Bartlett and West kind of as a template once we get we've already had some discussions on this. Um but we're kind trying to use that somewhat as a template and then just kind of see what works best. Um there's a concept of possibly a prefab restroom concession facility with a separate storage unit for you know equipment and tools and things like that for maintenance. Um, I don't I don't know if they'll be right next to each other or separate. We haven't gotten that far yet. But yeah, be it'll be I want to say two different building, two different uses, whether it's in one building or two separate buildings.
And will that be when when you bid it out, will that include options for them to submit those things? Yeah. Yeah. Well, uh, one thing we've started to look into a little bit, um, because I'm not as familiar with, uh, the prefabs is kind of looking at some pricing, see where we're at versus just stick build um, just to kind of see what makes sense uh, in terms not not only in price uh, of purchase, but then also um, you know, when we do hire the construction company, what it's, you know, what it cost for them. You can't just bring in a prefab and okay, there you go. So, there's more work that goes along. We're still trying to look at some numbers. So, yeah.
Is this storage area, is it going to be large enough to maybe house tractor or whatever implements you need? Yeah, we're trying to we're trying to plan for that. Um, scale-wise, we haven't finalized that. We would like to be able to put a tractor or a gator or something like that in there. you know, rakes, um, paint sprayers, chalkers, you know, everything we would need to work on either if it's a baseball and softball or the soccer field type thing. So, yeah, not not meant to be, you know, like the public works building, you know, it's not something that big, just something that we could have as a little bit of equipment. So, we're not running around all over the place.
Field dry and marker and equipment that you might need for Yep. With the exception of the concessions, it sounds a lot like the building over at Lexington Lake that they have JCPRD has for their similar maintenance. Yeah, similar. Okay. Yep. Yep. Any other questions?

All right. Item B, consider ordinance number 2686 amending the city code to expand allowed use of barbed wire for security of commercial structures.
Yes, council. um in connection with the uh site plan at the planning commission for a a power uh plant. Um, Councilman Bradley uh brought up um that that plan as submitted u contemplated the use of barb wire which uh technically would not be consistent with our city code because the language in our city code talks about securing city facilities meaning facilities owned by the city. Um, so what you have before you is a code amendment to add what's reflected in red text um towards the bottom of page one uh to cover facilities in commercially zoned uh districts that desire to have enhanced security by the use of barb wire. It would require specific approval by the planning commission. So, and that would apply to existing commercial structures. If someone wanted to add barb wire, they would have to go before the planning commission to get approve over that. So, with that,
okay, stand for any questions. Questions? Just might note we did present this to the planning commission and they seem comfortable with Yeah, I like the provision that it requires specific approval of the planning commission that it's not just a byite approval for a commercial or M2 zoning and I believe that the planning commission can if I'm not incorrect here that they can mandate certain things like it has to be 7 ft off the ground or whatever. That's a planning thing, right? Yeah. Part of their process. Yeah. They could put any condition, right? Okay.
So, would they be make any adjustments if needed keep a balance between security versus kind of the visual appearance of that based on who who might live by there based on kind of that. Yeah, I think so. That was the idea, right? The use would be specific. I mean, yeah, you can't use it just anywhere, right? It's going to be where it makes sense. something really does need that um barb wire at the top to protect the facility, not just because you think it might. So it was kind of with the understand it can be an eyesore or look really out of place. So that's why we thought the planning committee
and to give some background on on my suggestion was that specifically to um securing critical infrastructure uh there's a whole definition of it in the federal law and everything but not going into that. It seemed like you know a substation would be somewhere you want to have a little more security than a simple fence would allow and it seems like barb wire was included in the original plan which seems reasonable to me. So That that was my thinking and my backing, my reasoning behind it. Made sense to me. Any other questions? Ready for a motion?

All right. Item C, consider contract approval for the Waverly water tower project with Caldwell Tanks Incorporated.
Yep. Thank you. So, we've been working on the design for a new water tower with a W water tower for some time. Um, we went out to bid and on March 10th, we opened uh bids. We received three good bids. Um originally the the tower is scheduled to be about 125,000 gallon and during the bidding process it it um with some little proven evaluation it was decided that we need to increase it from 125 to 150,000 and we added a couple feet to it for storage so that all three towers and this would be the same. Uh so what we'll have is 150,000 gallon tank. So we had three bids. The low bid was 19 1,968,800. The high was $2,750,000. Cobwell tank was a little better. Based on PEC's evaluation, uh their reputable tank contractor and build a lot of tanks similar to what we are needing. Um and the CIP or the construction is $2,50,000. Um, so it' be my recommendation to uh approve the contract for Coswell Tank in the amount of $1,968,800 plus an $80,000 contingency, which brings the total to $2,48,800. Uh, but the one change is that the mayor would be uh signing the contract. That's not a contract written. So, I have to say, administrator, it's actually the mayor that would be executing the contract. And look for any questions. What was their schedule for starting those?
So, they're going to start in here. Go back and look. It's a I think it's in the contract. It's a 12 month construction timeline. Um Okay. Demo the tower. They'll do all the site work. Uh as they're doing the site work, they'll be building the tower. I think it's later for part of next year that they would uh install the tower and uh be done. It's about this time next year, but it's about it's a 12-month process. uh from start to get the tape. So we would start as soon as we execute the contract. Okay. Then start demoing the existing tower. That was my main question. I'd had a couple questions about when when it would start. So all right.
Joe, I just had a quick question. Do they foresee any disruption of any residents that are around there? Just to make sure they're No, the current tower is not in use. Yeah. Um so I mean the the disruption would be as they bring in equipment. Yeah. They do it, but If it outside of that, uh, you know, they'll work during the day. There may be a time where they'll work, um, probably when they paint or erect the tower, they may work consistently for, um, seven or eight days. Um, but we'll address that as it as it comes. Okay. Good. Thanks. And and work with the rest, make sure that they always have access.

All right. Item D, consider ordinance number 2687 vacating public rideway within Astra Enterprise Park. Yes, council. When um council approved the final plat for Astra, um there was right of way on the plat uh for Stringtown Road and um Sunflower redevelopment is uh under discussions to sell a portion of their ground and that right ofway interferes with the proposed use of the buyer. Um so anytime uh right ofway is dedicated to the city via plat or otherwise um by statute we need to hold a public hearing and have a vote to vacate the uh right away. So that's what you have before you. Um and uh vents with sunb redevelopment is online but I did there are two criteria you have to find after a public hearing is that there's no inconvenience uh to the public and justice to the applicant requires a vacation. So, I would note that we are not going to record this with the county until um the city is dedicated substitute right ofway for Stringtown Road in a different location. So, with that, I'll stand for any questions.
All right. Any questions before I open the public hearing for that? Ju just to make sure I understand this right. We are vacating our right of way as currently platted and going to receive a substitute right ofway at some point.
Right. And we're going to receive it by dedication. So it probably won't be via platting. We're going to get deeds of dedication from some property redevelopment. And then the buyer, just the way they have the sale set up, the buyer will need to dedicate us 10 ft of right away as well. So, we're covered in all that. Okay. Any other questions? All right. Yes, council. Uh before you is a six-month extension um by the developer for Rio Apartments. Um and that's uh extending the deadline by six months to commence construction of that project. Uh Dustin Baker with Al Cove is here. Um the extension if you grant it will run uh to October 1, 2026. Okay. Any questions from council uh of either Patrick or I'm sure Dustin would answer them if you had any for him as well.
Is it actually going to get started in six months? I knew that question. Um, yes, we are. Um, council, I I appreciate you uh uh taking this item up uh for discussion and consideration. Um, yeah. So, where we're at in the process is all my plans are done. We actually submitted the plans to Dale uh for uh for review. Uh he he made some initial comments and reviewed. Um and then we went out to bid and um the the cost of the construction was just um it was roughly about $4 million more than what I had budgeted. Now currently we have three buildings with uh designed with um with three podium structures underneath the building. And so, um, what we're looking at right now, we're I'm committed to the project, of course, we're we have hundreds of thousands of dollars in the plans. Um, so what the time frame that we need now is we're looking at trying to go to two buildings, same uh same uh unit count, two buildings. um and just adding a um the three buildings were podium and then two stories above the podium. And so now we're looking at uh going uh one building no podium, the second building having a podium, and we're taking basically the building that we're we're eliminating and adding to the two buildings. So that will require me to come back and get a site plan approval. Uh, so I need the additional time to do that and um I've already given the go-ahad to my um design team to go ahead and and and re revise the plans with that in mind. Uh I think that'll bring
the project back in budget and the and the and the um the design of the buildings are going to not change. I mean, um, the the exciting part about the about the project is where it's located in downtown and the design was completely different than, um, you know, just the just the regular garden style apartments. So, uh, design will stay the same. We're just trying, we just need enough time to get this thing back in budget. And I'm hoping six months will do it. So those uh units will have a little bit better view of the valley.
They will. Yeah. And and I and both buildings will have rooftop right right now as it as we contemplated it. Uh the only one of the buildings of the three we're going to have the rooftop terrace and the and the rooftop clubhouse. And now I'm looking at having rooftop terrace on both buildings and the and a little clubhouse on both buildings. Yeah. So, and then you'll pick up a little bit of surface parking that maybe right where that other building was. I'll pick up the surfing surface parking so the parking count won't change. You know, we'll we'll either be better or the same as what we were before.
So, I'm hoping six months we'll do it. Um, you know, we I wanted to start this project this spring and like I said, we were ready. We had submitted plans. We were wanting to get the permit and we were ready to go. And then I just got the construction sticker shock. I really appreciate it. And uh mostly the sort of revitalization of downtown that'll bring with more pedestrian traffic to our businesses there and hopefully spur some more um development in our downtown district. That's what I'm hoping for, too. Yep. It's a it's a it's a passion project for me. So,

You know, no city planner here. So Joe, what do you got? So just a little bit of good news. Uh not has a lot more money for federal projects because of the way they they used to have uh they used to set aside some money. So now they're not. And so there was a lot of extra money that needed to be spent in the next couple years. So today, uh, the cancer party committee approved several projects to increase funding. One of them was 83rd Street adding another $3 million. So we'll have a total of $4.5 million. So it looks like we'll be able to move forward with uh replacing 83rd Street Bridge. We're very fortunate that Okay.
Yeah, it was a good deal. We'll be we'll be elevating the bridge standard and meet the railroad specifications. Yeah, they both carried out in BNSS requirements. I'm still not thrilled about that part of it at all. Yeah, I'm glad that it doesn't cost our taxpayers any more money to accommodate that, I guess. But it's it's you know, like I say, if you if you driven across it, it's it's been posted through Yeah. GV8 uh had to do a mode rating on it, right?
And because they thought by now we'd have the new bridge. And so when they did the rating, given its age and and how the structure looked, yeah, we had to put a little rating on it. It's the pedestrian access across the pedestrian and we'll improve distance on either side of the roadway. And then once that's done, then we can look at making improvements to Lexington from there all the way back to Lexington.
Good work, Joe. Um, Joe worked hard with Mark to get that extra and swiftly too. I mean, it was a short quick notice, you know, get our name in the hat in the ring. Um, and it was very fortunate to us through his his work there was council. So that's perfect, Joe. Thank you very much. 3 million. That's pretty good day. Yeah, that's not a bad day. All right. Um, welcome, Edgar. Doing a great job over there and congrats. I was just going to check in. I wasn't able to make the um town hall meeting. Just wanted to see how that went. Everybody that went I I heard was another successful one and encouraged that we're still doing those. I don't know if anybody had any feedback. I think we had a few less people I think at this one than we did at the first one, but um you know uh we had an engaged group of uh citizens. So Oh, good. That's good. That was my take. I guess Zach did a lot of talking. Maybe got a different more than a lot.
Uh I uh you know, the only thing I really run around here is my mouth. So, you know, I I do appreciate it though. We did have a pretty good turnout and I would like to see more citizens come um and more constituents. Even even our neighbors are welcome, I think. And uh that'll be nice to have them there.
Uh thank you. Okay. The other thing I just wanted to bring up, um, I had a great conversation with Mike this week. He's like, "Oh my gosh, what she gonna say?" Um, but I know we've talked a lot about and and even Tim has been involved in, you know, it's the, of course, we're wanting to recruit new businesses, recruit, you know, what we feel would be great, you know, additions to our city, but then also retain those businesses and what we have here to to keep them here. And so, you know, I know we discussed and some things are changing regarding incentives based on maybe the particular industry or what it is we're wanting to come in. So, looking at some changes there, but if there might be some discussions in the future about maybe incentives for retaining business, the business owners that are already here that are local, maybe there's some type of incentive. I don't know what that looks like. I don't know what that would be, but um especially in my heart too is the the downtown area and really revitalizing that maybe helping some of those uh local organizations, businesses, something to to incentivize them to continue whether what that help might be. So, I want to thank Mike for that conversation. And I I think every time I I meet with him, my first conversation is what are we doing for downtown? What are we going to get some this? When can we do this? you know, and so that just um that that was a a good conversation and I was all over the place that day. I think I threw all kinds of spaghetti on the wall
because I had a lot going on personally. So, thank you for that. And that that was just a a great conversation
around um helping those that are here and to keep them here and help them succeed. That idea really sprang out of, you know, some lessons learned from other communities who are growing very rapidly with big scale economic development. How not to forget your existing town. And one of the suggestions is, you know, we're going to be redoing this incentive policy. We're going to be having a look at that be as we go through the year. And one of the best practices is consider uh incentivizing your small locally base existing businesses to expand, to grow, to remain, to maintain. Um so that was just one one idea that came out of that and it works in well with I think what we really want to do for the downtown. you know, we know we we're going to look at the downtown. We're going to focus on downtown and elements of that are fix up the streetscape stuff, but also how do you incentivize and retain? So,

Uh, I have I have quite a bit. Uh, sorry. So, um, to your points about the downtown and to Dustin's point about wanting to be involved in that, I think having our local business be our focus is important. Um, you know, they're the ones who grew the city into what it is, and I think we can't forget them. We we have to keep them in mind, just like we have to keep the citizens who've lived here and helped grow the city in mind as well. Uh to that end um the meeting uh there was a forum the other night which was very interesting um data and energy forum that was hosted by Kessinger Hunter um I attended it along with a couple of the folks here mayor um administrator uh Mr. Halderson Mr. Michael and I I wanted to point out that uh I've gotten some feedback that perhaps people thought it was some sort of a small meeting room thing. This was a uh a forum with I don't know how many people it was, but I would reckon at least 250 people there probably. It was a giant room and it wasn't like it was a meeting between the city and any particular business. This was a forum for other businesses and and civic leaders to hear from these um presenters. Uh, and I I got a lot of interesting information from it. Um, just some folks included the chairman CEO of Train Technologies, the HVAC people, Iron Mountain, um, global information management, uh, Kinder Morgan, uh, Digital Realy, the Southwest Powerpool, chairman of the Kansas Corporation Commission, and the former chairman of, uh, Sprint. And some of the things they talked about that I found very interesting was how these mega corporations fit into um the future and how they look at expansion and how they look at um communities like ours and other places,
not just in Kansas, but in general. Um some of the things that I got out of it was that, you know, there used to be perhaps this opinion that these mega corporations were the, you know, the 800 pound gorilla in the room and they could do what they wanted wherever they wanted. And I don't think that's the viewpoint a lot of those folks are taking anymore. uh it seems like they are recognizing their role as members of the community and I think there's a better appreciation for that especially amongst some of them uh that they want to be part of our community not imposing on our community uh also they uh don't see much future as far as I can tell in uh coal power or uh dirty power production mostly they want clean energy um not just because it's the right thing to do for the environment and in general, but because that's what, you know, the people where they're building want to see. Um, it's going to be very hard to to achieve buy in for a community when you say you're going to suck up all their water and power. Uh, and I don't think that's what I got out. I got that they want to not do that. Um the other presenter there uh besides Evergy was Terrap Power who is still looking at multiple sites in Kansas. Um they haven't announced anywhere yet. Uh but they are they did talk about finishing I think it'll be in 2030 their Kimmer Wyoming plant. Um and after they finish construction they still have to go through the Nuclear Regulatory Commission application process to operate and they they still don't have that. and they won't have that until they finish construction. So before anything is built or operating in Kansas will be a number of years from now. Uh a and as that happens, technology will grow and things will be um analyzed and improved.
One of the concerns that I um I heard from a constituent was concern about the 10mi emergency planning zone for nuclear power plants. Uh recently the nuclear regulatory commission's advisory uh committee for safety reactor safety um determined that you know so that's for boiling water and pressurized water reactors and the type of reactors the molten salt reactors not just terap power but uh a couple of other um companies are developing uh don't require that same um emergency planning zone size because they don't uh they're not pressur ized and they don't explode like that with if they were to catastrophically fail. They can't spread radiation like that. So, I just wanted to share that information uh that I gotten from that. Um in addition to that uh I got from some of the couple of data center people there that they are very interested in in low water consumption, clean energy and decreasing the pollution that their facilities provide whether that's noise, light or contamination. Uh and so I found that very interesting and useful to hear from and the way those companies are interacting to make things better. So trained as HVAC and they're working with data centers to improve the efficiency and the process for cooling them. Uh I found that very interesting. Uh but I did want to share that information that I I got out of that meeting a forum wasn't really a meeting because it was one directional really other than a little bit of question and answer from the audience. Um, so I wanted to share that and also I wanted to mention the uh a couple of questions a couple of our constituents have asked me and I I'll talk to you about it um when we meet later but uh about seeing the new water and sewer treatment plants that we've got. Um and I see that Whitney and Ashton are here and um maybe we can get them involved in
arranging someformational sharing about that uh because they're very interested. Um, you know, it's it's easy to say, well, the old water treatment plant was really old and dirty and and kind of disgusting really. Um, but the new one is really nice and clean and very good, but I can say that and it doesn't carry the same weight as physically being there and seeing the the plants. So, I would like to see if we can set something up perhaps to get at least a few folks out there if we can and perhaps share some media on it and publish that message to our great idea. Might be a little premature on the sewer.
Yeah, maybe a little little earlier in the sewer, but but yeah, the water still same concept. Good idea. Ronda had some of the same ideas when we were talking. Just uh like to throw another shout out to Joe and his team uh for working out at uh Chris Hildebrandt and Amber Keading's place. Um they there are the couple at uh 9817 Ingrid uh that kind of had some drainage issues and have spent uh several thousand dollars of their own money after the sidewalk was put in and uh um uh it was causing some uh water backup issues into their yard. Um, I think uh you guys were out there this week or and uh put in a new drain and and dredged and they were uh very appreciative and and thankful.

We were there at a meeting where Terara Power was presenting. Um it was good information and it's just uh a way to gain additional uh knowledge about Terrap Power but then about that that other part of the presentation with the the train without with those other players in more the data center world that um kind of what they're seeing um and where where things are headed um which uh relative to water and energy use is in a good direction um in all of them. So, um, state of the county, I think everybody probably got a reminder. If you wanted to respond to Brandon on that, make sure you do that. Uh, we'll attend that. Um, and I think that's all I have.
