I invite you to stand as you're able and join me in this invocation. Let us pray. Gracious and sovereign God, we come before you with gratitude as this new month begins. Thanking you for the privilege of gathering in service to this beautiful community of Daytona Beach Shores. As our children, teachers, and school administrators prepare to return to the classroom next week, we ask your blessing upon them. Grant them wisdom, patience, and a spirit of discovery. May our schools be places of safety, growth, and encouragement. We also give thanks today for our public servants, those in this room, and those working behind the scenes. For their dedication to justice, to safety, and to the well-being of our residents, we are truly grateful. Strengthen them with

integrity, compassion, and endurance in all that they do. Lord, as we move deeper into hurricane season, we pray for protection over our city and this region. Kim was the f one of the first ones that welcomed us to the city that explained to me how everything worked and um it was always a joy to see you there and it's nice to see you here and for everything you do for the city. was the tennis savior and fast forward now and she's the community center coordinator and um, my right hand. couldn't do things without her. Um, she not only does things at work, but she cares so much about her community, she lives here. Um, she's just integral in this community. So, um, I'm grateful for her. Um, couldn't do it without her. She handles the tennis and all of them so well and they all respect her. um which is what we need, you know, because I love them, but they can be sometimes. Um just like our pickle ball players and she's, you know, plays pickle ball, too. So, she knows all of them also and handles anything that comes our way. So, um Kim, congratulations on 21 years. And there's three that I'm going to ask you for your approval. The first is our city commission meeting of July 1st, 2025. The next is the city commission. An ordinance of the city of Daytona Beach Shores, Valuchia County, Florida, relating to voluntary annexation of real property located at 2920 South Peninsula Drive, tax parcel identification number 53270900160, together with associated rights of way in accordance with section 171.044 044 Florida statutes providing for legislative and administrative findings redefining the boundaries of the city providing for a legal effect and implementing administrative actions providing for conflicts providing for separability providing for non-codification and setting an effective date. and uh city planner. What do you have for us this evening? Thank you madam mayor, vice mayor, commissioners. I do. I do. I'm Gwen Herstein, city planner for Daytona Beach Shores. This is the second reading for an ordinance switch of approval will annex a single family residence on South Peninsula into Daytona Beach Shores. The owner applicants are Andrew and Bonnie Melville. We met them at the July 1st uh city commission meeting. This is a single family residence and it's proposed to remain a single family residence. property is located at on South Peninsula Drive between the two access points of River Point Drive. Aerial and street views of the property uh which is about 1,600 ft from here, our current location as the curve laws and the street view with staff analysis and exhibits having been submitted for the record and the requirements of of Florida statutes 171.044 044 having been met. Staff recommends approval at the second reading of ordinance 2025-08. And then on September 8th and October 7th, we hope to bring the property back before you with two ordinances which will add it to the future land use map and assign it a Daytona Beach Shores zoning classification so we can properly apply our code ordinances. All right. And that passed 50. Um again, um I hope they're listening in tonight and we told them last meeting, but um welcome to the shores. We're glad to have you as one of our residents. Okay. Next, we're going to go on to uh new business, and this would be an economic development. um somebody coming into the shores and applying for an economic development grant and uh Nancy could you help us with this please commission um we are talking about Methos Brew they submitted a grant application and the economic development committee um met with them hours will be Monday through Sunday 7 days a week 8 a.m. um 7:00 a.m. to 8:00 p.m. And then during peak time, peak season, it'll be 7:00 a.m. to 9:00 p.m. Um, it's located at 2514 South Atlantic um in Daytona Beach Shores and they have a 5-year executed lease. Um, Miss Trek has invested approximately $100,000 in renovations to the rented space. Um, and uh, they're going to provide artisan um, great coffees, teas, gelades, and homemade pastries. Um the restaurant will employ two full-time employees and two to three part-time employees. Um the economic development committee met on July 25th. Um and they are we are recommending that the grant money dispersement calculation um be 25% in the first year, 15% the second year, and 10% in the third year. So um Mr. Ricard, I don't know if you want to add anything. Mer do you have anything to add to that? No, we we did speak to her on the phone. Uh we got some information crossed, but uh everything seemed like it's going to work out. We're hoping so.

So the first one, normally we do 30 20 um 10. Was there what was the reasoning for changing? I think because the rent was higher, we're trying to make it go longer again, just like we did with Luna's 15%. It's kind of the same scenario with with this. Okay. Then my second question is, and it's probably even been a while before some of these people were on the council. One of the things that we said, and it wasn't a hard fast role, but we felt like we had um enough breakfast and lunch places in the shores. We're really looking for someone to be open that dinner hour with they're going to be. Can you just tell me if something happens and they decide not to remain open at dinner, do we have any recourse of stepping back anything written in the lease? We haven't really had that issue at all. But the only if you remember we had and it was it was before we even approved it. We had um I'm not going to name the business of Visos A1A that had their menu out. They had their dinner menu and you know applying and then never opened in the dinner hour. So and that was a different No, that was the same that was a lease. It was a 3020. That was before me. Yeah, it was probably before you. I just wanted to give you some history on that too. I'd get with um attorney post and and see if there is recourse and then I can let you know. Okay, great. Thank you so much. Appreciate that. And next we are going to go on to our city attorney comments. Uh I think we've all told attorney Vos how much we enjoyed Stephanie last week. Thank you for sending her to us. But do you have any comments for this evening? No, not really. I will tell you that Stephanie fell in love here. She She is begging me. She called me today. She said, "Are you sure you're not feeling bad? Can I go?" Well, thank you. Tell her we really appreciate her being here, too. Okay. So, thank you very much. Thank you. City manager, what do you have for us? Uh, nothing city related, but as Reverend Bob mentioned, school starts Monday. So, uh, allow yourself a few minutes extra time travel because the roads will be busy and watch for kids walking and riding bikes. Okay. Can, uh, we talk about one thing. So, uh, the city manager and I had to make a visit to one of the condos on the beach and it was south of, um, of the pier. And can you tell a little bit about what we're pleasantly surprised to see? Can you talk about that a minute? So, we were able to walk down one of the city ramps and the sand is the sand project going south, I believe, is is done. They might be tidying up some areas, but the cool thing was they have

done all the plantings uh there. So, if you haven't been down there, there are I don't know how many, probably tens of thousands of plants. This big, but they're small, but there are a lot of them. So hopefully those will uh take off quickly, although I'm told they're a pretty slow growing growing plant. U but they're are the ones that will best hold that sand in place. And um the sand was plentiful. Yes. Yes. You know, and um the city manager knew where the end of the ramp were was before and we could barely see the end of the ramp. It was so plentiful. And not that the um mayor yelled at anyone for walking on the plants, but I mean it was unbelievable. I'll tell you. I mean, so there's an end closest to the ocean, not near the ocean at all that you could have easily walked and here was four or five guys trooping through the plants. So, I'm hoping they last because that's what we need to hold down the sand. That was the plan. Um we don't know exactly when we will um be getting it coming further north from Sunglow. Um, I have spoke to Jessica Fentress today, the city manager and I both had talks with her. She's going to be at our meeting mark your calendar at coffee with the mayor in November. So, she should have some updates on the project when it will start further further north. Um, one of the other things that I do want to mention, Frank Rendan Park will be closed starting Monday, August 11th for six months. there is massive renovation that needs to take place there. So, um we've been asking them when it's going to happen, when it's going to happen. So, we can't complain too much because um there is a seaw wall that needs put up, playground equipment, a lot to be done there. Um my understanding is Florida Shores will remain open until around February or March and then they'll start construction on that. So, I think that's all I really had. Was

there anything else that you knew? Okay. All right. Uh we will go on to I want to tell you too, I know this is like a short meeting this evening. We only met last week. If we didn't probably have an uh the only meeting this month, we would have canled this postponed, but we knew the folks were anxious to get their annexation in. So um that's why it might be a little bit shorter than normal. So when I keep you here three, four, five hours, uh don't complain. Um so anyway, uh Commissioner Dinsky, what do you have for us? Uh, just that I won't be here for the September 8th meeting. And Sherry, I have a question. Do I call in or do you call me? Which do you prefer? Oh, just give me a call. Okay. Give us the number you best reach and we'll dial it right from here. And then attorney vice, can you go over that again? I'm assuming at the beginning of the meeting, we will vote to be able to have uh first of all, Commissioner Dinsky call in and then second vote. Is that correct? On Friday the 1st of this month, we had a swearing in of two of the police officers, Diemo and Ingram, and we appreciate having us over there, and we wish them best in their careers. Mayor, I had a call from someone who lives here who asked me, and I I think I gave them a a pseudo gray area answer. They asked

me, does the city have a time period of preparations for storms? Do they check the equipment? Do they check the sewers? Do they check all the things they need to do, the buildings and and and all that in anticipation of of a hurricane? And I said, I am confident that they do, but I never really formally know. So if you have and it's not the time for me to answer, but maybe by next meeting if someone could have just a brief, you know, just a little tutorial so that way the citizens know that we actually do prepare and you know it's not our first rodeo. We can absolutely bring something back for you. Thank you. Okay. Anything else, Vice Mayor? Okay. Thank you. Economist. Yes. Uh the militia Flaggler TPO is participating in national stop on red week and uh that's the entire month of August and that's a nationwide campaign dedicated to saving lives by raising awareness about the dangers of red light running. Um it was launched by the Federal Highway Administration and they gave some statistics why it's important um to participate in this. Uh in 2022, 1,149 people were killed in crashes involving red light running. That same year, over 107,000 people were injured in these preventable collisions. Uh near nearly half of those were not violators. They were pedestrians, cyclists, uh and other innocent road users. and they actually have an event taking place Thursday, August 25th from 9:00 a.m. to 10:30. And that's going to be at the intersection of East International Speedway Boulevard and Beach Street. Uh again, that's 9:00 a.m. to 10:30. There's actually going to be a press conference scheduled at 9:00 in the morning and then followed by a signwaving demonstration and they're

encouraging uh citizens to come out and and participate with them. So, thank you. Oh, and one other thing, too. I'm sorry. Uh, and I will not be here um in the September meeting and thank you for excusing me and unfortunately I will not be able to call in. I I knew that too. Thank you for that. Um, Commissioner, I had one question too. So, I know this originated I think out of the TPO um the construction or the upgrades that are happening in Orand and then working their way down to Daytona. Is that is that something that gets approved or maybe vice mayor you knew from the TPO and works its way down? I'm hearing some negative of course negative comments that it's too much cement in the middle or anything like that. Has anyone brought that up that any of your Not not that I've I've heard, but um we do have um a representative from the Florida Department of Transportation on site with on on hand and uh and we do go over that thoroughly. So, but I can try to find out a little bit more for you at the next meeting. Again, we did not have a meeting in um July, but we will have one um in just a couple weeks. Okay. So, that's a project that started in Orand and worked its way down to Daytona. Right. Okay. Great. Thank you, Madam Mayor. I have a little bit of knowledge. The the story behind the design and the concrete and the landscaping is to slow cars down. and they said there are a lot of uh transient uh tourists that come crossing the streets not at crosswalks and there have been a lot of injuries. Number two is people are just speeding when you have it 35 miles an hour they're doing 50. So they learned from Fort Lauderdale, Miami, uh North Miami, those particular A1A locations and other locations have done this streetscaping which includes both landscaping as well as concrete. And there's a purpose behind making it kind of turn and enhancing the sidewalks and making them wider and not allowing on street

parking. It's all designed because the p, excuse me, because the statistics reduce the number of injuries and fatalities. Great. Good. Glad for that background. And they say it enhances the quality of the appearance uh uh aesthetic wise as well. You happen to know is that going to continue down into the shores? I know. I don't know it is, but I don't know if it's going to continue down to the shores. That's the one thing I asked while I was there and they didn't have an answer. I know it's going to go right up to the Daytona line. I can only presume it may go, but it may not because of the way we have our underground infrastructure and our under uh ground utilities. We may not be able to do that. and and I try to keep an eye out for anything that's going to happen in the shores obviously all over Valuchia but um and I don't recall anything hearing anything coming down to the shores but I will find out the next meeting city manager did you have an update on that they are coming down into the shores I I think it was October November time frame we had an open house here where they laid out the maps um and we're asking for feedback from the community here we will probably not have a lot of those center lan amenities because we have so many um entrances and exits to all the buildings here. So, it makes it really hard for them to put either grass or concrete in that turn lane because then it forces people to go up and make U-turns and um we probably don't want that here. Do you um know if we're going to have any of the winding? They haven't come up with the final design last time I talked to anybody from DOT. And um my good friend, Florida Representative Bill Pardington, who was the previous mayor of Orman, will be our guest speaker that evening. Want him to go over the last session that we went through in legislative or he went through that was different from anything they ever had. And there's a couple of contentious bills that I would like him to go over, too. So, if you know of anything you have any questions for him about the past session, about an upcoming session, please be on hand that day. I'd love to see everyone there again. Missed everyone. Um, September 11th, the end of summer bash. It'll be a low country boil at Krabby Joe's. The pre-sale tickets are $35, $40 at the door, and the gratuitity is not included. Um, and the waitresses and waiters really work hard that evening with the crowd that we have. Please make sure you take care of them. A third of the tickets have been sold already, and that is fantastic because we're normally one to two weeks before an event, everything gets sold. So, I'm happy about that. So, yes, I know Kim pretty good. she uh but I I am here to address the oceans 25 and I don't know if anything can be done but um the patios right now there's only three that's got something up. One of them has sheer curtains that blow in the wind and then they had another sheer curtain and somebody decided to cut it short and then they have a pretty um wood shutter. So, I was wondering if right now they're new, so it doesn't look too awful out there, but imagine in five or six years what it's going to look like. So, I was wondering if there was anything that we could do, uh, you know, make some kind of guidelines or something that they would have to kind of be the same. Um, so right now, um, I'm going to ask you after the meeting's over to get with our community service director, Stuart Cruz, with you right here behind you. Rub your hand again. Okay. Mark. It's an economic development um request. So, I helped uh initially make the guidelines for the grant. I mean, I helped. I was a very small part, but it seems like we overlooked and it kind of came up tonight. And it's not against mythos at all. It's uh I think that it in order to be to get the grant, they need to have said hours. And I heard that they are starting with those hours, which is great. But for example, if their hours reduced in the future, I think that their rent rebate incentive should also be prrated there. There's just some language missing in our grant that if they hang up a gone fishing sign and they are only open two hours a day and we're still subsidizing the rent. I I just don't think that was our intention and I don't think that's a new business's intention either. But I do think you have to have set hours consistent in order to to be open for the public so that we help we're partners with them basically. So I think there's something missing in our language that would because I when we were saying that I heard Nancy say I don't know if we could do that. So that means that our our initial wording of the grant probably needs to have a an amendment. Yeah. I and I agree with you and I believe and I don't know I'll have to talk to the attorney, but this is our money, the city's money, and anytime we're giving money away to help these businesses out. If they don't perform or they're doing something, I believe we

can revoke it. Perhaps they could let us know if they have a a change in their hours because their business doesn't require them to stay there and I just think there should be a little bit more accountability for the hours of business.
