I'm going to move item 3D. up uh just because we have a one or two folks in the audience that i think need to get home for homework so i'm going to make that make that change uh are there any other changes additions deletions nope all right hearing none and with that change then i'll move the agenda to the floor and then at this time we will move to the recognition of the soccer teams So I'm going to read the recognition. I'm going to read it through for all the groups. And then after that, we'll move down, the council will move down to the floor and we will take respective pictures with each one of the groups. And we'll call you up one at a time once we're finished. That should be the most orderly way to get things done this evening. Okay. All right, so tonight we're recognizing two successful youth soccer programs. The first group to be recognized is at Albion SC, a local Cutler Bay club. In 2021, Cutler Ridge Soccer Club joined the national affiliate program, Albion SC, becoming Albion SC Miami here in Cutler Bay. This move connected homegrown soccer club with one of the most elite clubs in the nation, providing a platform for immediate national recognition uh receiving major operational strategic and advantages including connecting albion sc miami to recruitment and scouting systems of its very strong collegiate placement program and the professional clubs in the network we have three teams to recognize as well as the director and the coaches uh who guide them uh this evening uh mr doug sanchez director oh there he is hello Ms. Dominique Brown, coach of the girls 12 academy team. Mr. Diego Serrano, coach of the girls 14-15 academy team. Mr. Patrick Munoz, coach of the boys 14 academy team. Both Mr. Both Mr. Serrano and Mr. Munoz are from the Cutler Ridge League. Mr. Serrano as coach and Mr. Munoz as a former player. So I'm going to just go through the teams and then we'll call you up once we get down there. First, the Avalon SC Miami Girls 12 Academy. This team is the state of Florida President's Cup champions and now moving on to regionals to represent the state of Florida. They also played two years up in their league this year after not losing at their own age in the previous season. Very impressive. Next, the Avalon SC Miami girls 14 and 15 academy team is officially the South Florida Premier League spring season girls champions of last night, winning the championship game. And finally, Albion SC Miami Boys 14 Academy team. The team is currently in the league semifinals and will play again on May 30th. This team also won the South Florida Cup and Showcase Tournament this past April. The second group we'd like to recognize this evening uh we would especially we are here to recognize the juventos um 10 year old girls competitive team Currently competing in the Elite Development Program League, this team competes in a very high competitive U10, S Florida South Flight One Division, a division that spans the vast region from West Palm Beach to the Florida Keys. Through determination, discipline, and teamwork, these young ladies have risen to the very top. 90% of the players on the team live in Cutler Bay and attend Cutler Bay's Matter Bay Academy. where principal crews provide students with rigorous and innovative education. These girls team went undefeated for the season and secured first place in their age group as competitive division. Even more remarkable, their defensive strength and teamwork led to 11 clean sheets, holding their opponents scoreless in nearly every game. We'd also like to recognize the team's coach, Felipe Ramirez, who has gone above and beyond at every practice and every game to help these players their remarkable achievement. Your dedication to getting the players to practices, games, and tournaments never went unnoticed. Thank you for always cheering from the sidelines, motivating the team, and creating such a positive environment for the players to grow both on and off the field. Thank you guys. Good evening. I wanted to address something.

Obviously, because we know you, but for the record, your name and address.

Barbara Condon, 19641 Holiday Road. I wanted to address something that occurred during a recent meeting. An individual from the public made allegations against both the members of this council and the staff without evidence, framed with the claim that other unnamed people were afraid to speak, fearing retaliation. My son showed his disapproval of these remarks through a silent cross-armed gesture. I could not understand this person and did not react at the time. For that, I owe everyone an apology. In my opinion, this is gossip, and gossip has no place at a public meeting. If they were truly concerned, it should have been investigated in private, discreetly, and through the proper channels. On a different note, I wish to congratulate all of you for your work getting the ILL application for Coastal Ridge Preserve onto the A list. Eduardo Verona and a handful of residents submitted that application six years ago with the hope of making it onto the B list. The fact that it has made it onto the A list is a testament to your hard work, and to all those residents wearing yellow shirts who saw the true value of this land. And finally, I'd like to congratulate Alfredo Quintero on being named the 2026 Public Works Director of the Year. The fact that he knew that I had put in a new driveway just shows how attentive he is. Thank you.

Thomas Condon, 19641 Holly Road. Good evening. During a recent meeting, the topic of professional ethics was addressed. And firstly, I would like to make it clear the town has done an exemplary job ensuring that all town staff and all town officials uphold the most stringent standards of professionalism. I believe that our town continues to reach new zeniths in matters of transparency and communication. My concern tonight, however, lies in another area that may sometimes be overlooked, which is the importance of professionalism as it pertains to formal appointments beyond these core areas. I would encourage the council to continue upholding the same high expectations of professional conduct that imposes upon itself and town staff for those residents serving officially appointed roles within the town, whether this is in the capacity of a committee member, an officially sanctioned vendor, or in any other formal capacity. I especially urge the council to ensure that no officially appointed representative of the town is able to leverage their appointed position as a platform or a source of authority to advance unprofessional conduct or misinformation that harms the community at large. This is emphatically not a matter of political opinion. To the contrary, it is a matter of maintaining ethical standards, professionalism, and public trust across all formalized town roles, regardless of personal or political viewpoints. Thank you.

Thank you, Vice Mayor. We have with us tonight some of our age-friendly community committee members. I will call them up to the podium in a moment so they can give a brief synopsis of the work that we do. I had the privilege of acquiring this committee when I was first elected to office six years ago. This is a very hardworking committee who is quite influential in the town. and in the state of Florida, recognized by AARP for the work they do. They work tirelessly for the entire community, not just for the elderly. The impact of this this committee I see it firsthand. It helps combat ageism. It supports residents of all ages, promoting healthy aging and independence and social inclusion. And this is something that every one of these committee members take very seriously. And I'm very proud of the work that they do. Again, I'm very proud that I can liaison this committee for this council. And at this time, if you don't mind, I'd like to invite the committee members up to the podium who's here That would be our chair, our vice chair, and our secretary, Irene, Charlotte, and Avi. Please come on up.

Good evening. Thank you, everyone, for having us here. Thank you, Council Member Lord. We appreciate everything you do for this committee. Ralph, we couldn't do it without you. Our updates, asking for printouts. I know we do that. And Daniel, who we're always sending. Yes. All of our agendas, too. We do appreciate that. Yes, my name is Charlotte Marvez Barnes. I have been on this advisory committee for 10 years now. I started when Susie Loisel started. was with us here on this. So it has been a wonderful opportunity to see the town grow, to see the advancements that we've been able to do. We are an advisory committee again, as I say. But we love to say, you know, we think this would be so helpful for our committee. Abby here, Mr. Doctor in the House, he's great. great with helping us try to figure out what's the best way to help our seniors with anything. Irene with her social services background, myself in healthcare. We are just so proud to be here. I'm so proud to say that I live in Cutler Bay and I appreciate everything that the council does for us. Thank you.

Irene? Sorry, go ahead. Okay, my name is Irene Rivera Royston, and I've been the secretary for the committee for the last, I think, five or six years. I've been on the committee about eight years. Just a reminder in terms of what our committee does do, we work with Ralph and all of the staff for Cutler Bay. I want to give a big shout out to the Parks and Recreation Department because they just do a phenomenal job with making sure that our activities reach our aged community, our senior active, we're called active seniors or active adults. But our committee goes beyond the adults, and we look at the pillars which are part of the AARP plans. We put together five-year plans over for the last, what, how many years? 20 years now, right? So initially, the plan was working with AARP, and then we went on to get all kinds of recognition for the work that we've done. Our committee has been age-friendly from the beginning, so we look at making accessible programs not only to the active adults, not only to the shut-ins where we sometimes reach out, especially in times of things like the hurricanes, making sure that they get what they need, that they're reached out, but we've had intergenerational programs and activities and suggestions. And none of us will ever forget one of the high school students came in and talked to us about putting together a Valentine's event for our seniors for our maybe even for our shut ins, so that they at least got a hug or love or note on Valentine's Day because they might be forgotten. So thank you to the town of Cutler Bay. to all of you who are on council who are about to approve our next five year plan. And we'll keep working for you. I'm also a resident of Cutler Bay. And I really enjoy this town and I give you I salute you for the work you do.

Thank you. My name is Abhi Bhattacharya. I'm the Vice Chair of the Age Friendly Community Committee. There's not much more left for me to say between all that's already been said. There are many things to love about this town. When my family and I moved here in 2015, we knew we did the right thing. But what is especially outstanding is the fact that we even have a community like this. Few towns will take up such an initiative. And this addresses not just one or two aspects of living, but across the board, from housing to social activity to health care, name it, transportation. All of these things are addressed within our committee and we are just an advisory committee so we provide our recommendations to the town council and we are very grateful for the town council to you know, go by those recommendations or at least consider those recommendations. We are particularly thankful to an excellent town manager and his team, without which none of this would be possible, you know, getting grants and all the rest of it. And I must mention the fact that the result of all these efforts has put us on the WHO map of one of the most friendly places for seniors across the world to live in. Few people may know that, but that's an outstanding achievement. So thank you all for keeping this aspect of our town alive and moving on to the next phase of the five-year action plan. Thank you.

You are the advisory board.

You guys are very integral to the work that we do as a town for all ages of residents. And also highlight what Abhi just said, that the town has been recognized by the World Health Organization by being one of the friendliest towns for all ages, and that is significant. That is very significant. And that's because of you guys and your work. I also want to point out that right now we're working on modifying our master plan. These meetings are open to the public. You guys are welcome to come in and add to these ideas that we have a wall of ideas that we're writing down. And I welcome anybody and everybody who wants to come. I would also like to give a congratulations or a shout out, is that what the kids nowadays say, to Council Member Lord for her tireless work on chairing or the liaison to this particular committee. And you've done a great job. picking up uh right where uh susie loisel left off she was so passionate about this and um i mean fought for the uh the committee everywhere she went and um you you filled those shoes and you've pushed it forward so congratulations all right we'll move on to our next uh our next item well I tell you what, before we move on to our next item C, we are in the town council reports. I'd like to at this time call up to the podium our Public Works Director, Alfredo Contero, and the Assistant Director, Yerner Vega, for a proclamation for the 2026 National Public Works Week. I mean, our Public Works Director of the Year.

All right. Proclamation. I'm not going to make any promises that all these words will be pronounced correctly. Whereas public works professionals focus on infrastructure, facilities, and services that are of vital importance to the sustainable and resilient communities, as well as public health, high quality of life, and well-being of the people of the town of Cutler Bay, and whereas these infrastructures, facilities, and services could not be provided without the dedicated efforts of public works professionals who are engineers, managers, and employees, and sometimes state, public works winners at all levels of government and the private sector who are responsible for rebuilding, improving and protecting our nation's transportation, water supply, water treatment and solid waste systems, public buildings and other structures and facilities essential for our citizens. And whereas in the public interest of the citizens, civic leaders and children in the town of Cutler Bay to gain knowledge and maintain progressive interest and understanding of the importance of public works and programs in the respective communities, and whereas, as of 2026 marks the 66th annual National Public Works Week sponsored by the American Public Works Association, and whereas this year's theme, Rooted in Service, Powered by Community, acknowledges that the roots of service run deep in public works, It has also propelled public works innovations that have helped our communities evolve into places where people can lead lives for purpose and possibilities. Public works projects such as the building of roads and bridges are highly visible, while other public works contributions like maintaining water and sewer systems and sometimes hidden from view. Together these efforts from the foundation of thriving communities reminding us that every project seen or unseen powers the connection between service and the people it supports. Now, therefore, be it resolved, I, the Vice Mayor, on behalf of Tim Mirabat and the Mayor of Cutler Bay, and by virtue of the authority vested in him, and on behalf of the Town Council and citizens, proclaim the week of May 17th through the 23rd, 2026, as National Public Works Week.

Whereas items three through D have now been completing. Therefore, we will move on to agenda item four reports. 4A, the town manager report. Turn the floor over now to our town manager, Ralph Casals.

Thank you, Vice Mayor and members of council. Tonight we have Emma Jones from Stantec to provide an update on our design services for the 16-acre Legacy Park and Municipal Complex.

Good evening, everybody. That was so fantastic. It means so many fun things to commemorate. It's just wonderful. So all right. Hopefully you guys can see my screen.

Yes, we can.

Very quick update. So phase one, which is GMP1 site radiation, We are still awaiting DERM's approval for our final plan on all of the soil approvals. So we're hoping to have that by the end of the month. GMP2, we have the contract signed with Kauffman Lynn and we are moving forward with finalizing the buyout. We did have a meeting for the site flat for the new 212. Those plans have been approved. And right now we are waiting plans and finalization from Salts, Mickelson and Chenmore for the storm water management plan and calculations. We should have those by Friday. They are setting up a meeting next week to review those. And then after they've had that sort of review and agreement on what the final plan should look like, those will be altered. and be resubmitted that following week. On-site activity for GMP2, there is a small job trailer has been mobilized to site. Kauffman-Linn has applied for the permit for the larger site office trailer, which is basically a double-wide trailer. And they're going through some of the back and forth for that. we do have the truck wash station ready for installation. GMP3 or Phase 3, this is sort of the vertical build and the remainder of the park. The invitation to bid was sent on May 14th, and I just want to sort of reiterate this is sort of the second round of it. GMP2 and 3 were issued together. We then asked Kauffman-Lynn to um, parse out GMP two from that. And so now based on the, um, permit comments, et cetera, we are sent, Kaufman Lynn is sending out this sort of next set of GMP three building, um, drawings to, um, finalize the bid. So, um, those, uh, those drawings were sent out on the 14th. The, um, The due date for those bids are June 8th. RFIs, so that's request for information. If there's any questions on the drawings, those are due on the 27th of May. And then Kauffman-Lynn will respond to those questions by June 2nd. The total number of subs that have been invited to participate based on the initial response was 571, which is amazing. Just wonderful, wonderful amount of people that have responded. So we're really looking forward to sort of finalizing this entire process. As design and permitting, as I mentioned, final permit review comments are being addressed by Salt Michelson. The value engineering is ongoing for this project and will be basically for the entirety of the project. So project timeline, everyone has sort of seen this every month. Not a lot of things have changed on this. I think we are moving forward and we are obviously awaiting some approvals from Durham. So with regards to the pool timeline, which was a hot topic last time, you know, this is where we are right now. We have approval from the town as well as Miami-Dade on the drawings. We have executed the contract with Kauffman Lynn to proceed with the GMP2 as well as a notice to proceed. So that's where we are with the Legacy Park.

Any questions from the council? Council member Duncan, you're recognized.

Thank you, Mr. Vice Mayor. Just one quick point for clarification, and this could be for Emma or for Ralph, is the delays that we're experiencing through DERM and getting approval for phase one for the soil remediation, This seems to be a little excessive, but maybe I'm being naive on that, but is this typical as far as the amount of delays we're facing on this for other projects? And if not, then why is this one seeming to drag on longer than it should?

I'll take it, Emma. I think in this one here, since we know that the soil had to be remediated because of arsenic. So part of the process is importing clean fill, certifying the fill is clean. At the end, then we put in more sample wells. Sorry. points, not the wells, wells for the water, sample points, and then we send that back to Durham. There was a couple of wells that there was some conflicting data. So with that, we had to go back out there and do some more well points and provide that to Durham. But I could tell you that we've been in communication with Miami-Dade County Durham. They have all the data making sure that the soil came from the The site approved Durham quarry. It was transported, it was not contaminated, and then put into place. So that's what's been taking a little bit of time because there was a couple places that it was beyond the levels that it should be. So that's why Durham has taken a little bit of longer time to provide, really analyze the data that we're giving them. But as we reported in the past, that doesn't stop us from going through the GMP, too. We had the special council meeting, I think it was May 7th or 6th, and things are moving along for that. It's just a matter of we think that we should be getting the the report from durham the all clearance report like emma mentioned by the end of this month but there's other activities that could go on on site uh besides that but i think it's just because of those areas there was a little bit of conflict with the with the the points okay thank you uh just a point of uh clarification so um the the derm issues that we're having uh are related to the storm water retention correct Yes, there's two of them. So there's the one for the clearance for the making sure that the area is clear of arsenic with the new fill. And then there's another one for the stormwater retention. Correct. Because there is a since we know there's arsenic in the water. So just think about like a little bubble underneath the site there that we have to make sure that they identify exactly where that contaminated water area is so that we're not installing an exfiltration trench near it or next to it.

Right. Yeah. the storm water correct storm tension so but that that doesn't prohibit us or does it prohibit us from moving forward with other vertical builds such as water sewer electric and so forth

It doesn't. It doesn't. That's why we want to move up that meeting there to gain that timeline so we can start ordering a lot of the piping there. So we know the stormwater, but you still have to have sewer, electrical, et cetera, the lead time for the elevator that we mentioned before as well.

Right. Okay. I just want to make sure that we can get some shovels in the ground out there and we're not sitting on the sidelines waiting for Durham.

No, I think that's what we're trying to present, saying there's a lot more activity going on right now. And thank you again, Vice Mayor and the Council, for moving that meeting up, because it did move up our timeline a little bit there. It may not seem like a lot, but three weeks is a lot. Thank you. Thank you, Emma. Next, we have an update on Frangel Road. We have two of our individuals here, Ms. Angel Turpin and Janet Delgado from Kimley Horn. Both will be on virtually, so the clerk could bring them up.

Angel Turpin- hi good evening everyone, my name is angel Turpin here on behalf of Kim Lee horn to provide our may 2026 project update for the frangio road improvements project. Angel Turpin- So for our construction activities we continue to hold our bi weekly construction progress meetings. with the contractor, the town, the engineer of record, and ourselves as the CEI for this project. For our work zones, for work zone one, two, and three, these areas remain open for use to the public. And this runs along Franjo Road from Southwest 184th Street to Caribbean Boulevard. For this area, we are actually working on wrapping up some outstanding items that we identified during one of our substantial completion walkthroughs that was performed with the town and the contractor a few weeks ago. For work zones four and five, running along Frangio Road from Caribbean Boulevard to Old Cutler Road, ATI continues to work on reconstruction of the roadway at this time. So also, we continue to remain focused on keeping the site clean and safe, as well as maintaining the MOT throughout all areas and the entire duration of construction for this project. We wanted to also provide a reminder that a phase being open to the public does not mean that the area is finalized. We've talked about the final lift of asphalt still pending in these areas, along with finalizing those bus shelter installations. tree and sod removal and installation as well as those light poles and regarding the light poles we actually continue to coordinate with the county and fpl we have been informed that the light poles will not be put into use until all light poles have been installed An FPL account has been created by the county and an inspection has been performed and cleared. So at this time, we don't have a concrete timeline, but we're hoping to have those put into use prior to final completion in September of this year. And also for our schedule, we do remain on track to be completed by September of this year. for this project. And now I'll turn it over to Janet to provide us with our public information update for Franchot Road.

Can you hear me? Yes. Okay, beautiful. Good evening, Mr. Vice Mayor and council members. As the Franjo Roadway project improvement continues progressing towards its final phases, public involvement efforts have been remained focused on maintaining communication with residents, addressing community concerns and supporting a smooth transition through the remaining construction activities. primarily focused on spending time with residents and addressing areas of concern as the project phases towards completion. Continue working closely with residents and business owners to resolve questions related to final construction activities, access, and overall project impacts. Maintain an active presence within the community to ensure concerns were heard, communicated and addressed properly. Assisted residents with ongoing updates regarding remaining work activities, scheduling and project closeout expectations. monitored construction areas, pedestrian pathways, and traffic conditions to help maintain safety and accessibility for the community. I focused on maintaining positive community relations and minimizing disruptions as the project progresses towards completion. And again, I will reiterate, what Angel just said. So lastly, I want to reiterate that the final asphalt lift will be completed once all project phases are finished. The final lift will bring the manholes flush with the roadway surface and provide a smooth uniform street finish. Any questions for me?

Hey, Vice Mayor. Yes, just one quick question. So presently, Cranjo is open to traffic up from 184th until Martinique. Is there a plan for it to open up to through traffic from Martinique anywhere beyond the rest of stage four and stage five prior to final completion? Or are we anticipating that from Martinique to Old Cutler, it will remain closed to through traffic until the project is 100% complete?

I believe, Angel, you might be able to help me with this. I believe that phase four will be open prior to opening phase five. Is that correct?

Yes. And it'll follow similar to those other phases where we kind of slowly move that MOT out. So those areas will be open prior to final completion.

Thank you, Council Members, for letting me speak tonight. I am Amber Donley. I'm from the Nuclear Regulatory Commission. I am the Senior Resident Inspector at Turkey Point Nuclear Station. Every year we have a public meeting to discuss the performance of Turkey Point during the previous year. Tomorrow, we will be here in the town hall from 4 p.m. to 5 to discuss the performance. So please feel free to join us to ask any questions about how the Nuclear Regulatory Commission assesses nuclear plant performance through the reactor oversight process and the roles of resident inspectors at nuclear facilities. Thank you. Thank you, Amber. Thank you for your team. They'll be here present tomorrow. Once again, it's tomorrow from 4 to 5 p.m. here at the council chambers. And I attended last year. It was great to see all the folks there from from Turkey Point to help keep us safe. So thank you, Amber. Members, council. Lastly, I'm pleased to share that the town of Color Bay has officially been awarded the Certificate of Excellence in Communications. by the Florida Municipal Communication Association. Additionally, our communications manager, Rod Gibson, there he is in the audience behind the scenes, became part of the inaugural graduating class of certified local government communicators program by the florida municipal community case association so congrats kudos rob behind the scenes so thank you rod for keeping us uh up to date with all those items there in fact some of the other cities are actually using some of our policies as well so that's kind of you know great to see as well so we're we're setting the bar high there as well so so kudos rod thank you for for that month-long you know class that you have to take so uh yeah vice mayor that concludes my report

The town does a great job, and of course, a tribute to Rod on getting the information out to all of our residents on all of our many projects. All right. We'll move on. Town attorney report.
