You'll be seeing a lot of Connor. He's done some work in uh Prescid and around the valley. So, we were lucky to get
Connor. Thank you, Connor. And lastly, I'd like to thank you all for being so good to me in my stay here, but this will be my last meeting. Next week will be my last week because we have hired a new director. Her name is Sammy uh Rial. She's joining us from Clark County, Nevada, and she will be at your next meeting. And that's all that I had. Wonderful. Thank you for that. Um, do we go back to the election of chair and vice chair now?
We're going to wait. Okay, we'll continue to wait. So that brings us to old business and item the item on the agenda is public hearing on establishing design standards and an amendment uh 0-26-00002 to the city of Cottonwood zoning ordinance section 304 design Thank you.
Interrog community development director and I'll be discussing the amendments to section 304 design review and the design review standards that we are establishing. As you may remember from previous meetings, House Bill 2447 was passed and that requires all municipalities to authorize administrative review of development and design plans. So the design review that used to come to the commission will now most of the design reviews will be reviewed administratively by staff. In order to do that, we had to come up with objective design standards. Right now, and you'll see as I go through the slides, what we have in our code is vague because we used to bring those design reviews to the commission and we get feedback at that time. Since we are now required to do this internally, as are all municipalities in the state, everybody has to come up with objective design review standards. The House bill became effective in the on December 31st. However, the legislation did give municipalities time to adopt and adapt their administrative processes. So, that is what we will go through this evening. Section 304 of the zoning ordinance will be amended to authorize the community development director to approve approve with condition or deny design review application. That's what we call the administrative review. We are also tasked with coming up with processes for administrative review and also commission review should some design review still come to the commission. We have to also indicate the appeal
processes for decisions and indicate additional exceptions which would be required to submit for design review approval. That is all shown in a flowchart that I'll show you next. The biggest task though was that we had to come up with objective review criteria and reference materials and that is the newly proposed design standards document. This is the flowchart that addresses some of the tasks. When you have a design review approval, if you go to the top of the flowchart, if you meet all the proposed design standards, if you do administrative decision, so it would just go to staff for review. If the applicant does not agree with the decision, then they can appeal it to the board of adjustment. Now, if you meet the intent of the design review standards and or you have a development agreement for affordable housing, you can still go through administrative decision and still appeal to board of adjustments. So, you don't have to meet all of the design standards. And if you go through the design standards, you'll see some have AMI after it. Those are the ones that we would consider waving or adjusting if you have an affordable housing agreement. Lastly, if you do not meet the design standards and do not have a development agreement for affordable housing, the applicant would be advised to either revise their application to meet the standards or they can come to the commission and get their decision from the commission. So that's the review process we had been using for the past few years. So that doesn't go away. The applicants do have that option to do that. If they disagree with the decision of the commission, the appeal would go to the city council.
Then we have to come up with the design standards. When considering what to put in the design standards, we have to make sure that they apply to all development projects that are in section 304 today. As I mentioned, they can be modified or waved if you're at the AMI, the area median index. So, you are applying for affordable and that none of these standards that are being proposed allow you to deviate from the code and things that aren't covered in the standards you would still go back to the zoning ordinance for guidance on. As I mentioned, currently our guidelines are just that. They're guidelines and they're vague. When talking about architectural details, it says they shall be visually compatible with buildings and structures to which they are related. That's very vague and also not helpful if there are no existing structures. So what we are looking for in the proposed standards are things that are measurable that are objective. So building facades visible from the street shall have a two- foot variation in depth at least every 40 feet and things that are really you can look at and you could say state whether or not they're met. There's no bias involved. No personal opinion. The League of Cities put out a standards for us to come up with objective design standards and a helpful guide. In there they listed different types of objective standards. We decided on a combination of yes no standards. For instance, rooftop mechanical equipment must be screened. You look at the plans, it's yes or no whether they meet it. We also looked at counts and measures. The second example, fences shall not exceed three feet in height.
That's something that's measurable. Again, it's objective. It's not vague. And then we like the list categories. garage door shall have one of the following and there's a list of items they could choose from because this still allows flexibility in the architectural design but it does give us quality development. So looking at an existing vape standard in our zoning ordinance in proportion it says the relationship of the width of a building or structure to its height shall include balanced and harmonious proportions. Again, if you're a developer and you're trying to draw up a design, this is not helpful for staff to review it. We can't really objectively state whether you are balanced and harmonious in your proportions. So, we're proposing these are actual standards that are being proposed. The first one is a yes no. Streetfacing building facad shall have building entrances that front the street. Do they? Is it yes or no? For ground floor commercial uses, window doors or o other openings shall be at least 60% of the building wall area. This is shown in the example at the bottom with the umbrellas. Again, that's measurable. You can measure the wall, measure the windows and openings, see if they're at least 60%. Another one is a list approach. Where residential units are designed as town homes or row homes, you have to meet at least two of the following. The example on the bottom left shows all of them. Actually, you're not required to use all, but this shows a change of wall plane, change in color, change in roof form, change in materials, and change in other architectural elements. When we came to you two weeks ago or
three maybe four, we had a lot of the design standards completed, but we did not have the highway commercial or the industrial and community facilities. We also did not have the section on amendments or a full glossery. We still don't have the amendments or the glossery. We will continuously update this document but due to the fact that we are required to do this. We put together as much as we could quickly and we do intend to bring this back to the commission every probably more than once a year once we start using it and we realize there should be things that should be included or other things that we might want to adjust. But the following are the highway standards and the industrial and community facilities design standards. We also went through the mural section at that time uh the last meeting and we have murals and vinyl clings all together. We were asked to separate those out which we have done. We were also asked to not limit the murals to just 50% of the wall surface area. So, we removed that and we did make vinyl clings their own section and we did keep 50% on that, but that's when they're on glass panes on storefronts and building fronts. Tonight, we are asking for a recommendation of approval to council. And I know I went through that quickly. A lot of it was shown to you at the last meeting, but if there are any specific design standards that you'd like to discuss or any other questions, I'd certainly like to hear from you.
I have a question. Um I noticed that uh you have it on uh number five miscellaneous mural shall not be elucory adultoriented or gang affiliated yet. How does this jive with the fact that we have large signage right now in our community that uh says naughty burgers and sinful sodas is I don't see a fit there.
Well, in the past we did not have any standards for mural and you just couldn't have it advertise. If it advertised what was sold there, it was considered signage. So going forward, we would look, but I don't even know if those would be considered adultoriented. Is that what you're you're saying? It's kind of a fine line. I agree. Just curious.

We looked at California had a lot of examples because they were required to do this, but theirs was only residential. So then we had to look nationwide for commercial and industrial standards. Thank you very much. Moving along to new business, we have a CUP-25-013 public hearing and consideration at of approval of a conditional use permit to allow for a recurring farmers market in the CF/R-70 Community Facilities/aggricultural Residential Zoning District.
Thank you, Vice Chair Rothrock Commission. I'm Tina Hayden with Community Development. Presenting on this conditional use permit for a recurring farmers market. The request tonight is consideration of approval for that conditional use permit. We ask that you consider the applicant submittal and the staff report with recommended findings and stipulations. So some details of the property and first I'll break down this site map here. Uh property is highlighted in red here. You can see that it is dual zoned. It's uh zoned both CF community facilities and AR70 which is agricultural residential for one and a half acre lots. Uh adjacent zoning to the north is AR70. I believe this is a wellness retreat in this portion right here. Uh everything else of zone CF is in the same ownership as the project site here. Uh we have a cemetery here, vacant land here that you know the intent is to be used for residential in the future. And then on the other side of 89A, we do have P A zoning. This is the 89 and Vine project which has a mix of commercial that's intended to be along the street frontage and then residential mixeduse residential uh further away from the street. Uh that is a project that's been a long time coming might be a bit longer before it's fully developed and we'll keep bringing it back to the commission when possible. Uh so we talked about the dual zoning. The existing church and school are permitted uses in the CF and the residential zones. The farmers market is considered accessory uh and would be of similar intensity to those permitted uses. It is a 1 acre portion of the whole 18 acres approximately. The applicant does propose operations from 8:00 a.m. to 2 p.m. on Sundays year
round. They do call out four special events per calendar year uh with additional amenities such as a Christmas tree lot, a pumpkin patch, uh just seasonal events. On the site plan, I'm sure you've noticed that they do propose an enclosure for Porter John's. uh applicant states that these will be removed for cleaning every two to three months and they've done some due diligence on obscuring that from the public view from 89A. For those four special events, they will propose off- premise signage per our zoning ordinance. Uh we do allow the off- premise signage to be placed uh 7 days prior to the event and it does have to be removed 24 hours afterwards. Now, we're dissecting the site plan here. First, I'd like to point out the north arrow here. Uh we have 89A right here, Bill Grey Road right here, and the church here to the south. This is that overflow parking lot area where they're planning to occupy on Sundays. Uh you can see emergency access here from Bill Gray. uh they call out their 10 by10s uh tents that they'll be setting up areas for food truck vendors and I think the thing we're most concerned with is the location of the porta johns they'll be in this area right here behind the tree cover set back from 89A here and then separated from that adjacent property by Bill Gray here we've got some renderings of the porter johns so here we're looking eastward forward towards 89A. You can see the foliage that they're planning on using to obscure this and their screening which should not exceed 6 feet in height per zoning ordinance. Another aerial imagery of where that is located. We can see Bill Grey Road here 89A over this side here
regarding so they will have signage during the event. has to be taken down at the end of each event. Uh but this will be their on-site signage that they'll have on Sundays and then looking at existing conditions. So, first we'll look at adjacent sites. Uh again, I'd have you observe my north arrow here. It's going to guide you on, you know, where we're looking at here. So, this is the cemetery that again is the same ownership uh just off to the west. Then here we have that wellness retreat location just to the northish of the site. We have some street views here and you can also see the vacant land over there for that PD zoning for 89 and Vine here. So here we're looking eastward towards Sedona on 89A. And then here we're looking closer, you know, towards Cornville and Cottonwood. Looking at the subject site and again I only took pictures of that 1acre portion that they're looking to occupy. U again I'll observe my north arrow. This is Bill Grey Road. Our backs are to 89A. You see the church here. This is that overflow parking lot that they'll occupy. another view with our backs to 89A uh looking westward. In order for the commission to approve a conditional use permit, they do have to make findings. Uh the first findings of fact regarding general findings that the project is not detrimental to the health, safety or welfare of surrounding properties. Uh again, applicant does call out there are hours of operation from 8 a.m. to 2 pm on Sundays year round. They do propose off- premise signage but that will be limited to the four special events per calendar year. They are proposing an enclosure for those porter
john's really working hard to obscure that from public rightway. Uh this will be conducted within the church campus on the overflow lot. Regarding compatibility with surrounding uses, we want the project to be compatible with surrounding uses in the vicinity. uh all the zoning for CF and AR87 does permit churches and schools and again we said that the proposed use is considered of similar intensity to what's already on site. Um then we also have significant rightway separation between the nearby parcels. So we have Bill Grey Road separating that wellness retreat and 89A separating um 89 and Vine. The last finding of fact regarding traffic and circulation that there be adequate access to public streets and highways. Uh this site is accessed from Bill Gray which connects to State Route 89A. Applicant indicates that the existing church parking lot will have sufficient parking. I think it's about 330ome stalls on site. There are five stipulations that staff has indicated in the staff report. I'm not going to read these you verbatim here. Just summarize the first stipulation is that the project adheres to what's approved tonight by the commission. Second stipulation that the project conforms to the code review board comments given. Stipulation three that the project just to comply with all applicable sections of the zoning ordinance. Stipulation four specifically calls out for the off- premise signage only being allowed for four calendar events uh not to exceed seven days. Uh and then stipulation five does indicate that as this is a conditional use permit, it's only good for six months. If the use is discontinued, it may be subject to revocation. Yeah, I have a question regarding the um the portaotties since that right off Bill Grey Road. It's an off-road section where a lot of people will um may boondock in their RVs and whatnot or or live there for an extended period of time. I think those portaotties will be should be locked potentially during nonoperational hours due to the fact I think they would be abused with all the people that camp out that way. Just my thought. Thank you for that, Vice Chair, Commissioner Glascott. Uh, you know, we do recommend those five stipulations, but you're more than welcome to, you know, work out Wordsmith another stipulation regarding the locking of that, uh, enclosure area. Did you have questions for me or would you like to discuss um, that stipulation with the applicant?

I got some probably more for the applicant than than yourself. So, uh I agree with the toilets, but if you leave those unlocked and having prior knowledge of owning those, if they're not locked, they're going to get destroyed during the week. So, but that's more for this for the applicant. I mean, and it'll it'll just create people to go in there. Like I said, that's just uh maybe the one concern I have is if I'm going to mass, am I going to know where to go? Uh, thank you for Commissioner Camela. Um, as this will just be in the overflow parking area, I don't think it will affect, you know, circulation to the church. I'd have the applicant speak more about that.
Okay. Thank you. Any further questions? My question is about the parking during mass because there's two consecutive masses. Um that parking lot is full during mass. I just am wondering where they're going to park.
Thank you for that question, Commissioner Kennedy. Uh at the time of the code review meeting that we had with the applicant, they said that one of the intents of doing the farmers market on Sunday was for those who attended mass that they would be able to just walk over to this area and enjoy the farmers market. U I believe that's where she expects to get a lot of her attendance and I would defer the rest of that question to the applicant. I think my question is also for the applicant. Um, my concern is the the uh increased traffic and the that left-hand turn off of 89A into that area. I I drive through there frequently right about the time that mass is starting and you see a lot of people um going making that turn and the traffic coming into Cottonwood is is going at 65 70 miles an hour. I don't know um if it's even how to go about asking that maybe that 65 mile hour speed limit be put back past the Catholic Church instead of I know it's a state highway so it's not Cottonwood's purview but is there a way that the that that might be a consideration? I I don't again I know that's beyond our situation here but it to me it's a a concern is the traffic. Thank you for that commissioner Helman. Uh that is uh ADOT right ofway. U I do know that the 89 and Vine P A um at some point when they develop they want
to have a road that connects to Bill Gray. Uh so I don't know what that looks like in the future. Uh it's something that AOT will have to look to define that problem unless uh Mike I don't know if there's any avenue for us or director Kucho what avenues we could take to get that reduced. Um, chair and commission, there's there's not much the commission can do as far as getting the speed limit changed, but you can have his conditions of approval. Um, if you have concerns about safety, um, you you can make conditions regarding that safety. But as far as making a condition that they lower the speed limit on this the state highway, they can't do that.

Hello, my name is Aaron Stafle and I am the director of parish administration at Immaculate Conception and I have been asked here by our pastor to make sure that I could address any of your questions or concerns. It is um one thing I'd like to acknowledge is that we are just the hosting site for this event. Don Peterson with um is the one who's bringing in connect the harvest LLC and will be utilizing the space. So I would like to address the parking and anything building related specifically and she'll address portaotties and the things that she will oversee. Um, in regards to the traffic, this is obviously something that we considered in uh multiple meetings that we had on board with our staff and our councils that we have at the church. And one of the things that we realized is yes indeed the traffic is very um very difficult coming in and out of there off of the highway. What our hopes is is by hosting a farmers market and having an event, it will actually help disperse the traffic significantly more with it opening before the first mass and continuing through the end of it and with all of the programming and the various things that Don has put together with the state in regards to the wick,
the SNAP, all of the benefits, the double bucks, the senior bucks, all of those things are part of this um entire plan that she's proposed forward with us. And with that, we actually foresee all of our parishioners taking time to utilize our local um you know, businesses and supporting them. That will be a heavy push that we will do as the church with our parishioners that are there. In regards to parking, we understand that ideally this grows to be so big that we have an issue with parking and we have the land, as you can see, to further develop and make temporary parking until we can get approval to have more extended parking. So, that is very something we're very well aware of. Um, we also have plans that are going forward to develop a senior community center as well as a couple other buildings. And with those buildings, as you guys will eventually see these permits come forward um when that time comes, we anticipate having more parking areas and better um access points developed around the entire campus. So I think you'll find naturally in due time that will also expand and provide more opportunity. So I think that was both. Does that is there any other questions or do you need further clarification regarding the thought there? Oh, and I can also let you know that as of now, it's hard to see when you're in the parking lot, but down by the school, we have quite a few parking spaces open. We also have a ConX box that gets parked there for temporary storage that occupies um a lot of parking spaces. We have a semi-d driver that's parking there. He's one of our parishioners. On the weekends, he's currently parking there. So, there's a lot of spaces that
are still available that will be opened when we open up the farmers market as well. Any any questions or comments?
Thank you all so much. I'm gonna have Don come up. Hi, good evening. Don Peterson with Connect the Harvest. We're actually the um the business that is hosting the farmers market. We are a nonprofit as well and we have gone through all of the steps with the um with the city and with the state to be able to bring in um food with the staff and with the um wick and with the senior benefits and the double ups which no one's doing here which actually doubles the amount of food stamps that the people are actually able to use. It's not food stamps, but it's an actual doubling of the amount of money that they're actually able to spend on food. And when we are looking at the portaotties, and yes, it was a big concern for me that someone would actually get in there, toss it over, do whatever. Um, Nice John's is the company that we're using. Um, they will be coming in every week cleaning those portaotties. And um one of the stipulations that we told them in order for us to use you, it does have to be lockable. So that will be locked. We also will be putting a chain around it to make sure that it stays there. And the actual fence that we're going to be putting in, it's not like a fence, but it's going to be a temporary structure that we can move out and move over. Um, and when that is moved into place, when the market is not going, it will also be chained. So, it will be locked. So, yes, that was a huge concern of mine.

And our four major areas that we're working on is food, kitchen, renewables such as composting, um anything that we can actually bring in to actually help people and garden. So, those are the four areas that we're concentrating on in the market. You're not going to have knickknacks. You're just not. And one more. Yes, ma'am. Are you include the kids from Immaculate Conception with their products? Am I going to include what?
The kids from Immaculate Conception with their products. The fall within all of the guidelines that the city has given me. I can't. However, there are city there are guidelines that we have to follow with the health department and with the city. And if that's the case, yes. But they will have to follow all the guidelines like everybody else on the market. Okay. Anything else? I just want to clarify. You will be you will be setting up and taking down the the stations every week. Oh my goodness. Oh gosh. Yeah. Oh yeah. So much work.
It is. you have. I've been doing farmers markets for 18 years. I've been doing them in the Phoenix area for 18 years. Um, my business I have been doing for 19 years. And yeah, I have missed in 18 years. I think five markets and a couple of them I had a kidney transplant. So, I had to be out for that. I do have a son that helps me in the business who's been with me since he was in 8th grade. the whole business is actually kind of built around him and he wanted to do this and it just blossomed. You know, we've um we have actually been voted best of Phoenix with my business and we've been on the Food Network as well. So, yeah, it's like I I know just a little bit.

Uh comment. It sounds like this could really be an asset to our community. Thank you for bringing it here. Thank you, sir. You know what? I really believe it will be. Um there's a incredible need I think here. Manzanita and Pinnacle are doing amazing jobs. Um but there's a huge gap. Um there's a huge gap. And there's one farmers market in Camp Verie that will actually do double up bucks. But double up bucks are where you go in and you take out um say $10 off your SNAP, which is your food stamps, and the the city or the state gives you an additional they match that and it doubles the amount of stuff, but it can only be used on fresh produce, uh garden starts, beans, and a couple of other things. So, they're actually giving them enough money or more money to where they can go in and buy more food for no cost.
And I have a comment, too. I I just wanted to say I really appreciate the fact that you're not competing with other farmers markets in the area. You you picked a different day, you know, there's more more access to people. you know, there there's this isn't a competition. This is feeding people, and that's what's important. Um, there are other farmers markets, and a lot of them have different programs, but I don't know of any farmers market within a 75 mile radius or even a 85 mile radius that's bringing in all of the state programs like we are. And we're including in all of this the Arizona Humane Society will be there with their adoptable animals. We're also bringing in a couple of the shelters and the rescue groups. And we're also including the Cub Scouts, Boy Scouts, and we're including the Girl Scouts that are going to be there as well. And I'm working on FFA and um 4. Any questions?

Thank you, Vice Chair Roth. Commission Tina Hayden presenting on a design review application for dermatology medical office facility. Tonight, we ask that you grant design review approval for that new medical office building. Uh we ask that you consider the applicant submittal and the staff report with recommended stipulations. Uh again, we're dissecting uh the area and the adjacent uh properties. So, this site is actually zone C1 like commercial. It is over two parcels combined. They're about 1.4 acres uh in size. And we will require that they are the property is combined prior to the issuance of building permits because they are proposing to develop that building over lot lines and that's something that the zoning ordinance requires. Uh we have 89A here. We have North Alamos Drive here. Uh to the northwest and southeast is additional C1 zoning. These parcels here while they are zone C1 have a conditional use or permitted to have multifamily residential and so screening is required when adjacent uh when non-residential uses are adjacent to residential uses. So the applicant will provide some additional landscaping here that's sufficient to the code. Uh across 89A we have uh P A zoning. I believe this is the vineyards and gracetta pads uh for both multif family residential, single family residential and commercial. Uh to the south here we do have some I uh industrial zoning uh with industrial uses there on the other side of Alamos. Uh and access will only be provided from North Alamos Drive. So there will not be any access from 89A.
This is the applicant's landscape site plan. Again, I call the attention to the north arrow this way here. So we have 89A here and then Alamos Drive here showing that two-way entrance as well. As uh one navigates the site, this is only oneway circulation here providing for I believe that is 60° angle parking stalls. Uh this area here will provide two-way access. Uh we'll have a covered parking here and then that proposed building area here. This is where we have that adjacent residential use. applicants proposing a 15 foot landscaped yard along with a six foot tall CNU block wall along that property line. Applicants provided us uh some colored elevations here uh right here. It's a little difficult to see. That's about 18 feet in height. Uh so they're not exceeding any allowed m height maximums. uh some additional elevations of that covered parking canopy. It's got a max height of 9 feet 6 in and a clearance of 7 feet underneath. This canopy will not be projecting into the driveway. So, there should not be any concerns with uh fire and uh trash vehicles uh gaining access to the rear of the property. We have the trash enclosure as well. applicant has provided some renderings. Both of these, as you can see by the north arrow, we're viewing from the south. So, we're seeing that south elevation there. Uh, just navigating from the parking lot here. And then just looking at the current conditions of the site, uh, we have our adjacent properties. This is on the
other side of Alamos towards the south with those industrial buildings and uses on the other side of 89A. So more to the north and eastward. Uh we have that P A zone land. It's currently vacant. On this bottom picture here, uh, while we're looking eastward on 89A, you'll see that adjacent residential to the project site. Now, we're this is looking from Alamos towards 89A. So, we're looking at the subject site again just off to the east. You see that adjacent residential adjacent residential there uh with our backs to 89A looking towards the Alamos here. We do staff does propose five stipulations that are indicated in the staff report. Again, I'll just summarize these real quick. Uh first one is that the project adheres to what's reviewed and approved at the commission meeting tonight. Second one that the project adheres to the comments given by the code review board in that comment letter. Third stipulation that the project complies with all applicable sections of the zoning ordinance. Uh stipulation four is that lot combination requirement prior to the issuance of building permits and stipulation five that a building permit application be submitted and diligently pursued within 24 months of this approval. I think this is a a wonderful project. I'm so glad to see it coming. I've I've used um Northern Arizona Dermatology in the previous locations and yeah, it's definitely needed a space of their own. And um so I'm really glad to see it. And I I thought the responses to the previous I I know you had it reviewed by community development a couple times and you responded by making changes and your packet your information was very clear and I appreciate all of that so that it it makes it easy for us to understand what you're doing. And and it doesn't really have to do with you. So, thank you. And it it also isn't against you. Um we just the very first thing in the meeting we approved the new uh guidelines for design standards that'll be sent to the council for approval. And when I'm when I'm reading and I'm listening to the presentation, when it came to the design standards, the idea was that you were no longer going to allow big boxes to be built in the city limits, right? that everything had to have some type of architectural uh motif or uh a break in in the the way it's designed so that you got rid of big boxes and you created lots of little boxes, right? But when I'm looking at this design, it doesn't appear to me that it would meet your new standards that you're asking to be adopted because you basically got two big boxes and you're not having the elevation changes or the, you know, the different types of reliefs that you're talking about 40 foot across, you got to have a break. You don't have that here. you have a window and you have, you know, the use of steel on the other box that will be a relief and and add texture, but at the end of the day, you still have two big boxes. And I'm just kind of curious how this design jibes with what you're going to expect to be the new standards for the city. So, it's it's not against your box. I like the design. I love the I It's a very pretty building.
Chair, Commissioner, um, we didn't compare this to the design guidelines. I think you might be correct on the northwest elevation. uh but I don't know the measurement of that side but yes something like the northwest elevation is something that we would have asked for some some breakin but depending on the length of that it may be a smaller dimension than we're requiring but we will go back and we'll take a look at it and
no and that's not that's not what I'm after I'm just I'm trying to I'm trying to make peace with the new standard versus what in my mind is a beautifully designed building that I would be proud to have yet it doesn't fit our design standard and that's what you're going to start holding everybody to that standard as we move forward unless I guess they want to come to this board or the council and object and ask for a waiver right
and chairman commissioner Again, I haven't measured this, but I think three of the elevations would meet it because it's a change in materials and they have that. And we'd have to check the windows and see if they're recessed and the overhangs. So, a lot of that would probably meet the design standards. It's just the northwest, which may not, but that might also because it does have the break the um overhangs over the windows. So, we'd have to go back and check. But yes, we are trying to discourage the big box. I don't know that that northwest elevation is long enough to require a break in the plane, but but we would check things like that. And again, we would just encourage the applicants to do that. That's why we went with a lot of lists so they have choices and not just yes and no. And um I mentioned it briefly at the end, but we certainly we're doing the best we can with the time we had, but we do certainly believe this is a living document. And once we start using it, if we do have to amend things, we'll bring them bring them back for amendments.

Any headway? Anybody you weren't here. We were asking to uh review maintenance agreements like current maintenance agreements we have with partners.
No, it was more like um maybe a list of the maintenance agreements that were with say Walmart because we had discussed that in a previous meeting chair and commissioner what I'm hearing is since this is a suggest suggested topics for future meetings is that at a future meeting if it's within the purview of this commission we'd like to have as a topic uh maintenance agreements and then general discussion about that and what we can if anything do regarding those. Correct.

Could chair could we in in could we enlarge that whole concept to um we have in the past approved projects just like we did tonight with a whole list of stipulations. Yet the minute it's approved, the stipulations don't seem to matter anymore. So like we have landscaping stipulations that they put in the landscaping and then they drive on it and so the landscaping ceases to exist after they get their CFO. We approved right next to this project. We approved two duplexes and required that they stripe one side of that street, which it inevitably is to be non-p parking. Yet, since the buildings were built, that side of the street is parking. And yet, nobody from the fire department or the city is doing anything about. So it it just seems like we've created a lot of stipulations that we require people to do as part of their construction of their project. yet the minute they get their CFO, we don't ever seem to go at back and examine to verify and and maybe even on an annual basis or the first year we go back at a year, you know, I mean, I don't want to create more work for the staff, but it it seems it seems feudal that we put all this effort and all this discussion into these stipulations, then at the end of the day, they don't matter or don't appear. And that was part of the discussion about the maintenance agreements like who was following up, what agreements did we have, that sort of thing.
And and just for clarification, do do you mean maintenance agreements with regard to their fulfilling their stipulations or complying with the stipulations? Mhm. Okay. Correct. I think on the Walmart specifically, if I'm if I'm catching where she's going, um there was a a a stipulation that they had to create a very specific type of drainage system for the property that would feed into the wash
and maintain that. When we had another project come through, it was denied basically because of the increase in surface area and drainage it was going to cause to a to a system that already wasn't dealing with the with the water properly, which if it had been dealing with the water properly, then the new addition subdivision probably wouldn't have been a problem um at the end of the day. But so once again back to we require all these things and then there's no followup to make sure that they actually work which in inevitably impact something.
I I think that was I remember that that was due to lack of staff like checking the drainage and clearing drainage and whatnot.
Well, they didn't even have an agreement when it came down to it to to do that to make sure it was not right. Chair Commission, thank you for the clarification on it. I think now we know what you would like to come back. So, we'll see if we can get that on a future agenda.
