Thank you. So at this time, I'll go ahead and open up the public comment and see if anyone would like to come and speak on anything on the other than tonight's agenda. All those opposed? Motion passes. Passes. Moving on to consent public hearing discussion possible action for items a b and c. And at this time we're going to go through item number two and eight and commissioner Hendrik will be abstaining these two items, and then we'll move on to the other items on the agenda.

8:32 – 9:113

Thank you, madam chair. For the record, Andrew Demas with Development Services reading in tonight's consent agenda. Starting with item number two, there was a slight typo. It should be PL 800877 instead of 79. So, I just wanted to put that into the record. But that is preliminary plat, Riverstone Trails Phase 1. And number eight is a final plat, PL 9069 Meadowridge Subdivision. Staff and the technical review committee have reviewed both of these plats and determined they are consistent with the Texas Local Government Code as well as the Unified Development Code and recommend approval. If there are any questions, I'd be happy to address them.

9:12 – 9:390

Thank you, Andrew. Commissioners, at this time, do we have any questions for staff on item number two and item number eight? If not, then I'll go ahead and open up the public hearing for item number two and eight. If there's anyone here to speak on these two items. If not, then I'll go ahead and close the public hearing, consent public hearing, and entertain a motion or further discussion.

9:422

I move that we approve items two and eight as presented by staff.

9:453

I'll second.

9:46 – 10:070

I have a motion and a second to approve items two and eight. All those in favor say aye. Aye. All those opposed? Motion passes. And now we'll go ahead and proceed with the other items on the consent agenda.

10:07 – 10:463

Thank you, madam chair. So back to the consent agenda. Item number three, a reply for Brooklyn Addition. Item number four, reply for Saratoga Industrial Place Unit 2. Item five, reply come dream come build Subdivision Tranche 1. Item six, a replied for Steel Addition. Item seven, a final for Nemec Town Center Phase 2. Item number nine is a conditional approval for a final plat for Park PID Unit 2 of the listed plats. Staff and the technical review committee have reviewed them, determined they are compliant with Texas local government code and the UDC. Staff recommends approval.

10:46 – 11:103

And then our one zoning case, item number 10, zoning case z N 9062 Gulfway Mobile Home Park located in District 4 is a request from the C G 2 General Commercial District to the C G 2 General Commercial District with a special permit. The purpose of the request is to install a new 95 foot cell tower. Staff recommends approval. If there are any questions, I'd be happy to address them.

11:100

Thank you, Andrew. Commissioners, do we have any questions for staff on these items?

11:19 – 11:362

I just had a question on number nine. So it's a conditional approval looks like because you had a preliminary plat, the prelim expired. So now before they can get the final plat approved, they just need to go through the process or resubmit the

11:363

A preliminary preliminary plat plat again.

11:382

Exactly. So that'll come again through this body?

11:413

Precisely.

11:412

So they just basically can't move forward until that's approved and then it's kind of like simultaneous

11:47 – 11:583

It's the best we can do to make it the most expedited process because we understand the owner is trying to close on the sale of the property and we want to make sure we can move as fast as we can. Okay. Thank you. You bet.

12:00 – 12:150

Any other questions? I have one. I'm just curious to know. On this zoning item for 10, it is because they want to increase the square footage of the pole?

12:16 – 12:353

Correct. So, the way the UDC is set up there is an existing 83 foot tower. As the property is zoned commercial, if the new tower were to stay under 85 feet in elevation, they would not have to rezone. In this case, because they're going above that threshold, that is what triggers the special permit.

12:350

What is the maximum height that they can go according to, like, about any

12:41 – 13:143

There isn't a maximum height per se. The way the UDC and Texas windstorm is set up, in order to meet the mile per hour thresholds, that is really your major limiting factor, the engineering behind it. Second, there's a fall radius. So, the UDC says that for every foot you go up, you must meet a one and a half times distance of fall radius. Even though they're engineered to pancake upon themselves, essentially, if it were to fall as a solid piece, you have to have enough distance from rights of way and any dwelling unit.

13:14 – 13:293

We don't want a tower landing on anyone's property. So, those are the limiting factors. So, instead of us saying you have maximum height, we say you have to meet these fall dimensions and windstorm. And that sets an artificial limitation.

13:290

Okay. I was just curious, you know, because I thought I mean, I know that it's there's more development going out there and I understand that they need more of these towers.

13:373

It's all about data

13:381

now. Mhmm.

13:390

Oh, I get it.

13:402

Is there a certain point when the FAA has to chime in? 200 feet. Oh, okay. 200. Well under.

13:47 – 14:140

Okay. Any other questions? If not, then I'll go ahead and open up the consent public hearing for items three, four, five, six, seven, nine, and 10. If anyone would like to come and speak on these items, please come forward. If not, then I'll go ahead and close the consent public hearing and entertain a motion or further discussion.

14:172

I'll make a motion to pass items three, four, five, six, seven, nine, and 10 as presented by staff. I'll second.

14:250

I have a motion and a second. All those in favor say aye.

14:282

Aye. All

14:290

those opposed? Motion passes. Moving on to director's report.

14:353

No report tonight.

14:360

Great. Future agenda items? None either? Okay. Then meeting is adjourned. Cool.
