Um and Mayor Benetti uh will not be joining us. Um, I would like to acknowledge uh the passing of an incredible community member and partner to Mayor Benetti. Amy Gryle uh lost her battle to cancer on Thursday. Her father, Bill Gryle, was a longtime city manager in our community. So, our condolences go out to the entire family.

I can tell you she rarely missed a council meeting. she watched online and she was very passionate about this community, this place that she called home and we shall forever miss her. I'm a bit scattered this uh evening and I realize that I did not do the flag salute. So before we go much further, why don't we all rise? And uh Roberto, will you lead us in the flag salute?

There may be opportunities for public comments during specific agenda items that require a public hearing. Members of the public are requested to confine their remarks to questions or issues under excuse me under discussion during this time during any designated comment period. Individuals shall not engage in personal attacks shall not impugn the motives of any speaker and shall at all times while in session conduct conduct themselves in an appropriate manner. No person shall make personal impertinent slanderous or un excuse me unauthorized remarks or become boisterous while addressing the council. And Andrea and I know each other. So I hope that that's not going to happen in this instance. So

Oh, I reside in Kuz Bay. Um I am here with a concern. I had a water mane break. Um that is the responsibility of the water board. They maintain this. It is the third time that it has broke. Um, it broke on New Year's Day. That's how I started my New Year. Um, at 11:12 p.m. I had 10 in of standing water in my backyard, a completely flooded basement, flooded garage, flooded sideyards, and flooded front yard. Um, it took 58 minutes to shut that water off, and it destroyed our home. Um, foundation, furnace, garage, everything. um floors. We're living in an Airbnb. Um that wasn't easy with kids, dogs, everything trying to move. Um my husband and I work, we pay our taxes and the water board is saying it is not their responsibility. Um this is the third time that same man has broke. The first time was December 6th of 2021 and it dispersed 1,51,200 gallons of water that in the report they're not sure where it went. Second break was November 9th of 2024 that dispersed 36 gallons of water and the main was reported to be in poor condition. Fast forward to this year and it broke and in 12 minutes it created 10 inches of standing water in our yard and created all that damage and it ran for 58 minutes and in 12 minutes all of that had already occurred. So, um we're looking at a minimum of six more months out of our house um having to rely on our insurance to help navigate us. It doesn't cover everything. My foundation's damaged. That's 48 grand.

Um 26,000 for my furnace. All my ducting's destroyed. Um and they're saying it was due to a sudden and unexpected break. And they regret to inform us that it is not their responsibility, but it is a 6-in cast iron man that was placed in the 50s, and it's the third time it broke. And I it's not connected to my house. It's in the furthest corner of a lot. um an easement that is they're maintaining. It's their responsibility and they're denying us help. Um and I just I'm here to see what you guys can help me with cuz I don't understand I don't understand how it's our fault. We pay our taxes. We do everything right. And I've reached out and they just that's their only response. They don't see how they were negligent and it's sudden and unexpected and not their fault. So that is why I'm here today um to see if anyone can help me understand or help us navigate this.

Um, I have been on vacation for a little uh for the last couple weeks, so I'm not completely up to date with what has been happening. Uh, I it sounds like you've had some correspondence with the waterboard, and I will uh check in myself to see if uh see what the progress is on this. Um, I can also just check in with the um our director uh executive director for the waterboard as well as our legal counsel and just see uh what what is uh what the situation is because I I need to be brought up to speed on this one. But uh I will definitely check into this as best as I can.

Hello. Um my name is Jaden Ruff. Um and my address, I was like, what is my address? 1934 New Mark um Street North Band and I'm the executive director of the South Coast Health South Equity Coalition serving both Cous and Curry counties and also dipping into Crescent City when needed. But um I wanted to come up here today to um first say one, thank you for the proclamation that y'all did for Black History Month. It is massive. It's the 100th year of um Black History Month being a thing in our country and um I'm really grateful that y'all took it upon yourselves to make that proclamation and that statement. Um secondly, I also wanted to bring raise awareness that the equity coalition is the convenor of our rapid response network, our regional rapid response network in case ICE comes into community because um we are the a cultural cultural responsive um organization where we work with our communities of color, Spanish, um Asian, um across the board. and we have been tracking and doing a lot of work in community around know your rights um ICE verification and things like that. And I thought it would be important to make sure that the city is a thought partner in our rapid response network to kind of see what are the policies or what would your response be like just in case ICE does come into community and it's not necessarily only um looking at the impacts of people that they are detaining or kidnapping but also like the community members that are being harm actively harmed by ISIS presence in community. And so I wanted to see um if there was any policies, protocols that y'all have been working on um how can we help because what we thought we knew last year is different than what we um know today and how we engage. And so I thought it would be really important. We're currently working with um the rapid response network in Florence and also in Crescent

City. So we would have the whole one-on-one covered. Um, and my staff have been doing, like I said, know your rights trainings, ICE verification training, um, community deescalation training, so that way like we don't want community members being escalated and then c then them causing harm. And so, um, we just want to make sure that we're covering all of our bases um, with how we navigate forward. Um, and so far we haven't had ICE presence here, but we know that um, Cottage Grove had some. We know that Newport and have been a part of those advocacy spaces and want to make sure that we have a plan here just in case anything happens and we don't want to be scrambling. So, a part of our um rapid response, we have three pillars, preparedness, intervene, and um care, which is short-term and also long-term um for community members. And so, just wanted to make sure that y'all had y'all knew where to go and also how can we collaborate on this issue as well as far as um community safety. So, thank you.

The Oregon Revised Statute basically governs the authority extended to law enforcement officers for um immigration investigations. Oregon law enforcement officers do not participate or engage in immigration investigations and uh we um stick uh adhere closely to our revised statute.

And I do know that um currently I will be reaching out to the sheriff's department because right now Cous County is out of compliance of the sanctuary um statute and also Curry County is as well. I'll be happy to. Uh recently the city advertised openings on the budget committee. There were two terms that expired. Applications were accepted through February 11, 2026. We received two applications, one from Alli McGeehan and Brenda Brekie to be considered for reappointment to their expired terms. Those are the only applications we received. Okay. So, these are simply reappoints. Uh no need to do interviews. Uh and these are the two positions that we need to fill. Is that correct? That's correct. Okay. Uh, council, how would you like to proceed?

And so if anyone is interested in potentially sitting on this dis in any capacity, I highly recommend looking into a budget committee, whether that's with the school board or with a city. I think it's a great way to understand how the city works.

Next, uh, item on the agenda is a public hearing to consider the enactment of an ordinance amending the Kuzbay development code to restrict self-s storage facilities. And I think that's Chelsea.

Yes. Good evening. So, um, this ordin ordinance amends the text of the Kuzbay development code to change where self-s storage unit facilities are allowed in city limits. Um, it is in line with council's February 3rd approval of the associated land use record and amendments. And just real briefly, those include restricted areas would be areas within the Empire Area Blueprint Study Area, areas within the Waterfront Heritage Zone District, and then on properties with street frontage along Empire Boulevard, south of Newark, along Newark, on Ocean Boulevard, west of Norman, and then also along Highway 101. And so there are maps in the uh agenda packet and if you have any questions feel free to ask but certainly hold the public hearing and take public comment before enacting.

Uh, my name is Vern Hers. I own Empire Mini Storage. I live in Empire. Um, when you guys decided to stop all the new storage facilities in the city via the moratorum, you looked to the planning commission for their input. After they gave you the recommendations, which included 2 miles of roadway, you decided you wanted to add on an extra 5.3 miles. Some people are never happy, but so now the question is, are you going to pass it back to the planning committee or commission? Because basically, you've kind of started this thing over again. Are you going to send letters to all of the would-be affected property owners along with your best sales pitch for your request to reduce the uses of their property, not yours? If I decided to do something to your property, would you want me to talk to you first? You bet you would. Or are you going to just push aside all of that unnecessary annoyance and jam this through? You guys have done that before with the trans fee on the CBNB waterboard bills for road repairs, which I've not met anybody who knows that what that's for, but we do. That affected everybody and perhaps should have been sales pitched and put to a vote. You also done it with increased rates on business licenses. Why? Because other cities charge more, but that's not a valid excuse. You had all the contact information for the businesses and you could have asked for their input. But back to this land thing, put it to the planning commission. People like Joe Benetti. I like Joe

And it's a good vision. have those property owners share their opinions at a planning committee meeting. Get the planning commission's recommendations and go with it. Um when we first started this process, did we not go out and discuss this with property owners? We did. So, encompassing the whole area. Correct. Correct. All affected property owners were noticed

and that was from the the original encumbent correct which so then it went to the planning commission they redefined it in a smaller area and then we've come back and extended it to some point but not to the original beyond what was the original proposal. Just for clarification, you say that they had opportunity, but did that opportunity come after the proposed area was was made smaller or was it still in front of the public for public comment in that expanded area? It's been in front of the public for public comment the whole entire time. And so notices went out initially, notices went out after planning commission's recommendation and before council's hearing. So all the iterations have been out there for the public.

Did the planning commission reduce the amount or was that staff? The planning comm so staff proposed the total prohibition in line with the moratorum. So overall prohibition and planning commission reduced that down to the Empire blueprint area and the waterfront heritage zone district and can you explain why they did that? I I know that there are notations there but can for the public can you summarize that?

Um, essentially they felt that those two areas were uh reflective of the the areas we want to keep revitalized or work on revitalizing because the city's invested in uh studying the front street blueprint, the Empire area blueprint. And so they felt that those were the areas that made sense to limit that type of development to help um achieve other types of revitalization in the areas. Great. Thank you, uh, Councelor Kilmer. Um, uh, any other comments before I make a comment? No. Okay. So, Chelsea, I think what I've we've all heard is that there has been plenty of time to comment. Uh, and we've shown all versions of that to allow the public to comment. Ultimately, if I remember my role, the planning commission does come before council and council does have the ability to make the final decision. Is that correct? That's correct.

Okay. And I think I while I was not at the MA meeting when we had this discussion, I'm um well informed on it. And the intent was really focused on economic development and building out the um waterfront as well as building out Empire. Is is that correct? Correct. And then council um emphasized just the general need to keep our corridors, the entirety of Highway 101, Newark, Empire uh clear for that same type of economic development and revitalization. Great. um personally I struggle all the time with mun municipality role in limiting private property regulations. That's that's hard for me. But I also understand being involved that we have the responsibility for setting the vision and the growth for our community. That comes with developing a comprehensive general plan. It comes with legislative zoning actions. It also changes and and some of the impacts do either negatively or positively impact private owners with maybe value changes in their property regarding zoning changes, developmental restrictions. And these things aren't anything new. Um, you know, how high you can build, the density, all those things. And the struggle is to balance private property rights for the individual with the vision and growth for the whole. And I think we've really worked really hard to try to balance that, at least in my opinion, through through the work we've done. Um, and I I I believe you said it, not everyone's going to be happy. Um, but I do feel like we've done that hard work. Uh, and it it is with a vision of seeing our city grow and prosper the way that benefits us all in the long term. And I think we want to play the long game. So, it was really just my comment on on what we're doing and the difficulties at least for me on how to move that forward because while I understand the process, there's an internal part of me that says, "Wait a minute, I paid for that. I paid the taxes on it, etc." Um,

Uh, thank you for um I what I was where I was heading with the growth question is um yes, we see future growth in this area. I think um there's not much more to say I I would say other than we've invested a lot of time and resources in the Front Street um blueprint plan as well as the Empire blueprint plan and uh as Councelor Kribbons eloquently said, it's really a long game that we're playing uh for um future development uh and a city that we can continue to be proud to live in. So, I will not belver uh the topic. Uh, but it looks like before I um ask for an opinion, Councelor Matthews, do you have a comment to make?

I just wanted to uh echo uh my support for what Councelor Kribbons and uh uh everyone else has been saying about the struggle between these two uh roles of government and private property rights. Uh that being said, I also feel like it's it's very similar to almost like a zoning regulation in which we are trying our best to plan efficiently for the design and enjoyment of our of our city. And uh I appreciate uh the public comment um from Vern to you know kind of express uh the hopes and and dreams for uh how would we how we would conduct ourselves and it sounds like the staff has done an excellent job and I just want to commend them for that. Uh including this meeting here tonight where we have public comment and all concerned property owners are of course welcome to come and present at this moment. Um, so, uh, just I think we're we're doing the best we can and, uh, I I really wish everybody could come away feeling perfect about everything, but, um, I I I feel like we're heading in in a good direction. That's all I have.

So as stated in OS 457, urban renewal agencies operate under tax incremental revenues. Those revenues can only be spent towards payments against debt service. There are two ways uh we can get access to these revenues. The first involves obtaining conventional financing which is a lengthy and costly process. This um includes going out for requests for funding, bond attorneys and financial advisors which is intended to cover long-term large dollar capital projects. The second option is dour financing which is a short-term loan between the city of Kous Bay and urban renewal agency. It's initiated and quickly repaid with one paid 1% interest. It makes those funds available to cover current year short-term projects already identified within the plan. Adopting resolution 2603 would approve the intergovernmental agreement between urban renewal agency and city of Kbay establishing the repayment process and authoriz authorizing dour financing of $2,38,165. You will also see this come before you during the urban renewal agency meeting later this evening.

We did not adopt that in the previous so we'd like to enact that here soon. So that'll go before the hearing. We also found a typo in our previous um schedule so we can correct that at the same time. thank you. Um Christine, if you can if you could pull up the exhibit for council in the audience. Um and while she's doing that, I can give some background. Um the purpose of this rightway vacation request is to consolidate the parcels at 585 Newark Avenue in 130 South Wall Street for the future development of a public parking lot. The vacation supports goals associated with Empire Blueprint um by improving public parking, storm water management, and walkability in the Empire district. The rideway proposed revocation is approximately 86 feet in length and is located between 585 Newark Avenue and 130 South Wall. The intervening rightway does not provide through vehicular access or broader connectivity for the general public. It's not required for future public circulation. If the council is agreeable, a rideway vacation process can be initiated pursuant to Cous Bay Municipal Code Title 12.45. Upon initiation, affected property owners will be notified and the council will conduct a public hearing at a future meeting.

And uh I just want us all to know I want him to know that we are all here for him. And um want to lift him up and support him in this moment of grief and that we share in that grief. And uh I just I want to thank you Lucinda for being there as much as you can for him as well. And uh for everybody's grace uh as he takes some time to uh be with his family and and friends and uh I just yeah just my heart goes out to everyone who knew Amy and we are all all feeling that right now and uh that's that's all I have. Um, I would like to say that we deal with daily on decisions for the betterment of our city and they're very rarely are they simple. Usually, they're complicated and they involve many different people and many different viewpoints. And the goal is to find a vision for the for the best and brightest for our community. And I believe that everyone on this council and I actually believe the staff takes that uh to to heart and does their best to do the best work they can. And I feel like the staff does an excellent job, prepares us with great information, allows us to make a better decision because they're not easy decisions a lot of time. So I wanted to say thank you for that. And I do believe we have a good vision for our community and I I believe in our community. two, um I would like to echo what councelor Matthew said. Um and I know there's not a fairness quotient once someone you lose someone, but somebody that young is not supposed to succumb to that and it it doesn't seem fair. Um and thank you, Lucinda, for being there. And I want to tell my friend Joe that I care about him and he is in our prayers. And thirdly, lastly, I'm more of a light-hearted because all of the DAS are coming on up and my trees are blossoming. It's of course going to dip below sub freezing and snow and ruin all that stuff. So, just, you know, as a community, you know, this is what happens in in Oregon in winter or fall spring. Be careful out there. Uh the roads are slick and icy and I think a lot of times we have what many people don't pay attention to is those corners that are shady. So it might be 40 on the straight but that corner is below freezing. So just take care out there. Um be careful. We care about everybody. Thank you.

Um but again I do want to say that um you know I if if I can use the term echo again um what councelor Matthews and councelor Kribbon said but I guess I just want to remind folks that you you never know what's going on and sometimes we have targets on us because we're government officials making those decisions. that aren't always popular with everyone, but you just never know what someone's dealing with that's not here, but they're here. They're here and they're working for you. Um, and this has been a long fought battle that our mayor has um been working on, still maintaining and doing everything he can for the betterment of this community. And I just wanted to do my best to say to the folks out there that um I appreciate what he does and I hope that you do too.

So, I really want to thank Chief Chapanar uh for participating in that and the future meetings that I'm sure will come um of it. And with that said, uh I will conclude uh the meeting, but I would like to say Jennifer, can I get you with uh Roberto and Andrea uh to make sure we gather their information.
