Good morning again. Welcome to our regular session of Commissioner's Court for Comal County for Thursday, June 25th. We'll call this to order at 831 and let the record reflect that all members of the court are present and there is a quorum. We will begin with action agenda item number one to approve the claims.

Judge, I move to approve the The claims as presented for June the 25th, 2026, EFT is $281,309.30. Regular claims of $1,457,129.74 for a total of $1,738,439.04. Second. There's a motion to approve claims by Commissioner Hogg with a second by Commissioner Leacock. Are there any questions or discussion? All those in favor, please raise your right hand.

Motion carries. Item 2 is a proclamation recognizing D. and M. Owens with the Texas Historical Commission Texas Treasurer Business Award.

Whereas the Texas Treasurer Business Award program is an initiative of the Community Heritage Division of the Texas Historical Commission and was created to pay tribute to the state's well-established businesses that have been in continual operation for at least 50 years. And whereas the Texas Treasurer Business Award was created in 2005 and since then over 700 Texas businesses have been recognized as a Texas Treasurer Business. And whereas D&M Owens was formed in 1969 when Dave and Mary Owens had a vision to create something enduring for what would become a multi-generational success story. And whereas Dave and Mary Owen started the business from humble beginnings as a grave digging service involving their children and grandchildren who were on the job at the cemeteries playing hide and seek behind the gravestones. And whereas in 1999, three of their children, James, John, and Kathy, stepped into leadership roles for two decades until 2021, when a new chapter unfolded when five of Dave and Mary's grandchildren, Dusty, Jeremy, Devin, Christopher, and Patrick, took ownership of the company. And whereas a small-scale company first operated in a garage in the back of Dave and Mary's house and now located on a six-acre track on the northwest side of New Braunfels on Highway 46 to accommodate its growth and the growth of a large company specializing in commercial and residential development. Whereas the foundation of DMN Owens Incorporated was laid by its founders, Dave and Mary Owens, who instilled a culture of fairness, honesty, and reliability, and whose legacy lives on through the company's commitment to treating everyone with respect, speaking honesty, and honoring promises. Now, therefore, be it proclaimed that the Comal County Commissioner's Court hereby gratefully honors and congratulates D&M Owens, Inc. for being honored as a Texas Treasurer of Business by the Texas Historical Commission and invites all residents of Comal County to recognize D&M Owens, Inc. for their exceptional historic significance and their longevity in Comal County. Well, actually, this is going to be real short because these guys have got to get back to work. And these all have to be turned in by 9.30 to Jim's Tuxedo Rental. So we've got to kind of make it quick. I just wanted to thank you all and thank Susie Grist and the committee that she works with, Ms. Coors. They approached us about it, and I talked to my nephew Dusty, and he was like, yeah, he put together the hard work and do the stuff. And really, we're honored. We're actually getting the opportunity to be honored, but it's really about what my mom and dad started. Very humble beginnings. D&M, he used to get kidded by, well, that must be Dig Man, you know, because we dug Grace for a living. And they called him Digger Dave and all these things. But it just started. He just had this small little vision. He was very entrepreneurial. We did all these different things for... We had a large family, so he was always trying to make extra money. So he had concession stands at the Little League field, the football field for the high school, and then he had the opportunity when Wurstfest started to get involved in it early in the stages of it. And so he did that on the side, and he was just always looking for better ways to provide for his family. And in the midst of that, He sold a machine to, he was a salesman, and he was selling these Bobcat backhoes, and he sold one to a funeral home the other side of San Antonio, and he thought, well, that might be a good side job. And he literally just started it as a side job to be a supplemental income, but it took off so well that it began to develop. And then John and Kathy and I came along, and we were fortunate enough to have a some super guys, Patrick, Christopher, Jeremy, Dusty, and Devin, that came along, and they brought a completely different agenda in for us to make us into what we are. And it's through their hard work and through Kathy and John and I just being persistent through the years, they came and brought a knowledge and skills that we didn't have on our own. And so we're so very thankful for that. Thank you all for what you all do.

I'd like to congratulate D&M Owens and, on behalf of the Texas Historical Commission, present this certificate to them. The Texas Treasure Business Award to D&M Owens, family owned and operated in Texas since 1969. for exceptional contributions toward the economic growth and prosperity of Texas. That's very nice. Okay, so we will move back into our workshop agenda. I'm sorry, you're into our workshop agenda and start with citizens' comments. Citizens are able to speak for three minutes. Is there anyone here to address the court? Okay, seeing no one. I will move to workshop agenda item number two, which is reports by county staff and elected officials on items of community interest. Okay.

Good morning. Good morning, Judge and Commissioners. I would just like to talk to the public a little bit about what public health is doing at the moment. With the World Cup here, we have done a lot of education to our health care providers, and we are meeting with our EMS and our first responders every week. just to kind of stay on top of anything that might come up. We are also monitoring Ebola patients, not patients, my bad. We are monitoring any individual that has come from either the Democratic Republic of the Congo or Uganda for 21 days just to make sure they don't develop any symptoms. And that will kind of lead into a item number six when I get there. So we are also monitoring the screw worm situation. It is not in Comal County, but we are staying on top of that. There's no human cases, but just like rabies, we monitor anything that could affect the human population. Saying that, rabies is probably the biggest thing in Comal County, so just want to remind those in the public that not to touch wildlife, especially bat or fox. We have a lot of fox around Canyon Lake that have been positive for rabies. We have nine rabies cases in animals so far this year. Those are five foxes, two raccoons, one bat, and one cat. We have seen it in our feral cat population also. So we get calls every week about this. We got one last week. A lady caught a bat and put it in her freezer. So please do not touch the wildlife. We're also monitoring the infant botulism situation. If anybody has questions, they can call public health. Also the measles, now year to date in the U.S. there's 2,104 confirmed cases. As we know, this kind of started in Texas. And the CDC reported that 93% of these are unvaccinated individuals or vaccination status unknown. So if anyone needs the MMR, we encourage them to call public health. If you cannot afford it, we can make that happen. especially if you are uninsured or underinsured. We have some state programs for that. So we're just working with our state and local animal control and partners and monitoring these situations. And I just felt like it was important to let the public know that. Thank you.

Uh-oh, uh-oh.

Good morning, everybody. Bear with me because this is going to take a second because I'm going to tell on them. Commissioner Hogg was a younger trooper when I got here and Rick got here. I think these guys had 18 years on when we came from the academy from Highway Patrol School. So it was unheard of for somebody as young as, well, back then I was young, as me to get here. And Scott and those guys were the guys that we looked up to. But This is my Highway Patrol break-in partner. Now, you've got to remember, he'd been a trooper about a year, and I'd been a policeman seven years. So when we got in the car, we fought like cats and dogs, because I'm a trooper, you don't know anything. And I'm like, well, I've been a cop seven years. So we'd fight over the penal code. I'm going to tell two quick stories, and then I'll quit boring you all. First story is, back in the day, they used to run these task force, and we'd go way down to LaPrior, Texas, if any of you all know where that's at, middle of nowhere, right on the Mexican border. And you would be exhausted because you would be out 16 hours just up and down these highways and chasing drug runners or whatnot. And there's a little post office in Katarina, Texas. It's right across from this haunted hotel, I think, that's burned down at one time. And Rick was training me. And he said, man, I'm really tired, bro. I said, me too, man. I said, what are we going to do? He said, all right, we're going to pull in behind this post office. and we're going to take a nap. But you stay up and then when I sleep, then you wake up and we'll watch each other. That way we can get the radio. Great idea. So Rick says, I'll go to sleep first. So next thing I hear is cheep, cheep, cheep, cheep. I hear all these birds. I'm like, you know, when you wake up in the morning, the birds come alive. He jumps up, partner, you fell asleep. I was like, so did you. So we took off. And one more. starving to death and obviously we're a deep deep south texas and there's nothing around for miles and there's this little shack out there and i mean it's literally a shack and there's a smokestack with smoke coming out and i said man i wonder if there's anything we can eat over there he's like let's go in there so we go in and there's a little old lady she's probably 110 and she's got a crock pot going I'm like, well, I guess we'll eat that. And I said, what is this, partner? He goes, ah, that's barbacoa, bro. It's good. I was like, all right, I'll eat some. So she slapped some barbacoa on the sandwich and we get our patrol car started going. And I bite down on the sandwich and I'm like, what is that? And he goes, I don't know. I opened up and there's a big cow eyeball looking at me. And I'm like, oh, my God. He starts laughing, you know, because the gringo is freaking out. He goes, what are you going to do? I threw the eyeball out the window and ate the rest of the sandwich. Just so you know, it's not 17 years. The guy gave 41 years of his life to this community and law enforcement. He was a hell of a partner. And it's people like Scott and Jim Shea and those other guys, Archie Harvin, they got us where we are. So I love you.

Something in your eye? I'm glad he told that story because I was going to tell you all. So, yeah, you told it correct. You know, he's correct. I'll give you a little bit of history, just quick history. When I started in 1984 with the county, I actually got my start with PD as a reserve in 83. And in 1984, Walter Fellers, he says, come on, I'll take you. And the jail was still here. It was still a, yeah, there was a jail all back here. Some of y'all remember. And it was great. And then it progressed. And I've seen so much. you know, the growth in this county is just unbelievable. You know, I did ten years, my first stint with the county, and then I went 25 years with Texas Highway Patrol. But I did the majority of my time with Highway Patrol back here in Comal County because this is where I wanted to be. This is my home. I'm originally from Kingsville, Texas. Thank God Dad moved us away from there and we settled here. Yes, I did two years in McAllen, my first two years Highway Patrol, and then came back here. And, of course, the last four years I spent it on the border on the patrol boats with the tactical marine unit, but I stayed here. But when I finished, retired, the sheriff, Mark Reynolds, he says, Rick, why don't you come on home, man? You know, we've got a position for you. If you're interested, just apply and we'll go from there. I wanted to go to the courthouse. And I had goals all along. I wanted to be a bailiff for Judge Randy Gray, because my brother, who's passed away now, who's a retired deputy, did bailiff work for Judge Gray. And so there's a lot of history with the Alvarez brothers here. And I know my brother's looking down on us right now. And he's probably laughing at me. You know, I've seen this county evolve and trying to keep up with the growth. And I commend all the commissioners. You know, y'all are doing a great job. You know, in my eyes, you're the best because you listen to us. The employees, they're just, we're trying to keep up with the growing race. The Sheriff's Department has evolved into what was once a 10-man department, where at night, I used to patrol the county one man from 11 to 7 in the morning, just one deputy for the whole county. It's not like that no more, you know. And the sheriff and his staff are trying to keep up. They're doing a great job. And I've seen it evolve into something very special, very good. And it will get better and better. But remember who we work for. We work for the citizens of Comal County. They have a voice. When you need something, go to them. I learned that in highway patrol. When you need something, go to the citizen. They'll help you out. And citizens, which I'm with you now, I have a voice, too, so you need something, you know, listen to your leaders, and, you know, it'll come around for the best, you know, and you may not get what you want today, you'll get it tomorrow, mañana, okay? I want to say I love all of you. I've enjoyed working for the Sheriff's Department. It's been an honor and a pleasure to serve this community in a law enforcement capacity. And not get rid of me that fast, because I still want to be involved as a citizen with the DWI Accountability Court Program to help others that really are struggling in life. And being in that program with those participants really changed my life, certainly I dedicated my life to God, and I love doing ministry work now. And so, you know, I'd like to even come in to sit in a few commissioner's court meetings to see what's going on, you know. But thank you very much for your support. I love all of you, and we'll be seeing you soon. All right.

Before they go, we'll move into item number three, which is discuss and consider authorizing the purchase of county-owned SIG Sauer P320 duty firearm in the amount set by the purchasing director by Richard Alvarez with an honorable retirement date of June 30th, 2026, pursuant to section 614.051 of the Texas government code.

Good morning, Judge. Good morning, Commissioners. Essentially what this is is when we have people retire, they are offered the ability to purchase their firearm or one of their firearms. We do it all the time. It doesn't cost the county any money. I believe that it will be paid for either by friends or by the individual. We're just asking that you approve this request.

Congratulations again on your retirement. So action agenda item continued, item number four, discuss and consider approval of the following New Braunfels Utilities easements and authorized county judge to sign for A, easement number 202511-002-123 associated with a water tank at the Comal County Engineer's Office, and B, easement number 202512-001-123 associated with water lines near the Comal County Jail.

Good morning, judges and commissioners. The first easement is out of the county engineer's office. This is right adjacent to the water tower that was built a couple of years ago. And they're looking for an easement for a generator pad adjacent to that. And so that's item A. Item B is over the Comac County Jail. The location, you can see the two circled items here. We already have some existing easements in the area. They're asking for additional permanent easements for water lines. And they're fairly small adjacent to the jail. We recommend approval for both items.

Judge and commissioners, back on June 11th, we passed this item for the new right-of-way order. It included requirements for TIAs, new landscaping requirements, and we included driveways to include subdivision intersections. Unfortunately, we connected the wrong, had a clerical error, connected the wrong Title IV to that item. We put a legal notice in for Saturday just letting everybody know that we're taking this action today. And so we now have the correct version of Title IV that we'd like to connect to item number 566.

Thank you. Item number six, discuss and consider approval of Ebola funding opportunity requests to the Department of State Health Services for the surveillance and monitoring activities of the Comel County Public Health Department and ratify the submittal of public health director.

Good morning. So last Monday we were notified by Department of State Health Services that there could be some federal funds available, and they were asking for a budget of what we would be looking for to support our Ebola program. program, and it was due on Friday, so I worked with Michelle Valadez, and we came up with some things, also talked to JD, and with our warehouse space, there's plenty of space now which we've never had to store PPE that is kind of more temperature control than what we've had in the past. So these are the items that we came up with. I also talked to our first responders and asked what they would need, and these are the items we came up with. We turned that in. Since then, we have heard from the state, and they are going to prioritize the local health departments or the counties that have the most PUMs, which is patient persons under monitoring. And that's more like Dallas and Houston and bigger areas. But what it does, it kind of is a placeholder. If more federal funds become available, that they already have our budget and they can reach out and possibly offer us a grant at that time.

I guess I just have one question. So space-wise, I mean, in the event that we were able to acquire all the refrigerators and just, you know, it seems like we're always talking about, well, we're out of space in this facility, out of space in that facility. Do you have the space in the event that you acquire all of these?

Yes, we do have the space with our new building. We have the space for the refrigerators, and we also have the space for any PPE in the warehouse.

And to clarify, this requires no county matching funds?

We don't have that information, but they did not say anything about matching. We didn't put anything in there about matching. We only listed PPE.

Item 7, discuss and consider approval of the Texas Association of Counties Health and Employee Benefits Pool 2026-2027 Renewal Notice and Benefit Confirmation, ASO, and Stop Loss Exhibit Effective 10-1 of 26 and authorize county judge to sign. Good morning, Judge. Good morning, Commissioners.

Como County is a self-insured grandfathered plan that is partnered with Texas Association of Counties Health Employees Benefit Pool and administered through Blue Cross Blue Shield of Texas. The summary for the new renewal year for 2026-2027 is that the total fixed costs excluding RX rebates will increase by 20%, and then there is a 25% increase in the specific stop-loss rate. Renewal notice and benefit confirmation for the overall plan. I'll go over with you first what's not changing, and that is the plan structure. We continue to offer the deductible copayment and the coinsurance being the same, as well as the wellness incentives and the benefit as far as the short-term disability, as well as the life insurance. The only addition to that is that we've added the prediabetes to the Teladoc wellness benefit. What we are recommending for the 2026-2027 plan year is an increase to the tier structure. And the tier structure, the recommendation is 5.53%. That's going to cover the maximum cost as far as what the county historically budgets for. The expected enrollment for 2026-2027 is 800 employees plus its dependents. What does that mean as far as for the employee? The increase itself for an employee and spouse will increase biweekly by $12.82. For an employee and child, it will increase by $6.35 biweekly. For family coverage, it will increase by $19.16. And for any extra child, it will increase by $1.18. I would like to take this opportunity to thank the court for your support and always recognizing the county's most important asset, its employees. I will tell you, this is a great tool as far as being effective for a retention and recruitment tool and also supports our hire to retire platform. So with that, I respectfully request approval of this agenda item.

This employee-elected supplemental benefit supports air as well as ground emergency transportation. The three options remain unchanged for 2026-2027 for their rates, and I respectfully request approval of this agenda item.

Judge and commissioners, this employee elected benefit supports the employee's election but is paid as far as the administrative fees by the county in compliance with federal law as it relates to COBRA and the FSA. The biggest changes for 2026-2027 is that the maximum for the healthcare flexible spending account has increased to $3,400. There still is the same maximum carryover of $680 in 2027. And the biggest change is for the dependent care flexible spending account. The maximum contribution has been increased from $5,000 to $7,500. And I respectfully request approval of this agenda item.

Good morning, Judge, Commissioners. This is Sean Hasselt. He comes to us from Converse Police Department. He's retired. He's wanting to stay in law enforcement. We've done a thorough background on him. And, of course, sent the background confirmation form to TICO, which tells us that he's eligible to be retired. brought on board and all that is he has met all everything of course i'll bring in another investigator online so the only thing bad about it is he's going to tell me when we go out on somebody hey this guy spit gum on the sidewalk back in 2024 or whatever you know didn't pick it up The only thing, I don't want to say it's bad, but Frank, my chief, he is very thorough, I mean, all the way down to telling you anything and everything.

Good morning, Judge and Commissioners. The contract for the inmate medical provider at the jail is coming up for renewal in September. These requested funds are due to an increase in the cost of services with that renewal. With that, I respectfully request your approval of this agenda item.

Good morning, judges and commissioners. Back on May 10th, we had a severe windstorm out at Jump Open Sports Park. It ripped off part of the roof at one of our concession stands. We did file a claim with TAC, and they reviewed it, but it did not meet the standard for us to – it didn't meet the requirement for our deductible. And so the cost to replace the roof is just under $25,000, and we recommend approval.
