One thing I'd like to say on us passing this motion on like a 7.10 the $425,99.60,000 is from a grant that we received. And then the last one with the um 7.13 agreement on the sewer system between the city of Columbia developer which is a plus was over 415,000. So just those two items right there we're the city of Columbia is actually from the developer.
Yeah. From the developer he's receiving 415,000 he's going to put in there. So we're actually saving over almost a threequarters of a million dollar. That's a plus for the city fund. These all three, the next ones are all related to the same development.
Good evening, Vice Mayor, members of council. Yeah, I can speak on these three items. Uh the development asked for acceptance of three phases. phase 2, 4 A and 4B. We gave a punch list of items for them to correct. They have corrected those items and this is ready for acceptance by the city. Now, there were two other uh phases that received preliminary acceptance and they have a year of maintenance. So, you'll see those 12 months from now. All of the items were completed. The only item that would be ongoing is just general mowing of the open space and ponds, which will be covered through property maintenance. Now who's responsible basically for that? You said the developer is responsible for that.
Uh no, it's ultimately responsibility of the property owner property owner for the open spaces is the uh Taylor's Landing HOA. Is the HOA once we approve this is the HOA responsible for all that drainage out there that has been washed away? I was out there today. They need some riffro wrap put out there. I mean, it's it's not acceptable. I wouldn't think the city would be accepted for that with it washed out like
Okay, you if you could tell me the locations, we can take another look and show you. I mean, it I mean all that water coming down from Kroger's up there. I mean, this all riff raff rocks gone. There's nothing there except a ditch being the water's been uh uh washed out. Okay, that's probably phase one or yeah, that's probably phase 1 A or 1B which has already been accepted. Uh the ongoing maintenance of the pond is up to the property owner which is the HOA. So we can cite them for that.
But in the first one that supposed to have been done by the develop it would have been done. I believe that section was accepted maybe a year and a half ago, two years ago. So, but I'm talking about now. Is that who who's responsible fixing that? It would be the HOA on that. If if it's the pond that I'm thinking of, the one to the north of Long Leaf Lane. Yeah. All where all the water comes down cross of pipe down that hole there. Okay. And you said that you're going to cite them for it. We can send a a letter for the maintenance to to make them correct. Yes.
Okay. Now, do you understand who he's sight? He's not citing the developer. He's citing HOA on the roof. Yeah. Me. Okay. But some of that out there, the way I understand, and I've talked to two people out there today, uh the developer didn't hardly and I looked at some of that. I mean the the curbing out there they took and look and where it's been cracked and busted they took put epoxy look like me instead of fixing it right and that's part of what we doing tonight and and I think the developer needs to fix that. I don't think it's ought to be left on HOA to pick. I think the developer needs to pick. Right. So, we're looking at sections phases 2, 4 A, and 4B.
That's right. It's on that on part of that. I I walked out there. I walked off down in them holes this morning. Look, but they've been accepted. So, it has been accepted the u uh has been accepted by the city. These three these three phases have not been accepted. That's what the item is tonight is to accept these and and the conditioning in with the uh rocks that been washed away in I believe that's in a phase that has already been accepted. Yes. Okay. That's what that's what I try to understand. Now these streets right here they um I know some of them are private. Are these public or private?
It's a mixture. Each plat each respective plat shows which ones are private and which ones are public because that's a confusing part too on unfortunately I'm going to get some of them are private some of them are public and that was the choice of the developer at the time and some of they might think that they're a city street and they're a private street and HOA would take care of the private.
Okay. So, um, what we have to decide is if we're going to go ahead and with the recommendation of of the engineering, are we going to go ahead and set these these streets? Because I wrote out there and look at it. I didn't see the rip rocks. I didn't go that part. I went through the other part and it looks like they tried to fix the curb and we took care of the uh where there had been an old dump. The city was gracious enough to take care of that for them. We climbed off down in there and that. So, uh, and we got all that out for them to help the the service out. So, um, any more questions, Mr. Harper?
Uh, I'm not really satisfied. Uh, you're saying all of that homeowners problem now since we accepted in the past. So, it belongs to the homeowners now. That w that washed out rock part. If it is in the phase that was accepted, yes, it would be owned by the HOA, the homeowners association. So, who owns the HOA? Don't the don't the uh don't the developer own that HOA? The developer may still have control of it. So, we don't get in Yeah, we don't get into that side of it
as as to who owns the HOA, the developer when they turn it over to the management company, that's all outside of the city. We just look at the development and provide punch list for items that need to be corrected and then mark them off as they are corrected. Your recommendation that we accept it that's that's your recommendation.
Yes, sir. More question I think I mean we've done this a lot. I know Mr. Morris emailed all of us a lot. A lot of people have emailed us all and I think the problem is on this subdivision the unfortunately the people in Taylor's Landing wants us to help them with their HOA and that's not the city's responsibility. That's right.
We're it's it's not our job. It's not what we do and they have an issue with the HOA and unfortunately that happens. It's it's probably one of the first developments that we did when this big boom hit Murray County in Colombia and I feel for them out there if they're had struggling with with their HOA but it's not the city's responsibility to take care of some of these things that that have been turned into us that we've seen the pictures on. I'm g. Yes, this will be uh for multiple gyms at the uh Columbia aquatics and recreational facility with walking track basically provide double in our indoor recreation. Um it's 100% grant and um it's gone up a little bit but we provided for all the information and it was uh one of the main areas in our Columbia 101 that we did out on Riverwalk that the public requested. So if we can get it, it'll be a great project for us. Now this is the third time we've done this blue cross grant. Fourth. Fourth. A different project this time.
Yeah, it's a different project. And last year, unfortunately, they had the uh hurricane that went through East Tennessee. I think a lot of correct grant went that way. This where you this where you talked about the track, right? Yes, sir. I just want to hear be good for recovery. We haven't received anything this before, have we? Yes, sir. Okay.
No, we're uh we're one of the uh cities that perceived as doing real well. So, this is a grant that uh that it's hard for a city like our city of Columbia to get. The same being the zoning ordinance of the city of Columbia, Tennessee by adopting the waters edge at Taylor's Landing Clemer Pud master plan for tax map 90 parcel 7.12 located off of River Road and Taylor's Ben Ward three. Now I need to tell council I will be abstaining from this vote, but I will be able to take us down the road on this ordinance.
And I believe this is the item Councilman McCullum had asked for some clarity on during the public hearing. So if we want to ask um either after a motion or second or after or beforehand with Paul either way like to have Paul come up in the first off you can come on up please council I'd be happy to recap that for you there council mullen. So this is throughout the city you have a few plan unit developments that really never took off. So they've they're just been sitting out there for numerous years just sitting there waiting for somebody to basically pick that project back up and go through the process of renewing the approvals for that project that was abandoned. This particular one started 20 plus years ago. Um, it first came in under Nehemiah Builders as Savannah Green when it came in before Taylor's Landing and everything else out there. It was just a pasture land out there. So, this particular piece is a 5 acre piece. Um, it is separate from Taylor's Landing, separate ownership, separate um developers. Uh, it was been sitting idle for a number of years now. The last development on this one goes back to 2020. They've yet to move that forward. This new applicant has picked this up and kept the uses the same, but because of the age went through with a new master plan through planning commission, working with staff and the planning commission and what you have in front of you today, it did come before you with a 60 um recommendation of approval through planning commission. Um this is a 5 acre track. It has 94 units on the on the particular piece of property, which is um a reduction from what the previous approval was. Of those 94 units, 12 of those will be town home units to help blend the development into the existing
town homes that are in the area. Um majority of the parking is actually behind the buildings. And when you look at the attachments there for the site plan, you'll see these um buildings are pushed forward with the units. The civic space is sitting out there. Um the majority of the parking is behind it. They are dedicating rightway um to the city in order to accommodate on street parking um that will match what Taylor's Landing has done in their development so that everything will look um cohesive there among the development as a total. Uh working through the project they were only there was two deviations that they were requesting. Um staff consider those pretty minor deviations. One is you're required to have a building of a certain size, a certain width um in relation to your frontage. This one is particular is requiring 60%. Um they're asking for a deviation on one of the buildings which is 56%. So they're 4% or so less than what that requirement is. And then the window sill height. So the window sill height is under the plan unit development required to be the bottom window sill height at 5t. and they're requesting for 4 feet window sill height which um staff has administratively done some of those deviations on some other projects as well um due to um the ADA accessible building code side for Windows Heights and I'll entertain any questions if anybody has any.
I'm just wondering what those buildings going to look like compared to the other buildings already there.
So the Yes, sir. the elevations are in your exhibit. So your your exhibit A there has all the pattern books for that. It will be a mixture of of um fiber cement lap siding as well as brick. Um this there was two recommendations coming from planning commission and that's already been adjusted in your exhibits for tonight. One was uh on one of the buildings that were a little bit more internal to the site. They wanted to see that brick continue around all sides and that's what's shown for you on your exhibits as well as they were asking planning commission asked for additional landscaping with regards to the civic space because the pool is located kind of in between buildings and also the frontage road. Um so on the frontage road side in order to um shield that a little bit from the neighbors across the road they asked for some additional landscaping on that and they provided that as well. If I'm hearing this right now, they're going to build some town homes. Is that right? And they're going to build what? They're going to build an apartment building in the middle. Is that what they're going to do?
It's a mixture of of apartment buildings and town homes. So, they're going to build apartment building right in the middle of all those those homes up. The people's already there. The town homes. Yes, sir. They're going to build town homes, some town homes, and they're going to build an apartment building right in the middle of it. Is that right? Sure. Yes, sir. Oh, so the original put for this, how many homes was it? Was a how many apartment was it? 150 for some reason 130 sticks in my head. Yeah, maybe. And it was all apartments at that time, right?
Yes, sir. So this is reduction in numbers and then adding in the town home component to solve. And this came through planning commission first and was turned down and they redid it and came back with an approval. Is that right? And staff's okay with it. I don't I apologize. I don't recall whether or not it got um turned down or whether or not the staff or the applicant removed it after discussion with planning commission. It did go in front of planning commission. Um I wanted to what what district what's what they're in. Uh I wanted to just probably hear something from a ward a person that that third wrist secret. But uh I mean I was questioning the same thing. Why would you put homes in the middle of a neighborhood that's already there? Um there was so much more that could be done with that property, park,
things like that. So I mean what you know?
Well, it is five acres so um I think you'd be limited on how much park space you could have. I guess um think about it as a just a a transaction here. a transition. I'm sorry. So, before the town homes that are there today, it was it was it was it was hay. I mean, it was pasture land and there was people doing hay on it. So, then we turned it into town homes and now you're seeing the apartments across the road got approved. Um they're taking a pud that already had apartments approved for it prior to the Taylor Landing approval. So, before the town homes went in, the apartments were already approved. They're picking the apartments back up, but bringing the numbers down, bringing in the town homes. The the biggest thing I would say to you is look how close it is to your downtown is this isn't um sitting way off in Trotwood or way in the apple area. This is actually relatively close to your downtown and which is where you want to see the higher density within your community.
Have they done a traffic study out? Yes, sir. They're building apartment across from that intersection. That's correct. Yes, sir.

Couple years ago, um the um city of Columbia reszoned this property at CPS lands request to CD5. The applicant requested CD5 zoning for this property so that it could be developed under the right base zone. Planning commission said, "We don't really feel comfortable with that. We want to see the plane. Please leave it as a PUD and send it back through." That was back in November of 2024. We prepared the PUB document. We've had multiple neighbors with the community, four or five neighborhood meetings. Previously, these were shown as multif family buildings. These have now been changed to town homes. There are single family homes that are along the street here. There are town homes that are here. There's single family homes here. There's uh condominium and town home buildings here. town home buildings on this side. This is a real mixture and a a collection of different home types uh meeting different economic needs within the same neighborhood. Um there is collaboration that's being discussed between the HOAs as far as maintaining future greenway trails. How can this participate in the bigger picture? So those conversations have been had and are going to continue uh as we move forward. This is a reduction from 135 in the previously approved plan to 94. So, we're stepping that density down um really in response to a lot of the comments that our neighbors gave us. Yes, sir.

This is not anything doing with subdivision of the property. But their concept meeting our standard indicates they could get around 31 homes.
Is it is it the zoning around it too? Are they asking for the same zoning? It's uh it's a little mixed. So there is uh two sides have the CD3 zoning. One side has the CD2 zoning and then one side has a plan unit development that has yet to develop.

Yes, sir. they have to contribute to and help with a um a project there on Blackburn Lane in order to boost the pressure to not sprinkle. And then the upgrade is supposed to be done, I think, that we saw on our list within two to three years with hope or he could go ahead and do the help pay for the upgrade which we would be a plus for the city of Columbia.

on the south side. Hey, I think this is in in my opinion, it's 30 lots. They meet all the criteria to be annexed to the weigh down. They can decide what they're going to do with it. I'm trying to get make sure I'm clear because I don't just be knocking down everything and when when somebody come legit and the planning commission located and not not a big subdivision of that type, you know, but somebody come with a little small amount of lots of B whatever, you know, I'm I'm I'm kind of concerned about just knocking it down because I may come with something. I might want to be want to do myself, but I don't I don't want to be in a position that I can't uh develop anything that I really want to develop. I'm not I mean I don't understand all what's going on. I'm new on on on the block and but I don't want to be knocking down everything because don't want nothing to happen in the city. But you know, you can't in my opinion, this is my opinion, you can't just knock everything. But if it's not um uh big big subdivision because of the water problem and all these other issues, traffic, all this, I'm I'm concerned about that. But a small uh development, I'm not I'm not that just that's my feeling
and uh I'm very much persuaded on my opinion. You know, if I vote for it, I'm gonna vote for it, but I'm not I'm not. But uh and I know that's not my area and not my ward. And I want to hear from the man in that ward again. Mr. Mckelby,
so I'll tell you u walking through Quail Run as I've have and talked to the people there, uh they're really disappointed that this checker property was just essentially um cut down. It was a bunch of trees there and they just went through and just cut it down and burned it all and they were really upset about that. And so I'm talking about this piece of property. Yes. Yes. They were very upset by that. And um uh well unfortunately they're not they're not really in support of that either. So,
well, the way I've thought about this one, I've been hearing all the the noise about it. And unfortunately for them, they didn't like it, but they didn't own it. You can do what you want with your property. And that's what some people are kind of forgetting here. And you can do what you want with your property. It's yours. And this is 30 lots. Now, all these lots that we've got the piece of paper that was in our box today, if you look at this, most of them are owned by big developers, would you not say so, Paul? The majority, yes, sir.
Majority are owned by big developers. They're not selling their lots to the general public. They're building their houses and putting them on there. So, if some guy who might want to start his own little construction company wants to come in and maybe try to buy these little 30 lots, he has a chance. That's the only way to do it. If not, we're just going to be controlled by the big builders who, you know, the product with our new ordinance, they're upgrading it, having to upgrade it tremendously. We're in planning commission right now. We're working with them to upgrade their product. But this is a chance for somebody who could go out and buy five lots and build a house who a person who wants to start to be a contractor. The other way, it's not going to happen. And on this list here, I say almost half of them have zero beside them that they haven't started their lots yet. So, we don't know when they're going to start them. I mean, you just don't know because the economyy's changed. I even talked to a we discussed an apartment building. Why has it not started yet? It's been approved for over a year or two and they said, "Well, the interest rates too high. We're not starting it." So, the little things that they come in, they meet the criteria that the city has set up. I think will be a plus for Columbia and it still shows that we want to grow. If we want this commercial to come in here, we have to show we want to grow. We can't just say no more or we aren't going to get because commercial follows the residential as we all know. So, do we have do we ever get a motion to second? Yes, we did.
