If y'all would, back and join us. Dear Lord, we want to thank you for this day. We want to thank you for this time together this evening to discuss the county's business. We appreciate the rain that we've gotten this week. Maybe give us a little break the next few days. That would be wonderful. We ask that you guide us in our decisions tonight, that we all remain prepared, Peaceful and respectful of each other tonight as we discuss issues that may or may not, you know, we have a disagreement on. We ask you to look over all the first responders that cover us day and night here in this county, our fire and rescue, our sheriff's office, and the Gold Cross folks. If you wish to address the Board of Commissioners at their meeting, please see Ms. Mixon to obtain a request to speak form. Any requests with a public hearing will have a minimum of 10 minutes permitted per side for the presentation of opinions, data, and evidence by proponents or opponents of a request. The applicant will be allowed to speak first, and any member of the public may speak after. Either side may cede their time during the hearing if they so desire. Getting into the debate agenda, new business, we have a massage operator's license, H1A1. Will?

Yes, sir. This is the final plot for Hamilton Grove Phase 1 off Hamilton Road. This is the southern portion of the property that is currently zoned RA, residential agricultural, and it has been developed with 10 residential lots with a minimum lot size of 2.58 acres and an average lot size of 2.75 acres. The setbacks are 35 feet from the right-of-way, 10 feet from the side property lines, and 25 feet from the rear property lines in accordance with the RA Zoning District. And this shows the existing site, and staff is recommending approval.

Yes, sir, this is a conditional use application, and the location is 4490 Washington Road. The current zoning is C2 General Commercial, and the request is for the conditional use for massage. Here is the location of the commercial center on the south side of Washington Road. The zoning is C2, and the surrounding zoning is C2, and then some residential as well. Here's a close-up of the aerial shot. and this is an existing retail center, and the massage use will be in one of the tenant spaces in there. The massage therapy is moving out of a location that has stairs at the moment, and the clients would like to have a place that doesn't have stairs. On the future land use map, the site is within the community commercial area that is usually similar for retail uses, and several massage locations have been approved in the past in this district. And staff is recommending approval of this request.

Yes, sir. This is an application for variance at 113 Glenora Drive to reduce a side setback. This shows the location of the parcel near the intersection of Columbia and Bel Air. It's a residential parcel located at the beginning of the Glenora subdivision, but behind a couple of commercial properties that line Columbia Roads frontage. This is an aerial shot of the site. As you can see, it's oddly shaped. That is kind of the biggest determining factor that is confronting the property owner as he seeks to add an expansion onto his home. Due to this odd shape, it's difficult for him to meet the side setbacks on this parcel. He's also dealing with some topo that we'll see here in a second. This is a shot of the existing site. The addition is proposed on the backside of this corner of the house that we're showing where the carport is. And as you can see, there's already a significant privacy fence in place as well as topographical upslope to kind of keep that addition that he's proposing out of view of any passing by neighborhood residents. Again, this is a slide showing the topo on the site. As you can see, it significantly rises from the road level, as we just saw with that existing site photo. The most viable and flattest space on the parcel is located closer to the house. So in addition to the house, as opposed to an outbuilding, is a little more feasible for the applicant. He's suggested that in his argument for this request as well. The topo would back that claim up as well. And then you can also see even beyond that behind this parcel, there's a continued upslope to the commercial parcels back behind it, who are the only neighbors that could feasibly be impacted by this addition. Generally, the addition is going to be out of their view, both due to the wooded areas at the back of those parcels, the separation from their existing buildings, as well as the topography just kind of placing them up above that addition anyway. This is the proposed location for that addition. You see we're about 2.4 feet from that side lot line. Due to that, there is the necessity for an easement encroachment agreement that is a condition of approval proposed by staff with this request. Additionally, there's a comment that just highlights the fact that to build this out, they're going to need to do some fire grading. That's a standard code applied to anything closer than five feet to a shared lot line, just seeking to mitigate the risk or exposure to those neighboring properties that are so close to this proposed addition. And so again, with the condition for the easement encroachment included, staff is recommending approval of this request.

Yes, sir. This is a request for a variance to side setbacks also for the property at 509 Ernestine Falls. This property is located in the Ivy Landing at Ivy Falls subdivision off Columbia Road and is currently zoned R2 RCO, which is single family residential with a residential cluster overlay. That overlay provides for some smaller lot sizes and smaller setbacks than would be typical in R2. In this RCO district, the required setbacks are five feet from the side property lines. This shows the aerial of the site with the existing house. You can see the stepped retaining walls there to the left with the concrete pad at the bottom of the lot. That concrete pad is the proposed location for a new building to be added on the property in that area that's already been leveled and concreted. This shows a site photo of the existing house. and the existing site on the side. So this is looking at the property kind of towards where the building would be. It would be on the right in this image. So you can see the amount of fall that this property has from the house down to the bottom of the lot. So there is a significant topographic gradient here. The applicants have installed those stepped retaining walls to deal with that to help stabilize the slope and then provide that level space at the bottom of the lot. And this does restrict their possible locations to build a building due to the topography of the property. So they are requesting to be able to place the building on that concrete pad with a one foot setback from that side property line. This shows the site plan for that proposed building location again located on that existing concrete pad. I also want to mention there is that existing shed in the back corner of the property. The variance would cover that as well. That's an existing building that also does not meet the setback. So we're just kind of folding that in with this request. So the variance would cover both of those structures. This is the proposed building. It is a metal building. It does, since they are requesting a one foot setback, it does have to be fire resistant. The metal material should meet that concern. The HOA has submitted or has provided a letter of approval for this structure in this location. So they clearly do not believe this will be injurious to the neighborhood. The applicant is intending to use this building as a recreation area for his children. So there's not intended to be additional driveway access to it at this time. So overall, there's no particular concerns from staff or from the HOA as far as its compatibility with the area. The only requirement is that an easement encroachment agreement is required. That has been submitted and is being processed in conjunction with this variance request. And staff is recommending approval with that condition.

Yes, sir. As you said, this is another variance application for side and rear setbacks on Campana Drive. This shows the location of the parcel near the entrance to the Bell Tower subdivision north of Hardy McManus Road. This parcel is zoned R2, even though most of the surrounding property is zoned R1. This is the aerial shot of the parcel. This doesn't reveal a ton, except the parcel shape is a little bit trapezoidal and narrows kind of to the north, which is where we're going to be looking. The rear corner on the north side of the parcel is where... the area subject to this request again with this parcel being kind of wider than it is deep they're looking to make livable space and usable space in their backyard is kind of the root of this request and they're dealing with some topo back there as well so that is the couple contributing factors on the build out of the house is already underway on this parcel but it is not completed yet And again, referencing that topo, this is an illustration of that. It falls off pretty significantly. I don't know if you saw on a previous slide, there's a pond on this larger adjacent parcel on the opposite side of some green space for the bell tower neighborhood. So all of that slope is falling significantly downslope towards that pond in the back. which again is something that they're combating with their proposal to install some fairly tall but warranted retaining walls to create a usable pool and pool deck area in that corner of the parcel as illustrated here on the concept plan. Again, with this orientation, we're looking at the back left corner of this plan where they're proposing, again, retention walls roughly nine feet tall to create a flat pool deck and pool area for them to use. Again, the only concern with this, they're separated from any residential structures by a ways. They're kind of the end parcel out there on the outside of a curb. They don't have any across the street neighbors that are going to be easily able to view this area of their parcel. They'll install a customary privacy fence for their neighbors. backyard so the area is going to be screened from view from the right of way of campana drive and again that very large parcel that's residential that has the pond on it there is like a a boathouse or like a covered covered dock over there in that area so there's not really any more available buildable space for anything residential that they could negatively impact by installing this so the exposure to negative impact for anybody in the surrounding area is very limited The only condition of approval that's proposed is another easement encroachment agreement, and that has already been submitted and will be presented to the BOC at the same time as this item, provided it moves forward to that meeting date. And so with that condition, staff is recommending approval of this request.

Mr. Chairman, I make a motion to recommend approval with condition of VA 26-08-03 variance to reduce the side and rear setbacks to three feet for the property at 711 Campana Drive. Second.
I have a motion and a second on the floor. All those in favor, raise your right hand. Motion carries. Next item, H1C5. This is a variance to section 90-139, and this is on 4546 Washington Road. Will?
I'm going to share a request for a variance. As you said, to 9-139 and 9-98 was lot structure requirements. I'll introduce the building sub-ax and buffers at 4546 Washington Road, currently in the zone of C2 General Commercial. This is the location of the property within the Cardinal Square development. Again, most property around there is in C2. You have some C3 to the south and then R2 kind of to the north, we'll say. That's kind of causing the biggest issue. We've got a 30-foot buffer against that property. And we have a 20-foot building setback against the C3 there and also an existing retaining wall. It's about 10 feet off the property line that gets to about 50 feet in height. So we're doing a few things on this piece of property. Here's the area of the site and the plot itself. And the side itself, you can see the retaining wall at the back. Again, pretty big one, about 12 years old, we think. So the overall concept plan, we have about a 10,000-square-foot building, about 30 parking spaces. You have a dumpster pad kind of in the upper right there. Again, the property is well within the buffer. The building setback in this situation, plant left, has a 20-foot building setback. It's within that by about 9, 10 feet. The kind of issue with this is the retaining wall itself. Fire is a little concerned about that wall's integrity. They have requested a condition that basically moves everything 10 feet off that wall. So there's a condition for that. The other thing to think about as well from the buffer side of things, We've been talking about topo quite a bit here. Again, this site is about 15 feet below the site to the north that is residential. So, again, any kind of – it's already well below it. You can already – are probably not going to be able to see it anyway. So a reduction in the buffer makes sense because of that large drop-off there. But, again, there are several conditions with this. Again, you have the fire department where you have the 10-foot separation. Our conditions are in regards to basically following that. We're not going to say here's what it is in terms of the setbacks. And also reducing the structural buffer to 10 feet. And also that retaining wall has been reduced as well. That's only for the existing retaining wall. If it has to be rebuilt, we're going to have to kind of revisit this. Again, there are some questions about that wall and its integrity. But again, staff is comfortable with the request of these conditions. I include staff recommendation.

Mr. Chairman, I make a motion to recommend approval with conditions of VA 26-0804 variants to reduce the building setback and buffer requirements at 4546 Washington Road. Second.
I have a motion on the floor. In a second, all those in favor, raise your right hand. Motion carries. Next item, H1C6. This is a rezoning from R2 to S1 on Legion Drive. Dylan?
Yes, sir. This is an application for 250 Legion Drive. It is a request for rezoning from R2 to S1 for a glamping campground. This shows the location of the parcel, again, at the end of Legion Drive, which at times is a private road, at other times is a driveway. We'll get into a little bit more of those details in a moment, but it is southeast of Owens Road. The parcel is, again, currently zoned R2, and they're seeking S1 special zoning district. That's U-specific zoning, again, for Glamping Campground. They're surrounded on most sides by residential zoning, but they do also have one adjacent parcel that is also zoned S1. That parcel is in use for the Legion meeting space. The American Legion's chapter at that location meets at that parcel that's zoned S1 there. This is an aerial shot of the parcel. It is currently undeveloped and densely wooded. And we will get into the concept plan here in a second. But again, you can see Legion Drive illustrated there as not a roadway. It is a driveway there. This is a plat also cooperating those details. And part of the question facing this site, it's a little bit awkward to develop, but part of that is due to the fact that the pond immediately north of this parcel has a dam associated with it that must be crossed to access this parcel. So non-residential use of any kind, even though it's a camping site that... Generally, we'll have limited development compared to other non-residential uses. It just presents a little bit of interest as far as our interdepartmental review went, most specifically for fire rescue. There's a condition that the fire department is requesting either guardrails or lighting along that dam stretch specifically to help insulate their equipment and their personnel from any kind of safety issues as they seek to cross that dam in any kind of emergency situation. This is a shot down that stretch of Legion Drive toward the existing site, and it illustrates that pond that has that dam associated with it. This is the concept plan, 12, 25-foot diameter, yurts or domes or tents. We'll see some illustrations of what is intended for these separate sites in a moment. They're accessed via gate with security code. They have associated parking, vehicle turnaround. It's worth noting that the driveway here in its current existence is probably not 20 feet wide, but the applicants and the property owners are comfortable widening that as needed, again, for emergency vehicle access. Additionally, you'll see here In the areas where development on the site is proposed, it is most closely proposed over here to the western end of the property. And there are some residents that share access via this driveway over there, as well as some to the rear of the parcel, but still to the west in the adjacent Ashwood subdivision. Those are the closest residents to development on this site. And so in those areas, opaque fencing as well as a 20-foot wide landscape buffer is proposed. to insulate those residents from any kind of impact due to the development and then the occupancy of any of these units that are near to those parcels. This is an example photo of what the engineers associated with the project so far and the property owner are seeking to develop. Again, you can kind of see the domed, livable, glamping units that they're proposing as well as Each unit being developed on a deck to kind of combat some of the grading issues. You saw there was a creek running near to the property, and that helps naturally insulate the sites from the other adjacent residential properties. But this development pattern using these decks kind of helps to combat the topography associated with the fall-up as water kind of gathers in that creek to degrade. And again, more example photos, one of the interior of what's intended to be developed on these sites. And then, again, as we've referenced, this is a non-residential use that is being proposed on currently residential zoning. Beyond that, this is also in the traditional neighborhood character area. But we've discussed also that there is a non-residential component to the Legion property that's immediately adjacent. And on the opposite side of that parcel, there also is the community commercial character area area. here on the character map that we're looking at. That Legion site is used on a regular basis without any negative impact on the surrounding neighbors, as we can tell. Beyond that, this applicant has also gathered letters of support from all of the residents up and down Legion Drive itself, as well as one of the adjacent residents over there in Ashwood that we talked about previously. So presumably the most reasonably impacted neighbors are all on board with his request. And again, the Legion site being already off of Legion Drive kind of adds credence to this site being used non-residentially in seasonal or low-impact capacity as a campground would in our assessment. So given these details for the character areas and the zoning, staff is comfortable with the request. Again, the only condition of approval that's proposed via interdepartmental review is from the fire department as they request those guardrails or lights, again, in the interest of safety of their equipment, their vehicles, and their personnel in the event of an emergency at nighttime should they need to cross that dam. And so again, staff is comfortable with the request and recommending approval with that condition.

Robert Titus, 4424 Columbia Road, Martinez, Georgia. I'm here on behalf of the owner, Mr. Harris, seeking the rezoning request. we spent a significant amount of time with staff. We met with every department in a large meeting to go through everything. We've gone back and forth with the fire department. We have no objection to providing the safety requirements that the fire department has. In my eyes, it's hard to call this a development because it's a minimally invasive project. you know, piece of project. And this is a little bit different than other developers. This guy is not a developer, Mr. Mayors. He's the owner of the property. He has some health issues. He's found it to be therapeutic to be down by the creek, out in the wilderness, outdoors. So he's looking to come to put these glamping sites out there so that people can experience the same quality of life, therapeutic kind of thing. So it's a little bit different than a common development and developer. who's typically motivations and monetary, his or not. So I'd be happy to answer any questions.

Um, widening this road, how much more have we got to get it to 20 feet?
The from berm to berm, it's 20 feet already. Okay. So there are garbage trucks that drive up and down the drive across the berm date. So, or weekly, I should say.
And as far as the guardrails or lights, have you decided which way you're going to go? What's the cost impact going to be to the overall project?
Yeah, we have it. Um, My opinion is going to be the lighting. Like I said, 20 foot is the minimum for a fire apparatus access road. We have that. Adding guardrails and other, you know, obstruction that can be hit, damaged. And then sinking that into, you know, the pond dam and berm. So it's probably going to be lighting. But, you know, we'll talk to the fire department. They've given us the option either or. We'll talk to Mr. Harris and we'll make a decision. But we're fine with either way.

I'm Janice Hanley. I live at 242 Legion Drive. I've lived there for over 30 years. I'm speaking for me and Mother Nature. Mother Nature showed herself today. That area floods. It is a marshland, and that creek turns into a river. And if you look back in history, that little creek tore down the trestle years ago across the street on Washington Road. I don't remember the year, but I remember it tearing down the trestle on the train tracks. That little creek turns into a river. That area floods. The water comes down from my brother-in-law's house. It floods through our yard, and it goes down in there, and it floods. There is wildlife down there. I don't want him to take away our wildlife. The deer come through our yard every day. They nibble on our grass. They eat our mimosa trees. I mean, it's like a sanctuary back there. I've lived through two hurricanes in that house, and there's a dirt road. Y'all would not pave it because the first hurricane, Hurricane Eric, washed out that dam, and y'all had to replace it. I think it's a dangerous area. And I object very much to it. And I'm telling you, it's like an animal sanctuary back there. I have seen hawks. I've seen the deer come through there. And there's a thing on... I'm sorry, I'm not real good at this. There's a... If you Google why deer come through your land or through your backyard, I mean, even at Crawford Creek, I see the deer because they feel safe. I mean, I've told people, I said, those deer are watching us. They're in his woods. They're in the woods at the Legion. They're watching us all the time. And when we go in the house, they were... In between the storm today, I looked out the door and there were seven deer in my yard nibbling on the grass, eating the mimosa trees. As soon as that storm hit, they disappeared again. I mean, I don't want to see the beauty of that forest gone. Even though... Hurricane Helena hit our house, and I was hit on the head by a tree. But I'm alive to tell you about it. It took 10 hours to get me to the hospital. And that's another thing. When it's not raining, the dangers of a fire. Ashton Woods in danger. We're in danger. Holiday Park might even get hit. I have a fear of that. I have gone up and down that road for 30 years, several times a day. We don't need the traffic of more people going in and out. I think their idea is ridiculous and crazy. They need to find a place up at Clark Hill. There's nothing for anybody to do back there. Nothing. You know, Clark Hill's got fishing and hunting and whatever they do up there, boating. There's nothing back there. I mean, I really have a fear of a fire. It wouldn't take nothing to start a fire in those woods. That's all I can tell you. I mean, please don't run my deer off. They have nowhere else to go. I mean, all those businesses have already run them off.

thank you um so we're aware of the floodplain back there if you look at the concept plan you can see there's there's a line that's has the text at 100 year that's the floodplain and then there's a wavy line in between it which is the floodway uh we are staying significantly away from the floodway the floodplain would reach up into the areas to where we would have the raised deck um But we don't expect any issues. Again, I'm not sure if y'all are familiar with the floodway. Floodway is where the majority of the flow runs. during an extreme event. I'm not going to get into all of it, but essentially that's the case. And we're not trying to run the deer off. Again, he wants this to remain as natural as possible, which is why we have the wooden raised decks. There's really, within where the glamping sites are, there's no proposed grading. So he wants to keep it as natural as possible for that very reason so that people can go out and enjoy nature. Was there something else? Was there another thing that needed to be addressed?
Were y'all going to do some type of a tree buffer?
I mean, I saw where you had it. Yeah, there's a 20-foot landscape buffer. Between each glamping? Between, yeah, around the perimeter of the property. For adjacent properties, there's a 20-foot buffer.
So what is, say I'm in a glamp site for two nights. What kind of activities do you normally see folks do there? I mean, have we got campfires going with this fire concern? There is a... Would they have...
The example pictures you had didn't show any kind of fire pits or anything like that. It looks like there's a common area.
I don't know if there's a... We have no campfires that would be burning at all. That's going to be part of your agreement.

It currently is in R3 in the area of the site and the plat and also the site itself. So what we're dealing with is looking to remove the buffer. It's about 75 feet, that area that's highlighted there in yellow. The reason for that is the neighbors to the north, they would like to not have a fence and plantings on that side, basically against their yard in this situation. The other thing too, there is some potential issue with being able to see down Bellwood Drive if you put a fence basically further out than it would be currently with the residential property. The other thing, too, is that in order to kind of keep this all looking a little more residential in character, with a residential property, you can't put a fence basically beyond the front setback or the building, essentially. That's kind of how you can look at it as you drive down the street. This would keep it more in keeping with that if we were to basically get rid of that requirement for that first 75 feet. The only concern from staff is that because we are going to be getting rid of a buffer and also because this isn't going professional, there is the potential for lighting to be going 24-7 and kind of having that protection for the properties of the north is what we'd like to see in this situation. So staff does recommend approval with the condition that all lighting has to be shielded and directed away from that adjacent residential property. That includes staff recommendation.

Yes, sir. This is a request for a rezoning from our three single family residential to PRD planned residential development for the property at three 25 McCormick road. Uh, this is the former South Columbia elementary school site. Um, the school has been demolished, so the site is largely vacant at this time. Um, it is located on kind of the west side of McCormick road between old Evans road and river watch parkway. It is currently zoned our three single family residential as is the majority of the surrounding property. We do see a couple S1s typically for churches or church-related uses, as well as some nearby townhouse zoning on the opposite side of Old Evans. And this shows the aerial of the site. It is currently largely undeveloped. And the existing site after the school has been demolished. The request for this development is to develop a townhouse neighborhood on the property. The concept plan currently shows 107 units concentrated in the center of the site with the amenities and buffer areas at the perimeter. Since this is a PRD, the concept plan is being reviewed as part of this application. It does show the two access points, essentially the same access points the school had, and it does include the addition of turn lanes at those entrances. The units are laid out in groups of two to roughly eight. The two-unit group's a little unique. Our county code doesn't have a good place to put a two-unit attached residential grouping. Since it's shown on the concept plan, it would be allowed in this development, even though it's not technically a townhouse. For our code, townhouses have to be three or more connected. There would be 40-foot buffers around the perimeter of the property and a 25-foot buffer along McCormick Road. That would have a berm and landscaping to create kind of an attractive entrance. The development is intended to be gated, so all the internal roads are private. Typically, since this is a PRD, we would require street trees within the development. However, given the nature of a townhouse project, traditional street trees, which are typically spaced every 40 feet, are kind of complicated just because of the density of the driveways and the development itself. So there is an alternate landscaping plan proposed that would use kind of street trees along some of the main roads. And then they would use trees in the backyards and in the open space areas to balance the landscaping plan. They are intending to use pecan trees and other native plantings throughout the development to give it kind of a unique character and to honor the history of the area. and they are proposing a more robust amenity package than we typically see in a TR development, including the pickleball courts, pavilion space, garden areas, and other aspects. We do have one condition that would require them to add a play area suitable for children. That's a typical requirement for the county in a townhouse project, and since this is a PRD, and is expected to actually meet a higher standard, we'd like to see them add that. They're aware of that and already have an idea of where they'll put that. In terms of future development, this is in the traditional neighborhoods character area. This area is intended to provide for a mix of residential uses, including single family homes, town homes, and multifamily buildings, and is appropriate for moderate to high density development. The presence of existing utilities at this location within a developed area of the county also supports the intent to make use of infill sites and make use of existing infrastructure where we can. So this does meet the intent of our comprehensive plan, and staff is recommending approval with that condition that they include the play equipment in a portion of the open space.

Good evening. I live at 347 McCormick Road in Martinez. I don't really have an objection, but I do have concerns. This is a two... Two-lane road, the increase of traffic will be heavy. There's no signal light at the corner of McCormick and Old Evans. There is a history of accidents at that corner. I'm concerned about people walking on that road, which I see often since I live on that street, because there's no sidewalk, and there will definitely be an increase in traffic. We used to walk on that road when the school was there, and there was an area, a track, a walking track. We can't do that anymore, it's such a mess. And I understand this is gonna be a gated community, so it won't be open to the community, is that right?

So I just feel like it'll be a hindrance to the community. Um, I think that because it's owned by the Columbia County school system, it can be better. There can be better situations and a hundred townhouses, uh, better for the community. I don't know what, but I don't know a park for children. As you all will know this is a kind of a densely populated area for a residential area and we are getting a lot of traffic because obviously Bobby Jones comes straight over practically into old evans and down to river watch parkway so at the other end of this development you can also access river watch parkway my point is It's already a heavily, heavily traveled artery already, and then we're going to put potentially, you know, let's say every family has two cars. We're going to put, you know, 214 more cars, dump them back out into Old Evans, which doesn't need it, and then also out into Riverwatch, which probably can handle it, but with the speed of the traffic going down through there, you know, It is what it is, but my concern is living off of Old Evans, you already can't turn out of Old Evans in the morning and even get where you would like to go, which would be to Bobby Jones and get on your way. You have to take McCormick and get on Riverwatch Parkway. Well, with this, that'll also be backed out, probably almost back out to Old Evans on the other side. for the ones that don't take Old Evans. So my whole concern is just from a traffic aspect where we have got, in this county, we love to develop, develop, develop, but then we don't want to, we got to let these roads catch up to the stuff. I mean, it's everywhere you go in this county, you used to get across this county in 15 minutes, 20 minutes, you can't, you all know, you live through it every day. And we keep pumping these people in here, which is great, but we've got to let these roads catch up to some of this growth. You know, just like a lot of these folks, we stand at these voting booths and check these box boxes to improve this county for the better, but not for the bigger. So just the best of my concern is mainly the traffic and all the things that that brings. So thank you. Okay, thank you. How bad was the traffic when the school was there? During that time, the traffic was really bad, but we didn't have that many cars because the school bus can't pick up the kids at the same time. And we also have police officers to stop at the stop sign over there to hold the cars. They let the traffic go. If you look at Old Evans Road, before the mosque at the corner of Old Evans Road and River Watch, they're also building, I don't know, townhouses or apartments over there, too. So the traffic from that section from Old Evans Road to McCormick Road is going to be hectic. We already have a problem. When I want to go to work, I cannot turn left to go to Old Evans Road. I have to use the traffic light from McCormick to Riverwatch, go that road, pass from the gas station, get to the Old Evans Road and go to work because I'm going to be 25 minutes late to work. So if you add 220 cars to that traffic light and two main roads, there is no way we can go to work in the morning. And also in the area, there is nothing for kids. There is no park. There is no walking place. We need something because it was a school over there. At least we can walk the dogs or we can have some kind of nature over there. And also... The crime. We've been in that house for 29 years. Last year, in front of the house, my husband parked the car and they came to his car and stole all his tools. We are dealing with a crime in that area because they put a lot of apartments on the other side of the river watch. So it's another thing we're worried about. She mentioned it's going to be a gated for them, but it's not going to get it for us And it's going to bring so many people in that neighborhood. But I would also like to talk that there should probably be a park there because there isn't really a good place to walk. There used to be a track there, but it's kind of ruined after the demolition that could be transformed to a park. But also the traffic light, people mention that and you ask about that. Turning left into the neighborhood is also hectic because the visibility of the traffic, because it's on a hill, you can't really see the cars coming unless that... So you have to stop the whole road and wait for the traffic light already. And it's also pretty hard to see when you're turning right. You can somewhat manage it if you wait and stop all of Riverwatch, but adding all those cars to it would make that entirely unmanageable. And if you're going to add a traffic light to the other side, you'd probably have to bump all those houses and make it a four-lane road all the way from Bobby Jones, which would make it even more hectic. So there would be a massive mess in a place where you could just put a park in there or something. I went to that elementary school, and yes, the traffic was pretty hectic. So in addition to that... Thank you, sir. This is a rezoning from M1 light industrial to M2 heavy industrial of Gordon Highway on 30.97 acres. This is the location of the site. It's north of Gordon Highway in between Old Augusta Highway to the north. And on the zoning map, you can see that this parcel is zoned M1, which is the light industrial. All the gray in that section between Gordon Highway and Old Augusta Highway is also M1 zoning. The yellow... Dash line shows where the CSX Railroad crosses and to the north of the site and then is parallel to Old Augusta Highway. The other zoning there south of Gordon Highway is RA, residential agricultural, and north of Old Augusta Highway is also RA. This is a close-up of the parcel itself. You can see that there's a creek to the north. There are floodplain and wetlands there, which create a natural buffer to the homes to the north. There is a cleared area to the south of that site. These are the street views looking east on Gordon Highway. You can see where the clearing area is. And then looking west, there's the nearest home there to the west of the parcel. This is the concept plan submitted with the application for the rezoning. The orange shaded area is where the proposed concrete plant is proposed and the rest of the site on the other side is proposed for the waste transfer station. Just to be clear, the M1 zoning that's current does allow the use for a concrete plant now and that could be permitted. The rezoning is for M2 to allow for the waste transfer station. This is the site plan that's shown with the aerial just to show where it's going to be located on the site. And you can see there that it is closer to those homes north of Gordon Highway. There are three homes close to this site and there are a few others located across Gordon Highway as well. This is the close of the plan. You can see where there's the concrete plant located to the center of the site with a storm pond to the north. The closest to the homes would be the office building, then the parking lot, and then the waste transfer station to the west. This site shows where the existing home is about 250 feet from where the proposed office will be. Due to the location of the proximity to the residences, there's several concerns with this proposal that could affect the neighbors. Since this site currently doesn't have any water or sewer connections, if this is approved, the site engineer will have to work out how to provide utilities that are needed for the operation of this facility. According to the county code, the M2 uses would not have any restrictions on operating hours. However, the code does have the noise ordinance regarding unloading and loading that would give some protection to the residences. These are a typical waste facility. There's one on Columbia Road that you can see if you drive past that location. And this is a typical concrete plant. This one is the one on Lonergan Hume Road. You can see there that there's some buffers to this site, but you can see the structures there. The development of regional impact has been completed as an advisory report. There has been responses from the city of Harlem and Augusta, Richmond County, who have both raised some concerns with this development. With this type of development, the community is concerned typically about an increase in truck traffic, noise, dust, odors, water supply, air quality, stormwater management and waste management and site lighting, as well as the visual impact of the structures. Some of the methods to minimize these concerns could be buffers, use of landscape berms, and landscaping to reduce the impact of dust and noise to surrounding properties. Regarding the future land use map that you can see here, the site is within the rural residential agricultural area, which typically would allow single family homes, parcels with agricultural activities, It would include land with cultivated state, active farms, woodlands, timber operations, pastures and scattered rural homesteads. This is a slide showing the Vision 2035 map that was the previous plan to the current comprehensive plan. That showed Gordon Highway as a employment corridor, but in the current plan that was adopted in February this year, this was removed because there was a lack of infrastructure in this area, which wouldn't be available for the non-residential development. So based on those concerns, the applicant has requested to withdraw without prejudice this application and staff is recommending to accept the withdrawal.

This has been a wonderful, it's been a few years since I've been here and it is neat to see the opportunity to voice your opinion and what you have to do is community leaders and I'm excited to be here tonight to hopefully bring just a breath of fresh air and let Harlem know and my neighbors that your voice has been heard and we respect your opinion and your concern and we have In-house voted to withdraw this at the time. What I will tell you is we are not Vulcan. We are not Google. We are not Amazon. Although Amazon is a part of the reason I feel like we are in this predicament. They will send you toothpaste in a box that comes in a container inside of a box. And we have a trash problem. We have people want to talk about roads, infrastructure, housing. We've got a car wash, a self-storage center, a gas station, or some multifamily housing all throughout this community. And I applaud Columbia County because from a municipality standpoint, the goal is growth. That is the goal that every municipality strives to have. And it's got to be healthy growth. But at the end of the day, growth, the only thing it brings, good economy or bad economy, is trash. And we've got a problem. I stated all the people that we are not. I'll say again, my name is Price. I live in Appling. I'm your neighbor. I am friends with a lot of people in Harlem. I respect their opinion, but I also know that a good neighbor is no neighbor. I will just state for the record, for a lot of people that are watching, I was so proud of myself as I found this parcel due to the railroad track running along the rear. The Pollard family brought me this track originally to the left, the way I'm viewing it, as they were just thrilled that it was already light industrial. It was rock and roll. I believe, to a degree, some other property there has recently been rezoned with ease, and I congratulate them. But we are going to move down the road. But for all the people that just... Unprofessionally, I will say, have just lost their mind over this idea or vision that we want to bring to the community. I want to let you know, as we come down Gordon Highway, I leave Gate 6. We conduct a lot of business at Fort Gordon. My closest neighboring commercial facility is a mental institution. I know that's Richmond County. I don't think it's in Columbia County. But I find Gordon Highway to be a very popular realm of transit for a lot of citizens in Harlem. And the first thing I asked immediately before even trying to put this property under contract was, is it in city limits? And we all, okay, good. We don't have to stress over Harlem. But Harlem has definitely come forward and made their opinion very clear. Very clear, you know, so we are excited to be here and to announce our withdrawal. How y'all doing? My name is Franklin Kelly. I live at 335 G.R. Tucker Road. I'm not crazy, as this man just said. I don't like the idea of what's going on. There's health issues involved in this. There's a thing where you crush rocks. We are, that's for cement trucks, that's called silver. And it's fine dust. And OSHA will take care of the people there. But this is right on the Gordon Highway, a two-lane road. And we're talking about the traffic in there. It's just awful. Like I say, OSHA will take care of that. They'll have masks. They'll have gloves. They'll have boots. But this is floating straight into the Gordon Highway. It's two lanes. And I think it's just too much for that area. I don't know if we're going to get any water contamination in there. It's going to run into a low area when it moves out. There's a little cattle farm probably within a mile the way the crow flies. I know I got a little house that's three-quarters of a mile, and it's got ponds on it, and it's going downhill. So anything out there could really affect us. Now, running trash trucks up down that road is going to be awful. The dust that they call it, there's a disease it's called, sylvia, sylvia, anyway, sylvia itemia or something like that, and it causes... severe kidney disease, COPD, because it's a fine dust. Like if you see the cowboys and they shoot into a rock and you see the dust just go everywhere, breaking rocks is the same thing. And this stuff just floats around. It can get out in the road if you got... If you've got gravel trucks running up and down the road, it's raining, it's going to leave all this stuff in there. But it's going to eventually dry out, and then it's going to become dust and float in the air again. You've got people driving motorcycles up and down the road, cars up and down the road, and they're going to all be exposed to this. I just think it's a bad idea. The whole situation right in there is bad. It takes you away from the beauty of Harlem. Harlem's a really, really nice place. And you're going in there, and there's going to be a waste area and a cement mixing place. It's just not good. I think there's so many places in Columbia County that could take another place, but it's not a good idea. I've lived there for 50 years. I've seen the traffic get so bad, it's unreal going in there. Coming up here today, it was pouring down rain. You couldn't see in front of you, and there was just cars on top of cars coming in there. It's just two lanes. Personally, I just think it's bad. I live at 333 G.R. Tucker Road in Harlem. If you look at this picture, that's just one thing. This picture don't give it justice as to what Gordon Highway is there. Right past on east from this location, this location right about where those little houses are there. That's where... the road goes downhill. And it being a two-lane road, it's... That's a danger there. I mean, you got these trash trucks going in there and coming out of there at 7 o'clock in the morning, 5 o'clock in the afternoon, about the same time that all the traffic's on that road.
And...
I suggest that you, instead of putting a dump station there and a concrete plant, I suggest you put... Well, not there. But I suggest to Columbia County that we have a recycling plant somewhere. And if we have to make a deal with Richmond County or make a deal with McDuffie County, I think we can come up with a better way to get rid of our trash. All we're doing here is taking it from one location to another.

So based on the current zoning, which is M1, the concrete plant is allowed and can be permitted. The applicant is requesting to increase the hours of operation. The current use provisions mention that operation cannot occur between 11pm and 6am. This variance is to allow the facility to operate outside of those hours. The applicant would be Sorry, the operation is not for the manufacturing process involving the chemical transformation, but it's for the mixing of the raw materials for the concrete plant. The concerns have already been mentioned prior with regards to the noise and the dust, et cetera, air quality. By allowing the increased hours of operation, the duration of any adverse impacts to the surrounding properties is also increased.
