my name is Henry Feldman I'm a member of the planning board uh Jesse our um uh esteemed chairperson is on the road so I will do my best to fill in and uh see if we can get this uh all moving along um okay that's the chairperson's remarks uh anyone on the board have anything to add uh there's one quick D comment that I'd like to add at some point okay um you want to uh do that after the public hearing yeah okay let's do that we're not going to do the minutes because there aren't three of us that were at that meeting here um no we have any reports from Members just your thing uh do we have any correspondents no correspondence okay uh that takes us to the public hearing for 14 Main Street um do I have a motion to I'd like to a motion to open the public hearing for the um the 14 Main Street proposal any second second that all in favor I okay um so let's move along to that um we have a notice of the public hearing oh read notice public hearing seeex oh beautiful okay um notice of public hearing please take notice that the planning board of the village of Cold
Spring will hold the public hearing pursuant to section 13416 d1g of the Village Law on Thursday February 13 2025 Village Hall at 85 Main Street in Cold Spring New York and Via video conference beginning at 7 p.m or soon thereafter uh members of the public are invited to attend the meeting in person or by video conference the planning board will consider the application of Renee fiser the owner is Twisted Gypsy llc at 483 miltown Road in Brewster New York uh 10509 the subject property designated 48 12-1 d-67 on the taex map is at 14 Main Street in Cold Spring New York and is in the B1 business district as well as the villages historic district the applicants propos a change from Office Space to retail reporting the site plan review for change of use section 13416 d1c and parking table section 13417 DM of the Village Law uh the application materials are on the website hard copies are available for review at the Village Hall written comment on the application can be delivered to the village hall or email to the Village clerk interested parties should check the Village website in case the connection details change the planning board will consider all verbal Andor written statements from all persons interested in the proposed application in the various maners described above the planning board will also consider
such further relief as it finds necessary uh this is by order of the planning board uh the village of Colts spring Jesse St Charles chair okay so we did that um has the um notice been timely published in the official newspaper has the applicant provided proof of mailing to C to affected parties with the re certified mail receipts submitted to you okay 26 main 15 main four fish eight fish here's the l oh okay okay looks like there's a whole bunch of them okay and um there is a list of them here uh which seems to cover it goes on West uh one on North all the way from from two main up to about looks like 25 M okay does that work for everybody uh affidavit ass signage signed by applicant receed okay Affidavit of mailing um K Marino says she's not a party section oh she served two copies of the not this is the public hearing scheduled okay oh so this is the person did the mailing okay good okay has the village clerk received any comment by the public whether in writing email or in person
no okay uh State Seeker determination for the record um type two okay so the board has and I think we we have previously determined that it's a type two under sequer and does not require any further environmental review uh okay um who's the applicant me okay so why don't you come and uh give us a description of the project uh you're more than welcome to sit here or sit where you are um and uh and if there are any changes uh that were U made since the last time you were with us um no changes since last time so the building is about 5,500 Square ft um there's two structures one on 14 Main Street one on 10 North Street um the building on Main Street the first floor is currently office space uh the second and third floor are residential it's a one-bedroom apartment um the apartment's going to stay um the two structures are attached by a breezeway um the entire first floor except for one corner office is proposed to be converted to retail uh the one corner office is currently rented and will continue to be rented the second and third floor off of 10 North Street um is currently rented as Office Space by Tim Miller and Associates they've been there for I think 22 or 23 years they're going to remain in that space um there'll be two entrances one off of Main Street where we would expect most of our uh customer BAS to come from walking um up and down Main Street there's also an entrance at 10 North Street which has a 16 um lot parking lot um we don't expect to use the parking lot much for the retail space but we've got ample parking
there um so the shop will be um a spiritual metaphysical shop it'll sell oils herbs crystals things like that books um yeah so that's about it so this is uh two buildings that are connected and so in the front building the one you see on Main Street that is going to be mainly the shop with a small office on the first floor and an apartment on the second floor and the back building doesn't sound like there's any changes associated with it well it's the the entire first floor so it's really the first floor of Main Street the Breezeway connecting the two structures and the first floor on 10 North Street um the off the current office that's rented and will remain rented as office Spas is on North Street okay okay um okay um and we have uh what we have very colorful sheet which is is very helpful yeah okay and ah this is good because I there was some so the retail there was some question when you were here as to the extent of the retail uh I guess that's West heading west so the retail gets the the storage and everything right okay and um okay um where is i that's okay I'll take it
okay so we have uh lighting where's ah okay so oh here's okay okay got it light fixtures dumpster parken yeah yeah so we all with the little lines okay could have been black lines but that's okay you knew what I'm saying like red on red I'm red green color blind and I can actually see him so yeah so yeah so we're I can actually see the lines um okay um good good signage do we have a we are aware that the sign uh regulations will limit us to approximately a 16qt sign and in sare oh okay I got you okay four by4 yeah four by4 give and they are still in the process of Designing a sign when that sign is it won't it we will not exceed the 16 you we will not exceed the code requirements and when the sign is designed we will take it to the hdrb for their approval okay perfect put the ETA on on that being ready you have a an idea oh we're currently finalizing the logo once the logo is finalized maybe maybe three weeks or so okay yeah good okay okay I like the we good and uh we have a couple of letters here from oh this is uh Tim Miller uh he's the one who has the office space and has okay so when when we were here before you last that they had not closed on the
property they hadn't closed on the property so Tim Miller was giving his authorization for Abigail to I'm sorry for Renee to uh deal with her application Before You by by the time we filed the follow-up papers The Building closed and the owner is now Twisted Gypsy so the letter from Tim Miller is IMM material at this okay okay sounds good thank you um and then um and then the letter from Isabelle you had asked for a further description of what um you know what the operation will be like and the the description of what they intend to do is contained in that letter okay do so the shop is actually known as I of raw right correct okay um I don't do I need to read this that's just the letter um from when the application was I read it okay and um and it's posted on the website oh okay great than the letter is posted on the website yes I took your description your name was supposed to show you the letter that you wrote no no she did yes okay um since all all of you seem to be involved in this uh I am Gathering you I'm guessing you we are here in support of the application do you have anything you want to say uh I am super excited to be a part of the Gold Spring Community I am I think it's going to be a really incredible experience for me as well as for the community I believe in building Community I believe in growing community
and their healing we can achieve that so I'm very excited I I love it have you done a business before is okay and where would so my business is um M and soul is how I started my business um and I taught all over the world um and now I'm ready for a home base and Cold Springs just seems like the perfect place good choice the food is um okay uh so anybody we have a couple of people online um uh is hav you going to unmute them and sure do you have anything uh Doug or Josiah J do you have anything you want to say um I am currently the owner of 12 Main Street my name is Doug cim so I was just interested I see that you had um put in here about the lighting was not going to change much anything would be downward facing on the front Main Street side um I have a rather large porch on the 12 main side um so I really appreciate that that's fantastic I thank you as far as the building goes it doesn't look like there's any changes uh architecturally or structurally so I do appreciate that also and as far as the business goes yeah fantastic uh we welcome it and so I was just sitting in and just kind of interested to hear what was going on so I do appreciate after reading the application that the intent is to be subtle and uh that's very much appreciated by us so thank you all thank you for your comments and just for the record the um code is uh speaks a lot
about uh having the lighting downward uh that your lighting can't uh go onto other people's property uh this is uh this is something important to the village and once again I do appreciate that thank you uh Josiah you have anything you want to say uh no comment thank you okay this is this is more just an advisory than a this is not a a dictate or anything but um if if I'm doing anything close to my neighbors I try and just run run the change by them just to sort of say hey um you ultimately will you know S as de code can can do what you like but it never hurts just to get some input from them so that that's and buy before you do it and you know I think Doug has just uh given you some very nice blessing so maybe just Consulting with him and and running the thoughts by him before you do it could could be nice enough to do absolutely thank you I actually have a a question for John as an owner of a property and if I have Bountiful parking spaces am I allowed to charge for spaces if somebody wanted to come in um that would kind of be up to the the building inspector whether that was transformed into a a new use where now the use is a uh private parking lot or something like that but um assuming that the the building inspector said it was not a separate use then I don't see why not okay we've met some of um the neighbors who and I understand that there's issues with parking um so to the extent that we can help with any alleviate some of their parking issues for sure love you that's the goal that's great fantastic um okay I think we have exhausted all of the people online and
in the room uh so um uh is there any comment from the board I think it's a really nice proposing yeah uh the uh the color coding uh was really nice no actually I don't want I want to go one step further and say that you've been really organized you've delivered everything we've asked for this is one of the slickest uh in a good way in a really good way this is one of the one of the most professional deliveries and sze deliveries that we've had that is what Tim Miller does so good job you know we really welcome you guys walking it through the process you should see some of the so uh can I get a motion to close the public hearing for 14 Main Street I'll make a motion to close the public hearing for 14 Main Street change of use Office Space to re retail all in favor okay uh so that's good um so let us uh vote on approving this I did prepare a draft resolution I don't think um you really need it so much to help you because this application is so straightforward but I'll just uh do we have to put anything about a contingency on the on on the the signage yeah so that's was just a condition that any sign um be appr by the hdrb which the applicant is already planning on doing so uh that's really not an issue and then uh the payment of escro fees which is a condition for every application so other than that there's really nothing special for this one and I think we've pretty much uh covered everything else that's in the resolution already okay um so we
can just uh the only thing I did want to mention actually was uh the floor plan I don't think it has a date on it if um you could just put a date on it and resubmit it it could be today's date uh next week when you get a chance just so we have uh something to to reference um okay so um anyone want to make a motion to approve the um I guess we're approving the resolution right oh well you're approving the the application so the the site plan application Cur the most recently submitted uh plans ah so make anyone want to make a a motion to accept the um the resolution um granting site plan approval for change of use I'll make a resolution for the um approve the the site plan site plan approval for the change of use of 14 Main Street and a second second all in favor I I okay beautiful there you go so what do we do now applications approved does anything need to be signed or yeah so um does Jesse need to sign it so I'll finalize the resolution Jesse will sign that at the next meeting and um they're good to go well right just have to make sure the uh the escrow is paid up and uh once that's taken care of um the plans can be signed by Jesse fantastic okay thank you so much sign block on something we have like the we have the survey and the floor plan what is he going to sign the survey both so he'll sign both and that's why we we need the date on the floor plan just so uh if if in the future somebody looks back they know exactly which one welcome
to okay um and so you wanted to chat about the DJ yes legitimately it's the nicest ver thank you so much um so I would like to just um add one more piece that I will I will um put in writing to Jesse and the piece will say um it's going to be um a section in in the djas in uh sort of addressing the executive summary so so not not section FL it will be the um executive summary operational and that is that the um um in terms of you know what Cold Spring should be asking in terms of taking care of its um operational expenses that it occurred to me that um if we're going to be having 12 to 24 trucks a day plus all the other vehicles that's going to possibly possibly most likely take um a tremendous toll in our roads and that there has to be some kind of compensation for that I can't imagine that it's fair for the theage tax Bay to where the where the expense of of wear and chair on structure it's not Petty that's a real thing six years of that there's going to be uh a real cost so okay and you said you you'll write this up I'll write it up but I wanted to St in the meeting so that it's um it's not it's not it's not me shooting shooting Jesse an email that it's it's been stated in meeting and that and that it's a legitimate piece of piece of our documentation is that correct jonan yeah right so it'll say nothing more than
that it's going to address the costs to wear and tear on the on the roads and or infrastructure based off of um Construction Construction vehicle traffic in the village dur during construction yeah and I think he had something on there about uh um also the ongoing impact on U on our services you know police fire right which when I mean when I looked at the their big giant document it it sort of came across like we spoke to them and everyone felt it was like no big deal right and it's like minimal minimal yeah everyone but then you talk to you know the you know we had the officer in charge and he's going you know we're stretched and so I think they they've lost over that so he had that in in his comments I think they using data from 2017 2018 and it was it was we say that essentially the wrong people otherwise it's great data yeah um okay uh anything else on that yes and it may be it is a move point but I wanted again to ask Jonathan just for example if somebody anybody came in and wanted to use uh Village property a sidewall at the street and say it's state federal who cares we don't The Village doesn't want to give that property up do they have right like eminent the main and they pull that I'm just curious that I'm not sure off the top of my head whether the the state could usurp uh Village property I'm not sure okay they have a lot of power when it
comes to uh exempting themselves from approvals uh but yeah that I don't know here's the lawyer not the lawyer but it may be worth just looking into home roll into what home R oh okay is that that's the right term is it uh the mici home rule law yeah so that yeah that kind of concerns The Village's sovereignty as a a village I have another question for you I'm so sorry because we have a little extra time unless you wanted to go somewhere no no no it's fine um when it came to and this is old business I'm sorry guys when it came to six badier right no no no no no I'm sorry it would have been Parrot Street and those folks who are having issues with the sewage and the water is it the the responsibility of the village to make sure that they've got uh a system or do they they as a homeowner have to connect to the system and pay for that yeah I that would depend on how the the line is set up I don't know if it's private uh connections that go to a village line in the street I'm not sure so I did see in the newspaper that the village is paying like five grand to get the line scoped oh wow okay yeah it's really expens stuff is really expensive oh sure they but the village is doing it and I didn't see anything about you know trying to get money out of the homeowners so that so yeah so the main line is going to be theill responsibility responsibity get getting getting to that home and if there's damage coming up off the village line then that's also the
homeowners that's typically the way yeah like I said without knowing how the line is physically situated in the road or in the yards or wherever it is but um the the village obviously is responsible for maintaining its lines very good thank you thank you for letting me answer free anything else I'm gonna send my wife a text message and she's gonna go wow you know so if it's another 10 minutes it's fine anything else I'm good good good okay um and and you sent another um um what what do you call oh me you're talking about me yeah okay just just point to me if you yeah the it was the the the Dr right I if you're okay with it I would rather that go till there's more of us here absolutely okay absolutely I guess I was feeling a little guilty that there's there's Jessie there it is Jesse with a wife a new baby a new job right and traveling on business and at 3:00 in the morning he can he can you know pen some beautiful document and I'm like like listen I can get this done before tonight's meeting I was I guilted myself so okay we have plenty of time to look at it make comments so um nothing else no motion to adjourn I'll make the motion to adjourn I'll second it all in favor all right thank you minutes one's a good one like the old days when we first
