OK. State your name. My name is Larry McKelvey. I'm representing my brother, John McKelvey, dividing a part of our family farm so that his son Samuel here can, um, build a house out there. My brother's, uh, couldn't be here. He's, uh, deployed with the Naval reserves. And, uh, so he's out of town pocket for still another month or so.
What relation is this? Any relation?
This is my nephew. This is my, my, my brother's son. And so what this comes from is our family farm out there. I'm happy to say August the 19th last month was 99 years it's been in our family. And we intend to next year in August to make that a century farm. We are currently in the process of, if you'll look up there, 1401, 1402 is my part of the farm. We both share halves of it. but we still look at it as the family farm. That's my part and the other part's my brother's part. We are currently working on agricultural conservation easement for this farm. So this portion of development or cutting up will be, we're doing this in sort of conjunction with that. Basically, this is the only development that's gonna be done on either of those two pieces. And we're hoping to have that finished up by November of this year. it's a agriculture conservation easement basically can never be subdivided after and no developments no cutting up or anything so we intend for it to stay a family farm with that being said our nephew here or my nephew this is Samuel McKelvey he lives in our community works out at the Air Force Base he's for years dreamed of building a house out there in the farm so my brother I mean, was all about it. Biggest thing, we had to get the approval of our daddy, and he finally approved. If you'll notice on this portion, what you're looking at, we're cutting off the southwest corner down here, and why we ended up going to two and a half acres is because that dark spot is a pond, so it's really not useful for much of anything, but to give him enough space to put a house and septic lines proper, matched with this survey it ended up being about two and a half acres i will take that bottom little corner out he's going to build a single family residence there he and his kids are going to move there um we're just uh keeping it in the family and then just you know doing it proper so he can you know, proceed with going to the bank and doing whatever he needs to do, and it'll be set aside. What generation will this be on the farm?
Samuel is the fifth generation that will be there. I'm the fourth. My brother's the fourth. And our father still lives there, James Hugh McKelvey. We still farm the whole thing. James Hugh McKelvey. Okay, you know, dad, most people do. But anyway, he getting his approval. I mean, the board is very important. And we got the rules to follow. But his approval was number one. And it I mean, us putting this thing into a conservation easement. We never wanted to see our place get cut up. It was given to us all as as a farmland. We intend for it to stay farmland not as a not as an asset. I mean, per se, but it will stay active farming.
Does it front on Stevenson Road?
It does have a frontage on Stevenson Road, yes, sir. So it meets all the requirements for a subdivided lot. There's water access there. There's power access.
I think it's a six-inch water line down through there, correct?
Yes.
I think that when they put that last partition in, that was a six-inch.
That was something I... Well, Hillsville, I hadn't been out there, and when my mother-in-law built the house about 10 years ago, we went asking them, and I went through the community and talked to everybody, and they said, you've got 20 people. Yeah, we'll bring some water out there.
Yeah, I think the county, that mandate, that would be a six-inch water line.
The fire hydrant is less than half a mile up just at the very, at Stevenson Road and Highway 41.
You know that the property will purge.
yes i mean it's that the portion there that goes all the way back to that fence line is is is on a hill and uh has a nice slope to it so anything i can answer anybody else like that any questions anybody got anything for anybody else have any comments any other comments to the community or community

Well, being that it's going to stay in the family and they're putting it all, I mean, the rest of it's going to be taken care of for, you know, forever. I make a motion that we do that, that it's causing no, for number three, access and infrastructure. All the lots have direct access to that. And number four, there's no adverse impact to the community because just about every bit of it that surrounds that belongs to the family farm. Yes, sir. And it doesn't negatively affect the neighboring property values. In fact, it would probably raise the property values.

My name's Tamara West, and I just bought Lot 12, which abuts the rear end of that property on Newt Menasha. And we are trying to understand there won't be access for them there because I'm going to have a gate there, and that property does not touch Newt Bonaccia. Is it that lot there in blue? Yes, ma'am. I currently live on Newt Bonata Road. the and that right there that was whenever my house was under construction okay i wrote out something i'm todd ray i reside on new veneta road just adjacent to the parcel of land that is in question this evening i understand the desire to gift and or provide land to a child or family member however i feel that due to the county restrictions the current owner of the property should have to build and reside on the property before being able to gift a portion of the land to be able to split it up into two tracks. Having plans to build and a gift to part of the land actually are two different things. I feel like plans can change once the two pieces are separated, what oversight is there to be to enforce the child and the father being able to build on that piece of property other than just being sold for a profit. It's kind of counterintuitive to the five acre minimum restriction currently in place if that's not what ends up happening. I just feel like maybe it should be addressed later on down the road. Let the person that actually owns the property build their residence first. After that, and it becomes their primary residence, then I would completely understand gifting or whatever arrangements they make amongst the family for the three acre minimum. But once the land is split, there's no oversight after that. Well, I understand. If approved, then what would prevent anybody from purchasing land in A1 Agriculture Zone and saying they want to split the land in less than five acre tracts for a family member and or child, whomever it may be, and not do what they're actually intended or said they were going to do? I also say that there's not water or electricity on any of those lots in the middle there. I fought with Hillsville Utility District for over six months just to get water to my house.

There is to mine, but I had to run it from Miller's Crossroads. And then the next person that's going to speak, he lives on the corner lot there of Newt Venati and Baines Road. and then he had to tie off of my line coming from Miller's Crossroads to get water to his residence. And I can tell you that the three tracks that was previously discussed on Baines Road, there's no electricity and or water that whole area, or these five-acre tracks that are on Newt Van Addy, none of them have water and or electric on those properties either. Okay. I don't know the size per se. I think it was, I can't remember if it was four or six, to be honest with you.

And then it stops right past my house on that end, but from Baines Road. The house on the corner, which the owner of that is here with me tonight as well. This one? No, the corner. Yes, that one right there. He had to tee off of that to go under the road to tee off because he was unable to get water from Baines either.
But is that a Healesville water line or is that a personal water line?
It's Healesville. Okay. And then Mr. Campbell that resides across the road, he owns the water line on his side. He had to actually pay to have it put in himself from Miller's Crossroads. Like I said, I completely understand wanting to leave property and or, you know, split for a child. I completely understand that. But I just feel like, you know, The primary owner of the property should build or do some construction there and or before allowing to cut a piece of property off.
Well, with that piece of land being nine acres, there's no way to divide it. They would have to come here anyways, whether the father would or whether the son. I completely understand that. Because there's no way to get ten acres or two or five acres. I completely understand that.
I was just saying the fact that, you know, like I'm not against splitting pieces of parcels and giving it to a child. You know, I have children. So I completely understand that. It's just that I feel like, you know, What oversight is there after the fact if their plans fall through? Then now you have two pieces of property, one that doesn't go by A1 zoning currently in Coffey County. And smaller tracts sell for more per acre, so there's a profit margin there as well. I agree.
Well, if I could say that he bought this before this five-acre minimum went into effect. I understand that. Yeah, I'm aware of that. Oh, yeah. I'd already started construction before that.

They're going to sell the house at the front. My name's William Golston, and I'm speaking for my wife, Nancy Golston. We came in last month and asked some questions about this variance. You gave us some direction to get a survey. We had Mr. Norcutt come out and do a survey for us. These are two pre-existing houses, been here, one of them since the early 60s and the other one from the mid-70s. Septic system, everything's established. He conducted a survey here. We split these two acres into one acre lots and have an easement that goes along the existing driveway. And you can see on there where the septic tanks are and the easement. And it meets all setbacks as far as I understand.

Your son's going to live in the back? He currently lives in the back, yes, sir. We've had both our sons live back there.
We talked about this one last month.
Yeah, this was my wife's old home site.
She grew up there and lived in both houses. Yes. This is the one that we deferred to this month.

And the reason they want to do it is their target city life. Can't blame them for that. And what they're looking for is to start a little homestead. They want to start raising their own food. We have no city water. Long story short, when I first moved there, Hillsville said, yeah, we got you some water and bought me a little flag, and I was happy to know that I had a well there. Well, he come out the next day and told me, get my money back because we don't have water out there.
How are they going to get water in this?
Well, if I don't dig in a well. Is there an existing well there? I have a well on mine now, and it has no problems. Never has even hinted at going dry. And it's only 47 feet deep, I think it is, for the water table.
So they're going to share your well or are they going to bore a well?
They're going to drill around. Okay.
The question I have about that is your safety clients, can they be far enough away from the well?
Yes. The well is located. From the well they dig. From the new well. Oh, from the one they dig? Yeah. Yeah, they've got plenty of room to dig that. We haven't mounted that out yet. But they have plenty of room away from where the septic can go. Because they plan on building towards the lower part so the well can be back this way with no problem. I don't know. That is a question I do not know.
So what would happen if they didn't hit water?
If they didn't hit water? Mm-hmm. I can imagine if we had to, we could go off my will.
Is there still a standard for the minimum lot size for a will and septic?
I don't think. I'm texting Kurt right now, so he would possibly know.
You know how big a house they're wanting to build? They're just going to build like a, it'll be about 1,000 square foot. It's just going to be like a barn of medium. It's just two bedrooms. Two bedrooms at the most because it's just two of them.
250 feet of field lines and septic tank. Yeah, 250, 275. And they're building off of that corner kind of so they'll be off the road.
Well, I'm sitting on a well and I've got one too, but I've got city water also.
Well, the thing about that area there, city water comes just over the side of the creek over there. And so did Ben Lohman. I believe it.

These restrictions specify one home per tract and describe expectations for buildings, fencing, et cetera. After reviewing the application for variance, it appears incomplete. The required document showing a sketch plan of the site to include drives, parking spaces, et cetera, were not submitted. We don't know if access is coming from C. Anderson or Fredonia. No mention was made of the pond or infrastructure for the second lot. We think that affordable housing is not a valid reason to grant this particular variance. Thank you.
