um i've seen you report last week uh if you've got any questions i'm you know all ears on what input you might have we've looked at a lot of different options um and what we're presenting you today is a continuation of a existing sales tax that was going to fall off the books next year um these guys can talk the finances a whole lot more than me but given the options that i see it's the least impact on our community um and doing nothing isn't an option I think at this point. That's really the biggest takeaway I was trying to get through with report I sent all you is, you know, there's a good 30 months of work. Like if we started September 1st on the engineering design, this overhaul won't be done until January 1st, I think, 2029. So there's quite a bit of work to do. Some of that we're still coming up with contingencies. The pump station, number one, where everything in the sewer of the city flows into and the pump house are my two main concerns. The pump house is kind of like the heart of it that's able to push and pull everything through the system or the point that we've got. So it may be kind of engineering a little bit of construction to make sure we address the big things and then Those are the two that worry me. But that's really the big thing. This thing was in 1983 is when it went into service. So we definitely got our money out of it, but it's time for a new one. And the reason I'm asking for the whole amount instead of just some patchwork is utilities got to look long-term. you know, if this is going to be here another 30 or 40 years, we can't build back to the capacity we have, we need to expand it. So with that, I'll leave this open to questions or other things we want to talk about anything.
And I think it's important to mention that in your report, didn't you put some information about if we do fail, what kind of fines we would incur?
Yeah. So, I mean, it's no different than what Fort Smith went through 10 years ago. What they're going through now. Yeah. Well, what started that long ago, I guess being under a, you know, if, If we fail our mission on just the environmental impact of it, the EPA and the state will be telling us what we do rather than us fixing the problem now. So that's kind of why I'm saying there's really not... doing nothing's not an option, but I mean, I think Fort Smith has paid something like 900,000 in fines so far, and they were told to do $800 million in upgrades to their system. Now we're smaller than them, but it's still be significant and it'd be much more facing the emergency and being told how to do it rather than us doing what needs to be done.
Where's Morgan at? Morgan, I know you and I have had some conversations. Can you share what a consent order, what that actually means and how it plays out on the ground?
and why you know when i said my state the city that there's no greater threat in the city than our sewer sewer system right now you're about to hear what potentially can happen if we don't address it yeah so um like we're saying whenever you are doing your reporting they're required to do mandatory reporting to the epa health department on performance of their system whether it's overflows and also plant performance There are certain thresholds that get triggered as, okay, you need to start taking care of this, taking care of this. If it's not addressed, then you will start getting fined. At some point, you either make the corrections and enter into what's called a consent administrative order, where you are agreeing to make certain improvements within a certain time frame. I'm speaking from being in Hot Springs. We had to deal with a pretty extensive CAO down there with the sewer system. They'll lay out what the improvements are and you're going to say, yes, we'll do them. And then you have to come up with funding and it's either going to be the rate payer or taxpayer, depending on your funding sources. And just basic math will tell you the rate payer. It's going to be really expensive is if that's who you're collecting the revenues from to make those improvements. But you know what, what they're trying to do is head off that CAO. And you're on a timeframe. You have performance measures that you have to meet. we would meet with the health department regularly on our progress on even the design aspect. And on top of that, we had internally to create some new divisions for ini to track down on our collection system any kind of infiltration and inflow to limit storm activity and storm infiltration into the storm sewer system it was it wasn't quite doubling the the department but we had to buy extra equipment vehicles hire extra people just to keep up with the I&I portion and then the collection system improvements in addition to the plant, which I'm sure they'd probably need collection system improvements on top of the plant because if that's ignored and not addressed, that's why you get so much inflow during storm events. But it's something you want to avoid at all costs. And if they're at that point with their reporting, it needs to be corrected prior to having to deal with any state and federal agencies.
I know that some of us started trying to address this back in 2020 from COVID. They've done a good job so far, particularly showing interest in it and moving forward with it. I've got to ask the elephant in the room question that everybody's asked me.
I'll let you finish. One more thing. This was back in the late 90s. timeframe and we were part of our agreement was to perform a $60 million plant improvement. So that was back in the nineties. And then I can't remember the exact number on the collection system, but it was pushing 30 to 40 million. So we had to agree to perform. It was, if I remember right, it was a little over a hundred million dollars in improvements at that time.
Well, council, I'm going to ask, I don't know, you've probably been asked this question. I'm going to ask him point blank publicly. Yeah, we've been talking and we've been hearing all this good stuff about the data center and how they're going to invest in our infrastructure. Why are we not waiting for that?
The state of the plant, I mean, the pumps that I'm talking about, the equipment we've got here, the first time we had a pump go down since I've been here, we went back to the manufacturer and they told us, we don't have records of ever manufacturing that motor. We can't help you. That's how old it is. Yeah. And that was just one part. I mean, we've got a gearbox leaking oil that there's no replacement for it. We're just going to keep putting oil into it until we get a new one. And that's where this project comes up. I could say all of our systems could use some help, but this is the one that worries me. Like, yes, the sewer system needs some improvement. Electric's kind of tapped out. We can't really grab any new customers. five words, fiber is its own thing. I'll leave that one alone. Um, but they're all, I mean, none of them are going to fail tomorrow. I don't want people to be afraid that like, Oh, CCU is doomed and this and that it's not that, um, Portia, All of her folks, they're doing a really great job of just keeping this thing going so that we've got time, you know, to address this issue. And I think it's soon enough that we're not going to run into consent decrees. It's just a matter of timing. You know, I'm not seeing any new revenue from the data center for another two years. That's more than halfway into the project if I start right now. So it's something we got to do now. Now on the back end, Revenues, maybe that helps pay down the bonds sooner. That'll be something we'll look at when we get to that point. I'm just trying to address the emergency on my lap. And then however best to take care of the community and the funding of it. That's kind of why I'm here in front of you guys. addressing this to you officially first because, you know, whether it's any of the options open to me, I need you and the public's input because, you know, without that, I really don't have anything to bring back to the commission. All of this falls under city council's authority. So that's why we're here today.
Is this what the commission recommended?
um i've been keeping them informed with the different options but really it's uh um you know the three that i've seen this is the one that uh i feel like is the best fit and what i would be recommending them to approve but I haven't officially brought it in front of them. They're just as informed as you all are. But it's kind of a timing thing. If the sales tax is to be put on the public ballot for November, the cutoff's August 25th. And your meeting falls before our meeting this month. So it's kind of just a timing thing, too. Mr. Mayor, may I ask a question? Absolutely.
Kind of like the mayor asked, the other, I guess, elephant in the room that I would like to ask, is any of this improvement required or being forced upon us by the upcoming data center?
No. No.
This system that we started using in 1983 is basically just wore out, tapped out, and it just so happens to fall at the same time we're getting a data center. There's nothing corresponding the two together.
No. Just for the record, 1983 is not that old.

I want to talk to Gordon and Paul a little bit about the numbers and see. Thank you. This council is this close to retiring a tax and being the first council in modern memory to retire a tax. That's no easy thing to give up. That's how important this is. But I publicly want to see the commitment that when those revenues do come in, to the utility that they can be used to pay this debt off and retire this tax because that was we're this close to getting it done and we're getting all this money from the data center that needs to go to pay this bond off and get rid of this tax or at least 75 percent of it right because a quarter stays on forever paul yeah yeah
Well, thank you, Mayor, members of the council, and just maybe a quick reintroduction. It's been a couple of years since I've been in front of you, but I've spent roughly the last 30 years over at Cruz working with all types of different municipal financing vehicles and what have you in this county alone over a couple of decades' worth, including working with the city and the college and the hospital and the county. We've had a lot of good success and transactions here. And it's always been a pleasure working with this group to address kind of where we're at with the sales and use tax bond issue. Maybe a little bit of history makes sense here. So and I was involved in the, in the original tax here. So this, this dates back to 2011. And at that particular point in time, the voters approved a three quarter percent sales and use tax. What I call in my world, kind of the temporary tax or the bond tax. And then at the same time, there was a quarter cent permanent tax approved for certain lawful purposes, public safety and some other things. so as far as the three-quarter percent it's never been allowed to escape for any other purpose than to make those debt service payments and to prepay the debt so as tax revenues have grown the prepayment of the debt has accelerated right so it's been a nice a nice thing so taking advantage of that if you will in 2021 There was a transaction that took, there was no new taxes or anything. It was those same three quarter and one quarter. Went out and did a $12,715,000 not to exceed along with the refinancing and using those same funds. Now you could have borrowed more at that time. There just wasn't a need. So maybe that's a good thing today.
What was the interest rate on that?
um i'm proud to say i believe that was less little less than 190 i remember that's right so 21 was a good year for the rates in terms of that but um yeah that was a great transaction for the city um but so is this conversation and the need that eric's expressed there um it led to a further uh conversation and consideration of could we do something similar to what we've done in 21 and the answer is yes uh no new tax Um, that quarter percent that's always been there has never been used for any other purpose other than what the voters lawfully approved to use this for. Now it is approved to pay debt service. If the three quarter percent is not enough, that's never happened because we begin the transaction with a little bit of margin and three quarter. Cause I don't want to hear somebody saying we had to use part of our quarter this month. Awesome. So we make, we, you know, we are, we're conservative and we're safe and putting all that together. So it's always worked exactly like we said. Um, so in this particular case, as the mayor alluded to, you, you could, uh, you could sit here and do nothing and you're right. Experience that tax roll off, right? The quarter's still going to be there, but that could roll off or you could, um, re-ante up if you will and use the purchasing power that's available to you now through the existing revenue streams and do this project and there's a separate one in the ordinance for some additional improvements and there also is a refinancing question in there With the growth that y'all are seeing in the recent monthly collections, it's possible that refinance question won't be anywhere close to the, I believe it's $3,250,000. I don't remember what that number is. $1,450,000. Yeah. So, you know, it probably won't even be that much if y'all keep doing what you've done the last couple of months. But that doesn't matter. It's still a question. We can't do the $35 million project, if you will, until... the refinance pass. So if the refinance doesn't pass, then it's still pledged to the bonds that were done in 21, right? So it kind of eliminates, if that one doesn't pass, it eliminates anything else. So that's why you would be looking at, and he drafted it, so if y'all got to have him read it, that's fine with me. So it'd be those three questions, the refinance, which again will be a nominal amount, it'll be for the wastewater improvements and then for the parks so just to explain how we're designing it and setting up maybe go to the other point you were raising there is that you know we're going to generate this amount of dollars we're going to end up out with a stated final maturity, probably real close to 30 years. I put it at 30 years. Now, again, we're going to have some margin. It's going to prepay. So just to tax collections now, um, we would expect it to prepay with no growth or no decline four years faster. And then if revenues come in, I think what you were referring to revenues that the utility would have separate and apart from the tax, um, would be of course at their discretion we wouldn't necessarily force it into the bond documents because i don't know what those revenues are supposed to be but once we reached a particular anniversary date of the bond issue if it passed and we reached we you know let's just call a date four or five years into the future that seems like that might work for the timeline and to that particular point we could have them you know the call provision in there could be from revenues from any source right so if somehow there was revenues from a source that are not these taxes it would be available for that purpose so but it would be optional right right so not mandatory or anything so um Happy to answer any specific questions about numbers or anything.
Like I said, I go back. See what he needs from most of them. Can I ask a question?

I noticed that there's question one, question two, question three. Question three is about the parks and rec improvement. Do we have to have that part in there?
Yes. include these these three questions and it's up to the community they can vote it down they can say no it's an inclusive playground splash pad built there beside the inclusive playground in clinton park the veterans memorial park there at the old bus barn this is a snapshot of it and then carcel rodeo arena and the reason i ask is because we've talked about we need to
think about the fire department in trying to help them get a little bit more help and we have I think not enough staff to staff all of this so that's a question of my capital outlay funds versus budgetary funds when the data center revenues come in and we have budget we can do staffing with that would be great
We have money to spend on things we don't have money to spend on staff. That's a forever commitment. Until the data center funds come in, the utility revenues go up and we collect that 5% from them, then we can look at staff for sure.
I just don't understand why we would add some more projects without having the staff to take care of them.
We do have the staff to take care of them.
I hate to see it. We're throwing a splash pad and something else in here at Rodeo Arena when we've got three Rodeo Arenas in the area. I objected to this last time that we brought it up. I think we need to just have the sewer project on the election. I agree.
So why don't we let the folks decide what they want to really go around or let the real boss decide their own. But they'll make the decision.
That's going to be my thing is, oh, oh, is that they want it? What is the reason? What do we really need? And the need that I see is that if there's. Yeah, that's the real need that that other stuff can come. later because if you get it now it's adding to the sewer problem but and that's just my personal opinion and i i worked with this company 35 years and i knew how bad it was and that's just how i feel about it i think we ought to take care of ccu on this sewer deal and let me and let the other stuff come later on it ain't like it can't and much as i love kids to have this better thing but i think that's the most important thing right now
Well, I don't want us to get confused in that we're making the decision to do all this. We're just making the decision to put it in front of the voters to let them decide to give us direction.
Yep. I mean, we already have the maintenance fund for the baseball field, so that's taken care of. Splash pad, we run it from June, May to like August, five, six months, about 30,000 a year. That's in the budget. There's not much maintenance staff-wise for that. The veterans memorial? one-time purchase and then some recycling water, very little cost. But when we start adding the veterans' names and those bricks on the wall on Cherry Street, then next thing is to put horseshoe pits there. You brought life to a whole dead part of the city right there.
Let me add one thing because I think it was clear, but just go ahead and say it again. I connected earlier the refinance to the other questions because that's the pledge that now secures the bondholders and the bondholders are going to keep that pledge until those bonds are refinanced.
but i'll let gordon address this with regard to the other questions but they they are standalone what's to say that we're going to have a water problem in two or three years that we're going to have to spend 20 or 30 million dollars that's what i'm trying to get at you know uh let's do this let's do this project here and then Later on, we may have to do a water project or something else.
Later on, they'll have the funds come in. That's what you were saying earlier.
I just wouldn't want the voters to be confused and vote down our wastewater treatment part just because they don't want these other things. You see what I'm saying?
I think voters are pretty smart. They can figure out four things to vote on. They can vote yes on one or no on the other. It's not one or all.
pretty smart let's look i say you let the voters decide that's my opinion it was gordon well as paul said question one has to pass or it doesn't matter whether anything else passes but you know at that point it's if it passes then whatever else passes that's what you're directed to do i think paul ran the numbers you have about 40 million dollars of new money borrowing capacity that's about what you can do you know under the current tax you know without raising anything
But what's to say in two to three years, we don't have a water problem that we're going to have to have water.
You do a pledge. You do a revenue bond through their revenues.
We're going to have to vote on it again. No, that would be a utility revenue bond.

If it wasn't a sales tax, you wouldn't have a vote. You guys would just approve a revenue bond issue. you know you usually i think as paul alluded these things have about you know four or five years of call protection you know where you can't pay them off except from excess tax collections until that point but that sounds like that timing might work pretty well for you when you would really have significant funds to start paying these down what do you need from the council tonight well this just like any other ordinance you know you've got to approve this election ordinance to send it to the county election commission got to be done last possible date is august 25th to be on the november ballot so really just you know to do the three readings and and pass the ordinance. There is an emergency clause on this because the action that has to be taken immediately is to send it to the election commission.
OK. Ms. Lisa, we kind of did that backwards. Do you want to go ahead and read this ordinance for us?
ordinance calling and setting a date for a special election on the questions of the issues of sales and use tax refunding refinancing bonds and sales and use tax capital improvement bonds for the purpose of financing various wastewater treatment plant and parks and recreation facilities and improvements living replacement temporary local sales and use tax with the rate of three quarters of one percent will pay debt service on such bonds which tax they'll cease upon retirement of the bonds prescribing other matters pertaining thereto and declaring emergency Whereas Title 26, Chapter 75, Subchapter 2 of the Arkansas Code of 1987 annotated the Municipal Sales and Use Tax Act in Title 14, Chapter 164, Subchapter 3 of the Arkansas Code of 1987 annotated the Local Government Bond Act, each authorized the levy of general citywide sales and use taxes of up to 1%. in increments of one eighth of 1%. And whereas Amendment 62 of the Constitution of the State of Arkansas, Amendment 62 in the Local Government Bond Act authorized the issuance of bonds by cities to finance capital improvements for the public nature, which bonds may be secured by the pledge of I or all a portion of the receipts of the general citywide sales tax and use tax prescribed by the Municipal Sales and Use Tax Act and to of all the receipts of special citywide sales and use tax prescribed by the local government bond act and was pursuant to amendment 62 the municipal sales and use tax act and the local government bond act the city of clarksville arkansas the city is previously issued and their present presently outstanding its sales and use tax capital improvement and refunding bonds series 2021 in the aggregate principal amount of three million two hundred fifty thousand dollars the prior bonds And whereas the prior bonds are secured and payable from A, all the receipts of a temporary three quarters of 1% citywide sales tax and use tax, the prior tax levy pursuant to the Local Government Bond Act. And B, all the receipts of a permanent one quarter of 1% citywide sales tax and use tax of 0.25% permanent sales and use tax levy pursuant to the Municipal Sales and Use Tax Act. And whereas the City Council has determined that there is a critical need for a source of revenue to finance design, repair, rehabilitation, modernization, and upgrading of the city's wastewater treatment plant, together with related wastewater system improvements, the wastewater treatment plant improvements. And whereas the City Council has determined that there is a critical need for a source of revenue to finance the acquisition, design, construction, equipping, and furnishing of various park and recreation facilities, and improvements related thereto or in support thereof, including but not limited to a Veterans Memorial to be located at Cherry Street Park, a splash pad complex to be located at Klein Park, and the conversion of the existing baseball field at 1619 West Klein Street into an event center, Rodeo Grounds Campus, in which may include concession facilities, restrooms, playgrounds, and other ancillary improvements such as street and utility extensions and improvements, fencing, lighting, shade structures, landscaping, and parking for each of the foregoing projects, the parks and recreation improvements, and where the city council finds a temporary source of revenue will be needed in order to provide for the financing of the wastewater treatment plant improvements and the parks and recreation improvements. And whereas if approved by the electors of the city, The city is determined to issue one, it's refunding bonds in principle amount not to exceed $1,480,000 for the purpose of refunding in redeeming the prior bonds, the refunding bonds. Two, it's capital improvement bonds in principle amount not to exceed $37,500,000 for the purpose of financing the wastewater treatment plant improvements, the wastewater treatment plant improvement bonds. And three, it's capital improvement bonds in principle amount not to exceed $5,450,000 for the purpose of financing the parks and recreation improvements, the parks and recreation improvement bonds. which refunding bonds, wastewater treatment plant improvement bonds, and parks and recreation improvement bonds are to be equally and ratably secured by pledge of and lien upon A, all of the receipts of a temporary three-quarter of 1% citywide sales and use tax, which 0.75% temporary sales and use tax shall replace the existing prior tax securing the prior bonds, and B, all of the receipts of an existing permanent one-quarter of 1% citywide sales and use tax, the 0.25% permanent sales and use tax, all as authorized by Amendment 62, the Local Government Bond Act, Municipal Sales and Use Tax Act. And whereas the net receipts of the 0.25% permanent sales and use tax will be utilized by the city for the payment of scheduled debt service on the refunding bonds, the wastewater treatment plant, improvement bonds, and parks and recreation improvement bonds, if their issuance is approved by the electors to the extent needed after application of the net receipts of the .75% temporary sales and use tax for such purpose. And whereas the purpose of this ordinance is to call a special election on the issuance of the refunding bonds, the wastewater treatment plant improvement bonds, and the parks and recreation improvement bonds, collectively the bonds by the city and for related purposes. Now therefore be it ordained by the city council of the city of Clarksville, Arkansas, section one that under the authority of the amendment 62 and local government bond act and subject to approval by the electors of the city of question one, in either question two or question three all has set forth in section four below they're hereby levied one a sales tax at the rate of three quarters of one percent on the gross receipts from the sale at retail within the city of all items and services which are subject to taxation under the arkansas gross receipts act of 1941 as amended arkansas code of 1987 annotated 26-52-101 at sec and two and excise or use tax at the rate at three-quarters of one percent on the storage use, distribution, or other consumption within the city of tangible personal property or taxable services. Subject to taxation under the Arkansas Compensating Tax Act of 1949 is amended Arkansas Code of 1987, annotated 25-53-101 on the sale price of the property or in the case of leases or rentals on the lease or rental price collectively the .75% temporary sales and use tax. The .75% temporary sales and use tax shall be levied and all the net collections received after deduction of the administrative charges of the State of Arkansas and acquired rebates shall be utilized only for the payment of debt service on the bonds approved by the voters. The .75% temporary sales and use tax shall be levied and collected only on the gross proceeds or sales price in the maximum amount allowed from time to time under Arkansas law. Subject to rebates and limitations as required for certain single transactions as from time to time required by Arkansas law. A levying collection of the .75% temporary sales and use tax shall commence on and a such date is provided in the local government bond act and shall cease upon retirement in full of all the bond approved by the voters. Any collections of the prior tax received after the issuance of the refunding bonds described in question one or any other excess collections of the prior tax shall be used to provide for the payment of debt service on those bonds approved by the voters. Section two, that under the authority of Amendment 62 in the Local Government Bond Act and subject to approval by the electors of the city of question one and either question two or question three in section four below, there is hereby authorized One, the issuance of the city's refunding bonds in the aggregate principal amount not to exceed $1,480,000. The refunding bonds for the purpose of refunding and redeeming the outstanding prior bonds as described in question one under section four below. Two, the issuance of the city's capital improvement bond in the aggregate principal amount of not to exceed 37,500,000, the wastewater treatment plant improvement bonds for the purpose of financing all or a portion of the cost of the design, repair, rehabilitation, modernization, and equipping of the wastewater treatment plant improvements as described in question two under section four below. And three, the issuance of the city's capital improvement bonds in the aggregate principal amount not to exceed $5,450,000, the parks and recreation improvement bonds for the purpose of financing all or a portion of the cost of the acquisition, design, construction, equipping, and furnishing of the parks and recreation improvements is described in question three under section four below, if approved by the electors. of the city and issued the aforementioned refunding bonds, wastewater treatment plant improvement bonds, and parks and recreation improvement bonds. Collectively, the bonds may be issued in one or more series from time to time and aggregate principal amount not to exceed the respective principal amounts approved by the city's electors. Any bonds so issued shall be secured by a pledge of and a lien upon all the receipts of the .75% temporary sales and use tax and all the receipts of the .25% Permanent sales and use tax is authorized by the Local Government Bond Act. Section 3, that there be, and there is hereby called a special election to be held on Tuesday, November 3rd, 2026, at which election there shall be submitted to the electors of the city the question of the issuance of the bonds. Section 4, that the question shall be placed on the ballot for the special election and substantially the following forms.

Special election on bond issuance. Upon the approval and issuance of the refunding bonds defined in question one below, and either the wastewater treatment plan improvement bonds defined in question two below, or the parks and recreation improvement bonds defined in question three below, collectively the bonds, the city's existing levy of a three-quarter of one percent citywide sales and use tax the prior tax securing the prior bonds defined in question one shall cease and such tax will be replaced by a temporary three quarters of one percent citywide sales and use tax the three quarters percent temporary sales and use tax the net collections of which remaining after the state of arkansas deducts its administrative charges and after required rebates will be utilized solely for the payment of debt service on the bonds approved and issued The levy and collection of the three quarter percent temporary sales and use tax will commence on and as of such date as provided by Arkansas law and will cease upon retirement and full of all of the bonds approved and issued. The net collections of an existing one quarter of one percent citywide sales and use tax, the one quarter percent permanent sales and use tax remaining after the state of Arkansas deducts its administrative charges and after required rebates will be utilized for the payment of debt service on any bonds approved by the electors in questions one two and three to the extent needed after application of the net collections of the three-quarter percent temporary sales and use tax unless question one and either question two or question three described below are approved none of the bonds will be issued the three-quarter percent temporary sales and use tax will not be levied and the prior tax will remain in place until payment in full of the prior bonds Question one, refunding bonds. They're submitted to the qualified electors of the city of Clarksville, Arkansas. The question of the issuance of refunding, refinancing bonds in principal amount not to exceed $1,480,000. A certified copy of this ordinance shall also be provided to the Director of the Department of Finance and Administration and the Treasurer of the State of Arkansas as soon as practical. section 7 that the results of the special election shall be proclaimed by the mayor and his proclamation shall be published one time in a newspaper of general circulation within the city the proclamation shall advise that the results as proclaimed shall be conclusive unless attacked in the circuit court of johnson county within 30 days after the date of publication of the proclamation section 8 that the mayor and city clerk foreign on behalf of the city be and they hear by are authorized and directed to do any and all things necessary to call and hold the special election as hearing provided and at the issuance of the refund funding bonds and either the wastewater treatment plan improvement bonds or the parks and recreation improvement bonds described herein is approved by the electors to cause the three-quarter percent temporary sales and years tax to be collected in accordance with the local government bond act and to perform all acts of whatever nature necessary to carry out the authority conferred by this ordinance. section 9 that the city considers this ordinance to be its declaration of official intent to issue the wastewater treatment plant improvement bonds and the parks and recreation improvement bonds and to make reimbursement with a portion of the proceeds thereof for all original expenditures incurred in the design repair rehabilitation modernization and equipping of the wastewater treatment plant improvements and the acquisition design construction equipping and furnishing the parks and recreation improvements between the date that is 60 days prior to the date of this ordinance and the data series of bonds issued for such purposes plus the de minimis amount and preliminary expenditures as such terms are defined in section 1.150-2f of the federal income tax regulations Further, in the event that the issuance of the wastewater treatment plan improvement bonds is not approved by the voters, the City considers this ordinance to be its declaration of official intent to make reimbursement with a portion of the proceeds of a series of revenue bonds for all original expenditures incurred in the design, repair, rehabilitation, modernization, and equipping of the wastewater treatment plan improvements between the date that is 60 days prior to the date of this ordinance and the date that a series of bonds is issued for such purpose plus a de minimis amount in preliminary expenditures as such terms are defined in section 1.150-2F of the federal income tax regulations. Section 10, the QTAC ROC LLP is hereby engaged as bond council and crews and associates Inc is hereby engaged as underwriter with respect to the issuance of the bonds. The fees and expenses of bond counsel on the underwriter shall be a cost of issuance of the bonds to be paid with bond proceeds. Section 11, that the provisions of this ordinance are hereby declared to be separable, and if any provision shall for any reason be held illegal or invalid, Such holding shall not affect the validity of the remainder of this ordinance. Section 12, that all ordinances and parts thereof in conflict herewith are hereby repealed to the extent of such conflict. Section 13, that it is hereby ascertained and declared that there is a critical need for a continuing source of revenue to finance the wastewater treatment plant improvements and the parks and recreation improvements, all in order to promote the health, safety, and welfare of the inhabitants of the city. It is therefore declared that an emergency exists and this ordinance being necessary for the immediate preservation of public peace, health, and safety shall be enforced and effect immediately from and after its passions.

However, my concern is in about seven to nine years from now, when all these workers have left, We're going to have these RV parks all over the city, and they're going to look like used mobile home parks. That is my chief concern, and my direction to the planning and zoning is to make sure that our standards, make sure when there's nobody there, it upholds the neighboring beautification. We don't... No, the corner down there past where this is going is not where we want to be. We've hired Linda George. We've worked hard for seven years to clean up the blight in this city. We're not going back to it. And my biggest concern is that in seven to nine years, they leave us with these eyesores all over town, and we don't want that. So, yes, sir, will you introduce yourself?
This property, it's 100 RV spots that we're planning on putting in a clubhouse and also another bathhouse with a pond. The client's not wanting it just for the bath center. It's down the road. They wanted to have that there's more RV spaces for people that's going to do in the park also. And so they're putting this in for long term. It's not a short term. We do it for a while. Once the data center's completed, it's over. We're going to shut it down. Just speaking to your questions, you cannot put a residential building or anything that's being occupied barcodes and everything that we don't have anything within a hundred feet of that gas wheel where it's going to be somebody's real estate and so I did the design on this and went and thoroughly reviewed all ADH regulations other regulations pertaining to the gas wheels and other stuff to try to make this nice The landscaping requirements for the city, adding landscaping trees to the perimeter, making sure that we're going to be far enough off of people's property lines. It's not going to be at the blight that you're concerned about.

The City of Clarksville has heretofore adopted a zoning ordinance and official zoning map to guide and influence the allocation and arrangement of land uses, the development of land, and the future building within the corporate limits of the City of Clarksville. The petition was filed in accordance with the provisions of said ordinance requesting a special permit for Norton Homes LLC in a C3 zone for RV Park. The public hearing was held on said petition on July 23, 2026. The Planning Commission approved the special permit request on July 23, 2026 and recommended its approval to the Clarksville City Council on August 10, 2026, now therefore be it ordained by the City Council of the City of Clarksville, Arkansas. Section 1 approval. A special use permit is hereby granted allowing an RV park or recreational vehicle or travel trailer park within the C3 General Commercial District on the property described Exhibit A, subject to the conditions contained in this ordinance. All said property being located at 1543 South Rogers Street, Clarksville, Arkansas. Section 2, conditions of approval. The special use permit is subject to the property owner or its agent assigns employees or representatives collectively known as the property owner remaining in compliance with the following conditions of the property location. A, the RV park shall comply with the applicable proportions that the city of Clarksville zoning code is amended from time to time, including such code portions applicable to the operation and use of recreational vehicle or travel trailer park. B, in addition to the zoning code requirements, the RV park shall meet the additional requirements. One, all recreational vehicles or travel trailers, RVs herein located at the property must be and remain registered license in good and operable condition and capable of immediate transportation. Two, the RV park and incident use at any time as a manufactured home park or mobile home subdivision. Three, there should be no permanent structures, additions, decks, porches, fences, storage buildings, or skirting attached to any RVs except specifically approved by the City of Parksville building inspector. 4. The property owner shall maintain a minimum 20-foot landscape buffer adjacent to residentially zoned property in compliance with the submitted development plan and is approved by the Clarksville Building Inspector. C. There shall be no material changes to the site plan as proved unless such changes are submitted to the Clarksville Planning and Zoning Commission and approved by the City Council. Any failure of the property owner to comply with condition contained herein shall constitute grounds for suspension or revocation of the special use permit and set forth in Section 3 below. The special permit shall be reviewed no later than the five-year anniversary of special permit authorization date to ensure compliance. Section 3, Replication A. Upon any event set forth in Section 3B1 through 4 below, the city may issue written notification to the property owner that an event has occurred, which may result in a special use permit being revoked. Such notification shall briefly stay at the alleged event and provide a date in which a hearing shall be held in front of the city council, which may be at a regular or special called meeting. B, at such hearing, the city council may have a majority of a quorum of the council. rebut this special use permit upon finding that, one, one or more of the conditions set forth herein have been violated. We will have had $51,000 out of our pocket temporarily until it's paid by the Arkansas division or not, so but. We do have money out right now. They've got to do a flyover and a flyover survey, which incidentally costs like $77,000, if you believe that, which it does. And then we have an on-the-ground survey that Garber's involved in. So anyhow, I'll be done before November. We're on schedule. The AWAS, we're changing the grant. I want to preface this by saying the mayor really had, to his credit, lobbied for a more sensible solution to the in-kind part of this project. And there were more sensible solutions, as you well know. some good ideas but as it turns out the federal government and we need we need to keep on going so anyhow um we we changed the whole project and we don't even have an income anymore anyhow the bottom line is is that we had to get extra funding to do that in the arts law department of aeronautics which you may, I've told you in the past, but I'll just remind you that that's an organization, it's a state organization that is supported by tax money from fuel. It's not tax money from the general public, but it's aircraft fuel and aircraft parts and supplies and aircraft sales. And that money comes directly back to the Air Force. So, you know, there's a lot of people that complain thinking airport money the money the sport airports comes out of the taxpayers aviation taxes so anyhow that that extra money I'm going to a meeting the end of excuse me the 19th of this month and I'm going to present this, but it's already been okay that they're going to okay that the money that we were going to save with income, but as it turns out, we're going to be able to have that money. From the aeronautics? You're kidding. That's amazing right there, yeah. We got that taken care of. So it's still not going to cost us anything. trees also. We've had a want to remind you for years we've had, we've gotten away without having to have hangar ground lease. You know, people own hangers, but they can't own the ground underneath them. That's airport property. So we leased that property. The hangar owners leased that property. And we have not had a contract, which is ridiculous. And my concern still is that our bargaining chip of zoning or bonds is is being pushed aside and we're not having the opportunity to say, can we have third-party testing to address the concerns of pollution or contamination? Because these are- We're talking data centers? We're talking, because the zoning is for the data centers, IT. So that's the tie-in. Yeah, okay. I'm so sorry. But I just wanted to hopefully appeal for just a little bit of slowdown. You know, and I know it doesn't feel like to you guys because you've been dealing with this for a while. But I haven't heard... I haven't heard things that would protect the citizens. I haven't heard about what is going to happen with these closed loop systems that require, you know, biocides and scale inhibitors and synthetic coolants. And they have to be. You know, they have to be like your water heater. I've said this before. It has to be cleaned periodically. And where does that go? And is it going into our systems for cleanup? I mean, is it just like, here you go. Clarksville have, have at it. I don't, I haven't heard any of these things. I haven't heard like, let's have a vote on this. You know, I haven't heard the things that concern me and the concern others that I've talked to. Yeah. So the water use priority, is the data center in a drought going to have priority over the citizens? I mean, is that written down somewhere? Do we even know?
What? I don't think we do that. I think in industry around here, it's curtailed. It's the citizens come first. Okay. They will curtail energy to the industry before they will curtail our power. Okay. I'm sure it's the same with the water. Okay.

He actually cares about the community because he, in order to function in Israel, he has to meet those even stricter thresholds there. Okay. So know that first off. So it gives you a little piece. And I'm gonna tell you, there's industry in this town that poses more of a risk than the data center does, as I see here today. That's the fact.

The point is that Hain Green, just go back down to Hain Green, needed a higher filtration than what we did because the dye machines required more.
So I've had to learn over the last four years more than I want to know about this whole thing and how it works. And I promise you, I have no concerns about my kids growing up in here with that data. Not one. I have far more concerns with other industry that's here as opposed to that one.
