This review is being held because the Clark County District Attorney's Office has made a preliminary determination that no criminal prosecution of the officers involved in the death Lazaro Enriquez is appropriate. The Clark County ordinance chapter 2.12 requires a public review following such a determination.

This is not a trial. The purpose of today's proceeding is to present to the public with essential facts surrounding the death of Lazaro Enriquez. Chief deputy district attorney John Giordani will present today's fact finding review on behalf of the district attorney's office. He will determine the witness or witnesses to be called. The ordinance does not provide subpoena power on my behalf and does not allow for any other party to call witnesses.

Monique McNeil has been appointed to be the ombudsman. She represents both the public and the Enriquez family. She will have the opportunity to ask questions of the witness or witnesses. The procedure for questioning witnesses shall be informal with the view to providing the public with relevant information regarding the use of force. The rules of evidence shall not be strictly enforced in this proceeding.

If you could go to the first slide and describe kind of the generalities of our incident.

Yes, absolutely. So this is the Henderson Police Department officer involved shooting that occurred at 2312 Apartment Complex, which is located at 2312 North Green Valley Parkway, Henderson, Nevada, in 89014. This was a document under HPD report number 23Dash21323 with a date of incident of tentwenty seventwenty twenty three at twenty one seventeen hours, with the primary detective being detective Lippish, badge number 1710, and I as the assisting detective, detective Skinner, badge number 2233.

And detective, can you please provide the public with the initial call for service details?

Yes. So, on tentwenty seventwenty twenty three, at approximately twenty one seventeen hours, HPD units were dispatched to 2312 North Green Valley Parkway, Unit Number Ninetwenty 2, referenced a disturbance. Dispatch advised that the person reporting had stated that his friend's ex, who had previously been trespassed, was inside the apartment. Dispatch further advised that the male was vandalizing the apartment, cutting himself, and that there were two juveniles, ages five and six inside the apartment. Additional information was provided, and it was advised that the male had previously attempted suicide, which was documented under report number 23Dash20144.

The first HPD officer arrived, contacted the PR, which is person reporting, then and approached the apartment. As the officer was approaching, she observed the suspect, identified as Lazaro Enriquez, with a date of birth of 09/08/1997, outside the apartment holding a blade in his right hand. The officer immediately began giving the suspect commands to drop the knife. However, Lozaro instead immediately became aggressive, walking directly at the officer while holding the knife in his right hand. He made statements that he was going that she he wanted her to shoot him.

The officer then gave ground, retreating while continuing to give commands, drew her handgun to maintain lethal coverage of the advancing suspect. Additional HPD officers arrived and due to the fact that the suspect continued to aggressively advance toward officers, refused to comply with commands to drop the knife and was not stopped by the deployment of two department tasers, two HPD officers fired their handguns, striking and stopping the suspect. Officers then immediately began to administer medical assistance until HFD, which is Henderson Fire Department, arrived on scene and took over life saving measures. The suspect was then transported to Sunrise Hospital by HFD Rescue eighty four.

So, based upon the initial call for service, an investigation revealed these details to you?

Can you provide the public with an overview of the the scene location?

Yes. So, the location details are the initial call for service, which is going to be the top call out box, which gives the address of 2312 North Green Valley Parkway, Unit Number 922. The first contact the suspect Lazario is going to be just North of Building 9, which is the center call out box. And then the officer involved shooting location is going to be to the east, the last call out box to the right, and it's parking lot east of Building 9.

So based upon this, it appears the call for service came out from an apartment. An officer contacted mister Enriquez near that apartment, and then based upon your prior slide, that officer retreated as he advanced to what is described as the OIS location?

Did you conduct an investigation into the involved officers or the subject officers?

The first involved officer is gonna be officer James Schulke, badge number 13O3. His date of hire was 09/12/2005. At the time of incident, he was 42 years old. He was assigned as a patrol officer to the North Area Command. His call sign that day was 396. Officer Schulke did provide a walk through the scene. He did not provide a statement to investigators, and his body worn camera was activated. Our next I apologize. Officer Schulke's duty weapon, he had a Glock 17 with a tactical light that is a nine millimeter semiautomatic handgun. His round capacity was 22 plus one in the chamber. The investigation revealed that five rounds were fired during this incident.

Was there a second subject officer?

Yes. That's gonna be officer Nicole Ciatti, badge number 2041. Her date of hire was 04/18/2013. At the time of incident, she was 35 years old. She was assigned as a patrol officer to the North Area Command with a call signed that day of 03/1995. She provided a walk through, did not provide a statement to investigators, and her body worn camera was activated.

Her duty weapon was a Walther PDP with tactical light, which is a nine millimeter semiautomatic handgun. She has a capacity of 15 rounds with one chambered, and the investigation revealed that four rounds were fired.

And To be clear as we move through this process, the second officer Ciatti is the officer who initially contacted the decedent. Is that correct?

No. Unfortunately, it was not officer Ciatti, it was officer Bellinger.

Okay. Officer Bellinger contacted the decedent. Officer Ciatti was one of the two shooting officers.

Were there also various witness officers involved?

Yes, there was. So our first witness officer is gonna be officer Donald Tadey, badge number 1363. At the time, he was assigned to in service training officer. That day he was working overtime as bike one. His date of hire was 03/20/2006, and during this incident he deployed a taser. The second officer is gonna be officer Gerald Norton, badge number 2405. He is assigned as a patrol officer to the North Area Command. His date of hire is 06/26/2017. He also deployed a taser during this incident. Officer Patrick McCarrick, badge number 2230, he was assigned at that time as technical services officer.

He was also working overtime as bike two. His date of hire was 01/19/2016. And then finally, officer Danielle Bellinger, badge number 2241. She is a patrol officer that was assigned to the North Erie command, and her date of hire was 01/19/2016.

And, as you mentioned, she's the officer who initially contacted the decedent?

Did you do a work up on the decedent?

Yes. So, our suspect decedent, his name was Lazario Enriquez. His date of birth was 09/08/1997. He was 26 years old at the time of incident. He was approximately five seven, two hundred and twenty pounds. He had an address listed as 1417 McDonald Avenue in North Las Vegas.

You have a section that says crimes committed. Is that the crimes that you determined he committed during the course of this incident?

Yes. Had he survived, he would have been arrested for assault on a protected person with a deadly weapon, assault with a deadly weapon, and resist police officer with a deadly weapon.

And did you also look into his criminal history, if any?

He had no criminal history at the time of incident. However, he had several entries. One with being on 10/12/2023. He was a suspect in evangelism report reported under incident 2320144, where he had broke out the window of Rodney Glenn's vehicle. At that time, he was contacted and was determined to be placed he had a suicide threat and was placed on a legal hold.

And this incident involved some form of domestic dispute. Is that correct?

And then previous to that on 09/23/2023, LBNPD placed Lazaro on a mental crisis hold under incident ending in 9293. A call was placed to the suicide crisis line that Lazaro was standing on a bridge threatening to jump. He also had made statements about committing suicide by cop. He was coaxed off the bridge. He then went to a nearby soccer field where he had a butcher knife. Thankfully in this event, LBNPD was able to take him into custody and place him

Did crime scene analysts and other investigators locate the weapon that the decedent had on him during the time of the incident?

Yes. So this is gonna be the weapon for our officer involved shooting on 10/27/2023, and it's gonna be a blade only.

And during the course of your investigation, can I presume you reviewed body cam?

911 calls? Yes. And interviews of various witnesses? Yes. Based upon all of that, were you able to develop a timeline that you can provide to the public? Yes. Go ahead.

So on 10/27/2023 at approximately twenty one seventeen hours, the PR called stating that a friend's ex keeps coming to the resident, which was gonna be located at our OIS scene at Apartment 922, and that the subject had been trespassed and shouldn't be there.

Who was the PR?

11:50 – 12:19Speaker 3

The PR was Rodney Glenn. Okay. At twenty one eighteen, officer Shulkin and officer Ciadi are dispatched to the call, and that's gonna be dispatched by CAD, which is computer aided dispatch, or a computer, a laptop in the police vehicles. At twenty one nineteen, PR advised that the subject is a Hispanic male and is inside the apartment now. Twenty one twenty, PR advised that the subject is Enrique Lazaro, which later is Lazaro Enriquez.

12:19 – 12:45Speaker 3

2121, PR advised that the subject is apparently cutting himself and vandalizing the apartment. 2121, PR advised that two juveniles are inside the residence, age five and six. 2123, officer Bellinger and Norton are dispatched to the call. 2124, Henderson Fire is en route to stage nearby. 2125, PR advised that a friend in the apartment is texting PR pictures of the subject bleeding on the floor.

12:46 – 13:32Speaker 3

2126, officer Bellinger arrives, contacts the PR, tries to gather intel, and confirms the apartment number. 2127, officer Bellinger locates the suspect with a knife in his hand and advises dispatch to give a red a code red and start giving commands to drop the knife and stop walking towards her while the subject states, just shoot me. 2127 to 2128, suspect continues aggressing officer Bellinger while holding the knife and aggressing her at a fast pace, then attempts to go after the PR. Officer Bellinger tells the PR to run and regains the suspect's attention, who continues to aggress officer Bellinger. Twenty one twenty eight, officer McCarrick, Tadey, Ciatti, Norton, and Schulke arrive and run toward officer Bellinger's location.

13:32 – 13:57Speaker 3

2128, officer Norton deploys a taser, which is ineffective. The suspect continues to aggress officers. 2128, officer Tadey deploys his taser after announcing taser taser, which appears to be ineffective is what that's supposed to say. The suspect continues to aggress officers. 2128, officer Schulke discharges five rounds, and officer Ciadi discharges four rounds, each striking the suspect.

13:58 – 14:27Speaker 3

2128 to 2133, after making the scene safe, Hanneson officers start rendering aid by applying dressings to the wounds, direct pressure to the bullet holes, and applying a tourniquet. 2130 '3 HFD arrives, fire search work working on the suspect. 2135, rescue eighty four is en route to Sunrise Hospital. 2150, rescue eighty four arrives at Sunrise Trauma. 2157, suspect is pronounced four nineteen, which is code for deceased by Sunrise Hospital trauma staff.

And after that, based upon the officer involved shooting which had occurred, did you and your team then begin your investigation?

During the course of that investigation, were the witness officers interviewed?

14:43 – 15:17Speaker 3

The first witness officer is Donald Taddey, badge number 1710. In a synopsis of his interview, officer Taddey advised that he was working as a uniformed officer on the night of the incident. Officer Taddey was on a break when he heard a call for service at a nearby apartment complex involving causing a disturbance and who had a knife. It was also learned that there were two juveniles inside the apartment with the arms male. Officer Tadey advised that he and his partner, Bike two, as well as officer Ciadi and officer Schulke were en route from the same location when they heard officer Bellinger arrive at the apartment complex and advised that the male was outside and coming towards her, and he had a knife.

15:17 – 15:43Speaker 3

Officer Tade worked his way to officer Bellinger's location as he drew his firearm and joined the other officers who had arrived. Officer Tadey could see the male subject with the knife in his hand coming toward officers. Officer Norton had deployed a taser, and you could see the taser wires, however, the male was still coming at them. Officer Tadey drew his taser and deployed the taser in the area of the male's belt line. However, he observed that the male was still coming at them and that it was when that is when he heard gunshots.

15:43 – 16:25Speaker 3

Officer Teddy recalled that the male subject having a complete complete blank stare appeared emotionless and continued walking while ignoring verbal commands to stop and drop the knife. Our next witness officer was Danielle Belanger, badge number 2241. Officer Belanger advised that she was working as a uniformed officer in a marked patrol vehicle on the night of the incident. Officer Bellinger was responding to a call within the same apartment complex when a second priority call was involved and she was dispatched involving a man with a knife in Building 9. Officer Bellinger was the first officer to arrive and encountered a male who drove up to her in a vehicle and said that he, quote, is in the apartment and that he is cutting himself.

And when officer Bellinger asked if anyone was inside the apartment, the male advised that a female and two children were inside. Officer Bellinger knew that officer Ciadi and officer Schulke were responding and should be close to arriving, so she asked the male where the apartment was for confirmation. As Officer Bellinger began to walk in the direction of the apartment, the PR walks with her without being compelled or asked to, and as they approached the corner of Building 9 and the parking lot north of the building, officer Bellinger observed a male walking, quote, nonchalantly in the parking lot near the first couple of parking stalls. The PR stated, quote, that's the guy.

So Rodney Glenn points out to officer Bellinger that the decedent is the guy who was inside the apartment with the children.

After being notified that the male walking was the subject for the call for service, officer Bellinger then called out to the male in a loud voice to get his attention. Officer Bellinger immediately observed that the male had a large edged blade weapon in his right hand, and as he turned towards her, he had it up to his neck and was actively cutting his neck. Officer Bellinger then gave commands to show for him to show her his his hands, and at this time, he brought his hand down, still holding the knife. He with his shoulders rolled forward in an aggressive or fighting stance, and a hyper focused stare directly at her, described as a thousand yard stare, and with this with this posture, he started walking directly towards officer Bellinger. As the male walked towards officer Bellinger, she had her duty weapon drawn and pointed towards him, and she was giving commands to drop the knife and put the knife down.

17:55 – 18:17Speaker 3

He continued to walk towards her. Officer Bellinger walked backwards while continuing to give commands to drop the knife. The male yelled at her stating quote, shoot me and quote, kill me. With the male with the knife focused on her, officer Bellinger continued to back away. Now in a parking lot, she could hear police sirens from additional arriving officers and she was able to see the red and blue flashes from the patrol cars.

Officer Bellinger knew that officers were to her right, and she felt that she was the furthest to the left in the group. Officer Bellinger recognized that the advancing male no longer had its focus directly on her, and was now looking toward other officers. Even though there were now numerous officers, the male's demeanor did not change. He continued to advance while in an aggressive stance, and he continued to hold the knife in his right hand. Officer Bellinger advised that she heard and witnessed two taser deployments by two separate officers, which were both unsuccessful. Unsuccessful. The male took additional steps towards officers, and that is when she heard gunshots, and the male went to the ground and was no longer moving. Officers called over the radio for medical to respond to the scene, and officer provided on scene medical aid to the male.

So, would be Gabriela Martinez, date of birth 10/1998. At the time she was 22 years old. Her address was listed as 2312 North Green Valley Parkway, Apartment 922 in Henderson. She was a summary of her interview, she provided that she had two children with the decedent, a five year old and a six year old. The decedent suffered from depression, but since their breakup, he had escalated to suicidal threats.

The decedent attempted hanging one year ago, which had gone unreported. The decedent attempted to jump off a bridge a month prior, which was reported under event ending nine two nine three by LVMPD. The decedent attempted to run into traffic approximately two weeks prior to this event, which was also unreported. On 10/12/2023, the decedent said that he wanted the police just to shoot him as it would be easier. Rodney Glenn picked up Gabriela on 10/27 and went for a drive.

She called she received a call from Jacqueline, which was her niece and also babysitter that evening, stating Lazaro was at the apartment scaring her and the children. Jacqueline told her she and the children were hiding in a closet and Lazaro had a knife and was vandalizing the apartment. Gabrielle entered the apartment after they had returned to check on her children and observed blood on Lazaro's left wrist and one of her kitchen knives in his hand. Lazaro was extremely intoxicated, and Gabriela was afraid of him. Himself.

Lozaro slammed the knife into the wall, breaking the handle off, and left the apartment on foot. She heard Lozaro confront the officer, officer Bellinger, and kept saying, quote, what are you going to do? Shoot me? End quote. She stated she yelled that he was sick to the officers. She stated the officer continued to back up until the shooting occurred. She refused to give detectives consent to have the children forensically interviewed. Our next witness was Rodney Glenn. Date of birth 05/10/1985. His age at the time of incident was 38 years old.

His listed address was 3000 Highview Drive, Unit 2424 in Henderson. A summary of his interview, Lozaro did not like him because he was in a relationship with Gabriela. He stated that Jackie was the babysitter inside the apartment with Gabriela's children the night of the incident. Lozaro went to the apartment and wasn't welcome there. He grabbed a knife and sent photos to Gabriela of him cutting his arm and bleeding.

21:38 – 22:03Speaker 3

Rodney received a text message from Gabriela saying Lazaro was inside the apartment and advised him to call police. Rodney was outside and saw Lazaro, quote, come officer with the knife, end quote. Rodney stated Lozaro didn't really come towards him with a knife, but quote, got a little aggressive, end quote. Rodney knew a knife was from the kitchen as he had recognized the pattern. Rodney heard the officer yell to Lozaro to slow down and stop.

Rodney said Lozaro, quote, kept moving, end quote. After the officer tased him, he stated that three or four officers used tasers. Rodney said the tasers were ineffective. Rodney heard the shooting and said it was, quote, too aggressive and, quote, 10 officers stated started shooting him, end quote. He stated Lozaro was trespassed from the apartment on 10/12/2023. He believes Lozaro should have been kept longer for a psychological evaluation the last time he was hospitalized.

Yes. At that time, Jacqueline did not wanna provide a statement, and she gave and provided statements through Gabriela. She advised that she was babysitting the two children when Lazaro came to the house, initiating the call for service. Gabriela stated that Jacqueline is her niece.

Yes. So, the analysis of officer Bellinger's body worn camera. During her contact with Enriquez, officer Bellinger issued at least 16 separate commands or statements to him. During this dialogue, officer Bellinger attempted to deescalate the situation by giving commands such as, quote, drop the knife, end quote. In addition to changing her tone and pleading with Enriquez to, quote, please stop, the voice inflection was evident, and given the variety of different commands and please, no doubt attempts to deescalate the situation were undertaken.

Enriquez said, quote, shoot me at least six separate occasions, and there were likely more. However, the audio was difficult at times to decipher. In addition to the statement to shoot him, Enriquez can be heard arguing in a defiant and unusual tone for officer Bellinger to shoot him and stating, quote, but I really do, when she told him, quote, you don't have you don't want to do this, end quote. And these are just some of the still photos from the body worn camera.

The following injuries were noted during that autopsy and were subsequently reported in an autopsy report. The decedent had eleven penetrating wounds, with nine of those being entrance wounds and two exit wounds. The decedent was holding seven projectiles. Two of the wounds were through and through.

correct. And we just watched and listened to some of those. So I kinda wanna start with the 911 call. The purpose of the 911 call, the dispatcher is collecting information from the person reporting. Right? Yes. And they need to get that information to convey that to the officers who are going to be responding. Right? Correct. Part of that is so the officers know what they're walking into. Right? Yes. It's better for the officers to have some idea of what's going on before they just walk in. Correct? Yes. Okay. And so the dispatcher gets that information from the person recording, conveys that to the police officers. That was done in this case? Yes. It was. We hear on that 911 call that Rodney says that he Lazaro had a knife. Right? Yes. That he'd been hurting himself inside the apartment. Yes.

Right? There was no indication that he'd been trying to harm anyone else in the apartment. It seemed to be directed towards himself. Correct? That's correct. And we heard that Rodney told the dispatcher that about less than two weeks before this, Lazaro had been at his apartment before. Yes. He had damaged Rodney's car. Yes. And he had threatened to kill himself at that time. Correct. And the dispatcher, in fact, conveyed the information to the responding officers that the subject was potentially suicidal. That's correct. Okay. And in fact, there was some talk about the fact that there had been, I think, a four zero five a prior, meaning a prior suicide attempt. Yes. Okay. So officer Bellinger going in is aware that this person is suicidal? That's correct. Okay.

We also have Rodney Glenn in the area. He has already had two taser deployments which did not stop him. Who's to say that if we shot him in the leg, that that would also stop him.
