Good evening everybody. This is the town of Carver Zoning Board of Appeals for the date of April 9, 2026. It's uh 6:30 p.m. on the button. We are in meeting room 1. As is our custom, we uh move initially to approve meeting minutes of our previous meeting, in this case March 5, 2026. Also, as is my custom, uh I circulate a draft of these meeting minutes in advance to all the members so that they can review them and that way we save time and we don't have to sit here looking at each other. trying to
get people to say, "Okay, I've done reading and I'm ready." So, I'm assuming that everybody has received the drafts, right? Yes. And does anybody have any changes, amendments, or modifications? Um, I'm going to go uh next to uh the matter of Robert Basset. Is he in the There he is. You're sitting in the back. Come right up here, Mr. Basset. Nice to see you again. It's been three years, man. Why don't you come and visit us? I'm usually at class right now. Well, Mr. Ambassador, I understand you requesting to extend your special permit which we granted 3 years ago for a martial arts studio at 52A West Street. Is that true? Yes. How's business? It's good. It's good. I mean, small town, small business, so but it's But big-hearted guy, right? I try to be. Yes. Yes. Have there been any complaints uh that you're aware of? No. Nope. No. My neighbor Me and my neighbor are good. my customers. We're all all happy. Yes. Yes, sir.

Now, ladies and gentlemen in the public who are with us tonight in the flesh and also watching on Area 58, I'd like to make some very general introductions because we have some new members up here and to my left u with the pink hat and he he's he's in touch with his feminine side as I can see, but with the pink hat, this is uh Mark Porer who's been on the board for a while now and a former educator and uh former high school um chairman of the science department at his high school. So, we're happy to have him. To my immediate left is the board vice chair. That's James Bington. He too has an educational background many years and uh we're happy to have him. So, both of these folks are well-versed in how to read and interpret uh our bylaws. To my immediate right is Anita Doll who comes to us uh with an education in the electrical field and uh not only uh uh as an administrator but also as a hands-on electrical person. So, we're very pleased to have her. To her right is Joseph Sullivan who is one of our new members. Uh he's a full voting member and he has uh for many years been involved in property management and uh has also appeared before many town boards and committees in nearby towns on the southshore. We're extremely proud and pleased to have him with us with his background and expertise. And to his right uh joining us for the first
time this evening is K. Spencer. K. Spencer um is or should be known to many of you perhaps not in this room but at least some of you watching on TV. She served four terms on the school committee in Carver. And the last term that she served she was the chairperson. So she is wellversed on how boards and committees should behave. So, if any of us gets out of control, she's going to knock us down and tell us to behave. We're very happy to bring her back and have her serve on this board. Um, she uh for many years operated her own insurance agency, so she too has an expertise in reading uh contracts and regulations and um items having to do with coverages. So, thank you for your service tonight and welcome.
She is our alternate member, but as you will see when we go through these cases, we don't treat anybody uh different just because they're an alternate. She may not vote on all cases, but she will be a full contributing member to the conversation up here. Very proud of all of these folks. Uh, we have been, and I've said this periodically over time, and Kay reminded me that I said it the last time, so forgive me for repeating myself, but for 30 years, this board has not been reversed by a court of law. That for me is amazing because what I do for a living is practice law. And I see cases get reversed all the time. it doesn't happen here and I think that uh the town is probably very pleased that it hasn't because we've saved the town lots and lots of money over the years in legal expense. So, having said all that and bragged about all of you who don't get big heads, I want to move to the uh first case that I want to take tonight which is a continued hearing. Is Paul Young here? There he is sitting in the back. All these guys are sitting in the back tonight. Grab a chair. And uh Mr. Barington, you're going to read the notice into the record, please. for public hearing case which is continued from our last meeting number 56-252-0R. Petitioner Paul Young requesting a special permit pursuant to section 290-2-2.5 C- D 290-5-2-2 AI and 290-5-3.3 of the Carver zoning bylaw for property
located at 14 Murdoch Street in Carver, Mass. Assessor's map 56 lot 252-0-R so as to construct a front stairway with landing that would increase the nonconforming nature of that home front setback of 50 ft is required in the residential agricultural district. Can't you tell he used to be a teacher? Um Mr. Young, we heard from you extensively the last time and I'm not going to have you repeat what we went over. Appreciate that.
Trust that we have reviewed everything that we need to review on all of these cases, as is our custom so we don't come in cold on these things and start flipping through stuff like we've not seen it before. Sure. What I want you to tell us about tonight is the measurement that we asked you to take. Did you bring that with you? Because I think that was the only undone piece. Yes, sir. I've got remembering correctly you guys up here. Go ahead.
So, I've took uh I took all the measurements required. Um first of all, the very face of my house is uh 49 and 11. So, I'm going by that that um give or take probably. But, uh from the stake I put at the road to the to the house is 49t 11 in. But to the existing um steps, it's 43t 2 and 1/2 in. to the road to the road to that same measurement that I from the current steps. Yes. From the current steps, the very the very edge of the bottom step to the to the the first sign of concrete. You need 50 ft. Yes, sir.
You understand that correctly? So, you're looking for u a special permit that would allow you to build the front stairway a little bit closer to the road. Yes, sir. because you don't have the 50 ft. You're going to need 9 ft. I mean, uh, well, no, he's he's I think just told us what the current was. That's the current. Yeah, the current and what I want is um 42 feet 10 12 in. So, it's 4 in. 42 what?
42 10 and a half. So, he's going to need 7 feet one and a half inches. Not sure I understand the seven feet, but the setback that's the amount of relief that you need. Oh yeah. Well, yeah, I've got it as uh if he's basically saying is required amount. Understood. I see what he's saying. Yeah. Yes, sir. So, that's what you need. Yep. What else would you like to say to us?
Um, yeah, that's it. The entire structure, like I say, the the foundation is 4911. So, the entire staircase is currently within the setback. So, you know, the uh the dimension that we needed was from where you're going to have that last step. Understood. Yeah. The new last step. That's all right. Do I have that right? Yeah. And the current stairs, the last stair is how far away from the edge of the roof? 43 feet 2 and 12 inches 43
from the post I stuck in the ground. So give or take whatever the actual line is, you know. Um, I wonder if anybody up here would like to give this this nice man 8 ft even rather than seven feet and little room 10 and a half inches. I think that would make sense. That would be just in case. I appreciate that because there's some trim and stuff that goes around it. So there's give or take an inch or so, you know. Anyway, short of that, you can make him move his foundation back.
