The subject property is located in the manufacturing light design overlay zone and has a general plan land use designation of light industrial. The property is located primarily in an industrial area that is surrounded by manufacturing light uses to the East, the West, the South, and similar industrial uses located to the North in unincorporated Los Angeles County as can be seen on the map. The site is occupied by two warehouse buildings that were approved by the planning commission in 2022 as part of DOR number 189122. The construction of both buildings is complete, and you

Next item on the agenda will be item seven b, public hearing for consideration of recommendation to city council regarding zone text amendment z c c zero four two five, and we have a presentation that will be made and given to us by our planning acting planning manager, McKenna Alexander. Okay. And thank you for the introduction regarding this item to consider a resolution to make various amendments to certain, code sections. Okay. So the proposed text amendments to the new space one zoning code, and there also are, proposal to make amendments to the preexisting Carson zoning ordinance, which you'll be which you'll hear referenced as the old code throughout this, presentation. We're asking the part of it is to make changes to obtain city manager's concurrence before approving or conditionally approving, proposed new land use or development as well as eliminating some, burdensome administrative requirements on the city staff, that's related to the phase one zoning code, and also make it a bit more streamlined for our council members to request review and decisions that's made by the director or the plan commission, which was which will be added to the phase one zoning code.

Specifically, again, the project description includes a text amendment, ZCC's number zero four twenty five. Again, to reiterate, the modifications are to both the old and the new code, which we will reference as the phase one zoning code. These proposed changes, within the old code is to section ninety one seventy three thirty one. And within the phase one zoning code, you'll see recommended changes to sections ninety four eleven four, ninety four eleven five, ninety four twelve six, and ninety four twelve thirteen. This will apply to pending and future land uses or development within the city.

A part of the analysis that was done is and when when you review the staff report, you'll see references to bullet one through five, so to kinda correspond with the reading that you've done prior to the meeting. So part of the analyses, for bullet one is to add text to the old code, section ninety one seventy three. And in bold, you'll see the addition to the section, which reads, the director shall not issue any decision approving or conditionally approving a proposed use or development without first obtaining the concurrence of the city manager or his or her designee. Any such director decision issued without such concurrence shall be of no force or effect.

As a reminder, you're gonna see, various, iterations of this change throughout the next, sections that we'll discuss Because the overall reason is to make sure that when we have proposed land uses or development within the city that we keep the line of communication open between staff level, the, executive team level, which is the city manager's office, as well as our, honorable city council. Bullet two, the changes for the phase one zoning code section ninety four eleven, the community development director. And, basically, it adds a couple of caveats, such as subject to the prior concurrence, subject to, approval, the, the director must obtain concurrence of the city manager. And this is added at the beginning of subsections b, d, h, k, and l. And then also a new paragraph will be added that requires the city manager's concurrence.

Mhmm. And, again, if it's not done, then it's it's basically void.

The proposal is amending sections ninety four eleven excuse me, section ninety four eleven five and add a notation to the table of ninety four eleven five as well. And that's again requiring the concurrent getting the approval from the city manager's office before staff or director makes any type of, decisions related to land use or, development. And if it is done, then it's void.

And, basically, in this subsection j two, there's a line out or what we're removing is, the notification of owners and record of record within a 750 foot radius. The emphasis, again, is to make sure that the, council has the flexibility to, one, they'll know about it, and two, that staff is keeping with the, information flow from staff level to executive team and on to the council. In terms of bullet five, which again is another, amendment requested amendment to phase one zoning code. This is amending section ninety four twelve thirteen, the appeals section subsection g, which calls for review.

So you'll see a line that within this paragraph, any member of the city council may call for review of decision. This is, again, making sure that council has the ability to find out about a project and to have discussion about it. So, again, any member of the city council may call for the review of a decision of the director or planning commission within the appeal period. They can appeal it. The call for the review shall be processed in the same manner as the appeal by any other person.

In terms of CEQA compliance, this project is exempt from it, subject to one five zero six one b three as the CEQA guidelines common sense section.

So as you mentioned this evening this item is consideration of a resolution for a planning commission to delegate approval for certain disability bonus applications to the director. To provide a bit of a history, the phase one zoning code was adopted last year, and which includes a, new section, Carson Municipal Code section ninety three thirteen point nine k two. Excuse the typo on my presentation. This has established the Disney bonus application projects, including requests for concessions, incentives, waivers, which are subject to review and approval by the planning commission, which is on the phase one zoning, code books right now.

There's also the adoption of the new, code zoning code phase one also included a that a project would require city council approval for related permit or entitlement. The planning commission may deny the project or for the recommendation for approval to the city council, which is in in, strike contrast to the to the state law, the state density bonus law, which which does not mandate that a density bonus, including the concessions, incentives, and waiver requests need to be reviewed or approved by the plan commission or council. It actually leaves the decision on the approval authority to discretion of the local jurisdiction, and this is the main purpose why we're here this evening to align our our code with not only the state density law, but as well as our our general plan, our housing element. To bring it together, as a reminder, the project description includes to consider approving the resolution, delegating the planning commission approval of certain Disney bonus applications. And this only, this only applies to projects that do not require another permit or entitlement, meaning that it doesn't have to come before you in a public hearing for a review, needing planning or city council approval in a public hearing.

The language that's also included with the proposed amendment is there will be a one year trial period, which provides you the opportunity to see if it works or not. So, you could so at some point, we can come back. If this is approved, the planning commission can come back and say, hey. It's working. We like to continue this.

Staff is anticipating to bring a code amendment to kind of update it to align with what the proposal is tonight to it's basically a housekeeping item again to correct the issue to align our code with the state the state density bonus law as well as our housing element. If it's not if, if it is not, the proposed delegation of authority would expire in one year unless the planning commission revisited before the expiration. Going back to the purpose of aligning it, there's some issues that we need to that we we recognize that needs to be cleaned up.

The state law governs the density bonus law, and it the way it's written right now, it kinda presents some challenges, that requires the planning commission to review it even though this is a matter that is typically reviewed by administrative staff as the approval authority. Then they also adds another layer of review, which introduces additional burdens and delays for this, which could be a more streamlined process. And this motion wouldn't would not necessarily increase the or decrease the city's discretion. It's it's still be there. And then, also, the CMC does not require a public hearing for a planning commission to consider these type of requests.

For residential projects that proposed density bonus concessions, incentives, and waivers without another entitlement application, so that's what was a part of the resolution. So, again, this this is strictly if there's an application requesting a Disney bonus or its related concessions, incentives, or waivers, not related to, a project that needs to go before the planning commission. Approval of the delegation will align with the code, as I mentioned before, with the state law as well as the city's general plan housing element. And, again, it'll streamline the application review process, which is beneficial for our applicants that are proposing new housing our our new new Disney bonus within our city. Continuing, it won't again, it won't remove city's decision making discretion.
