I'll call this call meeting with the Carroll County Board of Supervisors September 14, 2026 to order. And at this time, I'll ask Mr. Collins to lead us in invocation and pledge.

Father, thank you for this opportunity to be in this place today to deal with the business of the county. We pray that you give us wisdom and guidance in all that's done. In Jesus' name, amen.

I pledge allegiance to the flag of the United States of America and to the republic for which it stands, one nation, under God, indivisible, with liberty and justice for all. Okay, upon the motion, the board's going to go to a closed session. Discussion is authorized by Virginia Code Section 2.2-3711. Mr. Durbin, I'll let you discuss what we're going under.

Yes, Mr. Chairman, that would be 2.2-3711-A8, consultation with legal counsel concerning a specific legal matter requiring the provision of legal advice by such counsel. and the general topic would be possible adoption of an emergency ordinance.

Can I ask someone to ask each supervisor to certify Whereas the Carroll County Board of Supervisors convened a closed session this state pursuant to an affirmative recorded vote and on the motion to close the meeting in accordance with the Virginia Freedom of Information Act. Whereas section 2.2-3711D of the Code of Virginia requires a certification by the Board of Supervisors that such closed session was conducted in conformity with Virginia law. And we went under closed session under 2.2-3711D A8 and it was a discussion of a emergency data center ordinance to regulate data centers and that's all the discussion we had was on this ordinance we have in front of us now therefore be resolved that the care county board of supervisors hereby certifies it to the best of each member's knowledge only public business matters lawfully exempted from open meeting requirements under the virginia freedom of information act were heard discussed were considered in a closed session to which the certification applies And all such business matters as were identified in the motion by which this closed session was convened were heard, discussed, or considered in the meeting to which the certification applies. Mr. Chairman, I'd like to make a motion to request the Planning Comp Board to consider amendments to the comp plan to address data center and extensions of public facilities as provided in Virginia Code 15.2-2232. That's a public hearing to revise it. Do you want to go ahead and set a date for the public hearing? Yeah. First, I want to request the Planning Commission to come forward to work toward that.

Mr. Chairman, under the ordinance that you've adopted, Code of Virginia allows you to adopt an emergency ordinance and have it remain in effect for 60 days. So you'll just want to pick a date before that ordinance expires so that you have a chance to consider the comp plan amendments and any changes, updates, or other actions with regard to your emergency ordinance. But we can go ahead and do them separately. You can, but I would want you to have all that sort of wrapped up within that 60-day window is what I'm saying.

So maybe when the Planning Commission has their meeting, or Mr. Newman, I think. Is Mr. Newman in here? If you can get with the Planning Commission and set a date. Okay. That wouldn't give us enough time to advertise our public hearing, but maybe we can set it.

Is that good? Yeah, I think if this board's comfortable with the Planning Commission meeting, selecting a date for a public hearing, then you can just call your... A joint meeting, correct?

Would that work, gentlemen? Wouldn't they vote on that? I don't think it's necessary, but certainly... Okay. I'll entertain a motion on that discussion with the Planning Commission. A joint meeting?
