Good evening, Chairman. members of board. My name is Dr. Malcolm Smith. I live at 45 Laughlin Road in Laurel. I'm here because a dam failed in Carroll County. And people downstream including myself, 30 other citizens paid the price. That dam is Virginia Dam 03504. It let loose 150 million gallons of water and whatever else was in that lake. It belongs to Old Mill. It is regulated by DCR. Old Mill's wastewater system, did you know they have a wastewater plant there at Old Mill Golf Course? And their dam failed and that wastewater plant is below the dam. These are not vague allegations. These are regulated facilities. There are records and there are inspections. There are compliance requirements. And there is a very simple question for this board. What did Carroll County know about this dam before August 2nd? And what can Carroll County do after August 2nd? I have 30 members of my community who signed a petition asking for time and a meeting in front of this board because nothing was done. In fact, the only way the county found out that this dam is breached is because I called DCR, who then sent a letter, I hope all of you read. What did Carroll County do? Well, I've been digging in the records about this dam. What I'm finding is very deeply troubled. There appears to be roughly a 20-year history of noncompliance by this owner of Old Mill, and over a group you brought before you and celebrated for over 30 minutes, yet you'll only give me three minutes to talk about it. 20 years they've been out of compliance. Not 20 days, not 20 weeks, 20 years they've been out of compliance. If that's wrong, if that information's wrong, correct You can't. If that's true, that they've been out of compliance, listen, I got two more minutes. Thank you. Why wasn't something done when this thing was out of compliance for 20 years? People downstream were flooded when it failed. And now the question becomes even more important. What happened after the pandemic? Did this county demand answers? Did each of you demand answers? Did you contact DCR? No, I didn't. Did you contact DEQ? No, I didn't. Find out what really happened. Put the complete history of Dan 03504 out on the table for all of us. Get VQ's records about the waste facility. Did it breach when the dam did? Find out exactly what happened during the August flood. Find out what the emergency notification system was supposed to do. And that's where they're mainly out of compliance. You have some work to do about this, errant neighbors. And I look forward to hearing what you're going to do.

I'm coming just to talk about a little bit about what several of my family members are concerned about and several people in this room. as the recurring theme here at the data center. A lot of the people that I know doesn't think the board's really concerned about them. I don't know if that's true or not. But what I've been told is y'all are supposed to represent us, our beliefs, our values. It's not like we're asking for y'all to do something illegal. But nobody I've talked to as mentioned, wanting a data center in this town. Nobody. There's too many negative side effects from having one. We just want to know that we're being taken care of. Most people think zoning is not the only option. There's got to be another option out there. I guess something I want to ask the supervisor as a whole. You really want your kids growing up with these data centers in their neighborhood states. You want your grandkids, your nieces, your nephews, your neighbors. You want them having to hear these data centers deal with the water shortages, the rise of electric bills that we get from them. Why can't you leave these data centers in Lowland County, Prince William County, Fairbanks, And we're all these areas that support Abigail's family. They don't care about this part of the state. Do we really think that doesn't fit in with our tourism industry around here? Nobody else does. And if it's a revenue tax income, revenue fund, why can't we get more backers in this place, in this county? I'm a lifelong, I have lived in Carroll County my whole life. We had Mayville, we had Cross Creek, we had all these other backers. They closed down. And we haven't really gotten a lot of jobs. We had Magnolia for decades. Now look at Magnolia. We are losing people too. take younger generations are now going elsewhere so they can find jobs but why can't we get factories in here instead of a data center uh it's something else that some of the folks that i know one border be reminded of no matter how long you've been on the board no matter how what your last name is what you've done respectfully Come election time, each and every one of you can be replaced if you don't represent your constituents. I don't think those are our only, you know, it seems like if we're being given started out the noise about data centers and then it became the noise about zoning and then it became we have to have both of those things it sounded like from this board that in order to reel in data centers we need to have zoning so in other words both things are an inevitable thing it sounds like from this board and I don't believe that's the truth and honestly I think that a lot of the there's been a lot of be nice about this obfuscation as far as what uh danison is approaching carroll county it seems like we've been told many times oh nobody's approached us yet it hasn't it isn't which has been being talked about for quite a while now. So, you know, I don't think that we're being represented truthfully and with, you know, clarity. And I think we deserve that as residents of this county. And as the man said, you know, you guys are elected to represent us. And, you know, that's what we deserve and that's what we expect. So my question is to this board, at any point are we going to receive that clarity and that transparency as far as what's going on with these players who want to come in here and extract from our community, take our resources, drive up our electric rates, pollute our environment with noise and water pollution and whatever else, you know, they're they're obviously uh talk a good game they're going to tell us what they what we want to hear but i think that we need to go dig a little deeper and i think as a representative it's you guys who should be doing it for us because we elect you to do that so anyhow thank you for the time and uh appreciate it thank you sir

Okay, we approved it, went through the process and approved the budget this year to provide funding for Carroll County Schools. When we went through the process, we knew that the budget was not approved from the state, so the funding would change based on the approved Virginia state budget. The reason for having the public hearing is because the total budget change would be more than 1% of the budget. Out of this, the total revenues that were received by the schools would be $1,296,087. Of that, only $277,594 is local effort. We fund the school system at required local effort plus the additional programming. And this is part of that as well. So this is not an addition on top of our local required effort or the additional funding. Part of this funding they received was for special ed, at-risk school, federal dollars for school improvement. But the total amount of the change would be $1,296,087. if the board would like to move forward with it to vote to approve the budget appropriation request for fiscal year 26-27 okay we'll close the public hearing at 7 40. school budget amendment and i'll entertain a motion

As a consequence, I'm a member of a group of three or more individuals who are for the Carroll County School Board. Similarly affected by the decision on the proposed funding, therefore in this situation, the exception of the Virginia State Local Conflict of Interest Act. BA coded section 2.2-3112B1 applies to this situation and complies with that section. And I hereby declare that I'm able to participate in this discussion and voting on this topic fairly objectively and in the public interest.

So whereas the personal property tax relief act of 1998 Virginia code 58 dash one thirty five twenty three extra session has been substantially modified by the enactment of chapter one of the accident assembly 2004 special session one senate bill 5005 and the provisions of item 503 of chapter 951 of the 2005 acts of assembly the 2005 revisions to the 2004 six appropriations act here and after cited as the 2005 appropriations act So now there will therefore be resolved by the Caribbean water supervisors that qualifying vehicles obtaining within the county during tax year 2026 shall receive personal property tax relief in the following manner. So personal use vehicles valued at $1,000 or less will be eligible for 100% tax relief. Personal use vehicles valued at $1,001 to $20,000 will be eligible for 22.55% tax relief. Personally use vehicles valued at $20,001 or more shall receive $22.55 tax relief on the first $20,000 of the bay. And all other vehicles which do not meet the definition of qualifying business use vehicles, farm use vehicles, motorhomes will not be eligible for any form of tax relief in this program. Yeah, first of all, I want to thank everybody for coming out. I appreciate the fact that you're here being involved. That means a lot to this county. It means a lot to me as a board member. Thank you for your patience to the county as we work out the details of the trash. I know we've had some snafus and some a lot of people happy a lot of people that have concerns but you know what i'm trying to tell people is when you contact me we'll get something done mike's been wonderful to work with and getting the things ironed out but we're close to getting all that ironed out and it's a it's a great benefit to our people so i'm glad that it's there and i appreciate your patience thank you to our county staff thank you to our Fire Rescue, Sheriff's Department, EMS. I mean, the way this county works together, I appreciate that very much. So thank you for all that. And that being said, Mr. Chairman, I have a motion that I'd like to make.

Based upon the clear and consistent opposition expressed by the citizens of Carroll County, I move that the Board of Supervisors decline to pursue or adopt the proposed countywide zoning ordinance. further that we withdraw any previous direction or referral concerning that proposal. Request that the Planning Commission terminate its consideration of it. Direct county staff not to spend additional time or public bonus developing countywide zoning unless specifically authorized by a future recorded vote of this board.

We're not going to work on zoning um soon we'll have a second for that motion second second by mr bryant any discussion if not i'll start with mr moore yes mr collins yes mr bryant yes mr horton yes mr hurley i stand as a member of the planning commission and i vote yes anything else mr collins oh i'm sorry that's all i have okay So, I've got a few things I want to get into. One thing on the, this will be our, this is, you know, the old mill, you know, there was 8 to 9 inches of rain that night. We do have sympathy, empathy for the people there, but we've explained to Mr. Smith several times, we're not the enforcement agency. We don't have regulatory We don't regulate or have enforcement authority over impounds. And there was no emergency action responses implemented because no one called 911. No emergency call from me. I mean, war boots on the ground will come if you call for emergency. But no one called. We weren't even notified by him until almost a week later that they had been abandoned. VCR did not invoke emergency response procedures or determine that emergency existed. So there was no emergency response for us to be, yeah, they are in violation, which we know that, but again, we're not the enforcement. Enforcement is VCR, which, you want to say anything about that, Mr. Felsermonica? I mean, I know you're all working with them and they're going to regulate it and get it, you know, and then we'll have a copy of it on hand.

and that's that's where it lays so i would just say that dcr is actively involved and they are the regular agency come to the market for me please mark So to my knowledge, DCR is the regulatory agency, and they are actively involved in working with the dam. Either they submitted a formalized letter advising them of the status of their noncompliance. And we, as Emergency Management, we're definitely in support of any action that needs to happen. We are to be a stakeholder and a community partner with all of our dam owners. And at their request, we work with them, help them, give them guidance. participate in tabletop exercises review their plans and things of that nature but we can only do that when those dam owners that are required by the regulation to submit that to us so our plan moving forward is to reach out to all of our dam owners and ask them if they do have an emergency action plan would they share that with us which they are supposed to do but we can ask them And our plan moving forward is to, at least on an annual basis, reach out to each of our debt owners, let them know that we're interested, and if we don't hear from them, then we will let DCR know that we have not heard anything. And I feel like that would be our due diligence.
