Okay, we'll call this meeting to order. This is the regular meeting of the city of Callaway Board of Commissioners. It is Tuesday, November 18th, 2025 at 6:00 p.m. If you will stand with me, Commissioner Pelier will give the invocation. Commissioner Griggs, would you lead us in the pledge, please?
Lord, we thank you for allowing us to gather today, and we pray for your guidance and making decisions for our citizens in our city. We thank you for our first responders and we ask that you bless them and their families. Please keep them safe and let them go home at the end of their shift. We thank you for our citizens and our employees that make Callaway a great place to be. And we pray you bless them with peace and success. In Jesus name we pray. Amen. Amen. Deputy McKenzie, we'll do the Bay County Sheriff's Office statistics for October. Good evening. Good evening. Hope you are all doing well.
We had during the month of October, we had uh 32 traffic accidents reported, uh 49 arrests made, 1,158 calls for service. We issued 108 citations, patrolled 23,630 miles, and over some of the speed bumps, and uh and we had 143 traffic stops. Um you asked for some traffic data, uh for the month of October, we had um 32 reported. Uh five of those were parking lot uh traffic accidents. Uh 25 non-parking lot crashes. Four of those occurred at of the non-p parking lot crashes occurred at Highway 22 and North Tendle Parkway. Two of those occurred at North Tendle Parkway and 87th Street. Two of those occurred right at the entrance to Walmart. And two of those happened at Lower Street and North Tindle Parkway. A lot of contributing factors there. Drivers failed to yield the ride of way. They followed too close. Careless driving. failed to keep proper lane, ran stop light or stop signs, uh improper lane change and improper turns.

Uh involves the um legislative uh paving engineering that we have on South Gate. Even though we're breaking up the the paving, um the engineering, as we pointed out, the engineering is going to be done for all phases and that's what we're actually approving. Um reason I'm restating that is that we brought that up uh that way in the meeting. So I was thinking that at least that point needs to be put in the written minutes. Now, I may be overthinking this, but you know, it may be a year or two years or three years or so before we, you know, actually get to the paving and get to phase three on it and all that business. So, we need to, you know, make sure we have the reference back there. Now, city manager knows it, we know it, engineering company knows it, but things change in two or three years. So, But that task order did we we removed the third?
Actually, we removed we removed phase three. We removed stage three. No, we removed not the engineering. Yes, we removed the because this is just the engineering. We removed that part of it because we knew there was no way we were going to have enough to go that far. So he resubmitted the next day a revision. say he was going to send a revised lowered amount. Yeah, it was it was a lowered amount. I I sent that out, did I? No, I sent that out to us. Okay. But that wasn't done at the meeting. Well, he talked about the meeting said he would that the one that was in our packet was old. It didn't have that reduction in it. He was going to send it back the next day or something.
So, we approved we approved that list. We didn't know that was discussed. We haven't approved the engineering for the entire project. No. No, I did not do the first two phases. Yeah. Just the first two. Yeah. Yeah. That's what I put in there. Um with the removal of the third phase. Yeah, we removed the third phase. There was no way we were going to make it all the way down to the zor. Okay. Well, that means that the minutes are correct. Yes, sir. Okay. And I'll make the motion we approve the minutes. Okay. Right. This is our second and final reading. Ordinance number 1131, an ordinance reszoning from R 6M, residential single family homes, mobile homes allowed to R5 residential single family. A certain parcel of land line within the city of Callaway, Florida consisting of approximately 3.37 more or less acres. Said parcel is located at 610 North Kimberell Avenue, Callaway, Florida. Partial ID 0620620000000. All is more particularly described in the body of the ordinance repealing all ordinances or parts of ordinances in conflict here with and providing that this ordinance shall take effect immediately upon its passage. This is resolution number 25-25, a resolution of the city of Callaway Bay County, Florida, adopting the final budget for fiscal year 2425 and providing an effective bid. city manager.
This is just the final clean up on last year's budget. Start getting ready for audit. I think these are items we had already approved through the year. Yeah. Resolution 25-26, a resolution by the city of Cowway, Florida to support construction of sidewalks on the west side of Bula Avenue from Cherry Street to John Bgore Park with transportation alternative program funding and providing an effective date. city manager.
Uh the application process for the lap grants has come open and as we talked about in redoing south redoing Bula that we were going to remove those bike paths on each side. This is going to be an application for a lap pro uh lap project to put the sidewalks on the west side. Anybody have any questions? You're going to remove them after we get the grant or as we process or are you going to remove them now? I guess but the bypass will have to come out when we redo the street. So So they're going to stay there for now?
They'll be removed. Well, they're part of the street. So it'll they'll all be removed. All of that has to be removed before we can over we're applying for this grant to put a dedicated sidewalk on the west side. Does that make sense? If you drive down, you look at it. the the what's on there now. Yeah, I understand it's was it wasn't even I think they did that after the fact because it's a total disaster and I it's like what a two three foot path on each side and you you can't really leave that and try to pave between it. So it's just going to all be taken up. So you're going to pave it and three years from now put a put a sidewalk in.
I think we had talked about that at the meeting if we get if we get the grant. Yeah, maybe four years. We get it. Any other questions? No. Anyone? Would anybody in the audience like to comment on the grant submission for sidewalks and view? Yes, ma'am. So, if we don't get the grant, then we won't have sidewalks at all. Is that correct? Or will there be any plans in the future to put a sidewalk? I would imagine that if we don't get the grant at some point in time, we would probably look at the city putting sidewalks or something.
Yeah, we I mean, we can do that. The issue is what you're dealing with is what's there now is not a sidewalk. I mean, it's it's a oneway on each side. And I I mean, I've drove down it many times. I don't see people walking that close to the road. Generally, they're walking off on the side. We have such a huge rideway through there that we keep maintained. Most people that walk are going to be off the road. Um, this is a much safer alternative because technically that's not a sidewalk. It's a bike path and it's supposed to be for bicycle. I got you. Okay. Yeah. So, we really don't have a sidewalk on there now that's usable. Okay. Okay. Thank you. Anybody else? Not seeing anybody. Would someone like to make a motion?
I'd like make a comment on on this. Um, it's important that we get the support of Exactly. Everybody out there and all the all the citizens that may be listening to fill out this application because the way the system works, we get graded on the need and and the actual participation of the citizens. So um wanted to bring that up. And also that being said, there is forms over here.
If everybody would wouldn't mind, you could stop by, fill one out, and just sign the bottom of it. It's just a letter of support, and that gets put in with our application. way this works. We're in we're I can use the term we're in competition for x amount of money, x amount of dollars. And the the more people that we have in Callaway that uh are helping us get those dollars, uh that helps our grade.
We get points for the letters of support. So the more letters, we've been very successful in getting these grants in the past and that's a big part of it that we do have so much community support. So yes, please fill out one of those or take one with you, fill it out, and drop it by city hall. Now, there's a time frame on here and I've forgotten what the time frame is getting this in. January, February, I can't remember. December. End of December. End of December. End of December. Okay. Thank you.
And and John, I I I'll recognize you slightly, but you're my little ace in the hole. John helps me out a lot with our lap stuff. He he makes sure that I stay very compliant, and I I don't want to bring him up too much because I don't want anybody else poaching. So then if that happens, he just won't get any more work. I have to threaten him with it all the time. Would he like to add something to what we've already said? John, would you like to speak? Is there anything else?

yes. Okay, we will go on to item number four, Brit board CM 2025-04, West Cherry Street sidewalk construction. City manager. You want me to? I can. Um, we issued an invitation to bid on se September 17th with a closing date of October 20th, 2025. This is for the West Cherry Street sidewalks. Um, six bids were received with BCL civil contractors coming in the lowest and was approved by FDOT. So, we do recommend awarding to BCL in the amount of $23,3418.
Wonderful. I see that was a very competitive bib for BCL. Did anybody have any question or comment? Just one question. Why liquid damages at 9004? That's right. But that 94 FDOT requires it. Pardon? FDOT requires it. They have a certain amount with their projects. Any of their lab projects, they have a certain amount per It depends on the amount of the bid based on the They have a percentage for that. I don't know why it's a weird number like that. There each tier is an an off number like that, but that's WHAT YEAH.
NO. OKAY. SO, it's a percentage of the bid amount. It's not a percentage. It's just they have tiers. If the bid is between these two amounts, this is the amount liquid damages has to be and it goes up from there. It's the state. Yeah. What do you want? question. I'm just curious why thresholds. This is I'm just curious the CWR contracting, where are they located in They're here. I don't know. They're They have one. They have an office here. 31. Yeah. Yeah. Oh, yeah. okay we've got a motion and a second there any further discussion if not all in favor say I any opposed motion carries we'll go on to item number Five. Change order number 15, Tetrate Tech Public Assistance Consulting Services 2018, Hurricane Michael, city manager.
Uh, this is the same one we see every six months. We're just extending their performance contract. It's no cost. We only do them in six months in increments. And so, we're we've run out of time and we're going to extend it another six months with no cost. And that actually should be June 2026. It says 25, but it's actually You already changed money. I sold that in there. And if we're not done in 6 months, we'll extend it another six months. So, but so far they're still within their budget. So, it's just getting the work. There's no more money. Yeah. I I just have one question. Where are we at total wise that we still do reimbursement from FEMA?
Mr. Schultz, are you aware of hand? The majority of the money has been received. We received the last payment the end of last fiscal year for debris. Right. Um so it's just clean up on some of the smaller projects that we're working on. 100,000 200,000. Yeah. And then the mitigation money, we have not seen any of that yet, but that's not the people, right? Okay. How much are we talking in mitigation money for the generators? 600. Okay. Okay. Right around 500. Okay. 500,000.
Yeah. We should be getting 164 cleared. That was the drainage at Bertha Bridge. Um they did another RFI on the generators for some asbuilts. The wind retrofits those and those just cleared. Swan project. So, I think the only thing we're really outstanding with right now are the ASUS on the generators. Okay. And I've been working with Cole Pepper to finalize those. So, we're close. Yeah.
Okay. Great. Any other question about this Tetrate Tech extension? Did anybody in the audience want to comment on the Tetrate Tech change order for time? I'm not seeing anybody. So, we have a motion and a second. If there's no discussion, all in favor say I. I. Any opposed? Motion carries and we go on to item number six, Cherry Street change order number two, American Sand City Manager.
All right, this is our wonderful Cherry Street project. Um, we had requested that we complete all the change orders prior to uh prior to start of the project. We are getting very very close. I do have Hunter Shaw with American Sand and I think he brought a team and John Ogamman who is with DRMP who is the CI on this. Um so basically this these are the cost increases. I'm going to let these guys get up and and explain it and go through it 100% so that I don't stumble over stuff. Um American Sand is very committed to the project. They've been great to work with over this whole thing. We're very excited to get this thing started. And I believe Hunter's going to actually give you a date, right?
Oh, I'm not the one telling you. He's going to give you the date. Okay. Is it Is it 45 days from that date or he's giving him a date, not a time frame? All right. So, we uh we had a motion to proceed for December 1st. Um we are actively working on preliminary things now. We plan on starting uh first week of December for the change order. Do you want me to go through
just broad base? Just kind of broad base so they kind of understand you know um when we uh had our original contract there was some few discrepancies on a couple of the uh line items for the bid form and we ended up uh having a change order to true up the quantities and all. Um, we've since had to make a few changes or the project's had some changes, had quite a few changes, and we waited until we got to the point we're at now to to come up with this final change order because it also had to include the cost increase of materials from the price they were in 2022 to what they are today. We submitted invoices from 22 and then what they are today for these numbers and John then verified them. But more or less, you've got a start a new uh modification to that whole beginning portion of the job and it was 185,86,59818. Then you've got a deduction of $57,147.60 from the uh the south side of the Cherry Street sidewalk and herbs that was basically funded by a different deal. So, they took it out of our contract. It's $57,000 deduction there. And then the rest of it was uh on line item three was uh the cost increases from the asphalt from 2022 to the asphalt prices today. The same thing with concrete and same thing with the base materials for rock. The city had already paid for uh the materials on the drainage and pipe structures. So, all that none of that changed. We didn't change our labor price. We didn't charge for any of that stuff. We left left all that alone. We just charged for the different from the cost increase of materials from back then to today's numbers.
Hunter, I want to I want Let me jump in here real quick. I want to make sure the u So he supplied us with the invoices from then that were original to the contract with the invoices of the prices today. Those were submitted to the CI or third party engineer. So he verified all that to show that that this is Hunter's just charging us our the cost increase. It's not there's nothing else more to it. I just want to make sure that was stated real well that we verified all that that it's that it is just cost of materials. So did the asphalt increase? Yes. Yeah. I thought that was going down.
Well, so it was going down from from what it was a year ago. Well, three years ago it was low. So,
I think it was around 72 to $74 a ton whenever the job did and now it's around 90 $95 a ton. Um, and then the line item four for change order to um is the uh big form calls for 12 in of GAB, which is graded aggregate base for the roadway. Um just recently when we were going through some stuff with the um the engineer design that designed the project we had a little miscommunication on that they wanted to actually go to 16 in which they did call in a spec um inside the plan. So, we ended up having 4 in of additional graded aggregate base that's going to be um throughout the whole project and that was a pretty large increase in price, but it was uh basically to go for 12 to 16 in of GAB um is what line item four is there. It kind of summarizes them all on the next page.
Are you the engineer? No, I'm the contractor. Okay. And then uh total amount that was 1,45648925 added to our original contract
which if I read this right brings the total contract to 12,257. Yes ma'am. That is correct. Which is still much lower than some of the bids that we had gotten. Yeah. Our second bid $18 million. We have we all know the the history on this and u um there is nothing but appreciation for you sticking with this. Absolutely. Because u several years ago more than several years ago you could have gotten out of it.
That's right. and you chose to stay with it and probably probably very honestly um you probably saved this city by by your actions. You probably saved this city four, five, 6,000 $6 million and all. I appreciate it. And u so thank you for that. Yes.
Um also of course Eddie knows where I'm going. So, uh, the if you're talking about the 1st of December, so then we're looking at by contract. Well, the contract days, the completion of it is still 360 days. Yes, sir. Even though we're dealing with 1410 to extend the contract. Yeah. So what I believe what they did is they took the original notice received date and then they counted the days between that date and December 1st of this year and they've added that to the 365 days to allow us to start December 1st and still have one year to Right. Okay.
So So and just so everybody understands we're under contract. We're still using the original contract. So the the days that we're adding on even though it looks like it's a thousand he doesn't need a thousand days from today. That was from the date when we very first had the original notice to proceed. So after December 1st, they'll have 300 360 360 or 365 something like that. He's got a year documents at 360 365. I'm sure we're going to have some rain days in Sure. Sure. Hopefully
we first of we've been actually on site in the last week or two doing some survey work and stuff like that. We will be we will be underway uh right around 1st of December. Thank you. That's all I've got. Anybody?
I I have a couple questions. I have some comments really. You know, uh when when uh we were running for election, city manager u was going to put on the agenda which we took off that we're going to have a cost increase on Cherry Street right at 560,000. Now we're at a 1.2 million. So, in less than a little bit over a year, u the cost of Cherry Street's gone up another 600 $700,000. And um obviously we again missed something that we're adding. And how many more change orders do you think is going to come, city manager, on this project that we've missed that we've had been thinking about meeting for for three, four years? Well, a a biggest part of this change order also has to do with the aggregate issue going from 12 to 16.
Um, the bid form had 12 in, but actually the spec sheet had 16. So, he bid it at 12, but now it's recently come up at 16. That's a majority. What is it? 600. Yeah. Uh, about 600,000. Yeah, it's about 600,000. So, that's something that's very unexpected. But who missed that? Who missed that? The engineer. I guess I would say it's a $600,000 error. And who made who made that error?
Well, I that's a great question and I'm assuming the engineer provided us with the bid tabs and he just put the wrong he put 12 in on the bid tab, but the spec sheet actually had 16. And so it would be I guess it would be an engineering issue on
it would go with engineering issue again like we did birth or bridge. you know, we we're paying these engineers good money and then who ends up paying the taxpayers out there and we're sucking it up. You know, that's what, you know, really angers me is that this project is going up because of an engineer again, you know, and we we up here are just sitting up here and allowing it to happen. You know, we're not, you know, we're not holding our engineers accountable. And that's what angers me is that we're sitting up here and allowing it to happen. Well, I guess the only and I'm not here to battle either way. I'm just telling you that our engineers doing their job. You're the one that's making the decision on these engineers.
Well, I I'm going to I mean, I don't know that we I mean, if I could say one thing, I know you know it's a price increase. Now, if it had been right from the start, it would still be the same price. So, mayor, if we've done the survey right from the start, we wouldn't be here. This project would have been done years ago. And you all, but I'm not talking about the survey. I'm talking about the the 16 in as opposed to the 12 in. Understand that that would have still come out. That would have still been the same. Yeah, that has nothing to do with the survey. Did you have anything?
This has nothing to do. It just goes with that. We're paying engineers good money. And with Ber Bridge and this project and other projects, it's always the engineer and we accept it. There's anything else you're looking at? Thank you. I just want to thank you for coming and briefing us and uh going through this, but I did have a question for you. Yeah. Um and I did talk to city manager about a little bit. Um and he said the aggregate, the extra 4 in is definitely required. Um, can that be reduced at all? That's out of my that's out of my Okay.
But I I I don't believe so because the question had been asked. Um, but I don't I don't believe so, but that's that's not not for me to say. Is anything holding you up? Is TCO okay now with y'all? I think we're good now on TCO. Okay. I think we're good on T. I think we're good on everything now. Okay. For the most part. I mean fortunate and and one of the things that we discussed was we wanted to really fine-tune it and John has put in a ton of work and I know American Sam's put in a ton of work cuz you know they don't want to have to come back anymore and I pretty much said if you come back you're on your own. Well, thank you again.
Let me bring up one thing. Um we had a lot of pre-purchasing of particularly as it related to the drainage and storm water all the types. Uh now um have we I guess I can just see uh the possibility of change order coming up because the age of materials you know sitting out as long as they have been. That's a good point. We considered that and we thought that might be a problem. We thought there might be some stuff to do. Our suppliers have inspected it and we're we're going to be all right with the site on site. Okay. Yeah. All right.

The thing I want to say is that you guys sit up there and you try to draw the attention to the difference in the pipes from the 12 to the 16. This has been hampered with issues from the beginning. whether it's the survey or the issues with Tiko, nobody staying on TCO to get everything done. But I mean, it started off with the survey of not doing a new updated survey. That would have caused a lot that would have cut a lot of issues out. And just as well as if we would have stayed on Tiko doing what they needed to do instead of hehauling around for the last what two three years with TCO getting their stuff done. And another thing is, you know, I hate using that word, but we're going to I'm going to use it again. You know, you s people sit up there and gaslight that, oh, the difference is is is the pipe. No, this has been going on for the last three years. And my last thing is is that Commissioner Pelleter said, it's always the engineer's fault. When are we going to stop using them? When are we going to find a competent engineer or start holding them accountable and making them if they make a mistake then they should be somewhat responsible instead of coming back to the taxpayers. I know. I'm tired of all the change orders and we're not talking little change orders. We're, you know, this is like a 1.4 change order. And I I find it ridiculous that you just use the TAXPAYERS AS A BACKUP, you know, when something goes wrong with our engineers.
I know. I want to just make sure we know it's a 1.481,000 1.481 481 million change order. So don't want to understate it. Don ending 431 time to pass. Like to ask the city attorney, do we have any thing we can do for Tito and AT&T messing us up or not? I mean delaying us cost more money. No. Okay. No. Like so we went through that before. It was either we could go do the work for them and then try to charge it or wait for them to do it. And so we we didn't want to put the money into it to do Tikico's work for them. Okay. I just want to know.

I'm going to make an admission here because people have asked, you know, what part of the delay? And very honestly, I said, you know, you can look at me for the delay of what's going on. Um because uh I can take my share of the responsibility because we were originally looking at correcting the the the bumps and the dips and everything on Cherry Street. We were originally looking uh and planning on the the paving and deep paving on the U Cherry Street and then we realized with the engineering that we did get that the storm water
was a problem because some of the original storm water installation um calculated with water going uphill and you know I think I learned in grade school that water goes downhill not uphill. Yeah.
So, we realized that what was going to happen is if we're going to solve our storm water issues, particularly with cherry, that we need to go ahead and since we're going to be tearing up the road, we'll go ahead and add um storm water project to that. And to that, would we um Commissioner Pelleter, would we we went ahead and approved what 1.4 1.5 million more Mhm. for the storm water improvement.
Well, what happened was, and that's why I say we I'm responsible for that because I voted for changing everything to where we add the storm water to it. And unfortunately that ended up creating issues because the engineering um uh that we had done was related to the street paving
and we did not uh and there's responsibility here not necessarily in my my court but um we did not go for the additional engineering as it related to the entire project. And um and the decision there was to try to save 30, 40, $60,000, which actually that cost us quite a few years and actually some more dollars. So, but u this started out. I still stand by. The delay was because I as a commissioner and the rest of the commissioners voted to
to add this particular phase to it. Yes. And I stand by that decision. So I have one more question there. Please I would I would add something to that also. And Commissioner Ashley's not going to remember this, but we didn't handpick this. This was part of a um state appropriations grant and also a lap grant. This was done off of RFP or RFQ, one of those two. I don't think I get them confused all the time. So, this wasn't a handpicked engineer. This wasn't one of our continuing contract. Was not a continuing contract thing. This was I was about to pull that up.
Forbid the design in 2019 with this wasn't the city picking an engineer. This was done by a committee of citizens that chose Yeah, this project was too that chose the engineer for the project. Oh, and and also by the way, the sidewalks. We had brought up the sidewalks, but we were getting grants for the sidewalks and we had grants for one side for the sidewalk. If we put if we' done all this on time, we would only been able to put in one side of the sidewalk as far as money was concerned. And then after because of the we were able to get the other side funded with the grant.
The south side is funded with the lap cr not the north side. And I you know and I will tell you that there was an issue. We were very concerned when it went out for bid because we had to bid the sidewalk out which had the potential to be another contractor. Fortunately, American Sand, who knew they were going to already be on site, they were able to bid so competitively that they won that bid. So, they can actually do the whole entire project as a whole, even though it's going to be built separate. The sidewalk will be built completely separate from from the road and the sidewalk on the north side and the drainage so that we'll be entitled for that money to come back to us. Yeah, just a quick question. I'm assuming this increase is all coming out of infrastructure. You would have to, sir. I'm I'm asking the question, you know, I know it would have. We got We got this late on Thursday and I I really have not had an opportunity. Fortunately, while it's not going to be budgeted this year, we'll look at how it works out and how we'll budget out through next year's budget, too, and just try to roll it the best that we can to make it work.
Anything else? Get towards the end of the year, we 100 stop sending invoices till we can make it a couple months and then hit us all October one in the new budget. I would suggest we do a change order to the budget this year and get it done. Add this 1.4 and be done with it. Then we know where we stand at the end of next year. Keep in mind I will not be here for next year's budget. I just want to make sure anybody Yes, ma'am.
Um the Cherry Street sidewalks are parallel. How did you just have a BCL contract for West and then you're talking about North and South? That's that's too many sidewalks. That's is that's a totally separate project. BCL is doing a sidewalk from Tindle Parkway to um Little Park, which is other side. I see what you're saying. That's a LA group for those and it's going to connect over near the cemetery. Okay. And then over here, it runs east and west, but we talk about the north side, the side, the sidewalks on the north side, the sidewalks on the south side.

And and because one of them drove you, so was driving me, right? Yeah.
So, thank you to staff. It was a great job and everybody was real pleased with the parade. Then I know this is a big thing for the community. Between November 12th and 15th, there were a lot of events going on related to the commissioning of the USS Pier. I always thought the city was Pierre, but it's Pier. And the mayor from Pier was there, so I think he'd know how to say his city's name. And one thing, it might be interesting to y'all. I listened to a legislative preview yesterday. RIA cities had a webinar and there are actually seven house joint resolutions that they have come up with that all relate to property taxes. So they'll determine which one of those is going to go on the ballot. So I'm going to do some more research on them, but it might be interesting to if y'all want to look at them. There is not a house bill or a senate bill as yet. So we'll just see what's going to happen with that. But there are seven joint resolutions at the house. They'll have to decide what they want to put on the ballot. And I know this morning the ribbon cutting for the human being. I wasn't able to be there because I had a transport transportation disadvantage meeting, but I appreciate you mayor promp for standing in for me. So, and it's good to get in. Yes, ma'am. Um, met with the city manager a couple times. Um, toured the city and looked at all the ongoing projects and all the future projects because there's a couple that are coming up that we're looking at doing. Um, very informative. Of course, we got to talk to a couple contractors and couple of the workers out there. Very impressed with our city workers. They're always hustling. Attended all three of the commissioning ceremonies for the USS Pier Pier um ribbon cutting today for the human being. I had to miss a couple um events. I cracked a couple ribs a couple weeks ago, so I was a little laid up for about a week or so. So that's all I have now.
Thanks, Commissioner Paliter. I didn't know we had a ribbon cutting, a human being. I guess my email got lost, but I found out last minute. Yeah. Uh, city manager, other than your updates, I had asked a couple three, four weeks ago about that sign on Jendo Parkway and Seventh Street. Do we ever figure out what that is? There's a big sign there. Oh, yes. Yes, that is actually um that's the lift station project. The CDBG we did and the contractor did. Oh, okay. Cuz that lift station right there is actually one of the projects that we're working on. Okay.
It took me a while to figure it out, too. It just it's the for CDR stuff. Yeah. Commerce requires them to put it up there. Yeah. I They wouldn't put We didn't know nothing about it and everybody's calling. I'm like, I don't know. and staff is trying to figure it out. Unfortunately, they identify everything with numbers. I don't know numbers. I know project names and so Okay. Well, good to know. Um, and the other thing too is that I never got an answer as to why do rated the birth of bridge good since it's brand new.
Um, I contacted DOT. Dr. Bryant Paul and you were there with me when I did that and he was not sure. He didn't know anything about the website and he was going to uh he was supposed to get back with me on that and he never did get back to No, he never should know. It was last inspected on March 31st, 2025 and it shows a rating of good. It's kind of weird that it's good when a brand new bridge it should be excellent. Yeah, my mind what's funny is either poor construction or you know it doesn't meet excellent you know it's in between. Well the report that I got it was a 99 or 98% health rating.
Yeah. So I don't know why that that's why I was confused cuz I'm like no it said it was excellent rating. So I I'll just I'll have to follow up with DOT. Okay. Was it done by one March by the way? Has it done by one March? was open by then. Yeah, it was December 23rd at 8:00 p.m. open by Christmas. Ask me that day. That date lives in infiny in my mind. I'm so used to going around now, especially with roundabout, too.
I I do have another comment too, mayor. Um I got contacted by a citizen that lives on Betty Louise about the three stop signs in a row. And uh I don't know if she's here this evening or not. All right. Uh, we'll start off with the um the flexet, the ice bridge was installed. Um, the electrical was finished today. Uh, we're now waiting on FPL to come and set the meter. and that will go active and we'll start our conversion process. We have been converting everything out off the other tower. Uh we have a couple of small hiccups. Not it didn't hurt us because we're doing dual reads, but we found some some some things that needed to be corrected and so we'll start working on that conversion on the flexet over the next couple of months. Of course, the holidays are going to kind of mess everything up, but we'll we'll we'll go ahead and start and get that one commissioned out as soon as we get a meter set in there. um got a lot of comments. Uh we went down on Lanny Row and we repaired that spillway. A lot of people don't know, but after the hurricane, it was damaged pretty bad. Um to the extent that the spillway level was actually lowered because the bricks and everything that was on it was bad and we did some some modifications, but we've raised the water back up to the normal level. It's a full brick higher that's allowing us to get in on that lake now, which was at the time it was very very clean to an extent. Um, but we actually we drained that lake down pretty low so we could check out and see what the bottom was like. It does have a huge muck layer. Um, so that kind of tells us where we can go from what we need to do to continue to improve that lake. We've since raised the water. The water level is back up to the original water level that it was at pretorm. So, it is back to its original water level. We did go in today and do a quick spray on it. Um, and the gentleman Jimmy Clark who's been doing our leg stuff, he he basically he came in did a very quick spray today and he said within two legs you'll see that leg's going to be clear.
Within two weeks? Yeah. About two weeks. You said two legs.
Oh, two weeks. about two weeks you'll see that lake is going to clear on up. Um and then I've worked with another company to work on cleaning up on the north end of that. We've got a couple of proposals. We got to figure out how we're going to work them into our budget. They're they're actually a lot less than I expected. Uh we're talking about two phases on this. Um we're not going to be removing debris. We're going to relocate the debris. So, uh that that's going to that basically cut our prices down tremendously because the biggest issue is hauling it off. Um, so we've got two phases, one on one side of the lake, the phase two will be on the other side. They're talking bringing in a floating excavator, 68,000 per side, um, which is actually relatively inexpensive compared to what we thought it was going to be and the some of the original prices we got. So, we'll we'll be looking at that for a budgetary thing. Um, and it will go all the way up to Veterans Park. We'll clean it all the way up. it'll go all the way up and we can open up all that water. We got some beaver dams back there. We we droned it, looked it over really good so that we could see what was going on. Um but and then once we get everything pretty much cleaned out, then we can come back and we can start treating that muck. And we do have uh some chemicals that can go through that'll start taking care of the muck in the bottom of that lake. It'll increase it and also cut down on all that vegetation that's growing in there. Uh the road cuts at uh Lake Drive and Fox. I sent y'all out. We've got those that road is blocked off. We've got it prepped. They're coming in first thing in the morning to do asphalt on Lake Drive. We're also having to do a section on Fox in front of some apartments. Um and that's cut out and ready to go. So, they'll come in in the morning and they'll they'll get that paving work done and get it completed. uh Hugh Thomas project. Uh they've ran into an issue with the the water line on the county side. They're working through that right now. Still don't think it
should be any delays on that project, but we are just putting in a spine road. And the subdivision is still they're ready to start, but you you know, we got a slight land issue that they're trying to clear up before they wanted to go in and actually start building. the one where the uh pipe that they spotted was 8 ft away from where they spotted it. Yeah. Yeah. Yeah. Yeah. The locate was about 8 ft off. And so, but they're working through it. They they don't think it's going to be an issue. They have other things they can do. They're just going to they'll figure out that when it does happen,
um we will shut down Hugh Thomas for a day, right, Bill? Yeah. One day we'll have to shut down Hugh Thomas on the other side because they have to put storm boxes in and everything else. Um lots and lots of complaints today about the construction that was going on over at Parkplace. Um they were running trucks through they were just doing it out of convenience, but they were running those heavy trucks through some our neighborhoods that were over there. Was it I think it's Heather Marie or something like that. went out there and had a very nice conversation with the young man who they got it taken care of immediately and they're not cutting through anymore and they've made concessions on their new truck route so they'll just be going down Betty Louise. Um, and and and I've responded to I don't know, five or six emails today over that. And I just tell, "Thank you. Let me know if it doesn't look right." And I got a no. And I think Bob, you tell me first. And I'm like, "Oh, yeah." And the minute he called me, man, I looked up and it was just emails were just rolling through. And so, but we got that taken care of first thing this morning.
When are they going to change their They're going to do it immediately. That was already done. done about 15 minutes after I had a nice talk with it was ridiculous this morning to 7:30. I can't have you talk with an audience, ma'am. I'm sorry. Oh, I trust me. I sat down there for about 15 minutes and counted about eight trucks at least. Yeah. And I was livid. And so I said, "Hey." And I told them they could do it. Said, "When they're done, you're going to repave the street."
It's real simple. You're a paying company. You're you're a company. You do it. Just repay the street for me. I guarantee everybody through there would just be happy to death. Just let let the trucks run all week long and then you can repave that street. Needless to say, they stopped about 10 minutes later. So, uh the lift station project uh materials are coming in. We're supposed to have a that's the five lift stations that's rehabing. That's the grant that you were asking about the sign on. Um materials are in. We have a meeting I think next Tuesday where we will go ahead and do their construction notice to proceed since the materials are in. So we'll we'll do that and get that going. Right now we're on an we're under what's called an administrative notice to proceed. That puts them under contract but their date their time frame doesn't start because we had to wait five months on materials. You just can't get them any quicker um for lift stations right now. Um, Sandy Creek is still under EPA review by the core. Um, we do now have commerce. Florida Commerce is now pushing for us because every time we give a report, we tell them it's the core. And so we had a conference call um Tuesday doing I think it was Monday we did a conference call and commerce said you know we just let them know we can't do anything so they're going to they're trying to assist by pushing on their end and maybe that'll help get that on along. It's I the core just doesn't care. I'm sorry. It's and it's not Florida. It's everywhere. I had the same issues back in Arkansas. They just do what they want to do and
they have cart blanc. We had trouble with them at the airport as well.
Right. That didn't surprise me. Um I sent you an email about the roundabout. So we have um mainine has finished the storm water that's in there. Um and Roberts and Roberts will come back and they will start their construction December 1st. Um their guys will be off the week of Thanksgiving. and there wasn't no reason to bring them in off of another project to try to do anything. Um, we did a time extension on their contract because this was signed in February and they started um and that was when the AT&T issue and some of the con the stuff came up. So, uh, we took their original, um, basically their when they when they hit the ground and start and they broke ground, we took that and we have their contract out there full 180 days and I think substantial completion is like May 18th.
They'll that but uh, they they have they say they have they're not going to have any problems meeting the deadlines. The infrastructure is in they can complete and work off of that. Uh, and y'all got an update from Hunter and I will be arranging for a groundbreaking. Y'all bring your shovels. I'll bring my pale. Mr. Griggs. Okay. All right, ma'am. I got I got two things I forgot. One is city manager H. Cruz. Where we at with that fixing that?
Okay. So, um I just actually Kevin and I and I need to send you the final revised copy of the punch uh the turkey paving thing. Um okay. And I need to probably I can send it for you. We're ready to put that out for bid, which this is what would fall underneath that. So, we're waiting for that contract.
Well, you can go. So, here's here's also another little snafu that we're going to have. Um it's going to be a budgetary issue for this year. Okay. We because of the Bula the cost of Bula the cost of South Gay even though they're reimbursement or the the South Gay will be a reimbursement when we budgeted all that we're going to be hitting short on our paving money. Okay. And so that being said,
we won't be done this year. Well, I think if we go a couple of months and see where we're at and I think we just need to get into and see what's going on. We need to see where these contracts are and we're going to go ahead and put out for uh put that um turnkey paving, whatever you want to call it, cuz these are push button push button. And then that we'll also hold off on some of our other things that are actually in our budget to pull under that contract too, such as Patterson Park,
um Viola, should we'll just see what the pricing is going to come out. I don't think we're going to have enough money to do viola this year. I think I think we under we undersshot uh the numbers on that one pretty bad. And last thing was that u which I need to make a comment on because I'm always complaining about the water department. I've made three phone calls in the last few weeks and they're Johnny on the spot. So whatever happened in the past, they're on the spot now. In other words, the water's not leaking for four, five, six days or two weeks at a time. So I call the next morning that evening it speaks. So whatever has happened in that department. Thank you.
Thomas is Tom Tom. Bill did a great job with the with the the hire of uh Thomas our our supervisor utility supervisor. I get a report every morning how many active leaks we have and what our schedules are. We do have a couple of leaks right now that we're having to do locates. One of them's on Cynica and 22. When are they going to do that one? Do you know? Probably next week. Okay. I think there's one on Senica and Seventh Street, too. By Aldi's. There's been a a leak down by Aldi's in a road for about a week or two now. Senica right there. And seven. Yeah, there's been water sitting here.
I think I I think we fixed that one already. Yeah. Um I if it's been fixed, it's still leaking. Okay. Well, then we need to take it. I know they fixed one down on on Yeah, it was on Senica. No, it wasn't. It's on Chameleon. I just But I just wanted to mention, you know, they're a much improvement as far as fixing water. They've also brought in a new is he our foreman water foreman Jacob? Yeah. Yeah. And Jacob is is is one of our new guys and we're
they're raising the bar on these guys. Um, and and a lot of the leaks, I will tell you this much, they're not we're not patching leaks anymore. This is one of the things that y'all complained about for forever, and that was, why do you keep going back to the same spot? Thank you.
So, when they go back to a spot and they find a leak, they're uncovering it all, they're pulling the whole entire line, and they're trying to run they're trying to run new lines straight through. Um, and so it that has taken us a little longer to catch up because we're doing that process. Road cuts, anytime we do road cuts, we're we're laying sleeves in the ground and going through those so we don't have to dig up roads anymore. Um, there's been a lot of processes that have changed in that department and both water and sewer. And the guys are excelling. They really are. Um, but it's a lot it's been a lot more work on. But you know, the whole thing is is like once you get caught up and you get ahead, you're not going back to the same places over and over and over again.

Hi, I'm Chambbury at 8105 per drive. Excuse me. So, my concern is about the speed limit and the stop signs on Yellow Bluff Road and that's the stretch of road between Star Avenue and Betty Louise Drive. The road is less than half a mile long. Excuse me. The speed limit is only 50 m hour, but there are two three-way stop signs within a span of 0.2 miles or 352 yards. So, I want to know why this is necessary. I think the stop signs on the side road should be adequate because directing onto Yellow Bluff and not having the stop signs on Yellow Bluff themselves. So we've got Colin first square which is shaped like a crescent. So it has two exits onto Yellow Bluff. The first threeway stop signs at the first junction of yellow bluff road and Colin first and that's as you turn onto onto Yellow Bluff from Star. You you've gone 176 yards and we got a three-way stop sign. Um, and that there's a house on yellow left 75 75 53 and they park sometimes at the end of their driveway and that car is directly in front of that stop sign which is which is is hazard. It blocks it. Um, the second stop sign is at the junction of yellow and Charles Court which is only 352 yard from the first three-way stop sign that I just mentioned. And Charles Cat's Court is a culdeacet with only eight houses in it. I've lived here 20 years. I think I've maybe seen the cars come over there two or three on two or three times in that 20 years. It's it's it's it's very very quiet. So at the junction of yellow bluff and and corp drive and yellow bluff road and second the second column first exit there only stop signs merging onto yellow bluff but the other end of column
first has a three-way stop sign on it. So it doesn't make any sense. So my question or rather my request is can the two stop signs in yellow bluff be removed completely? They impede the flow of traffic on what is always a very quiet road. It's 15 miles an hour, which is very slow. Um, and it seems like overkill to then add two stop signs into the mix. Um, the school the school the speed limit in the schools in the school zone during school hours is is 20 miles an hour. So, we've got 50 miles an hour going through here. And I looked up the Florida statute. Um and follow statute 316.183 states that on all streets or highways the maximum speed limits for all vehicles must be 30 mph in business or residence districts and 55 mph at any other time at all other locations. However, with respect to a resident district, a county or municipality may set a maximum speed limit of 20 or 25 miles per hour on local streets and highways after an investigation determines that such a limit is reasonable. So if it was 20 or 25, it's been lowered to 15. And then in the evening it's been lowered to 15, it was been deemed necessary to then put in two three-way stop signs on it, which I just think that's overkill. So if the reason for the 15 mile an hour speed limit plus the two stop signs on yellow bluff is to stop people from speeding and have to say that it's not a racetrack. It's a windy little road. It's not like a straightrough road where you can just put your foot down and go. It's not. Um then maybe we need to look at a more practical approach to it such as installing speed bumps, speed humps, speed tables or another method. So thank you because ma'am

Don Hendings 431 tang past uh mentioned about sign on 7th Street in Tenner Parkway. I know that action up there on that fence and all that. Are they going to replace that? Are they going to can we do something about it? It looks terrible. 6 months has been that way. I mean are waiting on insurance company? Yes, wait. We we're we're waiting on them to give us a final response. Then we're going to go in and we'll take the fence down because when they start the project on the lift stations, then they're going to go back with it. It just started 6 months, you know. I mean, it's been that way for seven months. Yeah. I've been I've been checking on that. Okay. Um and you know, we're waiting on them to go. I saw the sign through. I didn't know what it was. Give us a release, you know, so we can move forward.

Did somebody else want to speak? Yes. Now I have a lot to say. So um Teresa Leon 6031 L Street. The first thing I want to start off with is the lit the lead service line inventory which we paid 65,000 for it. Um, we were told different things about whether it was expedited, whether it was not expedited at the last meeting, but I just want to say that Panama City Beach had 25,587 connections and did the inventory internally. Panama City had 20,587 connections and also did it internally. Van Haven paid 55,000 for 9,333 connections. That's 10,000 less for 1,000 more connections than Callaway. The county paid 59,000 for 13,64 connections. That's 6,000 less for 5,000 more connections than so we've been told both whether it was expedited, whether it got expedited, whether we paid for it. In the contract, it states it is expedited and must be expedited. And then at the August 26th meeting, the city manager said at least three times that this was being expedited and the DP was happy with the expedited plan. So it really sounds like it was expedited even though at the last meeting we were told it wasn't. So it sounds like we kind of paid extra for the ex you know for it to be expedited when we had less than some of the other counties. I also want to speak on the notifying me. Um, I was just curious if the glitch was fixed because I did send an email to the commissioners, mayor and the city clerk, um, about some of the information not being included versus the link. I do appreciate the two commissioners that responded along with
the mayor and the city clerk is normal. She always she's very polite when she responds. Um, I would like to know if the assistant finance director position has been filled. I know the last meeting we had prospects. We were going to set up some uh interviews and stuff. And as far as the letter for the sidewalks, I mean, wouldn't that be a good thing to put on the city uh Facebook page so the citizens would know so they could actually show extra support? I know that our city Facebook page is not being utilized. Um, I know it is some it's not being utilized the way it could be as far as amounting to people. Um, I don't go to the city website to, you know, check what's going on, you know, every day or whatever. I kind of look around and, you know, see what people are posting or go to the the city website or the Facebook page to see, you know, for the announcements and everything to share with other people. I have I have one question, mayor, on that comment on that contract. City manager, did we overpay on that since the other cities are being charging less for more work?

I I'm I mean I was they had more. we may have well it also has to do with with what documentation that you have to be able to help whenever they go through. So you know the county runs their GIS so their GIS is very robust for them. Our GIS which the county maintains we give them the information every year. So they did utilize our ours. Uh was it expedited? Yes ma'am. It was expedited. Damn right. It was expedited. We we couldn't sit around and not expedite it. We had to have it done. We were we were delinquent. So, it was expedited.
Why at the last meeting were we advised that it wasn't? What did I say that said that it wasn't expedited? We had to get it done. I mean, if if I I apologize if if I did not use the word expedited, but yes, we had to have it done. We were almost about to be under consent. probably we end up paying extra to expedite it. Yes, ma'am. So concerning the red service line inventory. Well, first of all, Bay County did theirs a year in advance of the due date. But anyways, so at August the 26th meeting, our city manager said he received a letter in the mail. His words, I received a letter in the mail. Nobody knew that this needed to be done. Not sure who received the information. None of his current staff had a clue where this came from. Bill Fry wasn't aware. Thomas wasn't aware. Well, we know now that's a lie. Uh Thomas was very aware since he took the position. Um Bill Fry was aware. He uh was CCD on many of those emails that I presented last meeting. I have an email here dated November the 20th, 2024, which is about 3 weeks past the deadline. And it's directly to our city manager and CC to Bill Fry and it's paraphrasing. We need you to respond within 15 days of this email and let us know why you don't have this done. We need to know why. Now, I don't know if he responded to that or not today. You can ask him. Um maybe he'll tell you, maybe he won't. I don't know. Um and he also said at the last meeting that he did say, "I don't think we paid to expedite this." Um, sounds like we paid to expedite this. Of course we did. Uh, and then he said at the last meeting he said his words, "I kept us from getting a fine." That's not entirely accurate because well, first of all, it's not even accurate that he received the letter in the mail. It was an email. Of course, he said he didn't see the other emails. Obviously, you're not dumb. He couldn't say he didn't see the emails and then say he got an email. You're not dumb. Neither are we. Anyways, so the email
says uh the order will be narrowly tail tailored to outline compliance um and does not seek any civil penalties. So I'm not sure how accurate that is that he had any influence on not getting a fine other than the technicality of yeah, we're going to do this now to keep from getting fined further. But they didn't go in asking for fines. They they went in seeking compliance. Um, and also this was posted in our May 2025 newsletter and ironically Thomas sent this to D and said that it was in our newsletter and that it was posted in the public works department and D has it labeled as consumer confidence information. Well, who's watching our water if he's not reading D's reports when something's wrong? Bill Fry is not reading the reports. uh when August the 26th when he said nobody knew. They had a bunch of heavy equipment out there today and there's rock and gravel all over 22 now. It was like a truck road out there with its tailgate open and it still has yet to be cleaned up. The streets on either side, I believe, belong the city of Callaway or they're private streets. I don't know. No, I
think that's county. That's county. County paved the road right next to Real Time today. They they paved on both sides. Real time fishery and general. Okay. Yeah, that's county right there. Okay. Because the people out there working on it, one guy had a stop sign. It was absolutely a real circus out there. They had traffic back all the way through star and everything else, but um if you could do something about that road, I appreciate it. Okay. Well, I'll I'll check out tomorrow and see. Most of the time when they're done, they'll go through and sweep it all up and get it cleaned off. I I go up there just before I came here today. Just I made a special trip up around there and there's still gravel everywhere all over that road.

Okay. Um, it says, "Good afternoon, Mr. Cook. It has recently come to my attention that there is an effort to remove the three-way stops on Yellow Bluff Road. As a resident at 7605 Yellow Bluff Road, I'm opposed to this effort. Removing the stop signs will exacerbate the excessive speeding on Yellow Bluff Road. I live at the intersection of Yellow Bluff Road and Charles Fax Court, and I can attest that the three-way stop is effective in slowing down traffic. I would encourage the city commission to vote down any attempt to remove these stop signs. At the very least, I would ask that a traffic study be conducted so that the true impacts of removing the stop signs will be known prior to taking such action.

Nothing. Well, I I agree that speeding is an issue in Callaway period. You know,
it's an issue everywhere. And I I kind of I kind of think that if we do remove the sign, you know, the speeding will come in being even though it's a short distance. It's a short distance in Shadow Bay and they'll go from zero to 50 in just one block. Exactly. You know, and not only Shadow Bay, it's in your neighborhood. It's in everybody's neighborhood, you know. It's it's it's all over probably the entire county, you know. So, yes. So, as annoying as the stop signs can be, I still think it's best to leave. I I just wanted to bring it up since, you know, we've had, you know, I had mentioned that we were going to discuss it. So, yeah. So, I guess at this point, we're going to leave the stop signs the way they are.
