can you notice is hereby given that the city council of the city of Caldwell biston County Texas will convene in a called meeting at the city council chambers regular meeting place thereof at 5:30 p.m. June 11th 2024 please stand for the invocation and [Music] pledges let's pray Heavenly Father we thank you for this day we thank you for all your blessing father we acknowledge you as good and everything that you do is good and we ask you to bless this meeting tonight father bless our discussion bless our decision give us very great wisdom and very great discernment on the matters at hand Lord and may all that we do bring glory and honor to you father we ask you to bless not only our city but our our County our state and our country Lord we meet you and we love you in Christ's name we pray amen amen American flag flag of the United States of America and to the for it stands one nation under indivisible with liberty and justice for all Texas flag the Texas flag I pled aliance to the Texas one state God one and indivisible would like to welcome everybody to the city council meeting tonight um that you see people sitting here usually it's not to many um no citizens to be heard on City related topics so our first and only item is discussion and possible action on ordinance number 0611 2024 authorizing the street name of access road from Old San Antonio Road to Industrial Boulevard to officially be changed to Judy Richardson Road providing for the in corporation of premises authorizing the mayor to direct replacement of street
signs providing that this ordinance shall be cumulative of all ordinances providing severability Clause providing for publication providing for an open meeting an effective date we talked about this last meeting I move we uh I move that we accept this ordinance number 0611 12024 renam in the street to Judy Richardson Road do I have a second I'll second all favor raise your right hand none opposed motion passes next discussion and possible action on a resolution for a contract to finance a fire apparatus so this is more of a a check the box kinda we had to have a resolution for government Capital they're the ones that are going to finance the truck that all approved a couple of months ago so if you approve this resolution that'll just be the next step to go ahead and fund that it should fund later this month and hopefully have that truck in service later this month as well do we have a motion do any discussion on the resolution and financing move for approval we have a second second uh all in favor of approving the resolution for a contract to finance the fire truck raise your right hand none opposed motion passes do we want to save administrative elected official reports for the work shop I've got to kill two minutes because our Workshop doesn't start until 53 let's go um just a couple of things we got written down want to talk about or the question was posed to me if we wanted to have a ribbon cutting ceremony for the disc golf course they're having a grand opening this weekend playing a tournament as well it would have to be at like 700 am Saturday
morning so see a couple of head shaking yes so we'll go ahead and set that up and whoever can make it have Melissa send something out and also want to discuss budget Workshop I'm slowly pulling all the details together on that we will need to approve the budget in July so the July 16th meeting so I was hoping we could do again is have somewhat of a during the day workshop where we had run through all those numbers I am out the second week of July so we start talking about somewhere in between now and said did I cover were we gonna just go ahead and set the workshop budget Workshop tonight or do we just you want to find out [Music] from I do have one thing um this weekend is the juneth celebration at the Expo Center on Friday I think they're doing a pre party type thing and on Saturday they'll do the parade and then again at the Expo Center so just a reminder on that I have one thing um there is a group uh at calwell high school called Genesis band and bugle core have yall received calls about noise complaints okay so it's a couple of hundred of them it's a like a prestigious band camp and uh they are practicing you have this group of drums over here this group of trumpets and tubas and all of this over here and they're practicing outside of calwell high school and unfortunately um people in Edna Hill are bothered by it however it does not violate um the noise ordinance I looked it up for these people today um they're inside and outside and it's actually quite an honor
that they've chosen cwell High School to do this they only pick like six schools in the country and this is the second year in a row that calwell was chosen for our facilities and um um if you come to Cowell high school before 8:00 in the morning in the old gym there's 200 kids and sleeping bags lined up on the floor sound asleep and so they're showering in our facilities Junior High facilities and like I said very prestigious band camp that I feel we're honored to have and they are doing a community performance on June 22nd out by the football field so it's a really big deal so anyway there was is more public information coming tomorrow from the school district or from Genesis so anyway that's all I have for now do we have a motion to adjourn the meeting to start a workshop right yes in a second no second okay meeting adjourned now notices here about given that the city council of the city of calwell will convene in a workshop meeting council chambers regular meeting place thereof at 5:36 p.m. first on the agenda is discussion and presentation By Carolyn rilla and Connie alares on drainage concerns affecting their property caused by a nearby development located at 601 A and B Temple Street okay first thank you to the city council for this opportunity to speak to you my name is Connie olis and I own the
property at 603 North Temple Street Carol rabella is from R six leasing LLC she is one of the owners for 600 North Bank Street we've come to discuss ongoing flood issues in our area today's discussion is not a matter of if we play it's a matter of when we play we're here today to continue our good faith requests to the city manager and Council regarding the drainage ditches that surround our properties we have over the years into to present day had concerns that had been met minimal to no effectiv resolution by the city of C our community west of the tracks has managed to mitigate the risk and impact of the flooding to our individual homes and property and we have also taken care to be good neighbors and remove any underlying barriers that may restrict or alter the natural flow of water through the land we are not here against rising star construction we are against the flooding we are requesting that rising star construction and the city also be good Community neighbors by respecting and making effort to understand the impact of of the current build of the two new homes in our area the foundations of the two homes can contribute not only to flooding to the neighboring homes but also to flooding on Texas Highway 21 and far Market 975 also known as Bank Street to demonstrate some of the concerns with the flooding Carolyn will present a PowerPoint and videos of flooding in this area throughout the years
[Music] yes good afternoon um again my name is Caroline R um the packet of pictures that um we're providing for you today are pictures of flooding events before the present Builder altered the state of AFF FL the common goal is to find a solution that everyone can agree upon again as con stated the properties we are referring to are 600 North Bank Street um R six leasing LLC the owners are Margaret batty carollyn Ria Michael Ria and Paul Ria 603 North Temple owner Connie olivarez 601 North Temple Builder rising star on page four we um the pictures that you're seeing are uh from the FEA flood map for 600 North Bank 601 North Temple and 603 if you turn to page five we have included pictures of 6 more Banks flooding events from previous years on page six you will see pictures of 603 morning Temple again from previous
wedd so picture number one is what page Jesse uh page six okay that is at the corner as Connie's at the corner of 21 and Temple Temple so it's item number two is Temple Street May of 2021 that is when we got what like 4 inches of rain in 45 minutes okay page seven we have included pictures of flooding at 601 nor Temple prior to any alterations of the on page eight the pictures are of the current constrution site as of June 4th 2024 on page nine are pictures of a recently installed manho at 600 North banks that could also be imp impacted by water industry in Rings The Man homeing and the last picture on um my packet is it's on page 10 and it sums up the reality of floody um in this
particular area it was a flood event from 1991 and we also sent uh some videos to the city office Prov this is from 2016 [Music] [Music] oh so that water and that truck is where they going to build right now cor right the water in the trailer yeah same kind right there Traer [Music] this is
never flood it like this there's PE to this is 21 is your house a slab or Pandy py so water is running under your house like car your mom and dad's just kind of behind itly behind so from the videos and pictures you can see that we have reached our Tipping Point which the flow water into our construction the build for prous La
the water will be blocked from the commercial flow because the landscape has now been altered andat it's a dam from the flood maps you have you can see that 600 North Bank Street 601 and 603 North Temple Street as well as Texas Highway 21 at the corner of Temple and portions of car market 975 slbank Street are in the fuma regulatory floodway zung AE and designated a special flood haard areas high risk Pera a special blood Hazard area is defined as the area that will be unated by the flood event having a 1% chance of being equal or exceeded in any given year also referred to as the base flood or 100-year flood a regulatory floodway is defined as the channel of a river or other water for and the adjacent lands that must be reserved in order to discharge the base flood without punitively increasing the water surface elevation more than a designated height to Briefly summarize events and conversations that have occurred regarding Rising Star's build on May 21st 2024 the Builder approached me to discuss building a swell drain on my property the Builder stated his purpose was so that the drainage from the roofs of the two New home builds would be able to drain onto my property and into the current ditch the Builder stated this would be beneficial to me as well as to keep his water off of my property three times I declined the offer I asked the Builder why he could not build on his own property to which he stated that he did not have enough room he then suggested creating a swell
or a ditch between the back of his two new homes and the back of the property owned by theia family I did not agree and informed him to take that up with the city and the next day on May 22nd 2024 Camden white the Builder n had an impromptu meeting regarding the build and impact of flooding to my property the Builder was again informed that be creating by creating this land barrier on my east side and the land barrier that is currently in place by State Highway 21 on the west side of my property he would place my home in a bowl effect the Builder informed Cen white that he the Builder had asked to build a swell on my property and for the use of the alleyway to build a ditch for the runoff from his properties the Builder was asked to Halt the project by cden until a reasonable solution could be found for all parties involved the reason for the halt was that it was apparent that the plans that the Builder had for the property would indeed flood my property and the property within the same block the Builder agreed to the halt later that evening the Builder approached me to discuss the situation and stated that he had halted all projects He further added that he was not informed of the flooding until I had shed him the video and that he had immediately halted on the build and that his Engineers had given him the guidance for the build and that the city of calwell had signed off on it the Builder informed that had he had known that the property flooded he would have never purchased the land and that I nor the city had informed him I replied that it was not my duty to inform unless asked and that the Builder never came to me to inquire about the area it is the responsibility of the Builder to research his properties and
that those issues should be taken with the city as the city is aware of the issues concerning drainage ditches in this area the Builder further added that he would give me his word that he would halt the build and find a solution and if the solution was not to build a house then he would not build we moveed to June 4th 2024 the Builder requested a chat during our conversation he stated that he was going to build a small ditch on his property side that would be between both of our property lines this ditch would begin at the Temple Street ditch and run completely alongside of his property into the back alley where he would create another swell between him and Thea property the Builder stated that this would benefit us both and that the water would drain into the ditches and not cause flooding to my property I informed him that by building such ditch it would cause my property to erode and firmly replied no he again informed that if the final solution was not to build a house that he would not build he continued to doze the land on his property to create a slope off from the foundations for the rain he insisted that Hamden and the city council had already given him permission to build a ditch on his property and a swell or ditch in the alley between the back of his two properties and another of per Tex's water code chapter 11.86 overflow caused by diversion of water section A it states no person may divert or impound the natural flow of surface waters in this state or permit a diversion or impounding by him to continue in a manner that damages the property of another by the Overflow of the water diverted or
impounded section c of that same code adds however this subsection does not authorize any person to construct a canal lateral Canal or ditch that obstructs a river Creek volou sleo ditch or other welldefined natural jange in your pamphlet if you look at the Texas quick J I also refer to the Texas water development board quick dive page 44 which is in the book it states make sure your flood plane fill project won't harm your neighbors flood w bill is allowed only if an engineering study and the flood plane administrator can determine if a no rise slash no impact on the flood level will occur if you turn to page to page 45 it refers to code 44 of the code of federal regulations chapter 60.3 section D paragraph 3 prohibit encroachments including Phill construction substantial improvements and other development within the adopted regulatory floodway unless it has been demonstrated through hydrologic and hydraulic analysis performed in accordance with standard engineering practice but the proposed encroachment would not result in any increase in flood levels within the community during the occurrence of the base blood discharge the next page page 49 of the same dive provides the requirements for the compaction of flood plane fill it states if you look at
bullet three and four blood plane fill should extend 10 to 15 feet beyond the footprint of the structure it should have graded slopes that are not steeper than 2 to one one foot vertical rise for every 2 feet horizontal extent bladder slopes are recommended communities May they ask for a professional engineer to certify The Fill elevation compaction slope and slope protection materials in order to determine that the proposed structure will be reasonably safe and FL rising star construction wants to continue to build swells and ditches around the properties di diminishing the fact that these areas are in a 100-year flood plane as special flood Hazard areas high risk and are in essence the swells that protect the rest of the city and the highway from flooding the olivades Anda families have learned to mitigate our risk and reduce impacts of flooding by elevating our structures on K and bean lastly by making request of me to allow the build of a swell on my property and his own along with asking my permission to run a small ditch through his own property and requesting that R six leasing theia family to build a swell between his and their properties rising star construction is directly and indirectly one admitting that the two New home builds will create water runoff as well as flooding to all the other surrounding properties and two that he does not have enough room to build two homes on his current site perima or other requirements without encroaching upon the properties to the right left and behind of his building in closing the Olivas and the Ria properties have taken the necessary
steps to mitigate flood risk to our neighboring properties my property was owned by my oliv's grandparents since the 1930s and homes in this neighborhood were all built between 1930s and 1960s these families have lived here for three generations while we were able to mitigate our flooding to our homes in the past we cannot mitigate any current risk of flooding to our properties with a 3 and a half to 4T land barrier which has now been placed in the line of the natural water we do not and will not agree to another ditch or swell being built as a remedy we take no liability for flooding physical harm or possible death which may happen if the city allows rising star construction to create any ditch or swell in a special flood flood Hazard high-risk area or allow the build of a solid land barrier to alter the natural flow of the water we thank you for your time and we pray for an amicable solution for all parties if there's any questions we're avable to discuss well first of all I like to thank everybody for coming and the packet is very well put together me a lot fact um the one question I have is I know that in the past just look at some of the videos and uh just you know being from car you know just act like your families um you know the trailers have been there for a long time and you know the flooding would you know basically get to the um the floor base of them it was still flow um but it rained the other day and now with the two structures that are there I mean the the
pads did it block and defer around it or just FL uh I didn't get to see much of that well that morning I drove by there you know the ditches were full of course and a lot of the the uh material was starting to roll down and so from the property line to where it's built up you know what 3 foot possibly somewhere in there uh how far off the property line the the material is right on prop correct very much is it pretty much we were out of town on um was it Thursday we came up morning Heavy Rain yes maybe Thursday morning like rained really hard really fast wedes Wednesday um did you have any issues then that Thursday I believe we have that it Rose pretty high um it was also trying to fumel through it did come over into the art property but it had stopped rain and that's just a short amount of rain right it was like an inch or so a short time period a short time period okay okay camon so our Bea our director is City administrator yeah administr I don't know if Thomas is listed or or I am but it's one of us it was it was looked at and signed off on or she so elaborate on that yeah
sotif so I Rie application and we discussed it and because it's not within regulatory blood we the structured or not they complied with all the requirements that they needed to in and so the determination was since the structure was not with the theeg FL they didn't provide that no certification is the street street is the is Le Street the street in the flood plane so if you look on the map on page four the crosshatch section is the floodway this and each is the so I also did get a copy of the development permit application and it doesn't have anything there that's stady whether it does or doesn't comply should have been out but it wasn't and I understand there is a signature but it never said whether it did or didn't comply so you're saying as long as it's not in that channel then it it doesn't have to be Bas yeah based on the structure and
where it's located on that property it doesn't okay even though it's in the 100e flood plane it's just not in the and they did build in the building plans it is built up to the Bas FL elevation and it's actually two above I'm not looking I'm looking for a picture I'm not I don't want you to think I'm looking at something else I I took videos and unfortunately the state had not built their wing walls at that time on the new rectangle covers that they put in on Bank Street they replac those I believe it was 30inch pipes with rectangle uh pre-cast cement piping and I'm trying to find the video because when I was there the water was only about 34 up coming underneath 21 and I've taken videos before where it can't get out fast enough uh we did do a flood survey on the north side of 21 and we are in the process of putting in a detention Pond as soon as we have funding is that correct that's correct and we're hoping that funding is released with within a month we went ahead and and called our our grant writer Grant coordinator to see if we could start that project early and then just being reimbursed for the funds and the answer was no you know because i' I'd love to start that project today but as I said when I went by there
I can't I sent a video far as you remember I sent that video to you and but I for the life of me I can't find it and I know it's here CU I know I know I wouldn't have but uh to show the water flow on that day and that was a two and A4 inch rainfall I don't remember what day it is and I apologize for that but I but I sent but like I said the the wings uh I believe on one of the videos that I took they still had half of the pipes still in there the uh ptin horn pipes and before they had put the second half of the covers on the road so that wasn't a good that wasn't a good flow test and yes what date is that May 16th were any your pictures on May 16th just by chance this year yes no I'm just asking I I could look back but May 16th and just to show the the water flow there was nothing at that time that showed any type of flooding but your the dirt was being brought in at what date did they I'm sorry I I should I can look it up myself but I thought maybe you got your notes looking on May 22nd 24th start Okay so they start bringing in dirt after U my video so that but it's still in the natural flow of the water right so now it's beened okay so that water is
going to come back and it's not going to come back it's okay still it's still considered flood zone high risk okay all right for I'm might have to rely on something what you just said what go back on what you said as far as building the the approval the approval as far as that did did it when they submitted the application did it meet the requirements at that time yes I based on what was being proposed and the overall site and then building plans to make comp building instruction and that was with raised with with with ra foundation so their Engineers dur Veritas Engineers team plan review team okay so their their stamp of approval is on there is that correct on the building PL not on the Civil okay Mr zinho did you have anyone look at that property before you started like it type of engineer we based everything off of the the survey that that marks the the flood
plane and it marks what the forest is say they they they marked for us not to touch where the two lines in the back the so this area if you're looking that's the only area that they marked for us to to to lead uh intact which we are uh um and the the the swells that we're proposing would be to help really we don't need them it would be to help the flow of the neighbors if if they if they want uh we could do one on our property and then the other half could be on the alleyway that's behind our properties on the city property it's a 16t Alleyway that would be to help the neighbors if everybody agrees to that but I mean we don't we wouldn't need because we I mean and everything we're doing is engineered and had we known all this like I mentioned in this SC I definitely passed on that project um but now we're here so we're looking to to you know work with the situation um as Miss con approached we stopped the project the same day that she that she mentioned this and showed me the videos so we're willing to to help with whatever we can um we would like to build but if it's uh we want to do it the right way as Mr C has said the solution or the detention one would help or even I don't know if the city would would want to do a a culvert that goes between our properties and does an ale entice back to the ditch on the right side of our properties that would alleviate a lot of the water if and that would be maybe not as expensive as others and again that's to help the
neighbors sincer we don't need it but we we would even help with with whatever we can to that if if that's a solution to the to the to the situation I mean as you can see the videos that they're showing are from years ago which which we we sure we don't have any sure control over those so the the the flood has been there before um and we're willing to help with whatever we can uh a cob there might help um they they added the other two U concrete covers and that has sped the the drainage a lot but it still has to fit through that one that goes in front of our properties so if we did a second one that comes as an L behind in between our properties and then behind the alleyway that might you're talking about the five foot I think it's about five foot it's okay and the problem that that we saw in this study is the water when it comes under 21 when it comes out of the cover right there at Highway 21 and I have videos of that and that would be back several years ago when when the highway was fled I do have that too uh that we don't have a flow test right now true flow test with the the what the text Dot hydrologist or the waterf flow engineer that said this is what we have to have because that's why they changed those pipes because they were flooding their own Highway because it can't get it can't get out when that water comes out you can see it it's packed as much as it can get in that card but the five foot my question to y'all I'm G bring it
up now how you gonna get what are you going to do for even if you build it what you have now what are you going to do for driveways in front of the property I I know but what is that going to be is that going to be half covers or well it's it will we're going to extend it the time was to've been talking I'm just asking you extended 15 foot more uh in front of the one on the left would be Unit B so it would fit it would it would fit a driveway there and then a driveway over the existing grass to one on the left and I didn't agree to that because if you put that CT there it's again forced to funnel right now he does that there's 18 probably 18 ft of open area where it already has to funnel if he pushes that back all of that water comes back to me until it is a here I'm not an engineer but would would another cover there be beneficial but the only thing that I don't have and from just a visual is what's going to happen going through underneath Bank Street with the new design if it if those are filled up if those fill up then we have a once again we have a restricted flow if there and I even told Camden that after that one they were only half full but that's not a true test that's not a uh that was with two and a quarter inches I'm G ask the city have you g out to look at the site oh yes ma'am I've
got vide no I'm talking about with the build right now yes ma'am do you feel there's an extend did 10 to 15 ft beyond the footprint as well or does home take up the whole platform without that 10 15 I would if you look at page 49 there's a clear example of that are you saying from the front of the house to the channel side of the home 15ot from the footprint of the structure it should extend according to this 10 to 15 feet beyond the footprint of the structure so he should have an extra which I don't think I could be wrong I'm just asking to look at it to see I didn't take a tape measure or anything you talk about the other property there's the two properties and there's a third one that be there's there's one on the far end which is owned by another family is that between the property being developed and that now though we run off to that property that family is already losing their property to the ditch as it is well by putting um the post D interestes in front of those two houses uh just by looking at it we almost caught a land locked them but it can't get into that one lot in the end because the the ditch um comes there and there's a
drainage to the left of it a concrete drainage so um you know as of right now they had to use that main entrance to get into there you know when they but now once that's done you mean the the lck that's to the left of us correct corre they have entrance well well I mean they if they used to enter through the end through the other property they would that would be Crossing through our property so they would have to get access from the temple directly to their property install a cold or just really a driveway that's all they they would have to do pages also one other item is that these FEMA maps are from I believe 2011 and they haven't been updated I'm not quite sure it's the city respons ability to update those with information we've lived it for this many years so we do know how the flooding and the water runs what is the status of your project today Mr we're holding U as for Fun's request [Music] com all right I'm GNA ask a silly question but I'm gonna do it anyway far
as you're involved so would it be as as we have said here trying to work out a solution would it be impactful to get a flood survey done right there and see if that is a going to be a factor you you bought the property uh to see if that would if that's going to actually happen I'm not doubting what you're saying I I don't want you to think that I'm saying that's not gonna happen because I can't tell you that I don't believe anybody can uh I wish we had a detention pond on the other side already and then have a heavy rainfall before they do anything but that's not that's not realistic because we could have one tonight I mean so that doesn't help I'm I'm I'm looking for possible solutions and I know y'all have talked enough so it's not like y'all aren't come you're coming to us with not a solution you you have talked back and forth have y'all come up with any type of solution I think the cover if if the city would allow it if they if they did a 60in cobs there's one here currently from here to here and then it opens to this ditch here if if the city could install a covert here to tie that way this has two cobs now to new conqu covers so that would that would take in the same capacity or a little less still but it would it would it would alleviate a lot of that flow coming across the highway if they
can install a c here here but but my my fear speaking from my point is even if we put that cover and if it doesn't get through the new cement covers that they put in and it backs up we didn't do anything all we did is just make a a play yeah a play cobt a study would be great to see if if this cob would suffice but we But there again I don't know about what the state is I know the new culverts are going to pass a lot more water than what the old ones were and uh but but they're still going into the same C at Old Street yeah okay see so just not exactly that spot it's you leave you a problem in one spot you make a problem do you think that we could get the hydrologic study that t use to design this absolutely and then we could make some assumptions based some we did the H&H study Williams with strand engineering okay city engineer we did we did the H&H study for for the area north of 21 that that study that's going to to be funded by the Glo to build that that detention fond and that's going to help alleviate some of the stuff that's getting to the highway um doesn't necessarily address this specific location because this is U slightly a little bit removed from that area but we can certainly take a look at at whatever Tech Stop used um for for their design um unfortunately with with a lot of these you're kind of you're Boxed In by two text Dot highways and teot they do their best to to install
positive drainage but a lot of those structures are designed for five maybe 10 year storms uh not the 100e storms that that uh these float planes represent and and they're not 100% accurate all the time but uh it's it's certainly something that we can we can take a look at specifically for this this area and what Tech Stop used for that design and what might be done uh like y'all mentioned before you could you could add covers you could do things from here to there but it at some point you're run into a to a bottleneck unfortunately until all those are cleared um you do have rain events large scale rain events where you have four inches and 45 minutes or those kind of things where it's always going to exceed the capacity no matter how big you build the structure we had what was it that one time we had 16 in 1991 pictures in three and a half hours and I have that on video too but I mean nothing holds that Thomas that when it goes underneath Banks it goes to the covers behind the the Noak fi is on that street street T behind the go behind but that goes into a channel doesn't it so that's not a pipe the only restriction that would beip okay so O'Neal might be a restriction also because like I said but now we're in Catch 22 here say we have a heavy rainfall and you have your dirt there and it does back up because it can't get out regardless if if it's the
states covert or the O'Neal street cover now we got a real problem because you sure we proved it hey it it either didn't or it did and if it did it's bad news so I I'm trying to come up with when Connie called me a few weeks ago we drove by that evening that Culvert there right by the property is got trees growing in it have we cleaned that out in the ditch line in the ditch line no in the cement Culvert it's needs a lot of clearing out well it's not that one's not cement that's uh that's just dirt there okay it's it's I guess what you call it natural okay so and then they yeah we did clean out the one side that we did get to okay um had several discussions on this Thomas not talked about it I spoke with Mr Enrique about you know what do we do to improve those drainage structures um and that's something that that we can take back I can work with William on that too to to look at cost you know we th I talked about some Dozer work done cleaning all those ditches but then we're going to come back and do it again in two to three years because they're going to sit back in we look at some other Solutions where we Rec concrete those ditches or come up with a there's a cheaper synthetic product that we can put down that that will allow for some infiltration um we can take a look at that as well well this is just an example um you know some of these floods are three years old so that's pretty current and the ones who had here likely you know it's getting all the rain at once seems to be a norm lately but uh not
last year and uh but you know one of the things is um if you were to travel from m Cemetery all the way through town and go all the way down to Shaw it's solid concrete but one area that floods now every I drive down it every time when it's just like this or light it's Thomas going to test it stays in the channel never have you ever seen get out the concrete never the only place it does is where yep Broadway is the only spot for 80 foot does that does not have concrete everywhere else stays on the channel there it just gets wide in underneath the houses everywhere same thing on Temple you know digging out so many years what has it done made it wider deeper some areas is OT six foot so the water swells and at that point where the concrete curv meets there's an erosion underneath the road the road tricks drop you can stick your hand all the way underneath there underne and I did something right here so I got a r i but so uh but that said you know um something needs to be done to channel the water and and evenly flow with elevation make down going to um Bank Street you know we could possibly look at that see what that would entail but it's proven that everywhere that we do that the water stays inside the channel it does not get out even when it's a a major flood but uh with that said this here's another situation you know that we get a lot of water from
north of town osr that comes underneath the highway you can't get in there pass up it changes so many times underneath driveways you got 24 you got 30 got back down 12 you know just bottlenecks everywhere so uh and if you look at this the slits in the highway when they pour when they go through and they resurface the topping of 21 and 36 you see the water in the bridges why is it get underneath there they never clean out the slots where the water supposed to drain back down I walk down to it and it used to be this big now it's like this so water is not get back in there texti doesn't you know team they just lay over keep laying over top of it and U so that's another restriction there and you're going to keep having that until you know those are taken care of but uh you know all that water drains in that yard I know I'm looking to buy that but you know still that playing and currently by some other you're just looking at the other day I mean it's just gonna it's just going to back that water up even more that's just by just by looking at it um I think Connie seem I think the Shelby yes sir yeah Shelby and I were both out there driving by in the rain and and that was just a that wasn't I mean it was it was you know pretty hard but it it was already backed up everywhere I mean I just there's no place want to go and um you know just but yeah I would like to see us you know possibly do that you know study to on these areas where to help Channel it a little better some going to build up because it's already eroded did we ever have checks say that was a super M or no Jesse no sir I did not ever verify I did
went back and looked at it after we had done talking and I confirmed I mean at that moment in time that doesn't appear to be those bubbles that we saw that was it taken in the air going top of the you talking that pipe that's right there where the concrete ditch is by the highway correct I believe that it's a that's a SE right when I was young I remember that line right there because you can see where the property is where it's clean out it probably ties back into that that you know main but it's already eroded it you know more more well it seems to me we're back to engineering that's BR rocks well what what I know you you said what you said while ago but what steps do you recommend or would you recommend suggesting to do um taking a look at the the Hydraulics of of that area first before coming up I mean we could we could throw some Band-Aids or let's put a cover here let's do this but without studying what's really going on and taking the videos that you and pictures that you provided and shows because a lot of times we we just look at Maps you know that's all we we're given to to look at and to have some of that additional data to to um come up with a plan I just I hate to just throw something out there you know without doing a little more research study of of that but certainly something that we could we could take a look at just like we did with that detention Pond that was a a drainage study and
recommended recommendation for for what improvements needed to be done uh to help that area and then the cost estimates and all that in that study was the basis for the application for the grant and so that would be this would be another great uh opportunity to do something similar there we can K that off I what I can do number one is is a cost proposal for that study and then I think I if you give back of the napkin kind of estimate it on you know through concete channels or yeah that could be part of that we could we could come up with okay we feel like this is what needs to be done either putting it inside a cul or more likely concrete lining the channel and and provide some cost opinions for that for what sending that project out for bid you know for a contractor to come in and do that or if it's small enough that City crews could do or whatever have a cost for that is is part of that study not you let's say you bought the property already regardless you bought it and would peing beam being a possibility at this point you probably I know you spent a lot of money hauling dirt in right let me show you one more thing okay all of her water would not drain towards their property all of her water would still continue with the natural flow as well as you can see here these are two and everything would drain this way as the natural flow none of her water would come this way but but I think what what
from looking at the pictures and what you're explaining it's not the flow of the water it's the backing up of the water right you can't flow with a three and a half four foot because right now it's three and a half if you add a foundation which is another four to six in you add that on top of that the water can't push against that it's G to come back to me correct it wouldn't Flo through here it would Flo through through the area where I mean it it would still continue here it has a way out and that's what the engineers have told us and we're just going off with what they asked us to but just another point I wanted point out is all of our water would drain the natural we of the of the the L the way MH so none of our water would come to the to miss property at all will put gutters and all the drainage would go back out the natural way unless it can't get under Bank Street correct and then it backs up corre can the water flow through a wall yeah I'm I'm visualizing it and with all respect we've lived it there's nobody better experts than us on this we have lived it we've seen it we understand it we know how to mitigate it we can't mitigate this and I understand y'all did the study in 2022 I think that was requested in 2021 that took a year or I don't understand the process but it took a year to get that study okay even the study which states even when they modeled everything right now with the Basin because of the way everything else is
done it says here it will still continue down Temple Street not making its way to the proposed detention Basin wait okay I'm sorry no no the detention Basin hasn't been built I know so we have several more years of that and and I agree it needs a c we've talked about that how many years is that so can you afford that risk can we before that was we don't know mother nature and you're wanting us to wait again and have solid land barrier there blocking it and so I I just said that earlier that it if it happens way it is now with the dirt there then that's bad if it doesn't happen right now then we have time but as far as the the tension as C said we can't go out and build that detention without having the funds to do it through and the government saying no can't do it with our own money and then they pay us back so there are a lot of steps in this that like you said you don't know the process and I when I got on councel there are a lot of things I didn't know and and things just don't go as fast as I would like no we know that yeah okay so and we're trying to come up with a solution and I think it starts with you but but my concern is between his his recommendation and what's there now so your engineer uh his study shows that this will work or no I mean you only we have a survey from the previous
owner and Engineers I mean we we we asked them to do engineering for for his lab there and that's what they gave us back what we submitted to Forest and we were very trust and they they approved everything I mean um that's that's what we have done you know based off of what Engineers know and and they they designed the two slabs um based off of the base for elevation and they and they told us to to just keep this area of our Lots open for the for the for the hasser blood we and that's that's [Music] that's you have plenty other projects right I guess I I do have a question may in this blood frame development permit application and I guess I'd like to see also where it says because I know it's checked off but it's located in special FL but then section four says applicant must submit the documents below before the application can be processed I didn't see the supplication that the regulatory flood will not result so based on where property located they're saying there but like you said no one you're basing it on just that structure not the rest of that so if no one looks at the rest of it how do you know I yes I understand what you're
saying but like the way that the ordinance reads what so Taco Y y'all don't plan to do anything from this point right now right we're waiting to find solution uh the and I'm going to throw something out but everybody start laughing the dirt that you hauled in the top saw between the two select field say that you brought would that be to alleviate possibility of some backup would y'all be willing to haul that dirt back out and leave that that would be a it wouldn't be a coverboard but it would be a natural Waterway between your pro those two houses so so would we propos this it's even better it's on the right side on the right side we could do a a a a an open open dit cemented for the water to flow on the right side of the of the right house to the VRA houses to the alley so so that would help even better because if it gets in between the two houses it has to go higher so on the other side it would it would alleviate sooner because the water doesn't have to rise so much to have another exit if you
follow me so the water doesn't have to go so high to find another another other exit way otherwise if we if we need to push it to in between the houses it has to go higher to find another exit way what we have um proposed now to Mr cin um is to do a a a swell on the right side of the right house that it's low enough to catch the water almost before it even hits the out before it has to get get outside of the ditch and and then again like you say that that might not suffice so a study would be I think it would be the the correct way to do it to see if to see if a 60inch CT aligned in that same direction would alleviate the problem um and that way Highway 21 doesn't flood um I mean the problem is all the water coming to us right it it's it's not the houses the houses there wouldn't be the problem but we're going to wait regardless find a solution but the houses there are not the problem that the problem has been there from all the water coming across the street we're not blocking the the hazard flood way uh so I mean I mean we're happy to wait and find a solution we don't want to put anybody in a in a in a bad situation but the houses were not are not the problem uh the problem is the the flood that has been there for for years uh but we're happy to wait to find a a solution that that they can alleviate um Miss con and the old's family um but the house another problem well one of the solutions what you're just talking about we're all in here wanting to improve it regardless of what it was in the past we have a chance
to improve it and if the state if as Thomas just said if O'Neal backs it up then we got to do something on O'Neal because once it gets out in the wide open there's no restriction there so there there are a lot of things what ifs that I I have no answer for anybody else can course or any thas I mean we as con said we're looking for Solutions and the only way to start I I think is engineering okay any more disc um I'm sorry William I'm sorry um iot so what do you think about that where that line comes to there you know and being in that flood plane area how it's going to affect without doing any studies you really can't probably really I mean comment on it to where you know you know how that line Falls in there I mean you had to catch the edge of it yes I mean within that I mean that can just be defined by you know uh that outer line for she said is uh the straight lines we know that where the path but the outer line is what so it definitely falls in the one year front line the rain in 1991 flooded a lot of calwell oh yeah it wasn't it was not just that area it was a lot of C was underwater lot these other pictures are
21 yeah 24 sure sure sure sure but I think mention to that originally when you bought the property you didn't know it was in that FL PL no no yes I knew there was in the flug but they they gave us a finished floor elevation which is which is what what they do and they they just say if you want to build there you have to have a finished floor elevation that's uh that's based off of engineer uh and that's what we're building to we're building to what the engineers asked us to finished FL elevation is 392 2 foot above the the base FL elevation anything else okay thank you very like add request or our request um some of our requests are a pause of further build in the flood area by rising star construction the current independent hydrological study of the water FL pattern for the city BL the main proof of engineering no R certification based on technical data approved from FEA her requirements of FEA in the Texas water development board any corrective action recommended by FMA the state of Texas Texas water board or governing agencies to be precisely followed by the Builder Andor the city of calwell and FEMA inspection and approval post completion no further building to occur until recommendations are completed inspected and approved by F in the alternative we ask that the city of Cowell to revoke the building permit for the discussed property all dirt work and forms to be removed and the property be returned to its natural elevation no further building permits to be approved for this parcel until female recommendations are set in place and
based on the present limited information from the city of calwell we reserve the right to review and request more information in the future thank you very much for your presentation we will we'll look into all these things suggestions thank you okay next discussion on platting and development process as it relates to white tail Run subdivision final plat and future development projects um so tonight uh I was going to go into every detail on the overall process basically what ability given the State Statute I can still go into detail or we can visit that we have the other two Council here um I can go over kind of just the development riew process just so have refresher so for most new development going to probably go through the preliminary final PL process um so this would be for any large track that's going to be subdivided into multiple Lots um so pre-development meeting is the first thing that we do we meet with all of our department heads and utilities and make sure that we identify all of the different Necessities that are going to be required for infrastructure transportation and all that kind of stuff um during that meeting we meet with the developer and we listen to their proposal and usually they'll provide a concept plan after that that we'll go through the first subm we'll submit the application the title commitment along the current taxes
if there's any um tax certifications to show that there's no taxes owed on the property and then from there we'll do the first review and submit that to City staff and Engineering for their review um following that there will be review comments submitted and then that's when the applicant will have to pay for their fees um and from there if there's any revisions which most of the time for final PL process you're going to have multiple rounds of reviews um they'll correct those and send those comments back with the updated plat and then following that staff will submit that back to Eng um for the final approval certification and so once we have reviewed everything that meets all the code requirements then that's when it's actually brought to council for the public hearing and for approval um and so from there after it's approved for plary plat it doesn't get reported with the county it will just be on file and it's valid for one year and then if the property owner submits the final PL construction engineering plans before that one year then um they would proceive the final CL Report with um if they do not bring that back to Y you time um for existing properties this is more of the process that you'll see so minor and amending plat process um this is for any property that's going to be four or fewer lots and then amending plat is going to be if there is just a lot line change um so we'll still have that me with the applicant they'll submit the application and checklist um
we'll take that first review and submit all of the information documents to engineering and C staff for their review following that any comments that are made we subsequent reviews and then we'll have the staff certification so these do not require Council approval these are approved administratively by staff so once it meets engineering requirements and um City staff certified that it means the code then it goes forward and so this is specific State statutes um so there's a FAQ guide that Melissa and I printed out that we to Y do that kind of homor CML came up with that after the 2023 legislative updates um so a lot of the process that require the public piece kind of went away um so the state statute only requires public heing for replat so um not necessarily we are going above and beyond but we currently do based on our ordinance we do go above and beyond and haveing and have so the approval and initial approval it'll go through that same process that we discussed that we have adopted um and so really the the issue here is the 30 days so the way that state law has defined the review process is when staff me it the application is complete and certifies that it meets all theod requirements you have 30 days to get that approved so when it goes to yall for approval then that's when it gets to what you're actually able to approve or
conditionally approve or disapprove so the only time that you can disapprove an application is if there's something that does not meet the code requirements so if staff to certified that everything needs the code requirements the engineers have certified Cod requirements at that point application is approved and it's really those blessing is what you providing um so this state stat kind of limits us on what we have the ability to do so we try to do as much preliminary research and background information and make sure that you'll have that implemented plat process so that way you'll have the information that you'll need but then that way people can ask questions about what all is going on around that site um the design of the subdivision the design of all of the infrastructure requirements capacity is reviewing all that they looking at it based on our code requirements and all that we don't necessarily expect yall to know any of that information um so that's why we have our great Engineers here but um that's kind of where the certification comes into play with the timeline and so the the state was doing this in favor of making sure that the developers can get their projects done and not be held up on items um a lot of cities that have zoning regulations and a lot more restrictions on like L Ste and things like that it was tying things up with the development process so they tried to base it toally on the engineering piece the pling requirements as long as those things are met designed to standards then so that's kind of the N of bols of
it but like I said that overall that fa2 is more details so that is there any specific questions as far as that goes and we can follow up whenever we do our workshop on the subdivision ordinance and infrastructure design guideline updates um that's currently in review by legal so as we get that moving through process and start looking into the Zone pieces and all that can further you know discuss some of these topics as far as what y'all want to see or what y would rather have staff approve or all that kind stuff next discussion on current and future use of city-owned facilities and properties so this is kind of along the same lines I wanted to have a really open discussion with the entire councel on some of the properties that we have what we want to do with them in the near future because of course we have our new building now which is awesome um so that leaves this building vacant except for when we're using it for for these meetings so I want to kick off that discussion maybe we have it I think you know mayor you asked that we have it when when all members were present I'm fine with that but just thinking about we've got this facility and we also own the Senior Citizen Center that that needs a little it needs some work as well um we've got the library that we've talked about either doing some repairs there or finding a location that is better suited for that so we have some economic development property along Highway 21
um yeah I forgot about that one we have the chamber building that uh is owned by us but it's occupied by the chamber that we could possibly do something there there what else you got Hill fire station we've discussed on a couple occasions I don't know that I've brought it to yall but possibly moving water department into that building and then allowing the police department that is out of space right now to have the entire facility that they're they're sharing right now um and then the motor bank that came along with the gift with purchase the truest purchase so yeah I want to have some open discussion I mean I I will look at it if y'all have anything y'all want me to consider bring back some ideas just off the top of your head but definitely agree that we have that conversation when everybody's here yes I think that anything needs to be held until everybody can be a part of the discussion it's one of the few times we can actually discuss and finally discussion regarding the grand opening of the new city hall building on echel street when do you want to have that if I'm hosting I'm said dat it doesn't matter let me do let me let me check back with staff and of course how far you think we're still putting a few things together we don't have everything kind of on the walls that we'd like to see to make it just nice been busy getting foam set up and you know all the it type stuff and just really moving in and getting out of boxes at this point we may need another few weeks about first week of August before school starts we can do

really built up but on Highway 21 U from Woodson's to the vet clinic there have been limbs there for months and they that's what I have down here you probably need police say something about the other day and okay I just want to bring it up uh the uh Janes got a call um or got a a text or email several months ago and I sent you a deal on no act fill on dirt work and the issue at the uh Johnny Hill Park is the L boxes were low because of dirt being removed but it wasn't that bad but the issue is the coaches are dragging that fi and they're doing a good job but you know what happens over time it builds up a mound so sometime as you had mentioned that we want to do the dirt work right at no act fi so it doesn't so it drains properly so when they do if you're able to find somebody they need to do that at that field because there plenty of dirt there it's just been slung out so far so we met with the little league and they I thought they had found someone the same person that did the work at Noak that was going to do that for them and they had the funds to pay for okay so I just don't know if they ever worked out a schedule with it okay we'll follow up on it uh Park signage I know it's in the work in the work with candy
uh but the signage was almost complete on the disc off today but his truck broke down but Joe took him around and let him di some holes so uh this is for you Charles uh is we saw after the soccer U game the other night with 75,000 at Kyle Phil uh the traffic the light this deal I brought it up several months ago about when A&M and Texas play we're going to have to have control but you got Jarred straight and that's going to be the largest so during the day and even after the concert we're probably going to need somebody control and maybe get with text Dot and have some type of switch the recent past there's been two two deals the the solar eclipse and in in the soccer game as well what the experience has been is in the morning you know before the event C ofes through it's after the event where a huge issue and we did have traffic control out there that day I don't know if you see about traffic sheo I when I left the concert at 11:30 um the lights were not on 21 it was 3 seconds green and they were only allowing three or four cars at a time and I waited waited and waited and waited that the green arrow for me to turn left on 36 wasn't even that wasn't even a choice and so that's when I called the sheriff's office because the lights were not timed properly favoring 21 they were for 36 but not 21 and so those those two officers that went out there that day they weren't familiar with Bo we can open up the control so that's something
we're going to this weekend we're going to make sure that we have because I think we're going to see more and more of that with just I agree because events and everything else and going on uh I do want to brag on some City Cruise uh the concert I don't even know why Main Street people have to be there anymore uh they remembered everything from the year before didn't didn't even have to tell them anything so they did an outstand JW and the people at the concert you got to give them credit too cuz there was hardly any Trash left uh on the ground so they did good and Thomas I want to thank you for having the flail more with the boom going around doing the ditches it really looks nice it does help it does help and the turquoise Pond D that Kenny added to the park ponds is spot on it's beautiful and the even with the fountain now it's not looked like dirty water coming out it looks like sea uh good Beach water and the parks recreation crew has done an outstanding job on the disc golf I I took my M today and did every hole just to I'm not going to walk it or run it I can tell you but uh it it is in great shape and where the uh I know I bring it up every time but the where the mosquite trees were there's even ver muda grass now growing starting to grow in there and it's going to be a beautiful course uh I talked to Dustin today as we was putting the whole signs up and everything uh they had four people come from Houston drove an hour and a half to come up and play that course and gave it
the real thumbs up so that's Colleen has come Houston has come he says as of the day he had 40 uh people coming for the opening but he said it's just like everything else they wait till the last minute and he's expecting probably 60 so but the Parks and Recreation crew has done an outstanding job the park uh when they get through doing the flail Mo in the back is going to be beautiful for this weekend and that's all I have believe or not okay uh we partnered with Texas Tor Bureau and had a pickle ball tournament hot as blazes but it was very well attended and looks like everybody had a great time they take some take that very seriously it was a lot of fun uh hoping to expand and have one in the fall also I forgot about the Genesis drum and bugle core um the director today told me that from the time they leave which is the 23rd they will have spent $50,000 at our Brooker Brothers they're feeding this group you and then on Sundays these kidss are coming to all of our restaurants and eating so it's a plus for our community so um the website did uh link to concerns you know there you know not everybody has a computer a lot a lot of elderly or lot them don't have internet um so the question I get is when they do call you know after listening to for's voice they uh they should hanging up you know so I've actually called a couple times for some I actually put one out there night uh for someone and uh but U Le least
have a a direct M where somebody can go to also you know that don't have access to the internet or even a smartphone have a smartphone or something so you want direct phone number to yeah because if you H zero you normally goes to operator but it doesn't even do that no I do that it doesn't I start all over again for you have it down p um the other thing so Cameron's got to get with William and and they're going to look at uh studies for water uh and fossil drainage and U we look at going from there we'll bring that back this one expensive it's a smaller area I think we just have to look at those bottle X yeah yeah you know we've already kicked off in and seeing what the other side looks like and we have to add some modeling basically an extension of that yeah yeah it's more adding on to what we've already done so we'll see that okay the detention Pond's going to do this and then additionally we can relieve some of the bottlenecks by whichever projects are suggested and we'll bring that back and then find some money to pay for it we just keep in touch with everybody and one more
