Discuss and consider a recommendation to the City Council of the City of Bulverde, Texas, regarding an amendment to Chapter 14, Zoning, City of Bulverde Code of Ordinances, by amending Article 14.03, Zoning District Regulations, Section 14.03.013(a), PD Planned Development District - Intent, to revise outdated references to the comprehensive plan.

Each zoning district identified in the City's zoning ordinance has a specific section dedicated to describing the district, its intent, and enumerating any special rules applicable to that district. For the Planned Development District(PDD), this section primarily consists of rules governing the form and process for applying for a PDD. However, it also contains an "intent" section that has outdated and erroneous references to the City's former comprehensive plan and to "Downtown Bulverde Village", an undefined term. While the intent section is aspirational and generally unenforceable, staff recommends amending this wording to avoid confusion and convey correct information. The PDD is intended to be (and always has been) a tool available in any zoning district in the City, and the intent section should clearly state that fact. Current Ordinance Language: Sec. 14.03.13(a) of the zoning ordinance currently reads: (a) Intent. The intent of the PD district is to allow an opportunity for greater flexibility in the combinations of uses as envisioned in the Regional Activity Center Land Use Plan category in the future land use plan and in the Downtown Bulverde Village. Applicants are encouraged to create a development that mixes uses, incorporates quality development standards and provides for appropriate connections and transitions between activities. Standards may be based on existing zoning requirements; however, in order to create a better, more innovative design, modified standards may be approved. The location of the proposed PD must be chosen based on conditions in the surrounding area and the recommendations of the future land use plan. Proposed Ordinance Language: Sec. 14.03.13(a) of the zoning ordinance would be revised to read as follows: (a) Intent. The intent of the Planned Development District is to allow an opportunity for greater flexibility in the combination of uses within a development site. Applicants are encouraged to create a development that mixes uses, incorporates quality development standards, and provides appropriate connections and transitions between activities. Standards may be based on existing zoning requirements; however, in order to create a better, more innovative design, modified standards may be approved. Any proposed Planned Development District should consider conditions in the surrounding area and be compatible with the City’s Comprehensive Plan.
