Hello.
I open the meeting of the Council of the Commissioner of the Court. Let's start with the oath of loyalty. I swear loyalty to the flag of the United States of America.
A nation under God.
Justice for all. Add or modify the order of the day.
Io non ho nulla. Bene. Approvazione dei verbali e dei crediti. Ho esaminato i crediti e i verbali. Non ho riscontrato problemi particolari. Quindi proporrei di approvare i crediti. Così come presentato. E poi chiedi a Sandra della programma. Quando arrivo. Possiamo farlo. Se volete parlarne, ma non sono sicuro. Quando abbiamo esaminato il pagamento dei briefings, il credito presentato è per un anno intero o metà.
and for a year.
According to the motion to approve the credits and the papers.
Next point, at the order of the day. Proclamation of recognition of support expressions for the 11th of September service day. Introduce. Proclamation.
First of all, I want to thank you for the opportunity to share this information. My name is Tommy Elmore and I am a member of the communications of the Department of Fire Guards of Jackson Township. Basically, I wrote this letter to the commissioners and that's why I'm here. The Department of Fire Guards of Jackson Township has joined the United for Good National Movement as a partner of the 950 Days program. This year marks the 25th anniversary of the 11th of September. Unite for Good honors this historic anniversary by rekindling the spirit of unity, compassion, service and good that united communities after September 11. As a partner of September 11, the JTF has joined hundreds of other organizations at a national level, creating significant opportunities for Americans to volunteer, donate and do good. Together we will create the greatest day of solidarity in the history of our nation. I just want to make a little history about the day of September 13th. I think we all remember that day, what we were doing, where we were, with who we were. The founding principle of the 1911 Day was that if the worst day of our history could become one of the best, at the beginning their commitment was to reappropriate that day. In the following weeks, on September 11, the country was destroyed. Among the almost 3,000 victims there was Glenn, Luke, the attorney and guardian of the voluntary fire that, when the southern tower collapsed, ran inside to help and save Oscar. His brother Jay and his friend David Payne spent the following months asking themselves the same question. How do you honor such a huge loss, such a great mistake? How can we be sure that the memory of this day and of the people who lost it becomes something more than simple pain? Their answer was disarmingly simple. Let's turn the anniversary of the 11th of September into a day dedicated to doing good. Despite the tragedy, but precisely because of it, What we ask today at the Brown County Commission is to officially declare, through a proclamation, the recognition and support for the day of service in memory of September 11, encouraging residents and local companies to participate in service activities and volunteer at their choice. I will read the proclamation for you. On September 11, 2001, the peace and security of our nation were hit by a terrorist attack that killed many innocent people in the towers of the World Trade Center in New York, in the Pentagon, in the United States, and in the contaminated fields of Shanksville, in Pennsylvania. Although the goal of the terrorists was to hit hard the hearts of all Americans and lick the fabric of our nation, from the ashes of that tragedy emerged an extraordinary spirit of unity, compassion and determination that will never be forgotten. Just as we will never forget those who were lost and wounded that day and those who dedicated themselves to the service during the rescue and recovery operations and in the defense of our nation, both here in the homeland and abroad. Now, to commemorate the events of September 11, 2001 and the spirit of service that followed, we adopt with the present the proclamation in tribute to those who lost their lives and were injured on September 11, and to many who donated themselves to the service of their communities and the country at the end of the attacks. Considering that people of all ages, except social, throughout America and the world have collectively attended an event of immense tragedy on September 11, 2001. Considering that the events of that day have instantly transformed the lives of almost all, some through personal losses and many others through an unknown sex of individual and national vulnerability. And considering that an unprecedented historical bond between the Americans is born from the collective shock uniting the country in an effusion of national spirit, pride, altruism, generosity, courage and service. And considering that many brave people have participated heroically, tirelessly and with courage in efforts to rescue and recover extraordinary, difficult and dangerous, in some cases, voluntarily putting at risk their own health and well-being. And considering that the date of September 11 will never be and should never be just another day in the hearts and minds of all Americans and people around the world. considering that many people want to commemorate September 11 by committing or planning personal and individual acts of service to the community or other benefits activities as part of a solemn day of memory and tribute. Considering that on March 19, 2009 the US Congress approved a bipartisan law that authorizes the establishment of September 11 as National Day of Service and Memory recognized at the federal level that President Barack Obama signed on April 21, 2009. considering that the President of the United States, on September 11, 2009, issued the proclamation of the Patriot Day, officially and permanently designating September 11 as the National Day of Service and Memory, inviting all interested Americans to participate in this commemoration with moments of silence, exposing the flag of the United States in the middle, in addition to service activities, to the community and to charity, as a sign of tribute and memory. Therefore, it is clear that, in tribute to all the victims of September 11, and to many who mobilized in response to the terrorist attack, the commissars of the County of Brown will observe Friday, September 11, 2026 as a voluntary day of service and memory known as 911A. The commissioners of the Countess of Brown also invite their citizens and organizations to consider joining this important national retreat, engaging in activities of memory and tribute, including commemorative ceremonies, prayers, the display of the American flag in the Middle East and participation in any form of charitable service, including volunteering and supporting benefactors and the fulfillment of other good deeds, in the same spirit of unity. Resilience and compassion that united the Americans immediately after the tragedy in September. I therefore ask the commissars of the County of Brown to officially declare this day, expressing support for the 911 day of memory service and encouraging our residents and local companies to participate in service and volunteering activities on that day. At this end, the Jackson Fire Guards Department organizes an annual race for 11 seconds. We don't ask, well, actually we ask for your support if you can come and make the tifo for us and participate in that day. But there are hundreds of other wonderful organizations in the County of Brown that do good. So choose a charity or something like that. Do something good that day in a propositional and meaningful way and join us in the greatest day of the 11th of September. Thank you. This could be a simple one.
I propose a motion to adopt the proclamation as read by Tony Elmore. I support. Tim, as you vote. Kevin, as you vote.
The next point is the revision of the role description for the environmentalist and coordinator of emergency planning. This is a new position and the commissioners by statute have the responsibility to review and approve the new positions as well as the work descriptions in general. And so, do you want to discuss this in particular, until you have all the records? Yes, I'll start.
I know that this has been a key item in the results of the health department during the last year. And I understand the challenges of the health department regarding the recent turnover and things like that. And we have to progress, we have to reduce the staff that has left us, we have to create a life. But my main concern with this description of the role is that you are combining two technical jobs that require more specialized skills than the necessary ones if we had an EPC, an emergency preparation coordinator and an environmental specialist. So I'm reluctant to let it go. I'm reluctant too.
I wanted to say that we are talking about both positions. There is no version of the various descriptions that I have seen. Combining the two things does not have much meaning. Since one was that of the emergency preparation coordinator, which was once part-time, financed by subsidies. So I say no to this position. We need a motion. I would like to add another informative element, if I may.
Because since we are moving towards the categories of salaries that we are talking about in the system, this does not fit very well. Because now you are trying to combine two positions that do not necessarily fall under the same category.
Maybe they do, but we want to avoid trying to carry on the thing as a solution to solve the repercussions.
And again, I heard when I was at the meeting of the council on Monday that they will address the issue in their work session and it seems that there is the opportunity to examine the contributions and the various contributions to try to fill them. But this is up to them, not the commissioners. So I encourage you and Tony, I know you are here, you are part of the health council. And I don't know if Dr. Conway will be able to come. I think he is committed to saying that he will be present with the first day of September to try to define a positive direction rather than trying to change the system as soon as possible. I propose not to approve this description of the combined mansion. Kevin Patry, how do you vote? I vote in favor of the motion.
Ron Sanders.
Well, I thought I was going to say no. I know.
Yes, I thought so. Yes, exactly. Think. Yes to the motion to say it.
Yes. Yes to the motion to say it.
Yes.
Yes to the motion to say it. Yes.
Yes to the motion to say it. Yes. Yes to the motion to say it. Yes. Yes to the motion to say it.
Yes. Yes to the motion to say it. Yes.
Yes to the motion to say it. Yes. Yes to the motion to say it.
Yes to the motion to say it. Yes to the motion to say it.
Yes to the motion to say it.
Yes to the motion to say it. Yes to the motion to say it. Yes to the motion to say it. Yes to the motion to say it. Yes to the motion to say it. Yes to the motion to say it. Yes to the motion to say it. Yes to the motion to say it. Yes to the motion to say it. Yes to the motion to say it. Yes to the
And people, regarding the description of the mansion, there was confusion in the council, since usually the heads of the department can develop the descriptions. Wait for the commissioners to review and approve the descriptions based on the conformity with the policies of the staff. Then it passes to the council, which can also review and approve. They are the ones who have to finance. So even if we don't approve it, they could approve it, but they still have the payment authorization, whether to finance it or not. So it's like a control and balance of power regarding the positions. And Tony, I talked to Taylor today, okay? And I told her that we would have furthered it.
Let's move on to the update on unsuspecting issues. Bridges on asphalt.
We have received some indications, but I will leave it to Sandra to give us an update on the situation, since you are busy. Let's hope to find something else.
Therefore, on the advice of the legal office, we cannot stipulate an individual contract on account of the count for a job, whatever it is, asphalt or something else. So at this point we must follow the same processes that we would use to asphalt any other road. We must take preventive measures and proceed as if we were doing it ourselves. And then, if the individual wants to make a donation, we can accept it in the funds of the community and allocate it to that project.
And I think that when we received this response, Mr. Mappin, it was shocking for all of us, because I had not even considered the contractual obligations and responsibilities to social services. So there is no intention of hindering everything, nor proceeding. It's just about being responsible towards the public.
And I have no problem with that. I don't want to do anything. Obviously I sent him an email, I think from the last meeting he said he had to confront the lawyers to find out. I just did a search on Google using RIA and there are some requisites that clearly state that you should manage the project. But I was asked to present the proposal I had because when I presented the petition it was for a reasonable cost. I think you would have said that my figure was too low. So I thought I'd look for another plumber to see what his offer was to do the same thing. We can confront the county to make sure that I have a second standard. That's why I got the preventive initially. I will still have to take care of my road, but I repeat, I want to make sure that the road to North Richardson Drive is paved before mine.
It would not make sense to go from the asphalt to the gravel. And again, just to inform you, Trent went there and also Sandra walked there, and I went there too. We dealt with our concerns about the base and similar aspects. It is not a very trafficked road from what we observed. It is not that we have trucks with a trailer that go up and down like it happened on another road, but it is feasible for us. And regarding the area, without naming who did it, please, we will do some checks to ensure that everything is in order and follow the procedure. I have no problem with that.
The only thing is that, if my search through IA is correct, it will be postponed to the next meeting because it requires that you raise it and approve it as commissioners to finance a donation. I said it must be done during a public meeting. We have to check, because I didn't get into the merit, I just know that they made a donation. I don't remember the lawyer saying that there were some... Annoying? Well, there are some problems, otherwise raise the merit if I make the donation. In this way it has already been made public. It is done through the auction process. So we have to advertise.
Let me ask, well, Stefani is online and Stefani has done a good job on this.
So Stefani, are you there? We are receiving a question about putting the car in front of the cows or the car behind the cows.
The audio is interrupted.
I'm sorry. My audio is interrupted. Do you hear me? Sorry. So, can you hear me now? Now.
I don't know what the hell happened. Someone put their hand on my microphone.
So it's a question of the egg and the chicken, the one about Mr. Melvin. He says, I would like to proceed and make the donation without even being subordinate to obtaining the information, because as Sandra said and as Sandra said and as you have shared with us, we need two additional preventives. Fortunately, it does not come back in the context of having to undertake the most aggressive race process that would have required even more time. So there is a procedure. What is the procedure for accepting the donation? As you said, there are two different things that have to happen here. The first is that you have to follow the normal race process, that is, as Sandra explained, get three preventives and be able to accept them to carry out the project. You can make the thing separate from the donation and accept the donation for whatever purpose the gentleman wishes to provide. So that they are not really subordinate to each other. If you want to say, in reality he could make that donation. and of course you will probably want to specify that it is intended for the project but you will not know how much the project will cost until you have accepted the offers for this reason I advise you to do it at the same time however there would be two different actions and I think that the action that concerns it is the process of approval necessary to accept the offers So it is probably here that we will discuss during the meeting of the commissioners. If I remember correctly, if we follow the advertising procedure and we get the two notifications, we can proceed as long as there is unanimous consent from the commissioners and elaborate. If not, it would mean moving on to the second meeting of September. So I repeat, this is my position.
There's nothing else.
So it seems that there is unanimous consent. So on September 2, our meeting would probably be the last useful date to proceed.
I appreciate your availability. Thank you very much. The next point is the amendment on the music center. Let me read a statement, then I will present a summary of the key points.
Now, the advice of the commissioners of Brian's company...
I'm back. You can point it out. The Council of Commissioners of the County of Brown has undertaken this review as part of its responsibility to continue to provide a prudent administration of the goods of the County and ensure that significant public investments continue to be managed in accordance with the law of the Indiana and with a healthy public administration. The Brown County Music Center represents one of the most significant public investments of the County. Its continued success is important not only for the County of Brown, but also for residents, businesses, visitors, local organizations and the entire tourism industry. Officers recognize the substantial contributions made by many individuals and organizations in planning, financing, construction and construction in the music center. Nothing contained in this statement should be interpreted as a diminution of such contributions or as a discussion of the good faith of the parties that negotiated or implemented the administrative agreement. Rather, this review reflects the commissioners' obligation to periodically examine government agreements in the long term to determine whether they continue to serve legal responsibilities, financial interests and long-term public objectives of the county. The main question presented is whether the administrative agreement that regulates the Brown County Music Center assigns excessive operating entries in a way authorized by the Indian law and consistent with the fiduciary responsibilities of Brown County officials. particular attention should be paid to paragraph 3c of the administrative agreement that authorizes the management company, if allowed by law, to distribute 75% of the excess income to the Brown County Community Foundation with the balance intended for the county. The expression, if allowed by law, introduces a legal uncertainty that has pushed the commissioners to seek clarifications on the legitimacy of the provision and on the options of the county, if necessary, clarifications or modifications. The objective of a further investigation on the issue is that the current governance framework remains legally solid and to identify options to improve governance, reduce legal uncertainty and strengthen public management. Pay attention to the screen. A guy gave you a copy. The Brown County Music Center proposed to modify the administrative agreement.
I repeat, the Brown County Music Center is an important public resource.
The commissioners have the obligation to guarantee that public resources are managed in accordance with the law of the Indian and in respect of the constitutional law. Central question. The main question presented is whether the administrative agreement that regulates the Brown County Music Center looks at the excessive amounts of income in the way authorized by the law of the Indian and consistent with the fiduciary responsibilities of the Brown County officials. The signatories of the administrative agreement include as follows. The Council of Commissars. The management group of the Music Center. The number of members of the Council increases from 5 to 7. Includes a commissioner and a member of the Council. Includes also the Commission for the Visitors of the Conventions and the Building Corporation. The proposed modification of the amendment is as follows. Removes the legal ambiguity 75% if allowed by law. The Countess will receive 100% of the excess income. The Council of the Countess decides how the income will be allocated. They can continue to decide to maintain the distribution 75-25 if they wish. Citizens, the news is that citizens would be given a voice in the chapter to provide a contribution to the Council on how money should be spent. So I propose the next passes that we have available to investigate the legal options together with pro-contro and costs.
I'll let the audience speak.
Can we open if there are comments from the audience? Once, twice. I will accept a motion to discuss here among the members of the council.
I understand the concern about this. I know that this was a success. This is a project that has not followed traditional practices. Unfortunately, I was not involved in 2019, as far as I know. So, I don't know the details and I know that Tim has spent a lot of time and has been involved since the beginning of these conversations. My concern or hesitation is that I understand the desire to proceed and say yes, there is ambiguity and it should be removed. What if I had others? Again, not necessarily specific because this particular contract is probably unique and has been identified. As such, I don't know. Is it working? It's not ideal. I want to say that I have been a supporter of the modification, of the distribution. And again, you know, I am not against the fact that the council takes care of it, but the council itself has said that it is not interested in doing it for its own reasons. They gave their reasons. The time that has been devoted so far to a meeting with the council has not made much progress. I had some conversations and there is not necessarily a great enthusiasm in modifying the agreement, as well as I, I succeed. I really want you to go back to this, but I'm not sure it is. I don't want to call it a sacrificial lamb.
is not sacrificed.
I am one of those people who, when it comes to contracts, precisely because you will see it in the administration that is coming, the fact that something has been done in a certain way for years, not valid, necessarily that it must continue like this. So it is a reasonable approach because the environments change, the leadership changes, all these things. But I am hesitant to go much further than where we are. and I know that it is probably not a popular position among my two companions.
And the Council?
Do you have anything else?
Do you want to present a motion? Well, if you are not arguing, I will add to the discussion. Kevin and I. The point is that we are evaluating the legal options.
What are the legal options? Now that we have identified what is our problem, what is our responsibility, what is the... As you know, neither of us would approve this thing as it is. Yes, I would have problems about it.
I don't like the fact that I don't like them. Anyway, there are many problems. I would be worried. I was present in the ruins from the beginning. I think they probably started in the middle. He will never forget that the president of the council of Contea, Siazoi, said, hey, 100% of those entries, the excess distributions, wait for the council. Because usually in Indiana, the council controls the money, they have that responsibility of ownership, not only for the distribution, but also for how certain profits are made. Again, in Indiana, generally, that is what the council of Contea expects. And so, you know, the president of the council said, I want 100%. As you know, the commissars can cancel it, they are the ones who signed the agreement. This is what they do not understand, because we have inserted all these different groups. We went from 5 to 7, then we added two other groups that have a little distorted the council and there are only two elected officials. Everything that the amendment does is to eliminate a sentence. Removing that sentence from the 75-100 creates legal ambiguity. The Countess receives 100% of the advice and I believe 6 members out of 7, when they were questioned, all supported the current agreement. You have the choice. That money comes back and they can choose. Choose to continue with that agreement. Without a doubt. Then a councillor told me, well, we don't want future councils to have the option of changing an agreement with which we are in agreement, which for me is offensive from a constitutional point of view. Citizens should have a voice in the chapter and that voice is given to them by elected officials. So I am quite firm in wanting to examine legal options. I don't know the pros and cons. I know we can terminate the agreement, we have already talked about it.
Write me a new one.
And we also contested ambiguity in the current agreement. So these are a couple of options that at least I know I have. I don't know what the pros and cons would be. I'm not a lawyer. I don't know what the costs would be. I don't even know. So I think I have the responsibility as an elected official and commissioner, a confidential responsibility to at least investigate the options. So at that point I'll take... No, I'll take it into consideration. You want to do one? Propongo di esaminare le opzioni legali insieme ai pro, ai contro e ai costi.
C'è un secondo?
Secondo la mozione.
Ron Sanders come vota?
Tim Clark come vota?
Kevin Patrick come vota?
A warning about the next meetings. Tomorrow we have a meeting at 1 p.m. It is about examining and voting a contract for a human resources management system. A significant improvement in the way we operate and manage the county from the point of view of the staff. On September 2 we will have some contracts to vote.
Then on September 16 we will have an order on a new draft of the manual of the staff.
We have been working for several months and we are almost ready to conclude.
Then we have the ongoing work, so I pass the word to Teresa, Commissioner. Can I add one thing? Regarding the speed limits of Helmsburg, as for the legal aspects, there have been progressions.
Unfortunately, there are no progressions in the current direction.
Based on the review carried out by Warnis and Thornberg, that area is composed only of local roads. The condition required for an urban district to reduce speed below 30 miles per hour is not satisfied, since no road in that area exceeds a quarter of a mile.
So, as police officers, if we want to proceed, we will have to conduct a study to lower that speed limit.
And I have no idea what it takes to conduct a study on speed limits. And if you don't necessarily qualify as an urban district, I'm not even sure, and this is a question for Stefani, that we could lower that limit below 30 miles per hour. So Stefani, this is a question I have for you.
If it's an urban district, then...
But then you go back to how much you want to lower. And if this requires an investigation or an engineering study?
And so it is here that the conversation with Lindot would be useful. I haven't spoken to Lindot yet, but Sandra could do it.
I contacted Lindot and I was addressed to their assistance department, but I did not receive any response via email or other type of contact, but I will give the question a follow-up.
So, as for many things, when you start to read the regulations and to really observe distributions and the characteristics of our roads, I discovered that when we wrote down the list of goods last year for bridges and roads, those roads in that area are all local roads. There are no large or small roads of ability. So we struggle to get them back into an urban description because they require some of those criteria. So I hope I can give you a better understanding of what we can and cannot do.
What criteria do you use for the URRE?
I know we're doing research.
I'm sorry for that. This brings me to the amendments to the global plan of the... I found that it was about planning and we worked on an RFB. We went from an agreement protocol to an offer request. So we combined both perspectives and the details on this... So it should be put to the vote probably in September in one of the meetings. So let's proceed with this and estimate the requisites in the necessary balance. As for the financing of India Hill, there have been requests for engineering estimates. The railway has responded and has not shown itself in favor of opening to only pedestrians. They say to the Indut, we have not asked the Indut to proceed for a pedestrian crossing but for a vehicle crossing. So, in our prologue this year at Lindon's, we will specify such a wish. Stay tuned and then there are updates on Mount Estate for Pumpkin Ridge Road. If you type the keywords Mount Estate Forest and Pumpkin Ridge, a separate website will open where you can get updates on what is happening. Are we starting to receive feedback?
The relationship between Contea's office and Teresa is something for us. No.
As you know, we worked on the budgets.
Thank you for all the work on this. I mean, it's a real challenge.
So we're almost at the end, but obviously we're still working, listening to the advice and what they have to say. Our office is fundamentally recovering. So that's all.
I could examine, there was no reference regarding a request that we have made today on minor detention. I want to recognize the hard work of Malarie.
You should absolutely recognize Malarie, who gave me the numbers. So yes, I looked at it very quickly.
Remember, we had a month ago, I think, or maybe more. Our Director of Coordinating and Correctional Services comes from the police to ask to accept or propose and support home detention for young people, minors in Ardontea. Since obviously we do not have a juvenile detention center and therefore they are tired and we have only one person in his office who does all this. the cost of detention. In a minority in a structure outside the county of Brown it costs 150 to 300 dollars a day. The proposal they made was basically to adopt and use electronic tracking and GPS for young people. I saw the first case arrived among the requests we made for the next payment in which we had a young person confined in his house for 37 days. If it had to be confined to a minority detention center, it would have cost us $7,400.
With this approach that we have adopted, it cost us only $259.
This is where many of the officials in the departments and in all our areas try to help the taxpayer and make sure they do not exceed the budget. Unfortunately, along with this, we have had an increase in youth activity.
So if Mallerie had not started this new program, we would have already wasted the budget. So I want to make sure that Mallerie and that department are recognized for this activity. So I think I covered most of our things in the previous conversations. This evening I wanted to mention the bridge with the Alcric grid structure. We will continue to keep it closed until August 26th, so next Wednesday.
Both, if I'm not mistaken, are you making both updates on both bridges, only the second one? Only the second one. Only the second one at this point.
We removed the fence, replaced the beams and then we will reinstall the fence to bring it back to optimal condition.
And again, I will simply inform you that this is the work that is being done. That was a bridge that had been included in our rehabilitation list as critical. So, consequently, we are already advancing and working to shorten our cycle and prevent catastrophic bridges.
Correct. And we are using what we can to save money instead of buying a complete package for bridges.
It's over. Just one more thing. We had a conversation regarding the street leveler. I see you moved her there and I think... Nothing will happen to her.
Nothing will happen to her. We intend to keep her alive. They just moved her to a more solid shed. She's out of the grass.
It could be the time to go back to the car club of the time and ask if they have any plans for this.
It takes some space. Yes. And they were worried that the children nearby could get hurt.
Unfortunately, it is not protected. Where is it? Outside our gate and we do not have a place inside the gate.
Yes.
It would be nice if you could put it there.
But do you understand where it is?
Exactly.
I'm telling you, I appreciate the compliment. I appreciate the warning on all the various challenges related to the equipment we have, on what we have to replace and repair, on the compromises and on a plan for the future together with the budget.
It's nice that you thought about it in advance when it came to surprise me when you talked about this, because...
Now you call me and we talk about roads, bridges, palaces... And so, thanks for the due diligence at this point. Anything else? I don't have anything else.
Anyone in the audience? Once, twice. Stefani, you have something. Nothing, nothing. Oh well, I'll do this. Thanks to you and James for examining the contract for Paycom.
I know it was an urgent job and probably very demanding for your time. I appreciate it very much.
Yes, Stefani, I will give you the final versions of the policy on the capital goods of the request for public works. I'm just turning them into orders, we have just made the final checks. I don't think we have changed anything substantial regarding what is identified, but I will give you the final review before preparing them for the vote. I really appreciate all the work done on this. Well guys, I propose a closing proposal for the seat. I propose a closing proposal. Seat closed.
