Also, what what what is a conflict of interest form? I don't I'm not sure what you're talking about. It's one of the forms you filled out and signed. It's unsigned.

Um you guys all may remember uh well, some of you may all remember the notice of violation uh ongoing notice of violation at 63 Lincoln Terrace. In April, the commission agreed to a two-year plan um to correct the uh correct the violation. Um the violation was the placement of fill and construction in the wetlands and in the flood plane without a permit. Um uh last week or two weeks ago maybe uh Mr. Mara called me and said we have moved all the material. Please come out and take a look. Uh, I did that and the material appears to been removed from the wetlands and the water course uh and the flood plane, I should say, as requested in the two-year plan, but obviously way ahead of the two-year plan. Um, so um I went out there today uh to take another look. The area had been uh top soiled, seated, and uh straw was placed on the on the grass or on the new grass. uh and it was being watered. Um and so for the uh my recommendation for here is that the material placed without a permit has been removed in substantial compliance with the two-year plan for removal and it is recommended that commission vote to lift the notice of violation.

So, it, you know, it appears that the material that was there, if you guys recall, there was a shed, there was some concrete, there was um some uh um you know, some uh sidewalks, there was some landscaping in there. So, I think he's done what commission asked him to do. Yeah. Excellent.

So I mean how would I say almost a year ago I remember the first time coming in this meeting and as I always said to Peter I wish you guys had Peter seen the backyard before it got to what is recommended now when I dumped it I had no clue about wetlands inlands uplands any lands I had no clue so for me as an islander I was just utilizing my space that is on my property.

Um, unfortunately whatever happened happened. In the beginning it was difficult for me to financially do this. Miraculously I could go to my 403b and this backyard cost me more than $28,000. Not that it's anyone's responsibility, but I just want to put that out there that I don't need problem. So, I find solutions. I remember when, you know, I said this took me 9 years to put the dirt here and it's going to take me some time to remove it. The contractor that I found, he was leniency enough, but unfortunately, my entire driveway is ruined

because I had trucks for three days constantly from 7:00 a.m. to 7:00 p.m. in and out of this place. But I just want to tell you guys that on on behalf of me and my family, what I did, I had no clue that it was a violation. And that's why I made sure I fixed it because I don't need trouble. You know, and especially problems 20 years down the road where you go to sell the property or your kids go to sell the property and they say, "Hey, what's this?" 10 times. As I said to you before, and I'm going to say it again, this property will never be sold. Right?

Good. Um, okay. So, uh, this was one that was discussed with the commission the last meeting. Um, and it was decided that they should come to this meeting for, uh, uh, review by the commission. Um, this is a uh storm water basin that's in the it's in the Sigma condos um project uh that's off of Maple Avenue. Uh Maple Yeah, Maple Avenue. And um they're proposing to to remove vegetation um uh do some grading, remove sediments, and create some lowflow channels. um to the uh inside this basin. Um in a few minutes here I'm going to share my screen unless Mike you you want to share. Um but the uh uh the project is uh um uh it's as I say in my staff report um it's more than just regular maintenance. They want to try to do some improvements. This area has been um uh known for wet basements and they the the condo association over there uh 10 years ago did a project to help out um the uh flooding and I heard from one of the neighbors I'm not sure which uh unit she was in but one of the neighbors on that culdeac said that the whatever the improvements that were done 10 years ago helped her wet basement. She no longer has a wet basement. So that was good. But, um, Mr. Lawson's application is for more, uh, kind of more of the same. Uh, they're going to clean out, uh, you know, and and and maintain this storm

Um this is the stormwater basin behind them and and it shows some shows the regrading.

Can you Oh, can you guys all see this? Yep. Yeah. Okay. Um and the um there's a uh a couple of uh a couple of key features here. There's two one here and one here. Storm drainage uh pipes from the street going into the pond.

Um this is uh roof roof drains uh and and uh footing drains um that actually bypass the pond. They don't go in. Um, and over here is an outlet structure and the pipe that takes the water out of the pond and toward over here towards Tumble Down Brook. Um the spillway in this thing is a broad concrete pad with rip wrap on both sides. And the proposal is to um the proposal is to e excavate the found uh excavate the uh um the bottom and create these swailes. That's too close. Let me back up. Uh there is a I believe as I recall from the cut and fills there's there's material that needs to come out. There's excess material. So they're going to be hauling it out and taking it away. They're not proposing to use it on site. Um and so I think and I'm sorry I'm going to zoom in again. The deepest cut over here is is uh um you know here's a 119 six contour or spot grade. They want to take it to 11825. So it's you know a foot and a half something like that. I'm not sure if that's the deepest cut. It might be Yeah. Here's here's a deeper one. There's a 120 contour. Now they want to make this 116.5. So they're they're also proposing based on these contours to make the the flow going into the pond uh cleaner uh

in as far as flow. This will also effectively create uh a better place for uh a better easier flow for the water through. Um I'm not sure what's on the second page. Let's go look. details. Oh, these are details. Yeah.

So, um what's it say here? Uh oh, on our official map, the whole the whole pond is considered a wetland or or a water course. And so they're proposing to do some work essentially in in the wetlands. um approximately uh 23 acres. So about a quarter of an acre. 9900 square ft is what's on the application. And uh like I said, we're going to take out the vegetation. Um there's a lot of invasives in here, including uh a little patch of um fragmitees over here,

which we talked about when we met in the field about needing to, you know, excavate those separately because the the roots are are uh uh ryomeic, if that's the right word. They're they are ryomes in this case. And and you just can't scrape off the top. you got to dig out some some se, you know, some section. Um, but there's a lot of uh um there's a lot of ragweed um or golden rod and and and other invasives in here. So the plan is to take it out and regra take out the existing vegetation, scrape the top soil, put it over here and regrade and then put the top soil back and and uh reestablish the lawn or reestablish the vegetation, I should say. Um there are some areas here where I think Oh, I'm sorry. There's also um one spruce tree right there. And there are two. There's one here and one here. I guess maybe three. Um these are uh aspen trees. Fairly goodiz aspen trees. And this is a good size um uh pine or or spruce tree. Uh these symbols are are deceiving because the canopy of this tree overlaps the pond. M.

um I'm making some recommendations here for conditions of approval, including uh to do some re planting of trees maybe uh on the bank or on this side here to uh to increase the vegetated buffer coverage. um and uh to um have the uh let's see the only other restriction I think on the project other than my standard comments um is to uh not to do any work inside the pond or the wetlands uh um more than five days in in a row and not within three days of a rain or no event of one inch or more. Um the commission may have um may have noticed that I didn't ask for a bond on this one. And the reason for that is I believe the association is anxious to get this work done and they want to do it this season. Um Mike, is that still the the plan?

Yes, sir. Okay. It'd be nice to get grass growing this season, you know, or the bottom. It's not It's not too late. It's still September. Yeah. Y So, um that's uh you know, that's the reason why I didn't I didn't request a bond. This is going to be a fairly short project. I believe uh three weeks maybe within two weeks it'd be under two weeks, I believe. Okay. Under two weeks. So, pretty quick. Provided mother nature agrees with us. You know what I mean? Right. Right now, the pond is very dry. Very dry.

All like all ponds are. I I actually went in there to try to dig some soil samples and I couldn't get through the top, I don't know, inch and a half before I ran into gravel or something really hard. I couldn't dig in it with a with a hand auger. I was surprised. I usually can dig through most stuff, but I think you're going to find a layer of stone, you know, crush stone, not not bedrock, crush stone down there, because that's kind of what I was pulling up. Anyway, um our 13 recommended conditions of approval. Um the uh uh you know, the project is going to be a shortterm project uh short time frame project. So, I think again I'm recommending that the commission consider approving this application with the uh 13 conditions.

Um Mr. Lawson, do you want to say anything? Um I mean it's it's to improve the quality of the basin. Uh they're taking out the fragmitees. We're going to mine, you know, take that stuff out, create that swale which will collect sediment in the future, so it'll be a less impactive cleanout and maintenance procedure. Um next time. Yeah, the next time, you know, it's inevitable over time between leaves and, you know, road sediment, whatever. Um, that gets deposited in there. So, they created two small plunge pools at each outlet into the pond or inlet into the pond, if you will. Um, one here and one here.

Um, and if you've ever played the Sigma Golf Course, there's I don't know what hole it is. It's probably the fourth third or fourth hole. There's a big pond right next to the right next to the green. And this is within, you know, 300 or 400 yards of that. So, to give you an idea where it is in, you know, in in response, we're we're 600 feet or more from uh from Maple Avenue here, east of Maple Avenue. I'm sorry. Did that did that answer your question? Yes, I received a permit application for residential addition at 65 Rescue Lane in the Upland Review area. Um, it's a relatively small uh addition with um uh no additional bedrooms. They're on septic out there, so that might have been an issue, but excuse me. Uh, any enforcement actions? No new enforcement actions. Yay. That's good. Status of ongoing projects. Any updates here?

Yeah. Um, we've got a we've got um um it's going to be almost exactly the same report as last last month now that I think about it. You know, I went over there and I saw that the ramp was brick and and I and I tried to get an answer to to the question about what they're going to do for for um uh ice, you know, ice removal. Yeah, it's an it's an easy fix is to attach gutters where the um where the brick ends. Gutters will go right under there and run the water down to the um towards the um parking lot and have some kind of

And uh we had a meeting with the uh site contractor um and the new superintendent who's out there and we we looked at clearing limits and uh erosion control locations and made a few field modifications, but they're um they're getting ready to go. They have brush hoged the whole thing and um they're going to start with the um you know uh cleaning up of the site. They've got some some mass earth work to do. They've got to remove uh some concrete um bins that were placed that they're not going to use. And uh they're going to have to create a new driveway in from Maplewood Avenue. So most of the construction activity and all of the utilities are coming in from Maplewood Avenue.
