All right. Uh, first item we have on our agenda this evening is the uh review of our minutes from the April 21st, 2026 meeting. I will just um mention that have been made aware of a couple of items that were uh incorrect as far as attendance of staff. Uh the last time uh Chris Beal, our fire marshall, was not here, but Ryan Hopped was and uh for from public works. So, uh we will make those notes adjusted in the final uh printed version of the uh of the minutes, but that was not reflected in the ones that you've received. Are there any other corrections or additions that you're aware of that need to be made? If not, I would entertain a motion.

Uh first item that we had on our agenda as far as business for this evening listed under new business uh was the presentation of projest from Freedom Flex for approval of a resoning from C2 general commercial to M1 light industrial and approval of a preliminary development plan and special use permit for a 13,750 ft flex space major space and 50,000 square foot of mini warehouse space in an M1 light industrial zoning district located on a 5.04 plus or minus acre lot at the southwest corner ofund east 171st street and 58 highway and south Prospect Avenue. And this item had been continued from our April 21st uh meeting. It had been announced as a as a uh public hearing at that time. And we have a request that this be continued to our June 16th meeting. Uh I think you will note in the in your agenda it did say May 19th but uh that has been updated and should read June 16th. And uh if we can have a motion to continue this

Moving to our next item which is presentation of projest from Kimley Horn for approval of an amended preliminary plat for the plateau a 180 lot and six track single family subdivision on 60.55 plus or minus acres located north and east of the plateau first plat on South Cleveland Avenue and Paulo Alta I'm Paulo Verde Drive I'm sorry and uh Jenna Fernandez our city planner will present that.

Thank you chair. Um it seems the plat is loading currently on the screen. Um could you hit the escape button perhaps? Um an application was filed to amend the preliminary plat for the plateau a 180 lot six tract. Thank you. Um, single family subdivision on 60 approximately 60 acres located at north and east of the plateau first plat on South Cleveland Avenue and Palo Verde Drive. The first phase of 50 homes was completed in 2005 including the community pool and those are existing on this site currently. The original preliminary plat of the plateau was approved in 2003 and the first phase of the subdivision was constructed in 2005 which included those 50 homes and the community pool and the remaining four phases that were included in that plat were never built. Uh the property is currently zoned R1 single family and uh the proposed plat meets all of the R1 zoning requirements except for a slight reduction on the front setback of the culde-sac and knuckle lots. Um and that setback reduction is um 25 ft as opposed to 30 ft on those lots. And they are proposing to increase the buildable area of the lots from 25% to 40%. And this would be able to accommodate larger homes. Uh the plat includes 180 lots and six tracks. The lots range in size from 0.19 acres to 0.57 acres. And the proposed tracks include landscape buffers, monument science

space, proposed detention, a flood plane conservation area with a trail dedicated to the city, and a proposed amenity space. And the amenity space proposed here would include a play area and sports courts. The development is proposed to be completed in two phases. Um on your screen is the phasing plan. Um phase one is assumed to be the original phase here. So phases two and three are uh being proposed currently. Um phase two includes 101 lots in those six tracks and then phase three includes the remaining 79 lots. Uh the detention area will be constructed with phase 2 or their first phase as well as the amenities. The proposed street network mirrors the previously approved 2003 plat and that's also in the staff report packet if you like to look at the original plat. Um outside of the two culde-sacs replaced by street connections for improved connectivity. um in addition to three trail connections that are proposed in the subdivision that will connect into the city's local trail system and those are shown here on the side and through this midb block. Um there's one midblock crossing and three trail connections into the city system. Uh the flood plane area tract L includes a trail segment that would be constructed by the developer and dedicated to the city that would connect into the larger proposed trail going to the dry nature reserve and Cleveland Lake. And that's along the flood plane area here. A homer's association shall be established for the long-term maintenance of the common tracks proposed in phases two and three. And

based on the discussion between the current plateau HOA and the developer, a new HOA will be established for phases two and three. For this reason, the subdivision name for phase two and three or the new phases uh will be modified with the final plat. So there will be a slightly different name for the uh new additions here to avoid any confusion. Um staff believes that the modifications to the front setback on the culde-sac lots and the increase in building coverage accommodates larger homes with minimal impact to streetscape or adjacent properties. And the need for larger higherend homes is very well documented. And these minor modifications uh assist in meeting that need. Um, with that, stack staff recommends approval of the application as presented uh for the prelim preliminary plat with the five conditions listed in the staff report. Um, I'm here for any questions and then um part of the applicant team is here as well for any questions.

good evening, commission members. My name is Taylor Harrington. I am with Stinson. Um I represent the developer for this um preliminary plat approval. Here with me today is going to be Patrick Joyce, the engineer um for the development. I Jenna did a fantastic job kind of describing the historical background. Um we will reiterate that this plat um this revised plat does look largely similar to the plat that was approved back in 2003 with those minor amendments. Um no zoning request has been changed. No change in zoning has been requested as well as um a new HOA will be established that will be separate and apart from the original phase one that has already been established. Um those are the high points that I think we want to hit and then if Patrick has anything else to add I will let him do that as well.

I think that is an improvement that we wouldn't point out, but um the original one had some additional drainage going south. We have actually um redirected everything from our plat to be controlled with our detention basin over on the east side. So, um, just to make sure everything's contained and we we're in control of everything. So, just wanted to add that and we're also here to stand for any questions that you have. So, all right.

So, that was something that that was requested of us by by city staff. Curious why that big angled lot didn't have any. Which lot are you referring to?

Um it appears to just be a mirror of the original phase there. Um generally um the plat matched almost exactly what was approved in the 2003 plat. Um like I said, the only differences were really those uh road networks. So, it looks like that was just something that was planned for in the original phase one and that carried over and most likely had to do with the lot depth.

Okay. Any other questions from one on the commission? I uh my other question and it's more of a big concern is the HOA. Uh I think that's going to be a problem having two HOAs in the same neighborhood. I think that needs to be studied and looked at a lot harder because it's just going to cause issues down the road. So, whoever has that control should look at that hard. So, I think uh one big change probably from when the first plat was approved was we did not have the uh Dryen area at that time and to have this this close and with all of the studies that we've seen over the last couple of years uh the thing that we've heard heard time and time again is we need more homes and we need bigger homes and uh so I think this is uh you know with the exceptions of of giving that a little larger coverage is going to allow I think you are hearing what what our people have been telling us here in the city as well uh that giving uh some some larger options for for people and then to have that out uh in that area I think is is just really really good. I have a question. Is Westover going to come all the way through eventually? Yes. So Westover will eventually connect um when it's when the final phase of Timber Creek is completed. Okay. Yes. So, we visited with our consulting team last week um and they gave us kind of a revised schedule. We anticipate having all the remaining chapters of the development code update drafts uh by the end of this month uh with um a final revised draft by the end of June. So, we'll hopefully be able to share more details on those drafts um come July with the commission and council. And we are still um hoping to bring that forward for consideration late summer, early fall. Okay. And any other items for director's report?

Uh the only other thing I'll add is that since the public hearing on the first item was continued to June 16th, we do not have any agenda items for May 19th. So that meeting will be cancelled.
