Daniel Dodson of Fitz and Shipman is requesting a renewed approval of the preliminary plat of Kingswood Place subdivision phases 2 through 5, Bowmont, Jefferson County, Texas. This plan was previously approved by the commission in March of 2023. They are currently in progress of under an approved set of construction plans. The ordinance expires plats after 24 months have passed. As such, Mr. Dodson requests the commission to renew this plan to continue construction of the 119 lot subdivision. This subdivision is located in the north end just north of East Lucas Drive and east of Hellbig Road. Staff recommends approval of the following conditions. I'm sorry, recommends approval with the following conditions. Uh, number one shall include a note stating, "All property owners will be required to construct a 4 foot or five foot wide side concrete sidewalk adjacent to the street located 4 feet back from the four feet from the back of curb. At street intersections, if applicable, sidewalks are to include construction of a 5-ft wide landing to tie in with the concrete access ramps. If any lot is not developed within five years of the recordation of the final plat, the current owner shall construct the sidewalk. Condition number two, temporary erosion control measures must remain in place until permanent me measures are established. And number three, all fire hydrants shall be placed as required by the International Fire Code. The area outlined in red on the screen is the area in review. This is an aerial image. So, it just depends on which route that they want to to go. Um, typically once you start to make sure the uh continuity is is good, you normally it's a 4 foot sidewalk as they want to come off of the road for a complete street.

Commercial development along this corridor is generally appropriate given its location is on an arterial roadway that supports commercial and higher density uses. Staff recommends approval of this request. We did send 27 property owner notices. We received zero in favor and zero in opposition. The area outlined in red on the screen is the area under review for a reszone. So you can see it abuts the GCMD zoning district. The intent of the reszone is to allow for commercial development rather than multif family. This property is supported by an arterial road and a collector road, both of which support higher density uses. As such, planning staff recommends approval of the request. Staff sent 21 property owner notices. We received one in favor and zero in opposition. Um, in favor did not list any um details, just that they were in favor. Haney Al Rube of Bumont Collision Auto Storage is requesting approval of a specific use permit to operate a vehicle storage facility to be located at 2450 South Fourth Street. They will provide towing services 24 hours a day, seven days a week with office hours being Monday through Friday, 8 to 5. The city of Bowmont Police Department requires all towing services to be registered with the city in addition to bearing proof of being licensed and permitted as a tow truck pursu pursuant to state statutes. Staff recommends approval of the request with the following conditions. Number one, the applicant shall be in compliance with articles 12.06 and 6.08 of the city of Bowmont Code of Ordinances. Number two, the applicant shall obtain a certificate of occupancy from the building official. Number three, all recovered items must be located within an enclosed area and shall not be stored in any public rideway or easement. Number four, a detailed plan for the pavement and parking area shall be submitted and approved by the city of Bulmont traffic engineer. Any f number Number five, any future construction plans must meet all requirements by water utilities for the water and sanitary sewer services, including any requirements of the city's backflow pre-treatment and/or fog program. Number six, any addition to pavement must meet current drainage criteria standards required at the time of development per drainage district. Number six and number seven, the development shall comply with section 28.04.006 landscaping and screening requirements of the city of Bmont's code of ordinances. Staff did send 20 property owner notices. We received zero in favor and one in opposition. Opposition states, I am requesting no against the SUP to allow a vehicle storage facility. Oh, my name is Paul A. Brown. I live at 4370 at Cartright Street in Bmont, Texas. I'm retired and I own property across the street on fourth where the request is being made. If you look at the first picture with property that I own and look to the left of it, there's a corner of a building that I own. Behind that building, it's a little apartment building. The building in front, 2405, a lease to a lady that owns a nail shop. Directly across the street from that property is the picture that you're looking at with cars parked there. For a long time, I consider that a storage. I don't see any activity. I don't see anybody buying. No one can go into the place and really turn around. We have problems with people coming to us parking on my property in order to go to where they got these cars parked.

And right in the blue property, the picture that you see in the center on the end of it, I made a picture of the store that's on a corner of Carly and Forest Street, someone just invested a very good investment and made that store very attractive. What they're proposing is to put vehicle storage right behind that store. So what we looking at is another basically, if I can use that term, junkyard with cars just parked there to be taken to other places. This is a very busy place on fourth and Corley. Very busy. So my concern is that in this part of the community, why did you come here to put this type of investment with a used car dealership right there in the heart of that community? Where other places you can put this to store cars? That's just not the place. The two buildings that you're looking at, the two blue buildings is temporary. And if they store the cars, there will be 100. I'm a real estate broker. 110x 330 deep. It goes back behind the store. It's 330 deep where it would have cars stored there on four street right next to where you got cars already stored. So what you be looking at is a big gap with nothing in that community but stored cars. And I don't think it's prop just as a property owner. I don't think it's property proper for appearance for trying to put a bond through and make Bowmont look better. That certainly wouldn't help it at all. Not in that part of the community. I would suggest that they find another location. That certainly wouldn't be the place. If you're scoring one to 10, it would score

And I had a couple incidents where they parked on my property and I happened to be there at the time. I got the property leased. Where do you think I supposed to park?" Well, I said, "I'm not supposed to provide the place for you." He left and he came back and he apologized. He said, "Yeah, you're right." But he wasn't looking to buy a car. He was looking to talk to a guy there who fixed fences. And at one time I had a broken window and the man from across the street walked to me and said, "Could you help me?" I said, "Yes, sir. I got this broken window." And that was corrected. Uh but all I see is a continuence of cars parked a mass of cars parked on Fourth Street in a residential neighborhood where it just shouldn't be.
