And I am here. So all five are present. We have a quorum. Welcome. This is the Wednesday, December 3rd, 2025 meeting of the Bablin Town Board at 3 p.m. If you're here in person or if you're watching us on our YouTube channel live on the 3 at 3 p.m. Meeting is divided up into three sections. First is dedicated to the public hearings. There are three public hearings scheduled for today. Uh the second is dedicated to the agenda. There are agendas on the table up front and the third is the open portion when residents can come forward and address the board in any manner concerning town government or town services that are not on today's agenda. If you're watching us on our YouTube channel at a future date and time, that link that you see there is still live. You can access the agenda, the public hearing schedule, and you can send us a message with a question, comment, or concern. One of us will get back to you. With that, we'll go into the public hearings. And the first public hearing, public hearing to consider amending the code of the town of Babylon, chapter 213, zoning. Article one, definitions. Article 7 A, residence, article 7 A double A residence, article 8 B, residence, and article 9 C residence. I don't have any cards. Planning board job 25-18 AE for the premises identified as Suffach County Tax number 100-209-3-8 located on the north side of Route 109 830 ft west of Glenda Drive West Babylon for the applicant.
Good evening, Mr. Supervisor, members of the board. For the record, Nicole Bland. I'm an attorney at Bazelle Bllanda Viscanti with offices at 535 Broadwell Road in Melville. Uh this is an application to change the zone from uh res A to senior citizen apartments. We're seeking to have nine onebedrooms. We meet the density, we meet the parking. Um there's several other multi-res projects in this area including Manor Park, um Southshore Villas, a mixture of senior citizen and u non-agger restricted multiple residences. Um, this board might remember we were here about a year ago to reszone it to industrial, but when the owner looked into um, renting it out, there was really not much interest in industrial on that corridor. So, we do feel this would be a better use of the property and overall a positive upgrade. Um, if the board has any questions, I'm happy to answer.

Good to see you, Mr. Supervisor. Members of the board, um in two minutes or less, I I know you're familiar with the subject matter here. Um there's a letter that also fully explains it. This is uh these are two duplexes side by side on Teddy Place in West Babylon right off the Sunrise Highway Service Road. Um we're here asking relief from the owner occupancy um requirement of in connection with the covenant restrictions that are applied to the property. The zone residency two family uses permitted as of right in the zone. I have no idea why at some point historically they impose these CNRs, but I do know that they've never been occupied that way. Um there are two duplexes for years they were sober houses. Um and when they were sober houses run by a company called Destiny Village, a not for-profit um they were wreaking u havoc in the community resulting in multiple litigations. Um yeah, mildly havoc. Um the owners came to me saying they wanted someone that could come in and sort of get control of the situation and restore them to to family use. I looked at the properties saw that they um had this covenant. Um and when we had discussions with the town about you know sort of mitigating this problem um they had to include relief in the covenant. Um so uh we basically took over the management.
So can I just say and save you saved the day. He has stuck with this. He has jumped through hoops in order to accomplish this and we're we're very grateful. That will conclude my presentation today.
