live. Yep. We're good. Assistant tech person Pam says we're our planning commission meeting. Um, do we have the the application? No. No. For dealers. I think he's talking about dealers. You talking about dealers or for Yes. I had it in the last packet. I don't see it in this. That one's been advertised. Yes.
And and she made contact with all the neighbors and so I'm not sure about that, but it was it was definitely advertised. So hopefully um I haven't heard from her. Okay. If we don't have confirmation of that, I don't think we can move forward on that one. Is that what we're waiting on is just the letters from her? Yeah. So I guess we Maybe we do a plan commission meeting at the end of December because that's what we would want to do for the fall diamond property anyway. Yeah.
And have and readvertise and have her give her that advertisement again so that she can give notify the neighbors of the new dates. How how does she verify that she does certified mail? Certified mail. She has to bring receipts. So if if you haven't heard anything about that, then I'm I don't know that we can move forward on the dealer property. Which property? The beer property where they wanted to uh change to commercial so they could do outdoor vehicle storage. Yeah.
Yeah. No buildings, no anything like that. They said they would abide by all the zoning requirements for the landscaping and and things like that. So, I don't know. Obviously, it's not a everybody's opinion here matters, but it it seems not unreasonable to me. But, u if they don't if we don't know that everybody's been notified, I don't think I don't think we can move forward on that. So, So does that bring us to Hold on. Hold on.
So we are trying to reszone our own property from special commercial to C2. I believe should fit. I think that's what they want. I think that's what we want. Yeah. In in looking at the different zoning classifications that seem like that would fit with what you all want to do. I mean, I think the setbacks are all pretty similar. I think
Yeah. And I don't think that will the uh purchase agreement said something about variances. I don't believe that would require a variance for anything they want to do, too. The problem with a variance is we don't have any control over that. That's that's a different that's the board of zoning appeals. Sure. Sure. So, uh, but but I think we can certainly reszone our property before, uh, the end of the year. I have I have an application. Do we need an application for us? Yeah. Yeah. Okay. Well, I'll fill this out then because we have Mrs. Steel. Well, I didn't know we the planning commission needed a
Yes. The town of Atlanta needs to apply to the plane commission to resell. Town of Atlanta is the owner, right? Yes. So what after we do this we would we need to advertise we need to notify neighbors have a public hearing a plan commission meeting and a council meeting before the end of the year which we can make happen I believe the last yeah we'll just schedule it all that day we can do the public hearing and you know the plan commission public hearing prior to our final meeting. Okay. Does anybody know the address at the ball fields? 75. I think Fred ought to know it. Fred, do you know the address of the ball fields? I do not.
What's the I left my packet from last week in
that is currently special character commercial. Correct. And what's the address here? 105 East Main Street. Okay, here's your uh application. When is our final move?
The 29th. That's 1800. So, Since it'll be concerning two properties, you want to do five o'clock that day for commission public hearing. That's a good me. What day did you say? 28th. 29th. 29th December. Yes, ma'am. That just be a planning commission only because this is our fourth meeting of the month or fourth Monday of the month. No, that's the one that it takes place of the final final council meeting will be at 6:00 that same night.
So that way whatever the plan commission recommends to the council, the council can take action on. That is the 29th birthday. Yes. Because we're not having one for Christmas. Are you available then? Are they allowed if they have a contractor that fits into all of this? Is a contractor allowed to rent one of their buildings as long as it falls into zoning? Yeah, I would I would imagine so. Yeah. I mean, as long as it conforms to all that's what I would say, too. I thought I better present that in case that they're not doing it today, but if that were to come up,
yeah, sometime in the future that made sense. I don't know of anything that would prohibit subleting of of any kind. Okay, very good. Thank you. Do you need this application? Yes. Uh actually, I'll just make sure C2 I took a shot.
Oh, you want me? I'll sign. You're
[snorts] So in the in the meeting then would we have to approve Jennifer spending the money to mail out certified mail? No. So
just as part of the process advertising come out of the advertising. Okay. Why? So then we would advertise for a public meeting on the 29th so people can come and address and pro problems they have with it and then you work as a council on the planning commission would vote to approve it send it on to the council and then the council I understand correct it's been a while since I've been through that process but I believe that's correct. If that all happens on the 29th, what do you want to do? Is that that
we have applied to ourselves to resone ourselves? [laughter] Well done. So, you're saying if everything passes on the 29th, we can close on the 30th. Well, I think that's the thing that's holding it up, right? Is that that's the only thing left? I I assume Murray would be the guy who would have to go sign the papers. Yeah. That shouldn't be a problem. Do you need more than one person or is it No, I don't believe so. Okay. Uh I'll go ahead and start work. Okay. Right.
It shouldn't really matter. I I should be okay anytime. So, does that does it matter to Jennifer when we get the funds? I was just say wired. They will be wired and so he'll just need to have all the wired information and he'll fill out a document at closing and then if we close in the morning, he'll get by early. Sure. Does that matter to you last day of the business day of the year, Jennifer? Does that throw you off at all or No. No. As long as it's in there, all my Okay. So, sometime if they have availability, yeah, sometime in the morning would probably be okay.
You have a better chance of cooperating with all the monies going. Yeah. We actually purchased a building a couple years ago that there was a delay in the wire of about an hour and the you know, so we sat there twiddling our thumbs. So, Well, I always have my expire money the day before. Yeah. So that we're not sitting in clothing for hours waiting. [laughter] One time only at least good idea. Yeah. Nobody wants a drive. It's a long upward four hours. Very long. But handing over the keys to the castle.
Oh, I agree with you 100%. You don't trust us? No. [laughter] Good girl. I trust when you sign on the dotted line and we're done. Um there's there's one more thing that occurred to me while we were going through all this. I told her uh no not that. Um so we use Best Lock here. Okay. Right. So that's Stanley Best. Um there's a a dealer in Fischers.
Uh Central Indiana hardware. They're great locks. They're like seven pin keys. I mean, they're almost impossible to break into the doors and it's very easy to manage because you can get cores that let certain people in some doors and not others and things like that. Anyway, what would probably be easiest for us and maybe for you as well is um if we leave the lock, but we'll take our cores. And so, I don't know if you all were interested in using the best lock system. You could get your own cores and keys and I can help arrange some of that if that would be helpful. Uh, but what we have on there right now have keys to open the doors.
Well, that's what I'm asking is we can we have a town system for for our our our town locks and and so so I'll ask if he wants to continue that or we'll just change it to something. Yeah. If you if you all have no interest in that, that's fine. If not, that might even be something we might be able to switch to a unique core and key that we can give you lease for them or how does that work? No, no, you you buy the Okay. And and they give you a unique series of cut keys and cores that only you have. Um,
so I mean, we could, you know, I'll get pricing on it. Maybe that's something that we even just get a different set of cores and keys so we do have something to give you and you could use them forever then, right? Um um but I just didn't know if there was a preference if they already had a lock system they were using or because I don't know the answer to that. So I will ask what they want to do and yeah, they might just say do a different kind and put it on there so they have right. Okay. All right. Typton
u so what they'll probably do is I I threw it out there to them already. They haven't given a definitive answer but probably a single key in a key box on a gate would be the easiest for them in my mind. So they don't have anything now. They've got town keys right now to but uh to that facility they don't work on the town hall or anything like that. So anyway, anyway, I thought I'd throw that out there. Um, if they if they already have something in mind that they want to use, we'll take the whole thing. If not, we can we can figure it out where you guys have something that works. Okay. So, very good. Yeah, because we'll need something that works closing for sure. So, I'll ask them what system. Okay. All right. Good deal. Sure. Thank you.
All right. Thank you. And then the sewer line between the concession and the press box is shallow. Yeah. And I've never even had a camera in it or anything like that, but I do know that the elevation at the manhole that it goes to uh about a block away is pretty shallow there. So I imagine up by those buildings it gets shallow. That's what I've always been told is, "Hey, watch what you know, you know, in a certain area. Don't drive." Okay. Basically probably between the concession stand and that fence on that ball field to the north. It's kind of that real shallow area as far as I know. But I've I've never seen it. I may have those all look okay. Very good. Thank you.
That's the that's those are the only things that we've thought of in the last couple weeks. So Okay. Well, anything else thought of? Yep. [laughter] Let me know. All right. Hopefully not. Hopefully not, but you never know. Is there anything else you can proceeding to do? I don't think so. Those letters out. We follow the same process everybody else does and there will be ample time that if we send them out the person next week and advertise the person next week that's even if there's mail delays that's plent time. So,
and since he'll be the one signing, can you It's Murray. Yes, ma'am. Could you send me Murray's contact information, please, with an email address so that I can give that to Sure. That'd be awesome. You want my address? Yeah. Okay. All right. Well, thanks. Is there any other uh plan commission business to discuss? Uh kind of sort of rumorish. Oh yeah.
I've heard rumblings from a few citizens that the gas station was wanting to go 247 and I talked to Kevin and I was walking and he was out there. I talked to him about the ball diamond make sure they didn't have anything to do with it and he he was telling me that he thought he he said that's a bad idea. They weren't allowed to do that. The reason they got his own variance, but right he did say was they also want to go uh a 5:00 in the morning to 11 instead of 6 to 10
which personally I can see 12:00 in the morning because people leave early here earlier than that to get coughs. So so as I understand it the 6 to 10 is what they presented when they went for their variance, right? So they would need to go through that process again to have any change and that would be through Kevin. Yes. Not us. Yes. Or zone. Okay. So I've seen people out there at 6:00 too waiting. Yeah.
The the variance was the people who said no to 247. It wasn't plan. It wasn't the planning commission. Uh no that what enabled them to have a gas station with the hours that they have was a variance as far as Okay. So it's the BCA varian the hour. So they wouldn't come to us for that. Okay. All right. That's all I got. Is there a motion to adjurnn our planning commission meeting? I make a motion we our planning commission meeting. Second. Go for it. All in favor? I thank you.
