All right, so our first item is a resolution appointing the city clerk and canceling the general municipal election for city clerk scheduled for November the 3rd, 2026. I will turn this over, I think, to the city manager first, and then she can hand it off to whoever she needs to.

Yes, so tonight we're gonna have actually our assistant city clerk presenting the report and she's gonna be going over it. All right.

Thank you. We are recommending, per the resolution, appointing a city clerk and canceling the general municipal election for the city clerk, scheduled for November 3rd. So the recommended action is that city council adopt a resolution appointing Michael J. Mandy as city clerk. and canceling the general municipal election for city clerk scheduled for November 3rd and directing the mayor to present the certificate of appointment in lieu of election to Michael J. Mandy and directing the mayor to administer the oath of office to Michael J. Mandy with the official term beginning November 4th following the November 3rd general municipal election.

All right, excellent. So I have the certificate of appointment here that I'm going to present to City Clerk Mandy, and then I will read him the oath of office, which I hope you've brought with you today.

Okay, perfect. So this is a City Clerk certificate that there are not more candidates than offices to be elected for the City Clerk. It says, I, LaTanya Peoples-Stokes, Assistant City Clerk of the City of Antioch, do hereby certify pursuant to section 10229 elections code in the state of California to the following facts related to the general municipal election to be held on Tuesday, November 3rd, 2026. As of the close of the nomination period on Friday, August 7th, 2026, only one person has filed nomination papers to fill the at-large city clerk office that is up for election at the November 3rd, 2026 general municipal election. Therefore, there are not more candidates than offices to be elected for city clerk. The person so nominated is Michael J Mandy for city clerk. That section 1022 of the elections code and of the state of California allows one of the following courses of action to be taken by the city council at a regular or special meeting held before the general municipal election. One, appoint to the office the person who has been nominated. Two, appoint to the office any eligible elector if no one has been nominated. And three, hold the election if either no one or only one person has been nominated. A notice of these facts will be published on August 15th or have been on August 15, 2026 and newspaper of general circulation in the city pursuant to section 6061 of the government code. After the fifth day following the data publication, the city council will meet to either make the appointment and cancel the election or that office or direct an election to be held, the person appointed, if any, shall qualify and take the office and serve exactly as if elected at a municipal election for the office. If by the 75th day before the general municipal election no person has been appointed to the office pursuant to one or two above, the election for the city clerk shall be held along with all other elected elective offices on the ballot. If an appointment is made to the office, the general municipal election for the city clerk will be canceled but will be held for all other city elected offices on the ballot. If the City Council makes an appointment pursuant to Section 1022-9, Elections Code, the City Clerk shall not accept for filing any statement of write-in candidacy for City Clerk, which is submitted after the appointment is made. Thank you all very much. I've enjoyed my time here and that's why I'm running again because I want to keep on doing what I'm doing. I've met a lot of wonderful people in the time since I was appointed and I'm very grateful for your support and for choosing to have me do this for another two years. Thank you all very, very much.

All right, thank you for your service. And I thank the city council for saving us between $40,000 and $80,000 on this election. And thank you, Assistant City Clerk, for discovering this and bringing this to our attention so that we're able to go through with this. So thank you. All right, thank you very much. Thank you. The other item is also a conference with legal counsel regarding existing litigation pursuant to California Government Code Section 54956.91. And the name of that case is Lamar Young versus Sergeant Stinger, City of Antioch, et al. And that's in the United States District Court, Northern District of California, case number four, semicolon, 21-CV-08131-ASK. And those are the two items.
