approved. We'll move right into public hearings. Um, we only have one tonight is AA25-4. A variance request to set back at 417 Liberty Court. Thank you, Mr. Chairman. The site is outlined in red. Um, it's kind of down here at the bottom of your screen. I put it there so that it would help I so we could better see where we are. East Calhoun is kind of running diagonally here along your screen. Um, does everybody have an idea of where we are? Great. Um the applicant is seeking a variance from section 1410 of the development ordinance to construct a garage. The property is a corner lot with frontage on two sides. That's Liberty Court and Old Colony Road. Per section 143. Quote, "For corner lots, the two street frontages shall be considered front yards, and the two remaining shall be considered side and rear based upon the orientation of the front of the house." Close quotes. And per section 1410, accessory uses in the zoning ordinance, accessory um uses must be in the side or rear yards, not the front yards. and that's quote accessory uses may be located in the required side and rear yards. However, may not occupy more than 30% of such yards measured from the interior building lines. No accessory use may be located closer than 3 foot to any property lines. Close quotes. The front of the house faces Liberty Court, so it is considered the primary front yard. The old Colony Road frontage acts

as the property sideyard. The proposed garage location is approximately 47 ft from the old Colony Road. This distance exceeds, and I think this is important for you all, this distance exceeds the front yard setback of 35 ft required in the R15 zoning district from Old Colony Road. So, in other words, if this were a vacant lot and we were building a house on it, um it would have to be set back a minimum of 35 foot, but this garage is actually 47 foot back from the from the old colony. Does that make sense? Mhm. Okay. um to hear and decide appeals for variances from the requirements of this ordinance uh which when strict application of the provisions of this ordinance would result in unnecessary hardship. A variance may be granted in an individual case of unnecessary hardship if the board makes and explains the following findings. So in the ordinance you need to find these things are applicable to this application. A there are extraordinary and exceptional conditions pertaining to the piece of property in question. B these conditions do not generally apply to other properties in the vicinity. C. Because of these conditions, the application of this ordinance to the piece of property would effectively prohibit or unnecessarily restrict the utilization of the property. And D, the authorization of a variance will not be a substantial detriment to adjacent property or to the public good and the character of the district will not be harmed by granting of this variance. So staff is recommending approval. The variance requests um to allow an

accessory use in the old Colony Road front yard being set back 47 foot from Old Colony Road rightway meets the findings of facts and that means meets the finding of the things that I just listed. So A the site is unique because it is a corner lot. B the condition does not generally apply to other properties in the area. C, the two front yards restrict the location of an unnecessary of an accessory use. And D, authorizing the variance does not cause a detriment to adjacent property or to the public good. So staff is recommending approval as submitted and my apologies. We'll get there in just a minute. So this is the um this is the the uh plan that the applicant submitted. You can see Liberty Court down here at the bottom. Old Colony would be off to your right right here. So you can see the 47 ft setback for the proposed garage right here. And again, that's the proposed garage. It's separated from the house by 9 ft. And this is the existing structure. So, there is a there is an existing driveway here and a parking area right here where the garage will be going. Does anybody have any questions? Any questions for staff? I got a question for staff. He'd if he'd have made it double and moved it over where he's 35 ft from the old colony, we wouldn't have to meet. Is that correct? No, sir. I don't What's What's the What's the variance? It doesn't have to only has to be 35 ft. It's 47. So, so the variance the variance is from a front yard. You can't cannot put an accessory structure in the front yard. Okay. And so this has two front yards and technically this

garage is in a front yard. And it doesn't the front yard doesn't have a there's a setback requirement, but the front yard is all the way to the to the to the to the building. So it's this is the whole front yard right here. The setback is only back to here, but it's this is the whole front yard. Does that make sense? Nope. But we we've met on this so many times. We have. Well, yes, sir. On and on. And we met last one I remember was out off of Concord. The the brick house, Smithfield and house on the corner. We always treated them as a sideyard. You treated the front of the house facing that was the front of the house. Yeah. They had two side yards. They didn't have no front yard on the side. So you may have treated it that way, you being the board, but the code says that a corner lot has two front yards. Yeah. So our our variance is can we can you put it in that other front yard? That's what we're that's what we're deciding. I was looking at the distance. I want to see what we're doing. So any any any more questions for staff? Any discussion amongst the board? is not zoning. That's the title of it. It's the new zoning ordinance that's pending. If you re will remember, we had a comp plan that was just approved a week ago, a week or two ago. After the comp plan, we're moving into revisions to the zoning ordinance. Uh so it's there's a lot going on in Anderson. Um and this is why we're kind of focusing on local things for your all's education. So again, May 6th, um talking about the new zoning ordinance that's coming down the track, um with Maurice, it'll be after the planning commission. I encourage you all to attend. Um if the planning commission doesn't meet, it will it that will still happen at the at their regular time. Um and then again on June 26th following your meeting. So we're spreading these out over the boards to make them as as available to everybody as possible. Um there is a an opportunity um where Mike our planning uh I'm sorry transportation manager is going to be talking about um well transportation and getting in and around Anderson that includes trails uh vehicular circulation things like that public transportation that's all kind of wrapped up in his. So that'll be an interesting discussion too in light of all the changes coming. So, we're looking forward to all of that. Okay. And we just need We need to go to one of these just to get it. You need to go to three of them. Uh because you need three credit hours. You only get one credit hour for each one. We've already missed one. You already missed one.
