Today we have one public hearing item on our agenda. I would ask members of the public who wish to speak on a public hearing item to please complete a yellow speaker card and give it to staff if you have not already done so. The cards can be found on the table at the entrance. Please keep in mind please keep your remarks as brief as you can. We are influenced more by the content than the length of your presentations. First, we provide an opportunity for any member of the public to speak on items of interest to the public that are within the subject matter jurisdiction of the planning commission. Is there anyone who would like to speak at this time? Seeing no one, uh, prior to the beginning of the public hearing, I will now ask planning commissioners for any disclosures they wish to make regarding public hearing items on today's agenda. Seeing no one, please note the actions taken by the planning commission tonight for item number one will be final unless an appeal is filed with the city clerk. The appeal deadline is Thursday, October 2nd at 5:00 pm. Appeal forms and information are available at the city clerk's web page. Thank you. Um, good evening, Chair Walker, members of the planning commission. Item number one before you this evening is a request for a conditional use permit to construct a new 2,287 foot restaurant with a single drive-thru lane and a tenative parcel map located within Anaheim Hills Plaza at 472 North Hills North Anaheim Hills Road. The nearly 3 acre project site is shown as a highlighted parcel is fully integrated into a 9 acre shopping center and located in a general commercial zone and scenic corridor overlay. It is designated neighborhood commercial in the general plan. The proposed use would be situated in the portion of the part highlighted parcel by the gold star. Surrounding land uses include a service station and senior apartments to the north, multif family residential properties to the east, a commercial building to the south across Canyon Rim Road, and a senior apartment community to the west across Anaheim Hills Road. The subject site is developed with a 24,650 foot inline commercial building and commercial and surface parking. As previously described, the the project proposes to construct a 2,287 ft commercial building with a 303 ft outdoor patio, a single drive-thru lane that would wrap around the building along Null Ranch Road accommodating a stacking capacity of 11 vehicles. The application also includes a subdivision map to split the nearly 3 acre parcel into two parcels. Parcel one measuring 2 acres and parcel 2 measuring 1 acre where the new building would be located. The project was originally evaluated with a Starbucks as a proposed tenant as

reflected in the elevations. The proposed elevations feature a modern California design with neutral neutral gray color palette accented by brick veneer fiber cement panels and smooth plaster finishes. Architectural elements such as green screen panels, bronze metal awnings, and coordinated light fixtures contribute to the cohesive contemporary design. The proposed drive-through restaurant also includes interior dining area for customers and an outdoor patio. Although the project was initially evaluated with Starbucks as a proposed tenant, the property owner requests flexibility to accommodate another comparable restaurant use. A condition of approval has been included, requiring further evaluation for consistency with operational characteristics. If a future tenant is not Starbucks, as the propo as proposed, the project meets all the required findings for a conditional use permit and tenative parcel map. The drive-thru facility has been designed to operate compatibly with the shopping center with adequate queuing and circulation on site without adverse impacts of the surrounding properties, traffic, or parking. The subdivision would be consistent with the general plan, create a parcel suitable for the proposed development, and would not result in environmental damage, harm to wildlife, or public health concerns. For these reasons, staff recommends approval of the application subject to conditions of approval. Please note, conditions of approval um have been received following the publication of the staff report and will be added to the respective resolutions as shown on this slide. And that would conclude my presentation. Staff and the applicant are available for any questions. Thank you.

So, the owner has voluntarily um going to be making some upgrades to the shopping center that includes um an ADA path um and connection from Anaheim Hills Road and Null Ranch Road into the shopping center. And this will be completed when the structure is completed all of the same phase. Yes. So this is required to be completed um I believe prior to issuance of the building permits. Okay. Thank you. Um Starbucks has evaluated their sites and this one was identified as potentially not needed. Um but the owner wanted to move forward and would be um filling it with another tenant potentially.

So, as far as uh future meetings on October 6th, we do have a an application for a conditional use permit for a church in an existing industrial building as well as a tenative parcel map request for an industrial condominium subdivision. On October 20th, we do have a conditional use permit and a tenative map request for a condominium conversion of an existing apartment development. And that's all I've got for the month of October.

So um I will um have one more meeting with all of you um to introduce Joanne um and then she will run the meetings from that point. And then again as a reminder um as as you all saw the notices and we are holding the uh joint special meeting this Thursday with um the various cities commissions and committees for your um ethics and brown training.
