Is there anyone here to speak at this time? Seeing no one, we will move to the public hearing. Prior to beginning the public hearing, I will ask the planning commissioners for any disclosures they wish to make regarding the public hearing item on today's agenda. Please note that actions taken by the Planning Commission tonight will be final unless an appeal is filed with the city clerk. The appeal deadline is August 6th, 2026 at 5 p.m. Appeal forms and information are available on the city clerk's website. I will now begin the public hearing and ask staff to present item number one.

Thank you. Good evening, Chair Castro, members of the Planning Commission. Item number one before you this evening is a conditional use permit request to establish a daycare center for adults within a vacant tenant space located at 3150 West Lincoln Avenue, Unit 160, filed by Prosper Health. The project site, identified by the red star, is located within a commercial center nearly six acres in size. It is located in the general commercial zone and designated for low-medium residential uses in the general plan. Surrounding land uses include single family and multiple family residences to the south and north across Lincoln Avenue. restaurants and multiple family residences to the west across Western Avenue and a restaurant, single family and multiple family developments to the east. There's also an automotive repair business located at the southeast corner of Lincoln Avenue and Western Avenue, which is not part of the commercial center. The daycare center for adults would occupy approximately 9,000 square feet of a vacant tenant space formerly occupied by a DMV. The front entrance is reflected in this image. The daycare center would be licensed by the California Department of Public Health to provide services for aging and disabled adults. Community-based adult services would include nursing care, medication management, occupational and physical therapy, cognitive engagement activities, meals, personal care, and supervised daily programming. No exterior changes would be needed to accommodate the proposed use. The business would operate Monday through Friday from 7.30 a.m. to 5 p.m. with approximately 20 to 35 employees and serve up to 225 participants. Staggered pickup and drop-off consists of a combination of company-operated vans, caregivers, and independent transportation. Morning drop-off would occur between 7.30 a.m. and 9.30 a.m. and departures between 1 p.m. and 2.30 p.m. No walk-in or overnight care is proposed as part of this request. The proposed use would require interior tenant improvements to reconfigure the existing floor plan and closing the existing openings to separate the tenant space from the adjacent suites. Improvements include expanding the restrooms, constructing therapy rooms and activity area, clinical support spaces, and administrative offices as reflected in the floor plan. The State Assembly Bill 2097 does not allow the city to impose minimum parking requirements because the site is located within one half mile of a major transit stop. However, the applicant submitted a parking study demonstrating adequate parking for the center. The study found that even at full occupancy, peak parking demand is projected to be only 240 spaces, well below the 379 parking spaces provided on site. Therefore, the existing parking supply is adequate to serve the proposed project and existing uses. The project meets all the required findings for approval of a conditional use permit. The proposed daycare center for adults would operate within the existing commercial space and be compatible with the surrounding land uses. Although the project is exempt from parking requirements, the existing shopping center continues to provide sufficient parking. The project is not anticipated to create impacts related to public health, safety, site circulation, noise, or parking. For these reasons, staff recommends approval of the application subject to conditions of approval. That concludes my presentation. Staff and the applicant are available to answer questions.
