We're just like a welloiled machine. All right. So, at 5:00 we're ready to roll. Going to give you just a minute. Get out. Right. Roll. and Dar ready to go. So,
all right. Uh, it's five o'clock. Uh, I called order of this special meeting planning and zoning commission for April 15, 2026, and we'll do a roll call. Miss Melli, are you online? She was in the waiting room earlier. All right. She's there coming to us from outer space. It looks like Mr. Brian here. Mr. Hinckley here. And I don't see it's been David yet. Uh so for the moment she's absent. I understand she's going to probably zoom in later and I am here. So four of us here. One pending. Um may I have a motion to approve the agenda?
Motion to approve the agenda, please. I have a second. I'll second. All right. All those in favor say I. I I I All right. That motion carries. Uh Burn, do you have anything to disclose? Nope. I'm cool. Barb, nope. Nope. And I don't have anything either. So, um we get our presentation. We can't see you. We can't We can't see you guys. We're all here. Yeah, that's what they all say. There you are. Here we are. Yeah. Sorry, missed the button.
So, David, are we going to proceed first with a confirmed letter or uh the letter our presentation and training? The letter. Okay. Um Okay. So, item number four is consideration of the planning zoning commission letter to the DEQ regarding concerns of the wastewater study for rainer subdivision. We discussed this at the uh prior meeting a week ago. Um Burn has drafted a letter to go out under his name. Uh correct.
Um yeah. Yeah. I just would would say that David and Matt and I have gone several iterations on this to try to get it right just for for the benefit of our our colleagues here since the since the meeting. We're we're kind of plowing out into new ground here. And the proposal before us is I would emphasize not for the for the you us guys you guys on planning and zoning to say this is a problem but rather to say this concern has been brought to our attention and we would like you to look at it. So uh I think in fairness to to all of you guys we don't need to be convinced of the science. There's just a kind of a threshold level here. And I don't know, have has everybody seen this letter? I don't know if it came out with the packet or Barb, you guys.
It was Yeah, it was in the packet. Yeah.
Oh, it was okay. Okay. So, I was I've been kind of on the road here, so I wasn't clear. All right. So anyway, um yeah, that's the the backstory here is just that that it is by virtue of the opportunity we've had to review this the wastewater suitability study. Um we are taking advantage of that opportunity that we created for ourselves with the change in the in the subdivision rules just a few years ago um to then communicate any concerns that are raised either by ourselves or some some somebody from the public uh to DEQ. So, if there are any questions on it, I'm sure happy to answer those. But, but just wanted you to know that that David, Matt, and I have gone around to get the the wording just right and particularly to emphasize that here's the technical concern. Um, but DEEQ, we're asking you to look at it.
Is that Yeah. Barb, do you have any questions for Burn? No, I think it was well done. Thank you. How much? No, I'm I'm good. Thank you very much, sir. and and I've gone through the letter several times and I'm absolutely fine with it. Um so are you are we looking for um our formal approval of this or uh just the directive to go ahead and send it out? Well, I think those are the same thing. No.
Well, we already talked about asking you to do this at the prior meeting and again I'm just not sure what the formality is here or if there is any. Yeah, I guess I would think now again Matt can or David can correct me, but my my impression would be that if this is going to come out as a statement by planning and zoning, a motion to approve this particular version um with with second and vote would be the most appropriate way to proceed.
Yeah, and Matt's nodding his head. So, let's have a motion to approve this then. I move that we approve the letter from the Albony County Planning and Zoning Commission to the Wastewater Section of the W, excuse me, DEEQ uh involving the subdivision range acres subdivision and the water. Is there a second? A second. Very good. All those in favor say I. I. I. I. I. So that motion carries. Well, very, thank you for your work. I mean, that I thought that's just outstanding. And and Matt and David as well.
Okay. Just to be formal, Mr. Chair, if you're going to ask for I votes, you ought to ask for nay votes if you're not aren't going to do a roll call. Uh, or was it clear to you that everybody voted I? Well, it was clear enough to me. I mean, all four of them said yes. So, okay. We don't have Rob on the line yet. Okay. Just so the record reflects who voted. Okay. Thank you. Um, okay. Well, uh, the next item is executive session, but are we gonna have a presentation first or a training first or what? David, that it's it's during executive session. Okay. So, we need a motion to go in executive session. Yeah. Yeah. I guess
Well, I was going to say I would make the motion, but it ought to include the the reference uh to the statute that I don't have in front of me. So, somebody make that motion. Well, I I'll make the motion. I move that we uh go into executive session pursuant to wiring statute 1-6 1.6-4-405 AIX. Something like that. Yep. Second. Is there a second? Okay, we have several seconds. Very good. Well, let's go. All those in favor say I. I. I. I. So, that motion carries. So, okay.
Little thing you want out there? Uh, we don't have the scratching. The scratch. Oh, that's Kayla's opinion. Yeah, I think so. Unless well I won't stay
