“Yeah, I believe you said that the density bonus law provides an unlimited number of waivers and one concession. And I guess, wouldn't that concession allow for them to have zero commercial? And the other thing is, I'm curious, It seems like they could just reduce the setbacks to zero for the front setback and get more space. Is that allowable? I think Council Member Hardy was correct that certain setbacks are required for fire safety. So the space between the building and the masonry wall needs to allow firefighters to get in there. Is that the only constraint? Otherwise, it could go to zero…”

“So in the timeline, you said that this project was deemed complete a month before the El Camino Real plan was approved. Had, I believe part of the reason is that before the El Camino Real plan, we didn't have objective design standards. Is that why there's no requirement for articulation had this been approved after, would that have forced it to have some articulation of the building facade? I just wanna make sure that, to understand better what is different between this project and maybe some future projects.”

“I guess I'm saying will they get the half credit for that M&E space?”

“Yes, but we give them a half credit if it meets certain requirements.”

“So you're saying it doesn't matter whether that El Camino Real plan.”

“I'm still trying to understand what is the point of objective design standards if they can get all the waivers they want?”

“Yeah, I think you had mentioned that it's viable commercial space, but then you had said that it would be only a community room, and I'm trying to understand what that means. If it's a community room, will it have a restroom? How will it be reserved by members of the public? And then if it's a viable commercial space, will it have grease straps and vents. Yeah.”

“Do you agree on a number of community meetings per month One a month, two a month, three a month?”

“Okay. And will there be, I know you said there's a restroom in there. If it were to be converted to a coffee shop, does it have grease traps or vents?”

“Yeah, I had a question for staff. HLC Commissioner Kathleen Romano mentioned that there were minutes from the HLC designating 820 as a historic property, but apparently it didn't show up in the registry. Can somebody?”

“I learned a lot today. I learned that our hands are really tied here based on these new state laws that have gone in. you know, these automatic waivers, unlimited waivers, the concession, I don't see any room to wiggle here, and so I'll make a motion to overrule the appeal.”

“Yeah, I just wanted to ask, in the commercial space, are we requiring vents and grease traps? I didn't see that in the conditions.”

“There is the video that is available by the next meeting. And since we only do action minutes, any member of the public that wants to know the details of how a decision was made, they pretty much have to go to the next meeting. But I do have a problem in general with minutes being late. You know, this council approves the minutes for the Parks and Rec Committee and for Cultural Committee. Often I read those minutes well after events that they had planned have passed. Sometimes those those minutes are four months. We could do better, but with respect to, you know, council meetings are almost…”

“Thank you, Leslie. I had a similar concern about the perpendicular residential parking because for residential leave, are you talking about just for single family? Because it only said residential. And then on slide six, we're talking about visibility clearance diagram. And of course, these diagrams are way out of scale because it's 12 homes to see whether their fences, how many fences are out of compliance. People always want to put a fence around their property to prevent dogs and kids, all kinds of things. But would that be covered or... I'd like you to really explain what the impacts are.…”

“I understand your answers. So if somebody is building new construction and they want to put a fence all around their property, it doesn't matter whether it's wrought iron or not. If it's more than three foot feet.”

“Thank you Yeah, I still wanted to drill down into the fences Is this driven by state law or by vision zero mandates or where did this rule come from and I It seems to me that wrought iron fences would be adequate as long as they had a certain spacing that allowed a certain opacity, transparency to them. Then I wanted to go to the definition of the secured bike. I think we added a definition of secured bike parking, which protects the entire bike and its components from theft, vandalism, or inclement weather. and includes bike lockers, rooms with key access. If somebody were to put a bike…”

“If I have a bike locker in the parking lot that's exposed to the rain, it's going to rust. And so I would like it to be protected from rain. Here you're saying includes bike lockers. If a developer wanted to put a bike locker in the parking lot, not covered. The bike lockers, they're porous. They're metal, porous metal. They have holes drilled in them. The chain is going to rust. The whole bike's going to rust.”

“Yeah, looking at slide nine, it really wasn't clear to me. Of course, we want to support all of the ADA requirements, but it doesn't seem like the other cities are doing as much as what we're proposing. And I'd like to understand for San Jose, what do they mean by the scope creates a clear nexus? Like if the city were to be redoing sidewalk anyway because of trees Would the city just do the driveway? Automatically that seems to me be we would just add a little bit to the scope to get this done When we're out there doing the other work Again, I think the reason why councilmember Chihal brought…”
