“Hi. Good evening. Hello. I have a question. The pictures that you took and you attached to your brief.”

“Pictures. Photos. Photographs. Yeah, the photograph. So it looks like the deck was built, at least the platform for the deck. Is that right? Yeah.”
Board of Appeals · Sep 23, 2026

“No, no. I absolutely heard what you said before. But my question is, so the general construction and outline of the deck is now in their backyard. Is that correct? Yes. OK. So have you seen that? Because from what I read, they're going to have a relatively open deck. So go with me here for a minute. Are there any shadows that are being cast onto your yard”
Board of Appeals · Sep 23, 2026

“But within the outline of the deck that it is now, there's no shadow on your property?”
Board of Appeals · Sep 23, 2026
- Play at 14:04
“Because the fence, how high does your fence go? Six. Six feet? Yeah. OK. And then from the ground to the, it looks like there's about maybe three feet between the top of the fence and the bottom of the deck?”
Board of Appeals · Sep 23, 2026
- Play at 14:22
“OK, but then there's a setback, right? Because it's three feet.”
Board of Appeals · Sep 23, 2026
- Play at 14:27
“OK, but there's no, all right. No, that's what I wanted to find out. So did the construction stop after you filed the appeal? On the deck? Did the construction on the deck stop? Yes, yes. OK, great. Thank you. I have no more questions.”
Board of Appeals · Sep 23, 2026
- Play at 20:59
“What type of railing is proposed for this deck design?”
Board of Appeals · Sep 23, 2026
- Play at 21:13
“So when you say open, what does that mean? Like a metal thing?”
Board of Appeals · Sep 23, 2026
- Play at 21:42
“Okay. And then in situations like this, if the planning department were to recommend any kind of – modification to entertain the privacy concerns of the neighbors, what might that look like?”
Board of Appeals · Sep 23, 2026
- Play at 22:40
“OK. And then if the neighbors wanted to make their fence higher, do they need a permit for that?”
Board of Appeals · Sep 23, 2026
- Play at 23:30
“And I have one more question. What about hedges?”
Board of Appeals · Sep 23, 2026
- Play at 52:24
“I'm a little disappointed that the parties have had no discussion. So I know what it's like to live in the city. I know what it's like to have neighbors. My neighbors have a laurel hedge that's probably about 10 feet high. And it casts a shadow onto my backyard, which is just the way we bought the house. So I do think that the deck could be bigger. It's relatively small. I am concerned about imposing additional conditions on the deck itself. While I do hear your concerns, and I understand them, and I would have similar concerns if there was a deck near me, but I think that I'm not sure there…”

“I share Commissioner Lopez's sentiments about moving to proceed with the motion as stated.”

Not quoted here: it may name a member of the public. Hear it at the meeting.

“Who, Zhang Yimeng? No, no, the individual who said, no, the person, your program person that suggested that. They're not here, yeah. They're not here.”
Board of Appeals · Sep 16, 2026
- Play at 43:22
“OK. All right. And then I also wanted to understand, so you said two months. Were you actually able to attend, I believe, the June 26 Arts Commission hearing?”
Board of Appeals · Sep 16, 2026
- Play at 43:45
“Hold on one second here. We were given a transcript from June 23rd with summaries of all the discussions. Were you able to attend that one? No. I didn't attend June 23rd. Did you have a chance to review the video of the Arts Commission discussing and deliberating about the case before today?”
Board of Appeals · Sep 16, 2026
- Play at 44:24
“You read the transcript, but you didn't have a chance to watch the video? Correct. OK. And then my final question is, in the artist's code of conduct. And don't get me wrong, I understand we are where we are. But the first paragraph says that a violation of these rules may result in the denial, suspension, or revocation of your license.”
Board of Appeals · Sep 16, 2026
- Play at 44:57
“So where does the theory that intent doesn't matter or must come into play here? It's at the top of page two, the artist's code of conduct.”
Board of Appeals · Sep 16, 2026
- Play at 45:38
“All right. Thank you. Okay. Commissioner Wong? I don't have any more questions.”
Board of Appeals · Sep 16, 2026
- Play at 1:58:53
“I'm inclined to agree with my colleagues that the motion, I'm sorry, the appeal should be granted based on the fact that we continue to have insufficient evidence to support the penalty or suspension of the artist's license. And I also am troubled by the fact that we seem to still have conflicting accounts of the event itself. I understand that it's difficult to ascertain exactly what happened, but we don't have more clarity”

“unequal application of the rules to those individuals. I think that's fundamentally unsound.”
Board of Appeals · Sep 16, 2026

“Okay. I read permanent revocation and then. Sorry, I can't hear you.”
Board of Appeals · Sep 16, 2026

“I think the The Commission's hearing reflected the original recommend. Maybe you can maybe you can tell us. I'm sorry.”
