“So the developer The developer agreement comes to the Planning Commission and then to the Council. Correct.”

“How does... This proposed ordinance addressed transferability of the agreement from one development entity to another, given that developers are often forming different companies as they move things around.”

“Is there an approval process, or is it just automatic?”

“And then revocability. OF THE AGREEMENT AND THE OTHER SIDE OF THAT COIN IS ABILITY OF THE DEVELOPER TO CURE. I DON'T SEE THAT ADDRESSED. AM I MISSING IT?”

“IF I CAN, WHAT I'M THINKING OF IN STATUTORIAL LANGUAGE, WELL, WE WOULDN'T DICTATE WHAT THOSE TERMS ARE, BUT IT SHOULD BE CLEAR THAT THE CITY RESERVES THE RIGHT TO REVOKE WHEN THEY FIND NONCOMPLIANCE WITH THE AGREEMENT AND GIVEN X NUMBER OF DAYS OR REASONABLE AMOUNT OF TIME FOR AFTER NOTICE FOR THE DEVELOPER TO CURE OR THE CITY MOVES FORWARD. BECAUSE THAT WAY YOU'VE GOT BOTH SIDES WORKING WITH ONE ANOTHER. And as a statutory basis, that gives you the ability to do that rather than trying to negotiate the general. And you just say, OK, these are the specifics that we're looking for or not.”

“Yeah, I really do think it's important to include revocability and contrary ability to cure. There are structure of the agreement may fundamentally address a cure or not. So it may be like the Salty's agreement that if they don't apply it just goes away. There wouldn't be that. But that wouldn't fit then. But the ordinance needs to give I think the city, the ability to put that language in there. Otherwise, I think you end up in a situation where the first defense is, well, you didn't have the authority to do that because there is no statutory authority. The lawyer in me says, I really think…”

“You can track a sale, but you can't necessarily track the change of ownership as well. You form a new LLC, and that LLC takes it over. So I don't think it's easily done. I think if it's going to transfer, you come to the council or the planning commission and you make your presentation, we would like to transfer this. This is the new group that's taking it over. And, you know, we've got somebody reputable and something's going on that just gives us a check that the agreement that we've entered into will be honored.”

“Well, because they came back to, I'm sorry. I'm just, yeah.”

“I recognize this is my second time. And I just, I do want to say, this has been a lot of work and it's really pretty well done. I'm trying to add a couple of tweaks that caught my eye, just given my background and done this, that I think will put the city in an advantageous position. I think it will make us more developer friendly because there are clear standards and they know what they're getting into. Let's sit down and figure it out. They don't know what they're getting into and developers would prefer to do that, but I do think that we need to make sure the city is fully protected. And…”

“I really don't have a lot to report for city business, but I have enjoyed a great summer so far, a lot of good community events. The night market has been just an outstanding success. I'VE ENJOYED THE CONCERTS THAT I'VE BEEN TO. I HAVEN'T BEEN ABLE TO GET TO THE MALL. AND REALLY, IT DOES FEEL MUCH MORE LIKE A COMMUNITY COMING TOGETHER OVER THE COURSE OF THIS SUMMER, AND I REALLY THINK THAT'S A GREAT THING.”

“Yeah. Thank you for a nice presentation. Really appreciate knowing everything that's out there. You just used a couple of acronyms that I think would help people. Oh, I apologize. My son's a firefighter, so I know what ALS is versus BLS. Yes. Would you mind explaining?”

“Yes, I pulled this because I need to recuse myself on this motion. As many people know, my wife is heavily involved, one of the four members of the LLC that is putting on the parade. I THINK THERE'S AN APPEARANCE OF CONFLICT OF INTEREST THERE BECAUSE WE'RE PASSING MONEY TO THAT ORGANIZATION OR THAT'S WHAT THE VOTE IS ABOUT AND I THINK THAT WOULD BE INAPPROPRIATE FOR ME TO DO THAT AND I HOPE THAT EVERYBODY ELSE IN THE COUNCIL AGREES.”

“CAN YOU JUST KIND OF PUT A LITTLE MORE MEAT ON THE BONES OF WHAT YOU SEE THE ROLE OF THE THREE MEMBERS OF THIS COMMITTEE ACTUALLY DOING?”

“Just kind of to follow up, you talked about it very outward facing. What about the feedback that those members get? How do they bring that back into the budget process and are they working closely with the finance director? Do they bring it back to the council first? That's what I'm trying to understand is we're reaching out, we're getting more information, what do we do with that information? How are these three individuals”

“Several years ago, federal councils ago, we had an ad hoc budget committee that actually worked with the finance director and shaped the budget a lot. This is a very different process and that's what I'm trying to make sure that is clear that there are”

“You know, we... We often hear people want more public engagement. We want, you know, and I think it would be good, it's good for the council to get out and have some people that can really talk about the budget. You know, I don't, we are going into the next biennium of budget. As you say, it's the big budget, and I think that's an important piece. So there may be a little bit of figuring out exactly how we're going to do it, BUT IT'S NOT GOING TO AFFECT THE PROCESS OF PUTTING TOGETHER THE BUDGET. IT'S THE PROCESS OF ENGAGING THE PUBLIC ON IT AND MAKING SURE THE PUBLIC UNDERSTANDS IT AND…”

“Yeah, you could. Yeah. I mean, it's done an enormous amount of work, and I very much appreciate it. Obviously, Seattle Metroplex is a terminology that the airport uses, and it's important to use their terminology. So you're responding right to it. I don't see that as... But I think that the overall work is excellent and needs to be put forth out there. So I would support the council's approval of the airport committee letter.”

“Yeah, and I kind of want to get back to the members of the Airport Committee were appointed because of their expertise, their knowledge of the process. their willingness to dig in and do that. I'm going to presume you got it right. And I think that I'm sure you'll go through the letter with a fine tooth comb at this point. But I think this is well worth supporting. It is the point of the airport committee to get that information out there. And we picked people to be on that committee with that in mind. This is the document that they put together. We need to honor their work.”
