“THANK YOU, MR. CHAIR. MY QUESTIONS ARE VERY HIGH LEVEL. I THINK I BROUGHT THIS UP LAST TIME. Kind of 3 questions all similar, but the 1st, 1 is. I'm sure there's some history to this, but I still am having a hard time understanding why. A lot of the detailed, like, you know, the registration booking details. Process enforcement, why that's all in. The zoning were proposed to be in a zoning ordinance. Um. You know, so much of this is, I'm going to call it. runs with the applicant, whereas zoning really should be running with the land. And I get a little nervous. I don't want Airbnb to try to…”

“Yeah, but I'm still confused. Are there any other municipalities? All the ones I've looked at so far, the registration, what's the best word? All the condo requirements, all of that, that's not in zoning, right? Those aren't a separate general ordinance that doesn't have to you know for example if um if um peter or isd wants to change something in two months do they have to go through us again whereas if it's not if it's not in the zoning they can go to city council directly and make those changes and not have to go through this whole process and so i was just curious”

“Thank you. I was just going to say, you know, I understand at some point maybe the thought was like having a cap would help us or help people who want to rent short-term not to and to rent long-term and open up the number of units that are available to people. And it sounds like if there's only 500, not only, but if there's 500 and not like, you know, 3000 units or more than that, that are unlisted, but out there, that property is a lesser concern than everyone expected to be. So I'm in agreement with that. PB, Lupita D Montoya, rest of the board that I you know 90 days or even if it's like a…”

“Oh, okay. Thank you, Mr. Chair. I have two questions to traffic-related because, you know, we are here trying to make sure everything is safe to grant the special permit. So my first question is probably more towards the staff of DOT. I noticed that the traffic impact study pointed out there were, I think, multiple pedestrian exceedances. Um, I think it was new street and Bay state road. So I was just wondering, I apologize if I missed this, but I. Was just wondering if the staff had any recommendation as to how to mitigate those, you know, more more towards the pedestrian safety because I…”

“My first part was more, and thank you for that. My first part was more towards if DOT, if staff can talk about what, you know, what are some thoughts about mitigation methods for the pedestrian exceedances? I'm assuming the project team does not want to offer that. So throw it to the staff. Thank you.”

“Thank you. My notes are a little scattered, but thank you so much for the presentation. I really appreciate the proponent trying to play with depth to make the project look a little less massive or take up as much space. So really appreciate that. Like seeing those details. There still are I would say maybe it's on Birch Street. There's certain angles where it is still a very, very big and long building. And I wish, I might be in the minority, but I wish there was a way to, maybe it's different colors for different wings of the building, but to break it up a bit, because especially when we…”

“Thank you. And I think to that point, I was going to say my understanding is that, you know, if there are major changes to the plans that, you know, the building department technically should not sign off on it if they're too different from what we approve. So I don't know if that's of any assurance, but, you know, if they suddenly decrease the route by a significant amount, it would be flagged.”

“don't have particular strong feelings, but I was just going to say, one thing I noticed is the floor plans we saw, which is different than a lot of the residential floor plans we've seen recently, don't have, don't show where the windows are going to be. And I think that would actually be helpful and maybe appease Carolyn's concerns about like fire and just like all of that. So I think that'd be helpful.”

“Thank you, Mr. Chair. I just wanted a little bit of clarification. I believe in the staff memo there was, I think I alluded to maybe there was another similar proposal in the works. Did I read that correctly? And if so, What's the status of that? Is it meant to be parallel run or separate process or whatnot? Thank you.”

“Thank you. And I was just going to add, you know, when the proposal first came up, I don't remember, was it last year, two years ago, I was concerned that there was going to be a segment of project sizes that are, you know, between the sizes that we would review and versus what would not be reviewed. But I think it's been reassuring to know that You know, the projects are like halfway in between. They still go through staff review and, you know, once in a while I do walk around the neighborhood and then these projects are by pre this project. But, you know, there are projects I see I don't…”

“Thank you, Mr. Chair. I third the mural. And also my comments are more towards the dentist office. I do think it's a good use, good way to activate the space. But, you know, in order to really activate a space and a frontage, having an opaque space you know, glazing is not the best. I just wanted to throw out a suggestion. I recently did see a dental office I really liked. What they did there was They used a mix of, it was an older building, so they had a mix of glazed windows. But on the front, they had planters and shrubs, which did a lot of the covering without making it look like just one…”

“Thank you, Madam Chair. I have a few just clarifying questions. The first one is there's some of the documents mentioned a comprehensive permit or seeking one. I just want to confirm the proponent is not seeking one because, first of all, we can't grant one, but also that would require ZBA approval. And the second question is, SO JUST FOR CLARIFICATIONS, IT SOUNDS LIKE THE MODIFIED BUILDING PERMIT WAS NEVER ISSUED, IS THAT RIGHT? SO THAT'S WHY OR ISSUED IN TIME BEFORE.”

“Yeah, there's some building material, or excuse me, there's some materials, even the presentation tonight, references a club rehab stuff permit. I just want to confirm you guys are not thinking one, because that's 40B, okay, BZ, okay. Understood, okay. The second question is, I just want to confirm, it sounds like the building permit, or the building permit was never issued in time. Is that, okay.”

“Got it. And then this is kind of a side issue, but I was just curious. Does I don't know if the staff or the promoter knows there is on the plans. There's a little parcel sliver of land next to the highway. I was just curious who owns that right now. It's grass. And then the fourth question is, so just for clarification, I know there's a butters who talked about a little head court, but right now that's 10 feet. It might help reading the plans. It looks like the core will be, or the driveway will be expanded to 25 feet. Is that right? And so is that going to be shared? Is that going to be…”

“And how I'm reading the plans, I'm sorry, this is Ashley again, but it seems like it will be expanded by another 15 feet, is that right?”

“Overall, I think it's, I actually love the look of the building. I know it's a unique site. It's on a corridor. And as, you know, pointed out earlier, there is a buffer space between Um, the building and the site between and the highway that's, I guess, owned by the state. So that helps in not needing the full setback that is required on the cam 6. so. I'm personally fine with the relief that the applicant is seeking. I love the balconies. I love the different colors on the side of the wall that has fewer windows. So overall, I'm in support. Thank you.”

“Thank you. First of all, thank you for the presentation. I'm very encouraged to hear that the housing trust does, you know, look at our reports and take that into consideration. So that's great to hear. I had a quick question. So as you pointed out, there are, you know, few and far between. in between ownership or home ownership opportunities. And so I was just wondering, is that something that developers bring up when they apply with the housing trust? Is that something that like is a condition or I don't know.”

“ASHLEY. THANK YOU. SORRY. Similar to Mary Lineker's second point, I was just wondering if the housing staff had any feedback from the developers that come more frequently. I know when we first started this process, it was a little more frequent where we'd see proposals and it was already set, not set in stone, but it was 70% there and there was not much we could change. So I was just wondering... HAVE YOU RECEIVED ANY FEEDBACK FROM DEVELOPERS ON HOW THIS PROCESS IS GOING FOR THEM AND DO THEY HAVE ANY RECOMMENDATIONS?”
