That was a hold. There's a planning board meeting that night, so that's why we did Sunday. We do not have a meeting on that day.

Okay, I'm going to call the Town of Rochester Town Board October workshop meeting to order. If you could all stand for the Pledge of Allegiance.

Supervisor Nowlin. I am here. So tonight we have on our agenda a public hearing for Local Laws B. So that's where we'll start the meeting. That is a local law that is amending the zoning code Kennel chapter. We've had this public hearing open at a few meetings. So I'm gonna go ahead and open the public hearing for Local Law Z of 2026. Is anyone here to speak on the local law amending the kennel regulations tonight? Yes.

Is there anyone else that would like to speak on local law? I will entertain a motion to close the public hearing.

Any second? Any discussion? All in favor? Aye. Opposed? Abstained? Motion carries. So I had accidentally put this service recognition at the top of the agenda. That is actually going to be at our next meeting. I had both agendas open at once. And so we do the acceptance of the agenda. So I'll make a motion that the town board accepts the agenda as prepared by the town supervisor with the following amendments that we will be moving the acceptance of the abstract till the end of the meeting so the board can audit the bills. And I'm requesting that you consider authorizing me to submit a grant ap

Any discussion? All in favor? Aye. Opposed? Abstained? Motion carries. So first, we have two departments are here with us tonight to discuss budget. First up, we have the building department code enforcement, and we're joined by our code enforcement officer, Keith Rusa. Thank you for joining us. Does everyone have your budgets? So for the board in front of you, I did like a little, little, I did a cost analysis to analyze permit fees. And that's what you have in front of you. The spreadsheet for that is also in the backup folder for the board. So you can see the... the formulas I used in those

That's already factored into the straight costs. So I just wanted to share that. So I did indicate with the department, we had some ideas for how some of the fees should be restructured in terms of knowing that those fees aren't currently covering the work that goes into them. So I'm going to work on those numbers a little bit and have a working draft on Sunday when we look at it. But I'm not going to raise the revenue from the department revenue for those permits more than 10% in our budget projections.

Well, I did the 2026 because the department is operating very differently from how it did in 2025. Current last year, the department mostly just process.

Well, it's not right now because we had to catch up on fire safety inspection. So there's been a spike actually Um, so then we just wanted to look at expenditures and we're going to be looking at the detail which is on each Fifty-five. Okay, so I already found something right off the bat. So equipment should be $3,000. I believe. Hold on. Let me pull up the Department of Office.

Oh, I turned yours to where we're at. It's that. Yeah, it's that one. Okay. HAB-Masyn Moyer- Okay, so the department request was. HAB-Masyn Moyer- For 300 can you keep talking to a minimum in the audience, please I can't if you need to just if you need to talk, you can go outside. HAB-Masyn Moyer- and HAB-Masyn Moyer- The department request was for 300 on that one, as long as we expand what we have budgeted for this year. anything that we, if we're not going to extend the 3000 that we have this year, we will move that forward so that we get what we need because we still have to get the radios

Was there anything else that, so the 300 is supposed to cover, it looks like a small desk.

And has anything else come up since you guys submitted the?

um so then we go into we're at the 8664.4 these are contractual services um so we put in some of this the department didn't request that i put in um so we because we um had discussed the uniforms and it wasn't HAB-Masyn Moyer- wasn't in here, so I wanted to make sure that we had that because we have staff that won't have anything. HAB-Masyn Moyer- So we have 600 for uniforms. HAB-Masyn Moyer- office supplies. HAB-Masyn Moyer- 750 it looks like we're going to be more than that this year, but I when I spoke with the department, they felt like they'd be able to keep the office supply. purchases t

So the professional services that we that is for structural engineering consultants for the building department. The building department can charge escrow for applications, but if they need the opinion of a structural engineer for a violation or for a fire safety inspection, that is not something we can charge escrow for. It has to come out of the department budget. And that has come up a few times with some of the more complicated structures and businesses to really do a thorough inspection on those. Do you feel like 4,000 is enough?

That also includes the... process server.

Software, that's our contractual software costs for GovWell. So that's what it'll cost. Actually, that 600, I think, should just be deleted. Because I think I had added uniforms in, and that's not. So that 600 is going to turn to a zero. Education conference, we budgeted 1,000, hoping that we'll have another attendee at the conference. Correct. And then a little for any other sort of online courses and mileage.

So this is when the code enforcement vehicles were both out of commission.

It's in Central Garage. Postage fees, this is to, as it has gone up significantly, the reason being is that the department is utilizing certified mail, which it had not been in the past.

Yeah, and with the return receipt, it's over $7 per letter.

And we do think, so what you see in the budget so far year to date is as of May, that's the postage as of May, because the postage billing is two months. No, September, August, it's July. Our postage is two months behind in the budget. And this budget only goes to the end of this document only goes to the end of September. So that's it for those expenditures. I did want to just ask, Keith, for you to maybe give an overview of how the department is going. Right now, I budgeted for staffing of basically four full-time positions. We are about to launch GovWell, so we'll have a little bit of time

In terms of the staffing levels, how do you feel the four full-time positions works for?

And in the analysis sheet, we roughly estimated, so the number of violations is on this handout and it's also in the spreadsheet that I shared with the board. And I show the weekly hours and then the percentage on permits. So the remaining percentage there would be what's going to violations. And in the case of the zoning coordinator, that time is for FOIL responses. And then the remainder of the time for the clerk is actually the time it takes to send everything that's being done to the assessor. So I think we have an opportunity to create an efficiency there, but that currently, that's what

Yes. So yes. It varies. Like there are some weeks where it's like 25%. And then if there's not a foil, of course, then so we kind of did a middle ground there.

Did you have anything else you want to share with us, Kink?

And I currently think I have budgeted for if another tablet, if so, if you guys were interested in that for, I know there'll be more field work. And I wanted to show that tonight we're approving releasing the mini bids for the vehicles. Oh, really? So that process takes about two weeks. It's the New York state contract. Great. So I put in for a small to midsize SUV.

The Code Enforcement Office has been dealing all summer. They dealt with like no air conditioning. And thank you for dealing with that.

Okay. So I'd like to invite up our planning board. lisa smith, that's on page 54. lisa smith, So many notes.

lisa smith, Will you walk us through this? lisa smith, I'm sorry. lisa smith, Will you walk us through this?

Did you factor in the planning board attorney?

How much administrative review time, not anything, nothing that's getting reimbursed by escrow, but how much time is going into the law line?

But that the day of church time was being covered by, so the applicant might end up just paying the same amount in the end.

I guess I was thinking the cost of the applicant might not actually go up that much in the model that you're suggesting for lot lines specifically, because they were paying 100 dollars plus 150. So, what we would do if it works out, it's going to be distributed more towards staff.

So how would you say that doing it that way would save administrative costs of managing the escrow expenditure with the public hearings?

Well, what I wanted to say is that the analysis of the expenditures compared to the cost was not meant to say that the planning board should be revenue generating because planning what the role that you play is a public service. So what you, a lot of what you do is for the public good. It is tied to the town comprehensive plan. So what you are doing is in service of the entire community. So when something is in service of the entire community, that is when it is funded by the general fund. But the parts of the application that are for the benefit of the applicant, which is the administrative c

And we had bumped up the budget for the town planner, but we're not even coming close to using that. And we've been using him for other things. So not every bill is for things that the planning board has requested. So I have been moving money out of that for this year. And I guess I just wanted to check in and see what you thought of what I put in.

Yeah, and we're on pace, even with generous projections, for that to be $12,000. So I put in 22 for the 2027 budget.

yeah and i think what i've projected gives us the ability to do some of the uh work with him on those areas of code that he's identified are creating bottlenecks for applicants and for the board and we would really like to smooth out a lot of those processes and make it easier for everyone

PB, Lupita D Montoya, Do you have any questions or comments for the board. We don't get to see you guys.

Thank you. Thank you. I know you worked really hard for the planning board. Thank you all. We'll return to the budget in a little bit. Right now we are at the public comment portion of our meeting. So we reserve time at each meeting, each regularly scheduled meeting for the public to address the board. The ground rules for this is that you address the board and not other members of the audience. There's no back and forth or debate or conversation. The board also does not respond to questions or comments made during this session. So if you are asking us questions and we're just looking at you,

Yes. Okay. Hold on just a second. I'm going to reset my timer for you so that it doesn't go off. All right, go ahead.

Is there anyone else who would like to address the board tonight?

Anyone else? With that, I will close the public comment portion of the meeting. So now we have time, board member time. Do any, thank you again. Thank you. Board members have anything you would like to?

And we did submit that request to the county.

Just that we've taken the issue up and I will be tracking the progress. It is true that it takes a long time. It's not something that they take action on.

Okay. Do you want me to put my timer on for you? No, I don't.

You can, you can shut me down at any point, but I just, I want to say that I'm, I'm really disappointed by the lengths people are going to in order to mislead members of our community. And I want to be clear about something that came up at our last meeting, this board, takes transparency seriously. We take communication seriously. We take making ourselves accessible to the public and accountable seriously. And personally, I welcome criticism. I've said that repeatedly in meetings. I was saying that at the last meeting when I was interrupted. But for me, there's a difference between legitimate

Anything else? So we will move on to the discussion portion of our meeting. I also wanted to remind Jerry and the board that As of November 5th, there will be a spot on the agenda for Jerry to report to us so that he doesn't have to try to fit everything into that. So you'll have your own spot on the agenda. I just want to remind you that so that you can share any updates that you need to. Okay. I can still give you a time limit.

So we do have to audit the bills, but we haven't had a chance and we have a few agenda resolutions on the agenda, but I do think that we should spend some time going through the budget because we haven't. On Sunday, we have scheduled a special workshop meeting to work through the budget and get to the version that will be the preliminary budget. We will be scheduling the public hearing on the budget Sunday. On Sunday, I would like us to spend the first portion of our time talking about the wage schedule. Because the board had expressed some ambitious plans for what we wanted to do with the wag

I feel like revenue should be Sunday also because a lot of any number that's not a department number is something that I put in and I will be potentially adjusting those department revenue numbers based on the building department and the planning board. So, okay. We start on page 36. And this is kind of your time, because I'm the one that put this together. So the first thing we have is town board salaries. I put in a 2% increase for the majority of the elected officials. We did a decrease of the highway superintendent. So that's what that, the tentative budget number is 2%. Thanks.

So once we, for the preliminary budget, you can't raise elected official salaries once we've sketched the publication. We are supposed to get computers for you guys this year. You don't want one. If we don't, we need to encumber that or just decide that we're not getting computers.

I'm just saying in 2026 we budgeted $4,000 for computers for That would be the property of the town, but used by town board members.

I mean, we can, if we can, you had not wanted to get them through RIT. You wanted to just purchase.

Okay. Public notices. That is just... Yeah. And then... You guys haven't done any education or conference, so I don't have anything in that.

yeah let me see if they are holding that they hold it every other year.

Okay, so that is a very worthwhile training and it's January 13th through 14th in East Syracuse. I wonder if they have that virtual. So it'd be $275 for a member.

Yeah. So for that specific one is really the best one. They have hotel rooms for $122 a night. I mean, it would be if it's just one person. I'm just going to do that. So $700. It doesn't have to be used for that, but I just think that's... Yeah. And then postage, most postage comes from my office about... Okay. So, I think what we subtracted in the salaries we added in the conference. So for the court, we're going to talk about salaries, wages on Sunday.

So the justices had requested, I had put in 2%. They requested four. It's the board's decision.

Oh, I'm sorry. I thought we could talk about elected official because that's not part of my wage schedule. So the clerks and the officers, we won't talk about. But in terms of the elected official salary.

HAB-Masyn Moyer- And I did there were some things said about salary increases at that department meeting that were not accurate so last year, the justices received a 7.3% increase they said two or three, but that was not the case.

So right now we have the equipment budget is for the J-CALP project.

They. I don't think they've put in for any other.

I don't think they requested any other equipment.

So they had Okay. The only, they had said 6,900 for prosecutors, I put in seven. For the conference, they had said, they put in for 2,456, they get the quote, that's like, they get the quote for what the conference is. So I'm going to put that in because I was only, I didn't receive requests from them. So I just put in my own estimates in the budget. So I'm going to make that change. They requested $1,100 for postage. I can go back and do my analysis. Based on the projections, I didn't think we were going to hit 1,000. So that's why I left it. And then the other request they had was for unifor

Correct. Yeah. Do you want me to add that in?

I do think that I can reduce the supplies, materials, office supply probably by something similar because they don't come anywhere Close. I'm not sure why that one year there in 2024, I'm not sure why their office supply line was so high. But I'm just going to drop that office supply line down to 300. Is the board okay with that?

Okay. Anything else in court? So I am totally, so the next line is my office. I am totally fine with a 2% increase.

Okay. So it happens. Over the 2020 budget. Did I do that wrong?

Oh, I just took the change off. Six, five.

It has to be divisible by 52. So that's why I did the 1260 times 52 is 65520.

Because of the paycheck. Because otherwise you have to, like one time I forgot and we had to make the first paycheck for everyone different. Anyway, it's just, it's easier administratively.

My staff requested, oh my gosh, what did they request? This is how neglected my department is. They put in a request for a couple of things. One was a new, I think there's a new keyboard, a new monitor, This was, I just added up the things that they had requested. I have $1,800, a little less than that for, I'm supposed to get, this computer is very old and difficult. So we had budgeted that. The quote I got back with the install from Phish is $2,100. So I'll be requesting a budget mod from my own department budget. to do that purchase, but so I'll have that take care. You guys okay with that

Yeah, I started looking into it. There's some specific guidance. This is my evening reading. There's some specific guidance in here about it that I was reading about.

Yeah. We get like a slight discount. Yeah, we get like two cents off. Okay.

The tax collector's salary, I think I put in the request, but I made it divisible by 52, so it's slightly different than what's there, but just it's a lot.

We went through this with Kate already. So any thoughts on anything for the tax collector? It's all very minimal costs of. Let's see. I did do a. What did I do there for the budget officer? Is that 2%? Is that what you're doing? I can do it. I skipped.

The we increase the postage to try to account for it. For the budget office, yeah. And that's divisible by 15.

Dolly, I don't know. It's like $12,000. I mean, our accountant charges like $400 an hour basically. So they just review my work. I like give them... For the annual. They don't actually do anything.

But they're not actually doing anything. They're just reviewing.

We could hire the town supervisor can appoint anyone they want to be the budget officer. So, you know, that's it's the either the town supervisors, the budget officer, or they get to make that appointment. I do think the board should consider folding a lot of the salaries in. So I think that's just something the board should consider.

Well, I think it's more like a bookkeeper type role, except for the prep of the budget. Well, preparing the budget, but also the overseer of the budget is more akin to... A bookkeeper. Okay.

I like my job. Software, that is QuickBooks. I have a hate relationship with QuickBooks, but it's really the best for the money. Everything else is 10 times that. um okay so assessor so we're on page 39 um 1355 which is the assessor code um the one I don't know what the board, so the, if you recall, the biggest, we don't have the reval in there, which is nice. The software change is for the CoStar, which is the commercial software. The quote for that came in slightly under, so I believe it's like,

Anything that you guys want to change there.

So the deputy assessor was we amended it partial part way through. the year. So it's not those, it's not accurate.

It would be in the wage scale. I'd be able to tell from the wage scale. Or I could just...

The assessor aid is in line with the, that one's definitely 3%. Okay.

So we'll look at that too. I have that highlighted on the way. Anything that moved tiers, I highlighted on them.

And then for the assessor aid, that's at a 35 hours per week, whereas the other two positions are 40.

Okay. So move on to town clerk. I'm fine with the town clerk salary. I think that's like a 4.5% increase. It just made it up.

Okay. Totally fine with that. We're good with that. We'll leave that. Yeah. I know it's awkward, but page 40 of the equipment budget. I know we have a note that I'm going to increase that.

Yes. Okay. So what you see is on the yellow is department requests. And for all hourly employees, I ended up putting everyone at a 3%. I believe what this represents is a 4%, what Kate put in. So you can kind of see the difference between those two. And that's what we're going to look at on how we want to, how we want to, Do the overall increase the year over year increase and any changes.

So maybe we're a multi hearted beast. The equipment line, I have a note in June.

It's going to be 22. Thank you. Oh. Yeah. For the equipment line. Because it's a laptop. Yeah. Office supplies. We're just keeping that high.

Yeah. And there's going to be increased staff in the department, too. Never mind. Okay. The bank reconciliation. Is that... What's the story behind that?

And they're just review. It is actually I'm going to start having you guys review are the bank reconciliations for general fund next year.

So we'll go for 15 more minutes and then we'll switch to resolutions and then we'll have an executive session, audit of the bills. Okay. Software, that's everything.

The new license. The additional license for DocuBart.

Oh, okay. Thank you. Mileage. You haven't put in for anything. I know.

We can certainly look at that. I wouldn't mind having. OK. Education. So we have mileage, but yeah. We should, that would be in the, or it would be in buildings because that's where Harry.

Yeah, we should definitely, it's not always going to be available. You know, I think we will have like a booking calendar. Right. And it might work out because they'll give code enforcements using it and they're done at three. And I don't know if that gives her enough time. I don't know. Right. But it's only two days a week. Or more. We could do more. And postage. Most of your postage is tax collector. Anything from the board?

Oh, this needs to be fixed. I know what that is. That needs to be fixed. I'm going to have to update the annual financial report. I think that got double. I might have caught it for the annual financial report and didn't update QuickBooks. I'll look at that. There was a bookkeeping error with the leadership transition that I caught when I was doing the annual financial report. And I think I fixed it on that, but the QuickBooks needs to be updated. So the way the postage works is that we get billed. Postage is something you can pay in advance. and advance claim. The town pays for the postage me

I'll talk to Mary Lou, you and I should have a conversation about next year's projections and I'll also talk to the attorney that's representing us for the tax certiorari because a lot of those are going to end up in 2027 as well. And we are going to have to do. She is going to want to do a third party appraisal for one of the parcels that's going to end up on 2027 so that's also a consideration. So i'll do that follow up. and maybe we should bump the numbers up just for the preliminary budget if you guys feel that under it's a if you look though i did do a um 30 000 increase over what we budg

HAB-Charlotte Pittsburg- They were projecting. HAB-Charlotte Pittsburg- 22. But I think it should stay at 30.

It's that other. It's the it's the court stuff. And who knows what we will be facing next year.

Yeah. And whether it will be covered by insurance. And insurance only covers us to $10,000 for most. So what are we saying we're putting it up? We can bump up that last one a little, if you'd like, if you think I undershot it.

So this next one we have been having, professional services for HR. And I was going to talk to that person because I think it might be the end of that. Yeah. And right now, a lot of our personnel services is in the attorney line because I'm consulting with counsel rather than an HR consultant.

Yep. It's $200 a month and I can call them up anytime.

But there are certain things like he is working with us on the collective bargaining agreement, which is now, and then it's not for another three years. And we can always, like, we can always work with him in three years on that as a, you know, we don't have to have the retainer for that.

It's possible. There are things that the attorney has caught that we should change. That is the thing that I'm specifically thinking of.

He would charge us for that type of work.

What I'm saying is possible that he might not be available in that way also.

I will start. Because what you're talking about is like drafting policy that has been.

So the current HR person helped is the one that was that drafted the initial policy manual. Um, what I'm, what I'm kind of saying, I'm starring that because I zeroed it out, but it might be worth if for this specific thing, seeing what resources exist, because it might not be that particular person, but we might want someone to assist.

Um, We also have, I haven't taken advantage of it, but through our insurance company, we have free access to a more robust HR portal that does this type of thing where you get templates of policies and things like that so um but non-professional services just no just like the yeah just here's the law the law change this is what you need to update it's like that sort of thing oh no they track the law yeah they'll tell you whether it happened or not yeah so um i just i'm starting that and i'll try to have that figured out by sunday um all right uh the last thing is records management i think we

We should have stuck with a lot of things. Those roads also lasted a really long time. They're still there. So just, oh, we'll have to wait. Oh, sorry.

Yes, we're taking a brief minute break before we do resolutions. Now we're in a bit. You can do it now.

Okay, so just quickly, we have a workshop meeting on Sunday at 1 p.m. Then our next meeting is not until November 5th, and that will be our business meeting, but we will also have the public hearing on the budget and the public hearing on the tax cap override as long as you guys schedule that tonight.

Yes, and an appointment. So we should have the book at the fifth. Okay, so for resolutions. I'll make a motion that the town board authorizes the town supervisor to form an inter-fund loan from general fund unrestricted fund balance to capital fund in the amount of $100,000 for the purposes of covering cash flow needs for the three Bridge New York funded capital projects. Second. Any discussion? All in favor? Aye. Opposed? Abstain? Motion carries. We should have the ban within the next three weeks.

The ban, you mean? Yeah, it's really quick. Once they do the sale, once they do the bid and we select, it's like, it's within. It's done. Yeah. So we're tabling the abstract 10B, there will be a change to what I have on the agenda of $88. Okay, so we're going to do an amendment to the wage schedule. I'll entertain a motion to amend the 2026 adopted wage schedule as follows by moving the position of deputy clerk one to tier six. at the rate of 29.75 per hour, moving deputy clerk three to tier four at the rate of 26.50 per hour.

Thank you. Any discussion? All in favor? Aye. Opposed? Abstain? Motion carries. So the next resolution, I'll make a motion that the town board establishes the hours of the town clerk deputies as follows. Deputy clerk one, 40 hours per week. Deputy clerk two, 40 hours per week. Deputy clerk three, 40 hours per week. And I'm gonna add at the rates um, established in the wage schedule. Second. Any discussion? All in favor? Aye. Opposed? Abstain? Motion carries. Would you like to announce those appointments? These will be effective November 1st, 2026.

And because we... Because of the re numbering of the clerks, we're going to assign the secretarial duties of the highway department to the deputy clerk three. So I'll make a motion that the town board assigns additional duties to the deputy clerk three position. the secretarial duties associated with the Town Highway Department with a weekly stipend of $61. Second. Any discussion? All in favor? Aye. Opposed? Abstained? Motion carries. So this next one, the Toshiba contract is up for renewal. the board asked me to get quotes. I was going to just see if you guys want to table this until Sunday,

Yeah. All right. Got it. We're going to do them all together then. Okay. So I'm just going to give a little context. We now have four vehicles that we're trying to purchase that are not heavy vehicles. So these are all class one through eight. New York state has a contract with it's basically a like a purchase contract that goes across many, many, many dealers for every kind of make and model of new vehicle. They call it a mini bid because there's rules associated with it where you make a spec sheet, you put it out, they give you a list of all the dealers, you send it to them. There are rules

Well, yeah. So one, um, so the truck for buildings and grounds, which is in need of being replaced, like desperately. Um, and then one, the two others I'm doing mini bids for, um, hybrids, um, One would be a small to midsize SUV hybrid that would be for the code enforcement. And the other is for a hatchback sedan, small sedan type for a general town use that could be shared among departments. And I'm requesting financing from the dealers If we do it like that and we are paying monthly payments, we can keep it. It's not considered a capital expense. We can keep it in the vehicle budget accordin

So I'll make the motion that the town board authorizes the town supervisor to solicit bids on the New York state vehicle purchase portal for four vehicles as presented to the town board in form A of the mini bid process, which is incorporated into this resolution, a replacement truck for buildings and grounds, a vehicle for code enforcement office, a multi-use town vehicle, and a truck to replace the recently totaled highway truck, which will be paid for in part by insurance recovery funds. Any discussion? All in favor? Aye. Opposed? Abstain? Motion carries.

I think it's standard at, what is it? 12 years? I can't remember. There's like a standard use of life, right? I don't have the chart. I have a chart. I don't have it in front of me. Okay. We can lease vehicles, but I just feel like that's for the type of form.

Right. I think it's either. I can't. It's more than five. Certainly more than five. So in front of you, I have the law to override the tax cap. What is in front of the board. There is one change from Mary Lou. That is one word. Section three to delete the word as Um,

Sorry, should we amend that to say local law F? Yes.

Okay, i'm all in favor aye opposed abstain motion carries, so I have a brief executive session that oh oh.
