Vacation and standing for the Pledge of Allegiance, please.
Heavenly Father, please guide our words and our actions tonight. Help us lead with integrity, compassion, humility, and open hearts. Remind us that we are here to serve our community, not ourselves, and help us always make decisions with that responsibility in mind. Amen.
Thank you I'd like to call to order City Council meeting regular session number 15. Can I please have roll call?
I need a motion and a second. Great, thank you. Motion has been made by Mayor Tim Funk and a second by Council Member Atkins. Any questions? If not, please cast your vote.
Before... Let's see, one second. Make sure all the votes are in.
I had a question before we adopted the agenda.
Okay, I wanted to ask if we could pull an item from the consent agenda, the item C, the appointments. I'd like to have some further discussion on those.
We're going to amend the agenda and remove item C for further discussion. That being said, any other further questions? Mayor Paton, Funk.
Mayor, I'd like to amend the consent agenda as well.
Right now we're on approval of the agenda. Okay, any other questions or discussions? If not, please cast your vote. On the agenda as amended, yes.
Aye. Okay. Do you want to discuss it, ask your question now? regarding item C?
I guess what order do you want to do these in? Do you want to vote on the rest of the consent agenda and then discuss that later?
Let's get through the consent and yeah, we'll come back to that. That's fine. All right. Then that takes us to the approval of the consent agenda. Can I have a motion to approve? MOTIONS BEEN MADE BY COUNCILMEMBER CARLISLE, SECOND BY COUNCILMEMBER NEED A SECOND. ARTH. COMPUTERS ACTING WEIRD. MAYOR PRETEND FUNK.
MAYOR, I'D LIKE TO ADMIT THE CONSENT AGENDA TO ADD SOME COMMITTEE ASSIGNMENTS. THOSE ASSIGNMENTS ARE THE RESIGNATION OF COUNCILMEMBER CRAVENS FROM THE RULES COMMITTEE AND APPOINTING COUNCILMEMBER ARTH. The resignation of myself from the Public Works Committee and appointing Council Member Arth and the resignation of Council Member Shields as the alternate of the Public Works Committee and adding myself as the alternate.
Okay. Any questions, comments? If not, can we roll call or voice vote for the amendment?
Aye. Okay. So, the agenda is amended. And we'll go ahead and come back to you, your question. Discussing the item C of the approval.
Have we voted on the consent agenda yet?
Oh, that was a voice vote. So now with the amended.
Motion has been made by Mayor Tim Funk, second by Council Member Craven. Any further discussion? If not, please cast your vote.
Yes. Consent agenda is approved, 9-0. Please record the vote. Thank you.
Okay. So I guess there was one appointment I wanted to talk about, which is John Bedoin's proposed appointment to the Planning Commission. I think Council Member Frazier may have had some comments that she wanted to offer first. If you want to lead off, I didn't want to step on your toes.
Did you request to speak? Yes. Okay, go for it.
Sorry. I just wanted to note for the record that I have received a number of concerns about this appointment to the Planning Commission in lieu of some of the the postings, if you would, that have been received or been viewed by some of my constituents. And I just thought it was worth discussion or conversation on the dais.
Anyone have any comments? Council Member Shields.
So I had some concerns about this appointment as well. Most of my concerns are just about kind of Mr. Bedoin's ongoing role as an opinion writer, journalist, political commentator covering matters at City Hall and just how that would be compatible with the role of unbiased planning commissioner. Like I don't think I've ever seen someone in that role with that kind of public profile and I just wasn't sure how that works. So I wanted to kind of bring that up and see if we wanted to discuss it and what other colleagues thought because I just wasn't IT JUST SEEMS LIKE IT WOULD BE HARD TO BE AN UNB
Thank you, Mayor. I would just say that I as well had same as Sherry received concerns regarding this appointment. And although I've never been on planning, um, and I have, I have nothing personal against Mr Bedoin, which I'm sure is here somewhere. Um, I do hear the concerns of those that have been on planning previously and, um, I guess watching from the audience at home. So, I mean, I understand the concerns that are out there as well.
Okay, any other discussion or comments? Yeah, Councilmember Pryor.
Thank you. So I didn't know any of this was going to happen. That was clearly pre-planned. But I will say I was very opinionated before I ran on council, and I am still opinionated. And I put my opinions out there. And I have been very opinionated with the school district and their lack of resources for certain students. And I've been very opinionated with the city. And... around pay with first responders and the lack of pay for a very long time. And I was opinionated. I put my opinions out there. I still would if I needed to. So I am confident that he could adequately do his job on planning c
Thank you. Anyone else? OK. No more comments. I stand by my appointment. And I'm OK with the dialogue and opinions. But unless there's any public wants to speak, I don't know what public has reached out or citizens have. But I think Mr. Boudoin has been a longtime, very engaged citizen, has been a big asset to this community. I think we've had people from a lot of different walks of life and backgrounds that have been on the Planning Commission. And so I just see him as someone that, like everyone else that's been appointed to that commission and others, including us that are up here on the da
And Mary can we vote on his computer. First procedural question, yes, can we can we vote on his appointment separately from the other folks on that list of appointments.
Sure we can do that procedurally. So so the full slate is on there will go ahead and remove that particular appointment. And we'll take it separately. That being said we need an amendment. Okay, then. So the appointments that have been presented as item see 2026 dash 7, 8, 9, 5. Mask and for vote. They're not including the appointment of the planning Commission. Representative so that being said I will entertain a motion and a vote. A motion made by councilmember Craven second by mayor pretend funk any further discussion. If not, please cast your vote. Missing one? Are you on yet? Council Memb
So I just... Procedurally, sorry, but it's still on there to vote yes or no on. So I don't mind voting yes or no on all of them at once, but I thought that we had asked to remove that one, so doesn't somebody need to amend the motion to remove that appointment?
Still missing one. All right. All votes are in. Motion passes 9-0, the slate that was identified. So now we'll go back to the one single appointment for the Planning Commission of Mr. Bedoin. So I'll entertain a motion for that as well in a second. Motion has been made by Mayor Tim Funk and a second by Councilmember Pryor. Any further discussion? If not, please cast your vote. Motion passes 4-3. No, 5-3. My apologies. Please record the vote. Thank you. All right. takes us to Council Roundtable. Anyone have anything exciting and fun to talk about? Yes, Council Member Carlisle.
I'm getting my notes out. I'm very sorry. I attended a park board meeting, and they discussed the updated Greenway Trails, which was then approved by the board. They reached a milestone of 100 miles of dedicated trails in 2026. One of the other items they were discussing was the Greenwood Gap, which is the four miles between Lee Summit and Pleasant Hill. And once that's completed, it will give a complete trail from Kansas City to Saint Louis. um they also discussed the longview park update and hope for a completion around fall of 2027. and that is it thank you great thank you councilmember pry
Thank you, Mayor. I just wanted to say congratulations to Sergeant DePue. He is officially retired. I went to his retirement thing. I just stopped in really quick last week. But I feel like he's been such a pillar in our community for so long. And he's the first person you see when there's an interview conducted with LSPD. So I'll miss seeing him around. But congratulations to him. Thank you.
Absolutely. Thank you. Mayor Pretend Funk.
Thank you, Mayor. A couple things. I was invited over to Lee Summit North High School by Mr. Nathan Miller. He was their librarian and Dr. Tim Collins, where they accepted the exemption of exemplary library program recognition for the state of Missouri for their library set up over there and also Wanted to share the new Blackwell living facility some of the residents over there in that neighborhood in the surrounding neighborhood all got together and got with the LSR 7 school district and Griffin Riley the developer and had great conversations. Council Member Cravens was involved in the conver
Thanks, Mayor. Excellent. Thank you. All right. We're going to proceed with the agenda. See no one else wanting to speak. And we have a couple of proclamations. So I think we'll go ahead and start off with the chamber. Mr. Baird, if easier. I'll meet you in front.
Great, thank you. So I, Bethel Lopez, by virtue of the authority vested in me as mayor for the city of Lee Summit, Missouri, do hereby proclaim October 21st as Support Your Local Chamber Day and encourage all Lee Summit residents to learn more about the chamber and the impact and the support they make for local businesses. And before I let Mr. Baird speak, I can... attest, and I think everyone up here on the dais will attest, and many of you in the room, this is the best chamber in the whole Kansas City area, and probably the Midwest. So they deserve a round of applause.
the reason I told you they're pretty awesome. So thank you again.
Great. Is someone here from Rediscover? Here we go. Oh, sorry. Rediscover. Freudian slip. Hope House. Marianne, welcome. Thank you. Really quick, I'll finish the proclamation for you while you guys walk up. So I, Bethel Lopez, by virtue of the authority vested in me as mayor for the city of Lee Summit, Missouri, do hereby proclaim the month of October 2026 as Domestic Violence Awareness Month and appreciate what you all do here in our community very much. Ms. Marianne.
Well, thank you. And we obviously are very blessed and fortunate to have you all here in our community and the work you do across the whole area. So thank you again. Let's take a picture. I'll get that to you.
I'm Mike Collar. I'm a board member and former mayor of Lake Winnebago.
THANK YOU AGAIN VERY MUCH. APPRECIATE YOU ALL. Alright. that takes us we're gonna move on with the agenda I'm gonna point out as I did at our last meeting because of the amount of public hearings that we have tonight the public comments part of the agenda kind of gets moved up and down a little bit sometimes so out of respect and courtesy to our public speakers we moved it up early so that you all don't need to withstand the entire meeting and all the public hearings we're gonna have tonight so just wanted to point that out so we'll go ahead and proceed with the public comments
I always go in alphabetical order, so there's no preferences here. The other thing I will point out, I think most of the speakers that have signed up to speak are pretty knowledgeable. The topics that you all will address, this is not a public hearing for the projects that are coming before us tonight. So this is strictly your time to speak about whatever you want to speak about, but not directly involved with these projects before us tonight. So with that being said, Mr. Boswick, please.
Thank you. Okay, we're going to proceed with the public hearings. And this next item will be continued to a later date. Mr. Dunning, do we need to go into closed session for this? Or, I'm sorry, public.
All right. So I'm going to close the regular session and open public hearing on the application PL 2026-2028, a unified development ordinance amendments to Article 6 of the use standards pertaining to accessory dwelling units and Article 15, rules of interpretation and definitions. City of Lee Summit applicant. This item will be continued to November 3rd, 2026. Is that right? Yeah, and just take a vote of the council to continue that or a motion to eat a motion in a second, please Most has been made by mayor pretend funk and a second by council member prior was on there That's from the prior a
Thank you. Please enter into Exhibit 1 through 17. Enter the record.
Great. Thank you. Do we have any questions from council? Not seeing any. Is there anyone who wishes to speak in support of this application? Is there anyone who wishes to speak in opposition of this application? Seeing none or hearing none, are there any additional questions from Council? If not, I'm going to close the public hearing and reopen the regular session. Once again, are there any Council comments? If not, Council Member Pryor, will you please read this ordinance?
Thank you, Mayor. I move to advance to a second reading, Bill number 26-182, an ordinance vacating a portion of Northwest Ward Road right-of-way located south of Northwest Colburn Road, abutting 915 Northwest Colburn Road in the city of Lee Summit, Missouri.
Thank you. Motion to advance to second reading has been made by Councilmember Pryor and seconded by Councilmember Shields. Any further discussion? If not, please cast your vote. All votes are in. Motion passes 9-0. Thank you. Appreciate that. All right. Takes us to the third item. I'm going to close the regular session again and open a public hearing in application number PL 2026-186 Preliminary Development Plan Rivian Auto Dealership and Vehicle Repair Service located at the southeast corner of Northeast McGuire Boulevard and Northeast Cargo Drive. Brian Ron, North Oak Safety Storage LLC is t
Thank you. We'll have staff's presentation first, and then we'll have some questions for you.
Please enter into the record Exhibit A, items 1 through 25.
Great. Thank you, Ms. Bright. Any questions from counsel? Comments. Well, not seen any. Oh, Councilmember prior.
Edit. Okay, not seeing any other questions. Too excited. Then we'll proceed. Is there anyone who wishes to speak in support of this application? Is there anyone who wishes to speak in opposition of this application? Yes, come on up.
Thank you for responding. In light of the other question that was posed, do you have any kind of feedback or response on the power?
And it's within an industrially zoned area. I'm sure other neighbors probably have higher power usage requirements. Correct. All right. Well, thank you. Appreciate that.
Are there any other questions from council? Hearing none, I'm going to go ahead and close the public hearing and reopen the regular session. Once again, are there any final comments or questions from council? Seeing none, Councilmember Cravens, will you please read the ordinance?
Thanks, Mayor. I would like to advance to second reading, Bill number 26-183, an ordinance approving a preliminary development plan for land located at 2701 Northeast Hagen Road, all in accordance with the provisions of Chapter 33, the Unified Development Ordinance of the of the Code of Ordinance for the City of Lee Summit, Missouri.
Thank you. The motion has been made by Councilmember Craven, second by Councilmember Atkins. Any further discussion? If not, please cast your vote. All votes are in. Motion passes 9-0. Please record the vote. Thank you. That'll take us to the other ordinance associated with that presentation. So I will close the regular session and open the public hearing on the application. PL 2026-187 Special Use Permit Rivian Automotive Dealership and Major Automotive Repair Facility located at the southeast corner of Northeast McGuire Boulevard and Northeast Cargo Drive. Brian Ron, North Oak Safety Storage
Please enter into the record exhibits A items 1 through 24.
Please enter all the evidence and information recorded from the previous hearing.
Any further questions? Comments? Council Member Arth.
This one's for Ms. Bright. On the 30-year use permit, is that typical what we do for this usage?
Any other? If not, Councilmember Atkins. Councilmember Pryor. This is still public hearing. Go ahead. I'm sorry. No, not yet. Not yet. Go ahead. You have a question?
Okay. And hearing none, I will close the public hearing and reopen the regular session. Now, are there any council comments? Council Member Pryor.
Thank you. So I just really feel like I'm excited to see this come, and I just really feel like it's going to be more of a destination dealership than just like some of our dealerships just bring in the Lee Summit residents that are already here. But I feel like this is going to be a destination one. So thank you, and I'm excited for this.
I would just echo Councilmember Pryor's sentiments. I think it's a great location for one, and I'm looking forward to seeing you come here if this passes tonight.
We'll do. Is there any new wishes to speak in support of this application? Okay, I'm a little bit behind. So I will now close the regular session and reopen the public hearing for application number PL 2026187. Is there anyone who wishes to speak in support of this application? Is there anyone who wishes to speak in opposition of this application? Are there any additional comments from council? Hearing none, I will close the public hearing and reopen the regular session.
All right, if not, Council Member Atkins, I believe.
Okay, so to advance to second reading, bill number 26-184, an ordinance granting a special use permit for automotive sales or lease and automotive repair services, major repairs in District PI on land located at 2701 Northeast Hagen Road for a period of 30 years, all in accordance with Article 6 of the Unified Development Ordinance for the City of Lee Summit, Missouri.
Yeah, I think that was the confusion. What's on our screen is different than what's on our agenda as far as the bill number Yes, that's 184 or 187 on the screen it says 187 Mm-hmm So I guess that's fine as long as we are approving Bill number 26-184, right? Okay.
Okay. We have a motion made by Council Member Atkins, second by Council Member Arth. Any further discussion? If not, please cast your vote. All votes are in. Motion passes 9-0. Thank you. Appreciate that. All right. We'll proceed with these public hearings. Thank you very much. Appreciate the presentation. I am going to close the regular session once again and open a public hearing on application number PL2026-078, Preliminary Development Plan, Blackwell Convenience Store, 2661 Southeast Blue Parkway, KDP Hospitality, LLC is the applicant. With all those wishing to speak, please stand and be s
I'm going to ask Council Member Arth to please recuse herself from this discussion and this presentation.
You could please keep your comments to yourself Thanks
Great, thank you. We'll go ahead and have staff's presentation.
Please enter into the record Exhibit A, List 1 through 25. 25 or 29? 29.
Mr. Soto, do we have any questions? Yes, Council Member Shields.
Thank you, Mayor. This is probably for the Developers Council. I'm going to be totally honest. You lost me a few times, but I made some notes, and I wanted to make sure that I kind of captured your points adequately. So I think what I got from your presentation is that the site is zoned commercial. The residential area grew up around a commercially zoned site. It's adjacent to a highway. So while you understand that the neighbors object to this, you feel like since it's zoned commercial and they bought houses near commercially zoned property that you should be able to continue developing it as
Now we're not going to have a commercial use. I'm really just trying to clarify because there's a lot of information. I just want to make sure I kind of understood. And then generally that there's adequate drainage, adequate road capacity. You've worked to kind of revise the designing colors to be more compatible. There's adequate parking. All the normal kind of site stuff that we look at, you feel like that's all addressed. And then I guess to staff, do you concur that the parking traffic Drainage all that is adequate to city standards Yes based on the information we received and yes, okay I
Great. Thank you councilmember prior Thank You mayor
Thank you. Probably for the applicant to clarify on Councilmember Pryor, so no vape, no alcohol, no products of that nature, correct?
Okay. How many convenience stores do you currently own and operate?
So you're fully aware that three miles, what I would call east, is a brand-new quick trip, and three miles to the west is a brand-new quick trip currently under construction that you won't travel through three roundabouts to get to with right ins and right outs.
Okay, what is the restaurant you're putting in? Do you have a business model, a plan, a... Any type of franchise?
Okay. So is the entire site, when this project starts, this is a good-sized site, is the entire site going to be completely cleared and graded when this starts?
Okay. That's all I have for right now, Mayor.
Okay, thank you. Council Member Carlisle?
Thank you, Mayor. It's Hector. I'm sorry. Thank you. Hector, could you just... I guess this one works. So you were saying what they're going to build from the... I've got to read my writing, so I'm sorry. Please bear with me. The existing stub... And then they're going to build that road, and then it's going to be able to come out back onto the roundabout? Was that what I understood?
Yeah, okay. So yeah Thank you, because I was I thought that you were rerouting them to go back in a circle and that completely lost me Okay, thank you very much All right sure councilmember Atkins
Thank you, Mayor. Mr. Soto, there's a slide in there with the homes that had responded. Did you say the difference between the yellow and the red homes?
Thank you. And then can you help with, I'm having trouble with proportions, the church, between the church over a couple blocks over. The size of the church, I'm looking at the brown, well, wait, I can't tell what they are. Are those buildings the same size as the store, or is the store going to be smaller or larger?
Okay. And then I, and then my last question is regarding maybe for you or maybe anyone in development in, in terms of C stores on, on that end of town, are there proportion? Are there enough over there for all the like capacity wise? Like, is there enough proportion C suite C stores per, Homes on that end of town. Is there any way to gauge? You know ratio of C store to residents are there too many or not enough or what?
What about compared to the rest of the areas around Lee Summit? Are there other areas that are super compact? I mean, is this a weird placement for another C-Store, or is it how the rest of Lee Summit is?
Thank you. I appreciate that. Okay. Thank you, Mayor.
Thank you, Mayor. When we've had gas stations or convenience stores come before us before, they've provided pictures of their other locations just so we can kind of see how they've maintained the other locations and things like that. Do you have any pictures or images of your other locations that you run or own? Can you give me the name of them and I can just look them up?
Okay, and then I guess, have we checked, it sounds like they might be selling alcohol here, but is it far enough from that church? Is it a church and a school that it needs to be a specific distance from, or is it just a school?
Did that answer your question? Do you need more detail?
You good for now? All right. Thanks. Not seeing any other. Oh, yeah. Council Member Shields.
Thank you, Mayor. So a couple of questions that come up that seem to deal with whether this is a good business plan, like in terms of the number of other convenience stores around. Like this application is just to say whether or not this land use can go through. It doesn't have to, like we don't set the, like you don't need a certificate of need to put in a convenience store. We don't really set the number of convenience stores in the communities that Like this is just saying for this partial that could we approve this? Use here. We don't I'm just like we don't usually get into those details.
That's all I have Thank you Yeah, I'm not seeing any other comments anyone else wanting to speak. So we'll proceed with the public hearing Is there anyone who wishes to speak in support of this application? I Is there anyone who wishes to speak in opposition of this application? I see approximately 10 people. We'll start front row and work our way back. That's okay. Please state your name and address and your comments.
Thank you. Come on up. Please state your name and address when you come up, please.
Get to your point quick about this project.
Thank you. Anyone else in the back row? Is that everyone that wanted to speak? Come on up. State your name and address, please.
For the record, what was your name and address?
Thank you. I believe that's everyone. Is that everyone? Going once? Going twice? Is that everyone? Okay. I know we have some council members that want to ask questions or make comments, so we'll go ahead and start that part of the process. Council Member Pryor.
Thank you. And just to clarify, we're still in public? Okay, so I won't make any comments yet. I'll just... Can you please clarify what the hours will be of this convenience store and of the gas pumps, please?
Thank you. You good? More questions? All right.
There were a couple of questions that came up from the public that I just wanted to get some clarity on. How many cars per day or customers per day do you anticipate? Because I think someone said something in the high thousands, and that seems surprising. So for you, it's a successful business model. What are you kind of counting on?
Okay, but that is the number of people that would be in and out every day you think is like 5,000?
Is that something maybe staff can clarify? Again, just trying to understand what those numbers mean.
Okay. Okay, the future restaurant and all that too. Okay. And then a few folks commented that they had sent in communications about this and they weren't shown on that map. Does this map, I assume, just show people who city staff were made aware of those communications? It's like if someone just emailed one of us and we didn't forward it on to you, you wouldn't know about that? Or how is this collected?
Okay. Most did, but there were a few. In general, just for us for best practices for the future, is it good for us to forward e-mails like that on to you so you can make them part of the public record, or what's your preference?
Good question. Thank you. Not seeing any other questions at this point. That being the case. You care to make another comment? Sure, go for it, yes.
brought to our awareness that you did receive concerns regarding the business practices of the owner, and you stated that 90% was false, but 10% was true. What is that 10%, please?
So it was about how they were paying their employees, not fairly?
Thank you. All right. Not seeing any other questions or comments at this time from council. Therefore then I will now close the public hearing and reopen the regular session. Are there any final comments? Council comments? Yes. Council Member Pryor.
Thank you mayor. So a former member former mayor baird he was very big on. The gateways to our city. Looking nice and I just don't think that this is how I want a main gateway to our city being represented. I also, it really bothers me that the gas station is planning on being 24 hours. I personally do not feel like it fits the character of the neighborhood, therefore I will be a no.
Okay, thank you. Council Member Shields.
Thank you mayor, so I appreciate everybody's time tonight the presentations the information I guess for me this is a commercially zoned piece of property next to a highway and It just makes sense to have a convenience store there It's been pointed out tonight that there are a lot of convenience stores in the area because it makes sense to have convenience stores next to highways and I understand the opposition, but I also have to balance that against the value of small businesses investing in our community and the rights of property owners to develop their property as they, you know, as they s
Thank you, Mayor. So I would just say that in looking at this area, I mean, you would think it's right off a highway. Sure, a gas station could go there, but I agree that the access to that from the highway is just not there. If, and I don't remember who said that you could get access from 50 right there on that offshoot, that would make it better, but I... I understand and have seen numerous times how people do not understand how to go through roundabouts. And I think to get through that many to get into a gas station and then back out is just really not feasible. So I agree that access just
Thanks, Mayor. Excuse me. I just got braces, y'all. So if I sound a little weird, I'm still trying to figure these things out. So. I appreciate the presentation, and I do know that investing in convenience stores is a huge undertaking, just running it, but then the investment that goes to that. So I am not trying to take away from everything that you have put into that. For me, I try to look at the greater good of the situation. and the greater good for the area. And a couple of things that stands out for me is, one, this is so close to a residential area with school-age children. And so I'm t
Thank you, Mayor. First and foremost, my apologies because I didn't check the emails who did or didn't have their address on there. So I apologize for that. My colleagues have said the most, the part of the access to this property, the overall fit and character of the neighborhood, we've talked a lot about that. I think we need to have some onus on us as a city as looking at this as a gateway into our community. We have developers that want to develop, that we need to look at some master planning in this area of what we really truly want as a community in this area. And As I said, my colleague
Thank you, Mayor. I'm sorry, I tend to agree with the master planning environment on the east side of town because legacy is so void of things like this. And I don't think the proximity to the homes is necessarily an issue because all the other churches and things are home. But it seems like the volume of traffic is what is so disruptive to this environment. And I think that there are many great places that we could use a store like this on that end of town. There's so many kids coming out of the parks and games all days of the week. I mean, there should be a lot of really good opportunities o
Thank you. I think that's everyone that is able to speak. Are you good? All right, so I'll go ahead and make some final comments before we go on to, yeah, we're in open session, regular session. Before we go to the vote, I won't repeat what my colleagues have said, but for the most part, I agree with many of the concerns. I heard the word gateway a couple times. I've been on the council for a number of years. That is a big thing. That that Eastern Gateway into the city is something that I take very serious as well and I know many of us up here on the council do as well and we want to be extra
Thank you, Mayor. I advanced the second reading bill number 26 dash 185 an ordinance approving a preliminary development plan for a land located at two six six one southeast blue Parkway all in accordance with the previous provisions of chapter 33 the United Unified development ordinance of the code of ordinances for the city of Lee summit, Missouri Thank you.
We have a motion to advance a second reading bill number 26 dash 185 by mayor pretend funk and a second by councilmember shields any further discussion I If not, please cast your vote. All votes are in. We have seven nos, one yes, and one recusal. Motion fails. We are going to take a 10-minute recess.

2026-7878, public hearing, Northwest Maine and Northeast Douglas Community Improvement District, Douglas Street between Tudor Road and Chipman Road, Phillips Edson Company, LLC, and property owners as applicants. Mr. David. Oh, all those wishing to speak, please stand and be sworn in by our city clerk. I forget that all the time.
Thank you, Ms. Jensen. And I can answer any questions. We'll wait until Mr. Bushick presents as well.
We do have some questions. Council Member Pryor.
Thank you and this actually may not be a public hearing question, but because I was on vacation in July, so if it's not just let me know, but it's probably for you, Mr. Dunning. Since I was on vacation in July, does this affect, I know there's like a big water thing underneath Sled Hill, but does this affect Sled Hill at all?
Thank you. With the reimbursable project cost, that $6 million, can you go back to the list of what they're going to use that on? I don't I haven't shown it but we could oh I thought it was in like one of the first slides about like the Douglas improvements and turn lanes and This one I Guess so so that lists all the eligible ones. So what did they decide that they actually want to to request? What is the six million portion of that list?
So they'll still have all of those on their list of reimbursables, and as those expenses come in, they can reimburse, but only until they hit that $6 million top out. It's not like they said, well, we're going to just put the road widening and the traffic signal on the list. It's all on the list, but they'll only reimburse until they hit that next.
Yeah, that makes sense. Of that, do you know how much of it is off-site improvements, like the actual Douglas Street overlay and that kind of stuff?
Yeah, so $2.5 million is off-site improvements. Yes, looks like $2.5 million. $3.5 of on-site, and then $5.4 of soft costs. So that's... Correct. Well, that includes the land legal fees. Okay. Yes. Okay. That helps. I understand that all of this meets a legal threshold, but it's helpful for me to understand what we would think of more typically as a public improvement, improvements to the public roads and that kind of thing. Okay. That's all I had. Thank you.
Great. Thank you. Council Member Frazier?
I think this is important in that, just going to take a minute, we talked about a couple of sessions ago a community advisory council, and this is huge to be able to understand the difference between the CID, the amount that they could request, and the amount that they are actually requesting. So thank you for for expanding on that and what that could be used on. So hopefully this will be a case study when we move forward with the council. The other question I have is just in layman's terms, This is sales tax, so that means that at some point that 6.7, that's going to be terminated, right? Is
All right. Um, any other questions in council? If not, um, is there anyone who wishes to speak in support of this application? Is there anyone who wishes to speak in opposition of this application? Sure. Come on up.
Thank you. All right. Are there any other additional questions from council? Hearing none, I'm going to go ahead and close the public hearing and reopen the regular session. Are there any final council comments? Yes, Council Member Arth.
Thank you, Mayor. The purpose of incentives, they can be a tool to help us get what we want for our city. In this case, when the preliminary development plan and the rezoning came to Planning Commission, staff had recommended that the design standards that we just read that we have the architectural design standards that we just I don't know it's it's not been that long maybe within the last year for sure we we have new design standards on the number of materials used they they recommended to the applicant that they abide by those design standards and they didn't they didn't want to do it and
Thank you. I guess I would be in support of this. There are a few things that kind of top the list for me. One, it's very much in line with the level of incentive that we've given on similar projects, so it feels like it meets kind of our prior precedent. I appreciate the breakdown of showing what's really, I mean, obviously these all meet the legal definition of public improvements, but seeing the off-site improvements, especially the varying of overhead electric lines that we're always asking for, new traffic signals, new turn lanes, things like that, that really will be EXPERIENCED BY THE P
Any other comments? Not seeing any. Council Member Carlisle, will you go ahead and read? Oh, you passed it? Who's that? Council Member Shields?
Yep. I move for second reading of Bill number 26-186, an ordinance approving the petition for establishment of the Northwest Maine Northeast Douglas Community Improvement District, approving the execution of a cooperative agreement for the district and authorizing and directing further actions in connection therewith.
Thank you. We have a motion to advance the second reading bill number 26-186 from Council Member Shields and a second by Council Member Carlisle. Any further discussion? If not, please cast your vote. All votes are in. Missing one. All votes are in. Motion passes eight yes, one no. Thank you all very much. Thank you. Takes us to the last public hearing for the night. And I'm going to go ahead and close the regular session and open the public hearing in application number 20267742. Public hearing chapter 100 plan for the Project Kings Industrial Development Project Grand Packaging Company appli
Thank you, Mr. Brzezinski. Before we go to questions, I know during the conceptual we had Mr. Perry with our ADC make a few comments. Would you like to come up and reaffirm what you said last time? Yeah, it's late.
All right. Now we'll go ahead and open it up for questions from council. Council Member Shields.
Yeah, just a couple questions probably for Mr. Bushek. The industrial abatement chart that you showed us, the percentage on there, it's not like the percentage on this one where it's total project cost. It's the total amount of the property tax that's being abated. Is that right? Okay. And then this one, it's just a personal property tax because they already have a real property tax abatement in place as part of the larger Scannell project. Did I get that right?
But the underlying land already has a tax abatement, so that's not part of this request? That's correct. Okay. I think those were all the clarifying questions I had. I'll have a couple comments later.
Thank you. Great. Thank you. Not seeing any other questions at this point from counsel. Is there anyone who wishes to speak in support of this application? Is there anyone who wishes to speak in opposition of this application? Come on up.
Thank you. Any additional questions from counsel? Hearing none, I'm going to go ahead and close the public hearing and reopen the regular session. Now, are there any final comments from council? Yes, Council Member Shields.
Thank you. I don't want to repeat too much of what I said when the conceptual came through, but I like this project a lot. I think this is exactly what our incentives are for, especially when it comes to industrial, bringing in high-quality, high-paying jobs and this level of investment. And I really appreciate that you were able to build in, we won't call them clawbacks, but pseudo-clawbacks into this that will help give us some more confidence that that will really materialize. So I'm excited to support this one. Thank you.
Great, thank you. Council Member Frazier?
I believe I mentioned previously the first time around that I am in support of this, although with the performance agreement, I really like the job aspect of it, but wondering if you could kind of, you know, give some preference to Mizzou graduates, but... And if you know, you know, like maybe next spring. Thank you.
Good. Uh, yeah, just, I think we've had a lot of discussion on your project and we appreciate you all coming in and investing and believing in our community and, um, You know, we're going to be partners with you, so let's get things going. And appreciate everybody's presentations tonight. Appreciate it. Thank you, Mr. Bushek. All right, with that being said, I believe Council Member Shields, will you please read the ordinance?
I move to second reading Bill No. 26-187, an ordinance approving a plan for an industrial development project and authorizing the City of Lisa, Missouri, to issue taxable industrial development revenue bonds in a principal amount not to exceed $33,775,000 in connection with Project Kings and authorizing certain documents and actions in connection therewith.
Thank you. I have a motion to advance a second reading, bill number 26-187 by Councilmember Shields and a second by Mayor Fritton Funk. Any further discussion? If not, please cast your vote. All votes are in. Motion passes 9-0. Thank you all very much. Please record that vote. All right. Sure. We can do a five-minute recess.
We are actually done with public hearings. How about that? So we will proceed with the agenda. Agenda item number seven, proposed ordinances, first reading. Council Member Frazier.
I move to advance to second reading, bill number 26-188. An ordinance vacating a certain easement located at 915 Northwest Colburn Road in the city of Lee Summit, Missouri.
Thank you. We have a motion to advance the second reading, bill number 26-188 by Councilmember Frazier and a second by Councilmember Shields. Any discussion? If not, please cast your vote. I'll vote to run. Motion passes 9-0. Before we go to item number 8A, to remain consistent, I will not remain in the council chambers, and I will let Mayor Pro Tem Funk address this next bill. So I'm going to step out.
We'll move to item 8 proposed ordinances for second reading item 8 a council member Atkins. Could you read bill number 26?
157 I move for adoption An ordinance establishing compensation and allowances for the municipal judges with the city of Lee summit, Missouri I Have a motion to have a second councilman prior have a motion and a second
Any discussion? I see Council Member Arth.
Can we turn up her volume? Can you talk again? Oh, that's better.
Okay. So I might double back to that, but then you wrote an ordinance for the increase in the judge's compensation, and that ordinance seemed to support the increase. So can you explain why you did that?
that the opinion was one way but the ordinance was another way because like you said you were doing 2 different things for us as as functioning as our outside counsel substituting for city attorney. Okay, then yes, okay. So if we go back to the additional duties that remain. I want to make sure I'm getting this correct. When I think about duties that, when we're talking about the treatment courts, and I'm thinking about non-germane duties, if they're not germane to the judiciary, then I have to know where they would go. I mean, I have to know where they'd be germane to. I would say that I can'
Thank you. So, Ms. Zacharias, kind of following up on some of Council Member Arst's questions. So it has to be both a non-germane duty and it has to be imposed by the legislature, correct? That it's not just that it's outside of their normal function. It also has to be something that we are imposing upon them, that we are telling them that they must do.
And so I think in your opinion you wrote something along the lines, the counsel cannot mandate that the court establish a treatment court docket. The court is responsible for its internal structure and operations, including whether to establish a treatment court docket. And for that reason, even if adding a new treatment court docket could be considered as material different from judicial responsibilities, It does not provide a clear basis for the council to adopt a midterm compensation increase. So that's basically you saying that even if we consider this a new duty, we still can't actually i
So kind of from what you said in response to Council Member Arth's question before, you drafted this ordinance because we asked you to, because we had a motion that was passed by the council to bring forward an ordinance. And so after discussion with us, you used the treatment court as kind of the duty that you were tying it to. But that's why you drafted it, right, is because we asked and we're your client.
Okay. And I guess then my question is, because I did go back and watch the meeting, and my apologies for not being at that meeting. I had a previously scheduled mandatory work retreat for my day job, so I wasn't able to make our last one. So I appreciate you bearing with me through my questions. So some of what I saw discussed was like you being asked if this would be upheld or not upheld and kind of saying that it would be up to a court. But I want to understand the magnitude of that risk, if that makes sense. In your professional opinion, what's the likelihood that this would be overturned i
Um, and if a court did ultimately determine that it was unconstitutional or they overturned it, as you think is more likely than not, the judges would be re could be required or would be required to repay any, any additional compensation.
Okay. I think I just have one question left for you. So we've heard several times that THIS COUNCIL HAS RECEIVED OTHER LEGAL OPINIONS FROM OTHER ATTORNEYS, FROM OTHER JUDGES. WHAT'S THE DIFFERENCE BETWEEN THE LEGAL OPINION, LEGAL MEMORANDUM THAT YOU PREPARED VERSUS THE OPINION OF A JUDGE THAT COMES AND SPEAKS IN PUBLIC COMMENT OR I THINK WE GOT A WRITTEN LETTER FROM JUDGE HELM THAT LAID OUT WHAT HE CALLED HIS LEGAL OPINION. HOW DO WE WEIGH THOSE IN TERMS OF WHAT TO CONSIDER WHEN WE MAKE A DECISION LIKE THIS?
And I guess obviously I can't know what research any of these individuals did, but for example, in Judge Helms' letter, I didn't see any actual case law cited, any research cited. Would you consider what he delivered to us an actual legal opinion or just like a personal opinion?
Okay. Okay. I think those are all my questions from Zacharias. Are we able to ask any questions of the judges this evening?
Mayor Pro Tem I Think we should probably just take the vote on the matter and move on. I Think we all know where this is headed So I don't think we need to spend all night sitting here unless the judges actually wanted to skid up and No, okay
Okay. Well, then I guess that's all that I have. Thank you.
Council Member Pryor. I would like to say one thing.
Sure. If the judges are going to speak, I'd like to actually ask a couple of questions that I have.
Okay. Ms. Zacharias, can she hear me? So Judge Lopez, I do have a couple of questions for you. Okay.
Mayor Pro Tem, do I have the floor or does Judge Maxwell-Lopez have the floor?
She's got the floor real quick. Let her ask her questions, then you can ask your questions.
Okay. So I guess the questions I have for you, if this ordinance is not passed this evening, would you all accept Pro Tem judicial help in the court to help through your backlog, or is that something you're still not interested in?
OK. And then the other question that I had is, if this ordinance were passed and it takes effect, but then a court later invalidates it and either the compensation stops or it has to be repaid, what happens operationally? Would you guys continue holding the same number of dockets in the treatment court and all that? Or would you stop until new compensation went into effect? I really am just curious what would happen in that case. I understand that you believe that this is constitutional. But take the hypothetical. What would you guys do?
With respect, I really understand that you believe this will be upheld. I'm just asking for the counterfactual. If it weren't, what would happen?
Yeah, let's move over to the Senate podium.
Okay, I appreciate that. And then I guess to Ms. Zacharias, just to follow up on one of those comments, who would have grounds to sue to overturn this ordinance?
Okay. So any taxpayer in the city would have the grounds to sue? Okay. All right. I think those are all my questions. Thank you, Mayor Patel.
Judge Lopez, did you want to ask a question?
I would just assume move on, girls. Okay. Council Member Pryor has something, and then we can take this vote and move on.
Thank you, Mayor Pro Tem. Okay, so I guess since we're criticizing other legal opinions, Ms. Zacharias, I spoke with you, I believe it was day one, and you'd pretty much given me your legal opinion. You told me what your thoughts were, and I was concerned about that. So I called Mr. Dunning to voice my concerns to him. I also called Mayor Pro Tem Funk. At the time, I know you were still requesting information from the city, so you formed your legal opinion based on talking to initial council members. I believe it was Councilmember Shields was the person that you had spoken to before me. So, I
Everything that I had brought up to you, you had a rebuttal to every single thing. I knew exactly what your legal opinion was going to be based on what you told me that day. And so I'm just confused by this entire situation. I honestly am confused. I know that this entire situation has really raised a lot of red flags for me. I know that it has made me distrust this entire process that we're going through right now. It has divided our council and I'm sorry. I can't say that I fully trust your legal opinion on this. I don't. I think that we're heading down the... I think this ordinance helps...
Thank you. Any other discussion? Council Member Shields.
Sorry, thank you. I have just a few comments before we vote. I agree that the court's need more resources. They probably need more judicial time. That's what our audit showed. But I don't agree that doubling judge pay is the only way to solve this problem. But the thing is, even if I did think that this was completely justified, we still have to decide if this ordinance that we're voting on tonight is legal. And this ordinance does not set more court days. It does not create a treatment court, because that's not in our power to do. We've talked about the narrow exception to this requirement in
Council Member Cravens. Okay, so I have a question for you, Ms. Zacharias. I know we did have a lengthy discussion with you previously to 1 in the morning, if I remember correctly. We discussed in great length what additional duties could look like. And you did say that a treatment court could be considered additional duties, as well as another judge, I think that was in her recommendation as well, I can't think of her name off the top of my head, that also stated that a treatment court could be considered additional duties. So what I kind of want a little bit more, and I'm pretty sure we talk
Okay. So just so I'm clear, I think, um, You kind of said a lot there. That may have confused me even further. I'm sorry. So you're saying that we currently don't have that in place to tie all of this together?
Okay. And then one last question for me. So Judge Arteri just kind of laid out what are some of the reasons why you would need a temp judge, which kind of made sense to me when she put the analogy with the mayor and the mayor pro tem. So you would use those in lieu of if the judge isn't available, absent, and so forth. And we had also discussed when we were all meeting that that could be a possibility. Because the reason I'm asking this is that if this does not pass, if everyone votes the way that they voted before, it probably won't. And I want to know, you know, what are some options? Becaus
Thank you. Thank you. I know my thing's not clearing out. I think Council Member Pryor and Council Member Carlisle want to speak. I don't think we're going to rectify the problems with our courts tonight. Would you be okay, Council Member Carlisle, if we just voted?
I just have one request for the record. I have one to speak to.
Councilmember Pryor, I think you were in there. Did you clear those out, Devin? I think... Councilmember Pryor, go ahead, and then I'll get Councilmember Carlisle, because I think you were in there.
Thank you. Since we're talking about hypothetical lawsuits, can we get sued from the people that live in Lee's Summit or that have to have a court date? Can we get sued from one of them for failing to provide... basically an essential service. Failing to provide an efficient essential service. Zacharias? Would the city get sued? The city, yeah. Can the city get sued? Because we are failing the people that live here. Can we get sued?
Okay. Can somebody, if we fail to provide due process, can somebody sue the city? They can look back at this meeting, see that we are failing them. Can they sue the city?
Absolutely, they do. So the answer is yes. So there is just probably as much of a likelihood of us getting sued for that as we would be if we were trying to fix the courts because there are a lot of very upset taxpayers in our city that could very easily bring a lawsuit against us for not trying to fix the courts. So, I mean, I think it's a 50-50 wash at this point. Let's just try to fix the courts. But, okay, thank you.
Councilmember Carlisle Thank You mayor Pro Tem um, I we received the council and the City manager I believe received a letter Last week, I believe it was and I would just want it to be Read into the record for this topic since it was on this topic if we could do that. I
Council Member Frazier. Council Member Frazier, did you have something? Just real quick.
I just wanted to comment that, and this is for the record as well, we have received, and I think I can probably say collectively, we have received a number of complaints. We have received a number of threats. We've even had promises, if you would, for recall. That's come up as well. And I'll have to say it's from both sides. It has to stop because I don't think there's a single person up here, regardless of the pathway that we think we need to go that isn't in support of the court. What we are trying to do is figure out a pathway forward. And I think we can do that. And I also believe that we
Thank you. Council Member Pryor, please make it short.
I do think that with such serious allegations that were in that anonymous letter, who states honesty is the best policy and then wants to remain anonymous, but I do think that we should allow our judges to at least address that because that letter was read publicly and I feel like those allegations were serious. So would you be okay with them quickly addressing the allegations in that letter? Well, I mean, and I know this clearly is not going to pass tonight. It's not going to move forward. But I think that I feel like they should be. Thanks.
No, it's not. Please make this very quick because we're going to vote right after this.
Thank you. Thank you for letting us respond. I have a motion by Council Member Atkins and a second by Council Member Pryor. Could I please get the vote? Sorry. Could I please get the vote? It is 4-4, so the motion fails. Mr. Dunning, before we call the mayor back in, you and I had a conversation about this. What I would like to establish is a task force. Maybe as early as next week we could convene yourself, the court liaison, the judges, the court administrator and sit down and outline what this task force would look like. And then we could have a discussion of appointing two council members
I think I would look for consensus from my council that we start a task force and we start building from the ground up of what we can do in assisting getting the courts fixed.
I'll take full responsibility of bringing up the task force because we have to start somewhere to start taking the Raftilis report, start implementing it, and looking at all of the options that we have. I think that's the first step in the whole thing.
Okay, so, thank you, Mayor Pro Tem. At this point, we have to have a path forward. So we have to start the planning or the work like yesterday. So I would like to know what is a realistic time frame for us to kind of think through what all we need, how we want this to look. Similar to like how we did the housing and the incentive, where there was a detailed plan on what that is going to look like, when we are going to determine who's going to be on it and when it's going to get started. Because right now, to say we'll get to it at some point without a definitive time frame on when we're going
I think the initial meeting would be to establish the court liaison, the court administrator, get some dates that work best for everybody. I know the judges have court dates on certain days, and we put a timeline to this. We start dissecting the Raftoulis report. We put a timeline and say, hey, we're going to hit these marks, and whoever those council member liaisons are, they're reporting back to the full council that, hey, we've hit these marks on the reports working with the judges. We can't tell them what to do, but we can definitely all work together to get to that final outcome that we'r
I think it's it's an opportunity for us to take a step forward. This motion is done, it's over with, and we want to present the opportunity to fix the courts. And the opportunity is here to bring all of us together and hear your opinions of what can we do to help, how can we provide the help with the guidance of the council. Do we have consensus to work on a task force?
No, I have comments sure so So no, we just I have the floor currently Councilmember Atkins I have the floor currently. Thank you so I Suggested a task force in August like I thought that was a good idea My impression was that this council didn't want to wait that long. So I you guys want to do that August a month and a half ago and we just wasted a month and a half on this stop I'm not gonna tolerate it you have the floor thank you so I suggested this I was trying to work through the implementation action plan that's why I was asking mr. Dunning for updates on what had been done, what we could
I was just going to say that even if you wanted to do something like an emergency work session, I'm up for that, where we could meet. I have a huge tax deadline here, and I'm willing to do what it takes so we can move forward with this. So I am supportive of what you're trying to do, Mayor Pro Tem.
Well, I have a question. Sure. Can we also include the rest of the court staff in this task force? So we can discuss there and fix the whole courts? And then, so what's the point of rushing it when we have people that clearly do, that will not, we're not gonna pay them more. I mean, we're not gonna allow them to be in there more and compensate them for their time. So what's the point in rushing this when the conclusion's gonna be the same? We need to pay them more. We need them in there more days. But it's not going to go anywhere. I mean, that's been proven. So, like, what's the point in rush
The desired outcome for the task force is work hand in hand between city staff, the municipal court system, and the council to find a solution to get through the Raftoulis report and figure out all of those items.
So at the end of the task force, the goal will either be changing our mind and saying, okay, you're right, let's do it at election, or changing their mind and saying, yes, something needs to be done immediately. Otherwise, we're still going to be at a standstill. I don't want to waste anyone's time when it doesn't sound to me, people can say all day, I'm willing to fix this. We just had a solution to fix it, and it didn't get fixed. I'm I'm for the task force. I don't want to waste anyone's time when I feel like. I mean I can read body language up here right now and it's not. It's not good and
So I don't think the task force is intended to change anybody's mind. A task force is intended to have differencing of opinions and perceptions to get together to come up with ways to figure out where our gaps are, to understand the overall big picture of it all, so that we can start working together to one, start dealing with the low hanging fruit. I know the last meeting we talked about we need to get something in place to assist with the staff in the courts. That hasn't been a date or a plan hasn't been put in place for that. That's an area the task force can also look into is what are our
The notes I will get that put together I will work with mr. Dunning to get that done Yes councilman brackets We are upon the 11 o'clock hour.
So thank you for a chance to speak There's been a lot of times this season that people haven't been able to speak So thank you for being generous with letting people have a minute to speak. I'm in very in favor of a task force I think there's a lot of things to dig through because we have 18 months until the next term begins Even though this cycle began Before the last term, citing the term change as a barrier, we blew past that term and here we are again with that same barrier. We have 18 months to work to fill the gap until our next decision is made. I do not believe that we are all in agree
I want to say one thing just to wrap things up. We have heard here today that most of us are in agreement with the task force. I agree with Councilwoman Cravens. If you don't want to, don't. It's just that simple. Don't. We don't need your input if you're not going to. The other thing is, what has to stop is the bullying and the threats. I heard today someone say, hey, well, we're just not going to vote you in. That's not the answer. It is not the answer. So let's move forward. Let's do what we need to do. And what I said was, I think everyone understands that the courts need to change, right?
We're not going to have an argument on the dais, period. Mr. Dunning, I think you have consensus to move this forward. I will convene with you in the morning. We will start to outline how we can do it, share with the council. We don't have to do it first thing in the morning. But we will get together soon and start that outline. It is 11-11, no new business unless we want to. I can grab him real quick. Okay Where are we?
All right, let's go. All right, let's do it. Council Member Cravens will read the remaining three.
I didn't say that. I thought I heard you say that.
I move for adoption of Bill No. 26-158, an ordinance granting a special use permit renewal for an automobile dealership and major automotive repair facility in District CP2, playing community commercial on land located at 975 Southeast Oldman Parkway for a period of 20-20 years, all in accordance with Article 6 of the Unified Development Ordinance of the City of Louisiana, Missouri.
We have a motion to adopt a number, bill number 26-158 by Council Member Shields, second by Mayor Pretend Funk. Any discussion? If not, yes, Council Member Arth.
Okay, thank you. That being said, if there's no other questions or comments, please cast your vote.
There we go. Still missing one. I said aye. Okay, all votes are in. A motion passes eight, zero, and one recusal.
Move for adoption of bill number 26-159 an ordinance granting a special use permit for convalescent nursing or retirement home district cp2 on land located 808 20 north southeast battery drive for a period of 30 years all in accordance with article 165 development ordinance for the city at least some Missouri.
Thank you. We have motion to adopt bill number 26-159 by councilmember Shields and a second by councilmember Pryor. We have one recusal. If there's no other discussion please cast your vote.
All votes are in. Motion passes 8-0 on recusal. Thank you. Council Member Shields? Or Cravens? Who's going to read this one?
Move for Adoption Bill No. 26-160, an ordinance approving a preliminary development plan for 1.88 acres of land located at 820 Southeast Battery Drive, all in accordance with the provisions of the Chapter 33 Unified Development Ordinance for the Code of Ordinances for the City of Lee Summit, Missouri.
Thank you. We have a motion to adopt bill number 26-160 by Council Member Shields and a second by Council Member Cravens. Any discussion? If not, please cast your vote.
All votes are in. Motion passes 8-0-1, recusal. Thank you. Takes us to committee reports. We're stuck. I can't read anybody. Any reports? If not, we'll move on to council comments. Council Member Shields.
Thank you. So there was a letter that was read into the record earlier that was done by an anonymous person. I don't know what their relationship is to the city. They sounded like someone who had interior knowledge of how the courts works, but I don't know if they're a member of staff or not. No idea. But if a member of city staff in any department ever has concerns about the operation of their department, is there a way for them to make anonymous whistleblower complaints? What is the procedure for that? And are staff educated on that?
Thank you, Mr. Dunning. That's all I have.
Thank you, sir. Mr. Duddy, anything else? All right. This meeting is adjourned at 11.17 p.m.
