We are officially calling this meeting to order. Today is Wednesday, September 10th. The time is now 10.08 a.m. Madam Clerk, please call the roll.

0:27•Christi Fraga

Please rise for the Pledge of Allegiance led by Councilman Reynoso.

0:30 – 0:42•Nicole Reinoso

I pledge allegiance to the flag of the United States of America and to the republic for which it stands, one nation under God, indivisible, with liberty and justice for all.

0:46 – 1:01•Christi Fraga

Just a quick reminder for everyone to please silence their phones during the council meeting. And we will now go into the invocation. I don't see, is he here? Father Emmanuel? Oh, I'm sorry, didn't see you. I was trying to buy some time.

2:07 – 3:05•Christi Fraga

Thank you very much, Padre Mago. So tomorrow marks September 11th, a day that forever changed our nation. We remember the nearly 3,000 innocent lives lost. We honor the bravery of the first responders and stand in solidarity with the families who still carry that loss. May we never forget and may we always work to protect the freedoms and pay them respect. At this time, I'd like to call for a moment of silence in their memory. Thank you very much. And now we're gonna move into the agenda order of business. Madam City Manager's Office, do you have anything?

3:20•Christi Fraga

Okay, thank you very much. Councilman Pinedo?

3:28 – 3:42•Maureen Porras

Yeah, I'll be pulling 6A. And I'm going to defer my item 20A to October and 20B to no time certain. That's from the evening. 20A? Yes, and 20B.

4:18•Christi Fraga

Okay, Council Member Reynoso? No, Mayor. All right. Council Member Cabron?

4:30 – 4:58•Christi Fraga

All right, I also do not have anything to pull today. So we will go right into public comments. The public comments portion of this meeting is now open. You have three minutes to speak on anything on this agenda or anything germane to this council. Please speak in a respectful manner. Approach the podium. Say your name and address for the record. And I'm going to go ahead and start with the comment cards that we have. If you haven't filled out a comment card, you'll still have an opportunity to speak. We just ask that you see the clerk after to register. We're going to go ahead and start with

7:29•Christi Fraga

Mr. Glitzak, thank you. The three minutes is now up. I need to take up the next speaker.

7:36•Christi Fraga

The three minutes is now up and we need to take up the next speaker.

8:16•Christi Fraga

Thank you. Madam Clerk, did we have a minute left on the clock? No, the clock had run out.

8:30 – 8:54•Christi Fraga

30 seconds. So you've made your point, and remember that public comments should be anything that's germane to this council, and while federal matters may be very important, they're not germane to our city of Doral business. So we ask that you please respect the time of our residents and us up here. We love to hear you speak, and we're always open to listen to you, but we do give you the time, and that time should be utilized in talking about things that are important to the city of Doral. Okay.

9:04•Christi Fraga

It counts backwards. It's going. It's ticking.

9:42•Christi Fraga

Thank you, Mr. Glutzstadt. I would ask you to please respect the time.

9:57 – 10:16•Christi Fraga

Thank you. All right. Would anybody else like to speak in public comments at this time? Anyone else? Okay, public comments is now closed, and we will hear the motion to approve for the Consent Addenda. Madam Clerk, would you please see items that are being approved in the Consent Addenda?

10:20 – 11:03•Christi Fraga

Okay, we will hear 6A after discussion in the morning session. Correct. All right, thank you very much. I need a motion to approve on the Consent Addenda. Motion to approve by Council Marinoso. Second. Second by Council Pinheiro. All in favor say aye. Aye. All right, let it reflect unanimous support on the Consent Addenda. Thank you. Item seven, approval of minutes. Okay, I need a motion on the approval of minutes. Motion to approve by Council Member Reynoso. Second. Second by Council Member Pinero. All in favor say aye. Aye. Let the record reflect. A unanimous support on the minutes. And we'll move into presentations. Presentations keep to our beautiful business award. Mr. Estrada, thank you for joining us.

12:32•Christi Fraga

Please join us. If you'd like to go to the podium and say a few words, and then we can take a picture.

13:32•Christi Fraga

Thank you very much for joining us. Anybody else want to introduce themselves? Maria Luisa? We all know you, but for old time's sake.

13:54 – 14:18•Christi Fraga

Thank you, Madalisa, for everything you do in our community. Thank you all for being here. We appreciate the investments that Baptist has made in our community. I was able to be at the groundbreaking, not the groundbreaking, the ribbon-cutting of the building, and it's absolutely beautiful, but more beautiful is the work you do inside. So thank you for what you do and for taking care of those patients, and we continue to pray for your success. And we'll just take a picture up here to commemorate the Keep Doral Beautiful Award you received. Thank you.

16:07 – 16:39•Christi Fraga

This is my item. This is basically just a policy resolution memorializing the Golden Hearts grant that is in our budget so that as soon as the budget passes, we can go ahead and do the distribution of this grant. So all the information's in the backup. I presented it during the budget hearing. And should this be approved today, it's the policy to be able to distribute the grants. Motion to approve by Councilman Pinero. Second. Second by Councilman Reynoso. If there's no further questions, Madam Clerk, please call the vote.

17:05 – 17:47•Christi Fraga

All right, similar to the previous item, this is also an item in our budget. This is a policy to be able to distribute the grants and have a process for them. This is a hardship grant for families in our community. The way to qualify the policy that will Screen people and provide the time frame for the the grants is all included in the policy I'm happy to go through it with anyone if you have any questions, but like I said, it was on the backup I think the policy is very descriptive and Provides clarity to how it'll be distributed. So if there's any additional questions I can take them now or

17:49•Christi Fraga

Motion to approve by Councilman Pinedo, seconded by Councilman Reynoso. Is there any questions? Okay, Madam Clerk, please call the roll.

18:04•Christi Fraga

Mayor Fraga? Yes. Motion passes. Okay, great. We go on to the next item.

18:27•Christi Fraga

All right, Council Member Moreno, so this is your item. Apologies.

18:30 – 19:29•Nicole Reinoso

Thank you, Mayor. So my item is just to find better utilization of the senior membership cards that they currently have. Right now it's just a card with their picture on it. It has no function. So what I would like for parks to do is find a way to embed certain information onto that card so it could be more useful to them. I also would like to explore the possibility of having a profile for each one of our seniors, their name, birthday, maybe any medical condition that we should be aware of as part of that profile of that card. And that card so far based on the memo will have the calendar that

19:32•Rafael Pineyro

Good morning. Definitely, we'll start working on that.

19:35 – 19:50•Christi Fraga

Thank you, Michael. Thank you, Council Member Reynoso. Thank you. Any questions? Motion to approve by Council Member Pinedo. Second. Second by Council Member Reynoso. Thank you for bringing this forward. If there's any questions? Being none, all right, we'll have a staff work on that.

20:16 – 20:39•Nicole Reinoso

Thank you, Mayor. Well, in the spirit of transparency and responsibility and accountability, I bring forward this item as a way to see what our attendance is as a council for regular, special, and workshops. Through the Mayor, Madam City Clerk, The title that we're using on the agenda did not reflect the workshops. Can you amend that?

20:43•Nicole Reinoso

Okay, motion to amend my title. Okay, and to approve your item, right?

20:49 – 21:05•Christi Fraga

So motion to approve by Councilman Reynoso with the amendment of including workshops as well in the attendance dashboard. Second by Councilman Bineto. Any questions? I just have one question. Councilor Mariano, do you have any examples of this for staff to maybe work?

21:05 – 21:17•Nicole Reinoso

I actually do, Mayor. Madam City Clerk, there is a file folder. And IT also has an example of what that would look like. I will put it there. And I hope that answers your question.

21:21•Nicole Reinoso

Mariano. We'll put it up shortly. Thank you.

21:56 – 22:18•Nicole Reinoso

Awesome, so this is from the city of Dallas. Correct, and in the example that is in front of you now, there's different clicks that you can do, whether it's to look through based on the council member, the mayor, the different type of workshop or meeting, and it will filter it out based on those two things. At least that's what the city of Dallas has, which is the example that I'm waiting for IT to bring up.

22:18•Christi Fraga

So staff can work off of this example to create the dashboard. Yes, exactly.

22:31•Christi Fraga

All right, Madam Clerk, please call the roll.

23:14 – 23:31•Christi Fraga

Okay, I believe this is a planning and zoning item, but I don't think we need Michelle. This is just a change of date, correct, Michelle? I'm sorry, he did not, he didn't include the city logo in his application and then ask for it. I remember now, okay. Council Member Pinedo, motioned. Second. Council Member Reynoso, second. Madam Clerk, please call the roll.

23:51•Christi Fraga

Motion. Motion to approve by Councilman Reynoso. Second by Councilman Pinedo. I don't care.

24:05•Christi Fraga

Mayor Fraga? Yes. Motion passes. Okay, we're going to take up the item that was pulled, item 6A.

24:21 – 24:51•Christi Fraga

Okay, before we hand this over to Vice Mayor Porras, I'd just like to remind the council that we have in the shade sessions on these items which are still settlement matters in litigation that are pending. So I will leave it to the city attorney at this time just to remind everyone, I do not want this to become a habit where we're pulling these items. We have in the stage sessions that everybody should participate in. By the time it comes to us here, it's because the parties have agreed for a settlement. So we should not be having discussions on the dais.

24:51•Maureen Porras

I just want an individual vote. That's it. I don't want to have it in the consent agenda because I want to have my own vote on it. That's it.

24:59 – 25:12•Christi Fraga

Okay, so do you have any comments on the item? Okay, so I need a motion then. Motion. Motion to approve? Yes. Second. Second by Councilman Reynoso. Madam Clerk, if there's no additional questions.

25:21•Christi Fraga

No. Motion fails. Okay, we'll go back to settlement.

25:34 – 26:37•Christi Fraga

Yes, we have the mayor's report. All right, so I just wanted to remind everyone that Hispanic Heritage Month starts next week. Tomorrow is our first event at the Cultural Arts Center at 6 30 p.m. I would encourage everyone to join us as we celebrate Hispanic Heritage Month with a variety of cultural events here in our city. Besides that, our gala information, so Parks and Police for Kids is having its official gala. It's the Mayor-in-Chief's gala where we're going to be raising funds to be able to continue the great programming we have from Parks and Police for Kids. We would encourage people

28:06 – 28:39•Christi Fraga

All right. Thank you very much. Great job, everyone. We'll move on. Is there anything else, Madam City Manager? Thank you very much. Mr. City Attorney, any reports from you? Thank you very much. City Clerk's Report. It's attached in the backup. All right. That concludes our morning session. That was a fast meeting today. If there's no other comments, then I just need a motion to recess for the afternoon session. Motion. Motion to recess by Council Member Reynoso. Second by Council Member Pinedo. All right, we'll see you back at 6 o'clock.

29:32 – 29:43•Christi Fraga

Good afternoon, everyone. We're calling our LPA meeting officially to order. Today is Wednesday, September 10th. The time is now 5.39 p.m. Madam Clerk, please call the roll.

29:51 – 30:42•Christi Fraga

Present. Mayor Huffman. Please stand. The pledge of allegiance led by Vice Mayor Porras. Okay, I don't believe there's any changes to the agenda order of business. I'm gonna go ahead and open up the public hearings. The public hearing is now open for anything on this agenda. Or anyone who'd like to speak about items for the city of Doral, please approach the podium. You have three minutes to speak in a respectful manner to this council. I have no comment cards at this time. Okay, I don't believe there's any public comments. Public comments is now closed. And we will go into the public hearing.

31:24 – 31:57•Christi Fraga

Okay, I'm going to go ahead and open up public comments for item 2-6303. Anyone who would like to speak on this item and this item alone, please approach the podium. Okay, being none, public comments is now closed. Madam Clerk, Director of Reflect, no one has chosen to speak at this time. And now we will either hear from staff or entertain a motion to transmit to the City Council without a recommendation. Motion. Motion to transmit without a recommendation to the City Council by Councilwoman Reynoso.

32:09 – 32:21•Christi Fraga

Mayor Fraga? Yes. Motion passes. Okay, now I just need a motion to adjourn the LPA. Motion. Motion to adjourn the LPA by Councilman Reynoso. Second. Seconded by Councilman Pinedo. All in favor say aye. Aye. This meeting is adjourned. We'll be back at 6 o'clock for our regular scheduled council meeting.

32:49 – 33:01•Christi Fraga

Good evening, everyone. Welcome to our September 10th evening session of the council meeting. Today is September 10th, and we are now calling this meeting to order. Madam Clerk, please call the roll.

33:15•Christi Fraga

Please rise for the Pledge of Allegiance.

33:19•Digna Cabral

I pledge allegiance to the flag of the United States of America.

33:34 – 34:58•Christi Fraga

I'd like to please do a moment of silence. Unfortunately, there was a horrific attack on what I consider a true patriot in this country, Charlie Kirk. And unfortunately, he has passed. And so I'd like to ask us to please do a moment of silence in his honor. Okay, thank you everyone. We'll now move into the agenda order of business. Is there any changes, deletions, additions? Being none. Okay, we'll move into public comments. The public hearing portion of this meeting is now open. If anyone would like to speak on any item to remain to this council or on this agenda, now is your opportunity. Unl

38:17 – 38:34•Christi Fraga

Thank you, Mr. Glutzstadt, thank you. Anyone else would like to speak at this time for public comments? Please approach the podium. Anyone else? Being none, okay, public comments is now closed and we'll move into our presentations.

38:42•Christi Fraga

Good evening, Chief Jatava. Thank you for joining us. Thank you.

39:57•Christi Fraga

I think IT, we have the, yes, the presentation ready. There you go, Chief.

40:26 – 40:41•Christi Fraga

They're going to pull it up. Just give him one second. No problem. Sorry.

50:20•Christi Fraga

Thank you, Chief. Do we have any questions for the fire chief? Comments? Yes. Councilwoman Reynoso.

50:26 – 50:40•Nicole Reinoso

Thank you. Well, first of all, thank you for putting a transport vehicle, station number 45. Second, is there any plans to remodel that station?

51:12•Nicole Reinoso

Do you have any timeline more or less of when that would start?

51:23 – 52:09•Digna Cabral

Thank you, Chief. Anybody else? Councilman Cabral? Chief, thank you so much for everything. Your team is always, I mean, since, for me, the most incredible part was when we had the fire in the recycling plant. So thank you for everything. And also for the help class. I can tell you that have helped so many community members while they will be able to identify and minimize the risk of someone having a stroke or having any incident. So that's wonderful, the class and how it was presented from the members of the fire department. They are like really well prepared. And I know this because I've bee

52:12•Maureen Porras

I just want to also say thank you, Chief, for coming in today and also keeping us updated, all the great work that you and your staff do, and also the great collaboration that we have with your department in our city.

52:46 – 53:38•Christi Fraga

Thank you, Chief. I do have a question also. Yes. First, I do want to thank you, your entire team. You're all wonderful. Great communication that we've always had. Obviously, the work that you do in our city from fire rescue to dealing with actual fire calls is extremely important, and we're very grateful for the quality service that we get from you. I did have a meeting with you and the city manager when she came in. Yes. And we talked about something that's very important to us and we've tried for many, many years to do, which is having some type of service on the second floor for permitting

54:33 – 55:07•Christi Fraga

Thank you, Chief. I really appreciate that. I think that would be a huge relief and help for both of us. So I look forward to seeing a positive outcome on that. And we'll do a weekend on our part to make sure we communicate to the county the importance of that and the efficiency it would create for our business community. And even our residents. So thank you very much. Appreciate it. I think there's no more questions. Any other comments, questions? Being none, thank you very much. We appreciate all the service that you give us. Thank you so much. And to your entire team. All right, we'll move on to the next item, discussion items.

55:54 – 56:06•Christi Fraga

Madam Clerk, before we move on, I do have a question for the city attorney. We do have two items for this property today. The second reading of the rezoning, I believe, as well as the site plan approval. Could we take up both items at the same time?

56:09 – 56:20•Christi Fraga

Okay, so let's go ahead and read the other item into the record now. Madam Clerk, I should have done this during agenda order. With business, I apologize. But I think for efficiency purposes, it's best to do them both together.

56:43 – 57:15•Christi Fraga

Okay, so I'm going to go ahead and open up the public hearing public hearing is open for item 2 5-6 304 and I'm sorry, but I'm pulling it up one second Item 25-6 2 5 6 I do believe I have one public comment for item 21 K which is Adriana Rubio de Natale. I'm sorry, I can't really read this.

57:59 – 58:22•Christi Fraga

Okay, thank you very much. All right, if there's any other public comments, that would be your opportunity for public hearing. Item 21A or 25-6304 or 21K, 25-6256. Being none. Okay. Public hearing is now closed and we will hear from staff.

1:04:24•Christi Fraga

Thank you very much. We'll hear from the applicant.

1:08:09•Christi Fraga

Thank you, Ms. Slavin. Any questions for the applicant or for staff? Yes, Councilman Pinero.

1:08:18 – 1:10:04•Rafael Pineyro

Thank you, Mayor. Well, more than a question is I want to share, since we're speaking about 79th Avenue, I do share your concerns about 79th Avenue. I mean, I think it's not a surprise how bad it already is when it comes to traffic, when it rains. Certainly for me, and it's not because of this project, Tracy, it's because I'm really concerned about when it comes to these type of approvals and looking into the future of the city since I understand the use, It certainly makes sense because that's what it is for, especially that area. Unfortunately, there has been some approvals in the past in th

1:10:43 – 1:11:28•Rafael Pineyro

Thank you, Tracy. And the reason of asking our administration is because I know 79th Avenue belongs to the city. Sometimes people, unfortunately it's not the county, it's the city. And 79th Avenue is an area that we still have a lot of work to do. Looking for the future of Doral, I think it has to be our priority. So I know there's some projects along 79th Avenue, if you can go over that. And also to clarify, some of the streets are private roads as well. So when it rains, obviously we have the issue on the side, on the east part of the 79th Avenue. Right, well, that's another one, yes. But if

1:12:21 – 1:12:58•Rafael Pineyro

And again, I just wanted to have that clarification as well because it is important for residents, for business owners to understand what we're doing on 79th Avenue as well, which again, it should be one of our PRIORITIES WHEN IT COMES TO IMPROVEMENTS AND OVERALL TO KEEP THE QUALITY OF LIFE IN OUR CITY, ESPECIALLY BECAUSE WE HAVE A SCHOOL ON 53rd STREET RIGHT THERE. SO I JUST WANT TO SAY THANK YOU BECAUSE I KNOW WE'RE MAKING SOME IMPROVEMENTS ON 79 AVENUE AS WELL. SO THANK YOU. YOU'RE WELCOME. THAT INCLUDES MY COMMENTS.

1:12:58 – 1:13:28•Christi Fraga

THANK YOU, COUNCILMAN. SO ANY OTHER QUESTIONS? So I do have questions for clarity, just so that it's on the record correctly. The rezoning that's being done is a parcel within the same property. It just happens to be a separate folio. Correct. So it's all the same property that's currently industrial, and there's an inconsistency within the same property. That's correct. So the purpose of the rezoning is only to create the consistency within the entire property. That's correct. There's actually not another building going there. It's going to be parking. That's correct.

1:13:49 – 1:16:39•Christi Fraga

Right. It's overly landscaped than what it used to be. I think one of the important things to remember in 79th Avenue for me is we're always talking about how to improve. It's one of the older areas of our city that needs a lot of attention. And we have very heavily prioritized this area and a lot of the private roads that are resident responsibility. We've actually gone above and beyond in trying to assume some of those. so that we can better assist and maintain them as much as we possibly can within our limitations. I think that when we see redevelopment in these areas, which are going to co

1:17:21•Christi Fraga

Okay. Any other questions for the applicant? I think Michelle has one comment she wants to put on the record. Sorry.

1:17:35 – 1:17:58•Christi Fraga

Thank you. Okay. You got that, Madam Clerk? Madam Clerk, you got that? Yes, okay. Okay, if there's no additional questions, then we need to take up two separate votes. No additional questions? All right, let's go ahead and take up the vote for item 21A first, which is the site plan approval. Motion. Motion to approve by Councilwoman Reynoso. Second. Second by Councilwoman Cabral.

1:18:08 – 1:18:22•Christi Fraga

Vice Mayor Porras? Yes. Mayor Fraga? Yes. Motion passes. Okay, now let's go ahead and take up the item 21K, which is the rezoning, second reading. This is also second reading for this item, correct? Yes, second reading.

1:18:27•Christi Fraga

Motion to approve by Councilwoman Reynoso. Second. Second by Councilwoman Cabral.

1:18:42•Christi Fraga

Yes. Mayor Fraga. Yes. Motion passes. All right, thank you very much. Thank you for attending, and thank you to the applicant. All right, we move on to item 21B.

1:19:22 – 1:19:47•Christi Fraga

All right, thank you very much. We're going to open up a public hearing for item 21B or 25-6305. Anyone who would like to speak on this item and this item alone, please approach the podium. I have no comment cards for this item at this time. OK, being no public comments, we'll close the public hearing. Madam Clerk, let the record reflect. No one has chosen to speak at this time. And we'll hear from staff.

1:21:20 – 1:21:33•Christi Fraga

Thank you. Any questions or comments for the planning and zoning director? Being none, I need a motion to approve. Motion. Motion to approve by Councilwoman Reynoso. Second by Councilman Pinedo. Madam Clerk, please call the roll.

1:22:05 – 1:22:18•Christi Fraga

Okay, I'm going to open up the public hearing for item 21C, item 25-6306. Anyone who would like to speak on this item, please approach the podium to speak on this item and this item alone. I do have one comment card, again, from Ms. Ariana Rubio Dinatel.

1:23:57 – 1:24:14•Christi Fraga

Thank you very much. Any additional public hearing comments? Final call for public hearing on 21C, item 25-6306. Being none, public hearing is now closed and we will hear from staff.

1:37:53•Christi Fraga

All right. Thank you, Michelle. I don't know if we need to hear from the applicant's legal counsel, but you can stick around for any questions. I think the manager has a comment.

1:38:55 – 1:45:06•Christi Fraga

Thank you, Madam Manager. So I do want to opine here and put this kind of into layman's terms, because I definitely don't want the wrong information out in the public. I've been dealing with this personally since I walked in. From day one, I did not necessarily agree with the negotiations of this when the increase in density was given to the applicant. I was not on the dais at the time. There was other people here. Maybe they can speak to why this was decided upon. This land was something that was a huge liability for the city, not only in cost, but in the fact that there was nothing we could

1:45:10•Nicole Reinoso

I do have a comment. Yes, Councilwoman Reynoso. That I did speak to the applicant before this meeting and it's not gonna affect my vote? Yeah. Just in case. Perfect, yes, thank you very much.

1:45:21•Christi Fraga

Any other comments? Yes, Councilman Bineto. Just a quick, okay. There's no expertise on this one, but I think you just wanna be careful.

1:45:32 – 1:45:47•Rafael Pineyro

Just a quick comment. I also want to echo what just the mayor just mentioned. Great job to the administration. I know great job to you as well, because I know you guys have spent hours and months, well, months, years already.

1:45:49 – 1:47:15•Rafael Pineyro

Yeah. The whole planning and zoning team since the beginning has been, I know, working on this. And also Miriam, Alejandro, it's good to see you here as well. You guys have done a great job too. I mean, I know it's hard when you represent a client, but I know the client has been also involved and they have been helping in the process too. Because at the end of the day is what the mayor mentioned. I mean, it's about we're one community. We have to work together in something that makes sense for the residents and the future of the city. The nonsense from the past is over. Now we make sense to a

1:47:16•Christi Fraga

Thank you, Councilman. Motion to approve by Councilman Pinero. Second. Second by Councilwoman Reynoso. Any additional questions? Okay, being none, Madam Clerk, please call the roll.

1:47:37•Christi Fraga

Motion passes. All right, thank you very much.

1:51:37 – 1:52:14•Christi Fraga

All right, thank you very much. I'm gonna go ahead and open up public comments. Didn't do that right before. Oh, I'm sorry. It's okay, it was my fault. I'm gonna go ahead and open up public hearing for item 21D25-6297. Anyone who would like to speak on this item, this item alone, please approach the podium. I have no comment cards. Being none, public hearing is closed. Madam Clerk, at the record, no one has chosen to speak at this time on this item. Okay, is there any comments, questions for our code compliance director? Motion. Motion to approve by Councilman Reynoso. Second by Councilman Pinedo. If there's no additional questions, Madam Clerk, please call the roll.

1:52:23•Christi Fraga

Yes. Mayor Fraga? Yes. Motion passes. Thank you, Code Compliance and Mr. Estrada for the presentation.

1:52:58 – 1:53:23•Christi Fraga

Okay, I'm going to go ahead and open up the public hearing. Public hearing is now open for item 21E or item 25-6309. Anyone who would like to speak on this item and this item alone, please approach the podium. Okay, being none, we close the public hearing. Madam Clerk, I give the record reflect. No one has chosen to speak at this time. And we will now hear from staff. Code compliance again.

1:54:31 – 1:55:06•Christi Fraga

Motion to approve by Councilman Pinero. Second. Second by Councilman Reynoso. I do have one comment because I do want to put this on the record. I'm not usually in favor of providing for penalties as an incentive. However, for many, many years, we have had no penalty. And what happens is businesses will go 5, 10, 12 years, we've seen, and they've never pulled a BTR. So to my understanding, this penalty is a one-time $250. So if you've had your business here for three years and you weren't caught, Basically, you pay the one time $250. It's not $250 for every year that you were operating, correc

1:55:07 – 1:56:03•Christi Fraga

OK, so I do think that this is reasonable. And we should have something in our code to make sure that there is a penalty for those who don't comply. But I think more importantly, we need to start focusing on incentives that we provide additional resources to the businesses in our community that do apply for the BTR. They should have an incentive, right? You apply for a BTR, you're getting something in return. small, but some of that should go into business resources. So we are working on that. I just wanted to say that. We're working on it through the city manager's office. I've been working w

1:56:05•Christi Fraga

All right. If there's no additional comments or questions, please call the roll.

1:56:38 – 1:57:15•Christi Fraga

OK, I'm going to go ahead and open up public comments for item 21F, also known as 25-6319. Anyone who would like to speak on this item, please approach the podium. Being none, public hearing is closed. Madam Clerk, like the record, no one has chosen to speak at this time on this item. And this is my item. So this is basically what I brought last month, amending the Code of Ethics and Truth in Advertising Policy in line with our Citizen Bill of Rights, just basically codifying it, making sure that we hold ourselves accountable to the highest standards of ethics and transparency. If anybody has

1:57:19 – 1:57:33•Maureen Porras

So part of the changes here under Section 2-398, Enforcement and Penalties, I see that we are removing the ethics commission from being able to investigate violations. Is that correct?

1:57:33 – 1:58:07•Christi Fraga

Or how does that work? We're not necessarily removing it. It's that the IG now oversees our code. So the ethics department does not oversee our charter or our code, necessarily. They oversee state statute or ethics violations that may be brought to their attention. But many times, they throw them out because they're not the responsible. and Lorenzo can speak to this matter, but they're not necessarily the enforcement agency over our direct code and ethics. It's our IG now, Inspector General.

1:58:23•Maureen Porras

So it's my understanding that the Ethics Commission has jurisdiction over municipal code of ethics?

1:58:52 – 1:59:42•Maureen Porras

I know this is first reading right. So we can you look into something and I found that after we had our agenda review on the The creation of the Commission of Ethics and Public Trust, Section 2-1068, I'll give you that jurisdiction, says that the Ethics Commission has jurisdiction over any person required to comply with county or municipal code of ethics ordinances. I just want to make sure that they retain jurisdiction. I know we can also go through the Attorney General, which is what they're here for, but I just want to make sure that If they have proper jurisdiction as well, we can also go

1:59:42 – 2:00:11•Christi Fraga

Yeah, so I don't believe even if it's not stated in our code that we ever are precluding the ethics department, the Miami-Dade County Ethics Board to... impose any violations or penalties. They have the authority to oversee whatever falls within their ability, but many times things have been referred to them and it's been

2:00:25•Maureen Porras

Because our direct investigator. Correct. Yeah. If you can look into it, I'll give you the information. Thank you. Okay.

2:00:32 – 2:00:43•Christi Fraga

All right, so we need a motion, if there's no more questions. A motion. Motion to approve by Councilwoman Reynoso. Second by Councilman Pinedo. If there's no more questions, Madam Clerk, please call the vote.

2:01:16 – 2:01:30•Christi Fraga

Okay, I'm going to go ahead and open up public... hearing on item 21G, also known as 25-6321. Anyone who would like to speak on this item, please approach the podium. I do have one comment card for this one. I believe it's Sabrina Grimm.

2:01:55 – 2:02:23•Christi Fraga

Oh, I'm so sorry. This is 21G. I'm sorry. We're in 21G. I had the paper on the wrong one. Is there any other public hearing items for 21G25-6321? Being none, okay. Public hearing is now closed. And we will hear from Councilman Pinedo or from staff.

2:02:25 – 2:04:30•Rafael Pineyro

Thank you, Mayor. As you may recall, during the August 13 of this year, we approved and we instructed the city attorney to draft legislation providing for age and safety equipment and for a schedule of fines for violations related to the ordinance about micromobility devices. As you might know, the Florida statute, the Florida legislation amended Florida Statute 316-2128 to provide municipalities with greater authority to regulate micromobility devices on the right of way. And I want to take this opportunity to thank our city attorney and administration for working on drafting this part of the

2:06:30•Christi Fraga

Thank you, Mr. City Attorney. Councilman Pino, would you like to add anything?

2:06:33 – 2:07:43•Rafael Pineyro

Sure. I just want to make a quick comment. Thank you once again to our City Attorney. One of the things that I thought was very important was to certainly, and it's something that we're going to be hopefully moving forward with, which is the educational component. Hopefully once we approve the second reading, one of the requests that I will make to the administration is to launch an educational campaign through the police department and our public affairs department through the mayor's office as well, that we can start informing the residents about these new ordinance the regulations and also

2:07:44•Christi Fraga

Thank you very much. Any other comments or questions? I do. Motion. A motion to approve by Vice Mayor Porras. And there's a question from Councilwoman Reynoso. Councilwoman Reynoso.

2:07:53•Nicole Reinoso

Thank you, Mayor. I think this is a great item. And if allowed, I would love to co-sponsor it. Yeah.

2:08:01 – 2:10:15•Christi Fraga

All right. I also just have some quick comments. I think this is also extremely necessary. We obviously have all heard the concerns about the micro mobility, especially with children or minors. I did get some questions from some people just making sure that this wasn't going to affect bicycles, which I think that was clearly stated that it's a motorized bicycle because it did say bicycle. So some people were worried that bicycles, some kids ride bicycles to school. So bicycles, normal bicycles are not impacted, but if they do have a motor, that's where it's impacted. But it also is very import

2:10:49 – 2:13:03•Christi Fraga

All right, I'm going to open up public hearing for item 21H- I'm sorry, 21H, also known as 25-6329. Anyone who would like to speak on this item, please approach the podium. Being none, public hearing is now closed. Madam Clerk, like the record, no one has chosen to speak at this time on this item. And this is also my item. I will also have the city attorney opine if need be. So council members, this item was brought forward for two reasons. One, the charter change that was implemented in 2024 required us to adopt some type of policy for reimbursable expenses. We do have the stipends, but this

2:13:05 – 2:13:21•Maureen Porras

So just to clarify, this is only revising the reimbursement policy. Everything else, how we've been doing it, requesting the tickets through the clerk or through the purchase orders remains the same? Correct.

2:13:23 – 2:13:53•Christi Fraga

Yes, the other thing that stays the same is the per diem for travel. So if you travel, you get your per diem check, like always. Again, this just has an additional set of eyes for compliance, transparency, accountability, because there is a lot of reimbursable expenses being done. So you can see how I went ahead and had the clerk circulate. Those will come through the mayor's office now for approval for reimbursement. And that way we can also be accountable for what we're spending our tax dollars on.

2:14:09 – 2:14:50•Christi Fraga

That's correct. There also was not a codified policy or ordinance on the per diem for travel, and so we felt that that needed to be codified as well. Now, again, the events is the only one that is not here. If that is the desire of the council to also include that, we can, so that they all have to be done through PO. And if you do have to pay for it last minute, then that would have to be done through a reimbursement. But we didn't include it for the purpose that I do know that there is, from experience, last minute events sometimes that have to be paid through with the city clerk's credit car

2:15:02•Christi Fraga

Motion passes. All right. We move on now to item 21I.

2:15:23 – 2:15:37•Christi Fraga

Okay, I'm going to go ahead and open up the public hearing for item 21i, also known as 25-6330. Anyone who would like to speak on this item, please approach the podium. I do have a comment card for this one. I apologize. I thought you were here for micromobility. And this is Sabrina Green.

2:18:29 – 2:18:45•Christi Fraga

OK, thank you very much. Thank you. Any other public comments for item 21i, 25-6330? Being none, public hearing is now closed, and I believe this is Vice Mayor Porras' items.

2:18:46 – 2:19:41•Maureen Porras

Thank you. So currently our city's code allows for the regulation of private parking through the immobilizing and towing of illegally parked vehicles. Right now, the owner of a business has to provide 30 minutes or afford 30 minutes to someone that's illegally parked in their space, which has, as we've heard, Caused a lot of a big impact to the businesses that are right now not just this one But it could be causing impacts to other businesses, too so the request is to reduce that time limit and what this ordinance does is reduces the time limit that the owner has to wait until they can enforce

2:20:10 – 2:21:13•Maureen Porras

Yeah, and obviously it's been impacting this business The one that's being heard is the actual business that's in our city by illegally parked vehicles who have taken advantage of it and They have tried to work out work something out with the business on the other side Which has also caused a lot of traffic jams during certain peak hours and so I think this is very you know, fair to help alleviate some of that stress and burden to our business owners. And I hope that the council can support it. I don't believe that there's a change in the fine, correct? We didn't include anything in the ordina

2:21:15•Christi Fraga

We'll look that up. In the meantime, I do have some comments. I don't know if anyone else has some comments. OK, Councillor Mayeron also.

2:21:22 – 2:23:09•Nicole Reinoso

Thank you, Mayor. So it only came to our attention right now that this was a particular situation that caused the onset of this item. I do think perhaps additional conversation should be had with this particular business. Second, as part of the memo that was turned into us, Part three said, and the question that is asked is good faith estimate of numbers of businesses likely to be impacted by the ordinance. This is not applicable. So other than this instance, I don't know what other business would be affected. So I think this needed to be clarified within the memo and the ask. Right now, I do

2:23:09•Christi Fraga

I'm sorry, we can't have a debate from this audience, okay? You had your public comments. Now it's the council's turn to debate. Okay, so thank you. Anyone else? Yes, Councilman Pinedo.

2:23:20 – 2:26:51•Rafael Pineyro

Thank you, Mayor. First of all, thank you for coming because it's the only way that sometimes we get the information or you send an email as well. And I understand your frustration. I mean, if I was a business owner or the management company, I would do the same. So thank you for bringing this to our attention. However, I think that for your problem right now that you're facing right now, and I agree in part with Councilwoman Reynaud, so I don't think that lowering the time 10 minutes will resolve your issue because cars will keep parking there. That's a reality. So however, I think that you n

2:26:54•Christi Fraga

Yes, do you mind if I make my comments real quick too? Yeah, thank you. So I do want to comment on this as well too.

2:27:00•Digna Cabral

Council Member Perino, were you concluded? Just wanted to make sure, okay.

2:27:04 – 2:30:48•Christi Fraga

So I agree, I think that the problem with this is that when we modify it, it impacts the whole city. So it's not just your property. And I fully understand the situation you're having. And I empathize with it. And I want to help you guys. And so we will definitely have conversations about how we can help you. But making this change impacts everybody. And then what we're going to get is just emails from residents that are upset because they went there and they got booted. And that's not your fault either. You're protecting your business. But we want to protect the well-being of the entire city

2:30:49 – 2:31:12•Nicole Reinoso

And I'm sorry if I seemed at all insensitive. Again, it's just this problem that we didn't know was particular to one business was not made apparent to us until right now. And I am viewing it as how it's going to affect our community as a whole. Now, is there any way that we can defer this item so we can have some time to kind of...

2:31:14 – 2:31:39•Christi Fraga

No. No, I think there's other solutions. I mean, I won't be in favor of deferring it because we're just giving the false hope that it's going to be reduced at another time. In my... Hold on. We can answer your questions after, but we don't take questions. It's not a debate between one and the other. Okay, I'm sorry. But then we set a bad precedent. So is there any other? I want to clarify a couple things. Okay. Vice Mayor Porras. Yes.

2:31:39 – 2:33:42•Maureen Porras

So we were talking about cars that are illegally parked in private property. We are trying to protect and also respect the rights of private owners who have tried everything, including having the booting company there telling people, kind of like an attendant, telling people not to park there because it is illegal and they're ignoring it because they know they have 30 minutes. Does that make sense? So they're literally parking despite the warnings that they're being given because they know that they cannot legally be booted or they're not legally in violation of anything until after 30 minutes

2:33:42 – 2:35:12•Christi Fraga

Okay, we have a motion to approve on the table by Vice Mayor Porras. Second. Second by Councilwoman Cabral. Any additional questions? OK, if there's no additional questions, I just want to say it again. I understand all the concerns. And again, there is. Absolutely correct. This is private property and people are parking illegally. That's why there's penalties The penalty is 30 minutes so that people can be booted and get off so there is Ways to to remedy this issue I again I don't think that by lowering this you're gonna get a solution and I think what you're gonna get is more upset residents

2:35:25 – 2:35:49•Christi Fraga

Okay. I did ask... my team to look for the email that we responded to, as well as the chief. If you'll either wait for us to finish at the end, I'm happy to answer your questions. We don't get into debates after public comments. If not, you can step outside, and I'll have, through the manager, the chief speak with you on the issue. And then we will be reaching out to make sure we help you as much as we can, OK? Thank you. Thank you for being here.

2:36:19 – 2:36:50•Christi Fraga

All right, this is item 21J, opening a public hearing, also known as 25-6255. Anyone who would like to speak on this item, please approach the podium. Okay, being none, public hearing is now closed. Madam Clerk, may the record reflect? No one has chosen to speak at this time, and I believe we will hear from staff. No changes? No changes. Thank you very much. All right, this is second reading. There's no changes from first to second. Motion. Motion to approve by Councilman Pinero. Second. Second by Councilwoman Reynoso.

If there's any questions, I don't believe there's any changes. No changes. Okay, any questions? This is special exemptions or conditional uses. I need a motion to approve. Being none, Public hearing is now closed. Madam Clerk, I have the right to reflect. No one has chosen to speak at this time, and I believe this is Councilman Pineda's item.

2:38:50 – 2:39:04•Rafael Pineyro

Thank you, Mayor. No changes between first and second. The only, well, there's a, yes, there's a few changes, but there's also a presentation. So I'm gonna let our city attorney to take over from here.

2:39:52 – 2:40:03•Christi Fraga

I'm sorry by vice mayor porras second second by councilman Reynoso If there's no additional questions, comments, concerns, Madam Clerk, please call the roll.
