Okay, we'd like to welcome everyone and call to order the regular meeting of the West Valley City Council this February 10th, 2026. And we're beginning our meeting at 6:30 p.m. in the council chambers of West Valley City Hall. We have all members of the council present. Council member Wood, Council Member Wedstone, Council Member Harmon, Council Member Hume, myself, Council Member Christensen, Council Member Norfeld, and we're also joined at the DAS with our city manager, Mr. Peely, and our city recorder, Miss Kamik. Our opening ceremony tonight, we'll turn the time to council member Wetstone.
Thank you, Mayor. Uh tonight I'm pleased to welcome members of the Cypress High School choir. Cypress High located in Magna serves many students in West Valley City and they have a strong connection to our community. Um I had the opportunity to attend Cypress for a short time. Two of my daughters graduated from Cyprus and my I have a son-in-law that currently teaches there. And so we appreciate these students taking time out of their evening to join us. And if everyone would please rise and place your hand over your heart as they uh give us the national anthem.
Say [singing] by the dawn early [singing] light. What so proudly we held at the twilight [singing] last gleaming who brought stripes [singing] and bright stars through the perilous [singing] or the weed were so The rockets red. The birds bursting in gave proof through the night that our flag [singing] was still there. Yeah, that's what I thought I was gonna do. Okay. So, I I'm confused. Sorry. Nope, you're all fine, but I'll talk. So, speaker two, if you're here for just public comment or if you have a specific Okay.
Good evening. Um, I'm speaker 2. My name is Dan Bell. I'm here to very respectfully speak about the recent pricing changes at Stonebridge and the Ridge golf courses in West Valley City. The three topics I want to bring up specifically are the the walking rates for the players pass, which I know has been added to the end of tonight's agenda already. Uh the city's role in raising prices at the public golf courses, and then finally the the credit card fee has been added to the rates at the golf course. Um starting with the players pass, and I'll try to be to be brief here. Um, I know it's on the agenda, but the players pass walking rate on the weekends was raised from $20 to $50, and the walking now costs the same amount as a cart. Uh, in my experience, I've never encountered at a golf course, either public or private where the price to walk is the same as the price to cart. Uh, especially with walking having lower operational costs and environmental impact and significant health benefits. Um, I think the current structure discourages this healthier, lowerc cost option and devalues the players pass itself. Um, industry standard is $20 cheaper for walking. I know discounts are already included in the players pass. Um, I would advocate for weekend walking rate of $30 and a midweek walking rate of $25 in alignment with what's been set for the the driving rate. Moving on specifically to uh the rate setting at large. Uh we all know Stonebridge is a municipal course on public land funded by public dollars uh public dollars. Uh its mission in my opinion should be to be to balance revenue but balance it with access, affordability and community health and not just capitalize on opportunities to raise the prices. I am by no means advocating prices should not be raised going into this season. Just asking that price increases be intentional, transparent in the reasoning for them. um and sharing that thoughtfulness with the with the community. Um with that in
mind, Stonebridge and the Ridge are the only public golf courses in West Valley City. Uh this inherently creates a monopolistic situation simply because residents do not have an alternative and price increases aren't con uh confined by competition. Um, and so this is just, you know, something to keep in mind given that the the assets are publicly funded, the land is publicly owned, and the service is intended for the recreational use of the community. Uh, finally, to wrap things up, um, this season, a 3% credit card fee was added. Uh, with rates of $50 to $75 for around, these aren't insignificant in my opinion. Um, they feel a bit excessive, especially at a city facility. Um, given that credit card fees are essentially a basic cost of doing business, um, I would ask that the the council can or the mayor consider removing those or offering a a cash or debit card discount. Um, not asking the city to lose any money, just asking for perhaps more reasonable adjustments uh to restore the walking discount, remove the credit card fee, and provide transparency in how increased revenue may be uh invested to support the golf course. I think I'm here more on a [sighs and gasps] I don't know if this is something that the city is already uh addressing, but I have found that in our neighborhood since 2020, there has been an increase in marijuana smoke uh that is permeating our homes and our neighborhoods. Uh, I am woken up at 2:00 in the morning, 3:00 in the morning, sometimes 4 in the morning with the wafting of marijuana skunk smell marijuana. Um, and sometimes heading out to work at 6:00 in the morning or 7 in the morning, sometimes 11:00 p.m. at night, sometimes 10:00 p.m. What I'm just saying is our city is being inundated with um, illegal marijuana use. I think there's a lot of people who are confused about the laws with medical marijuana use and our neighborhood where I live. um it has become it doesn't make it very nice and we have a beautiful city. Sorry I get a little bit emotional but I love West Valley and I have a right to not be subjected to illegal use of drugs. And yet sometimes when we call officers um their hands are tied and as to what they're able to do. And so my my question is more what is the city doing? I know that the Karns Coalition is working to address this issue in their community and they're trying to do it through education and I really feel like if we
can educate the members of our community so that it's not so normalized that people realize the harm that does come from using this drug and recognize what the requirements actually are with the laws for those who have a medical right to it and making sure that people are educated in the right ways. That's one of my concerns that has been um happening that has made my neighborhood p personally not very nice to be in. Um it wakes me up at night feel nauseous. It comes into our home even with our windows closed and um it waves from homes that can be several homes away. And so it's just been a frustration for me as a resident of the city. And the other issue that I wanted to also address just for this time is um we see an increase in the many dirt bikes going up and down the canal roads as well as our main roads as well as the uh walkways. Thank you.

Speaker three I mean four. So, I thank you, mayor. I'm thankful for this opportunity to bring this also to the West Valley City attention. If you're already not aware, um I with my job, I am part of the Karns Coalition even though I live in West Valley City, but my job I represent the Krens Coalition um with my job. And that is one of the things that they have brought to the attention is that the problem is stemming from um a normalization in the family. and we asked one of the youth council members from Kurt High the um last night and she about what the problem is. Is this from school or not? And she said no, they perceived it as more as something they go home and it's normalized at home. And then we discussed also how adults my age are smoking the marijuana. And then yeah, there is the conflict as well with the um with the medical use and people not understanding because I've had people say, "But I have a medical card." Well, that's great, but the laws are you can't smoke it. You can't vape it unless very specific. So, I think I just want to bring it to your attention that in my neighborhood, it is really bad. Um, some mornings at 4:00 a.m. in the morning. Um, I have neighbors to the north that smoke it, usually around 11:00 p.m. I have neighbors to my southwest that smoke it. I drive down the road, people are smoking it. You can smell it when you drive by. The skunk is not that bad in West Valley City and it is I mean, occasionally you're going to have a skunk, but not this many times during the year. I drive down the road up um by 4700 um south and about 4,800 west. All up and down that road. You can just go up it, you smell it. Um I just wanted to
bring it to your attention that I think it's a bigger problem and if you aren't aware, it is a big problem in West Valley City and it's not it's not healthy for us. It stinks really bad. It comes in through my windows and if you're smelling skunk, it's most likely marijuana. And I just want to thank you for the opportunity to be heard and just to make you guys aware if you're not already aware. Thanks. Thank you. Speaker six, [snorts] Rosa. I think um a different one. Um, my name is Kimberly Sears and my address is 1345 West, 20280 South. Um, and I just also wanted to make a comment on the Ridge Golf Course on the Stonebridge Golf Course. It was recently brought to my attention by my friend and neighbor Tom Hune that um the golf courses offer free golf passes to city council members. Um, that didn't seem right to me. Um, because to my understanding, it's kind of a conflict of interest thing. My brother is an elected city council member in Springville City down in Utah County. He recently received two um, Hail Center Theater tickets for $27 each. He had to give them to city staff because it exceeded a $50 limit rule that they had. Obviously, the monetary value of free golf is a lot more. So, [snorts] I didn't think that was right. And while we're on the subject of the golf courses, it's also my understanding that they're subsidized by the city to the tune of several thousand dollars a year. And I think that that um money could be better directed to things that are more available to more people to be enjoyed. It takes a fair amount of time privilege and money to be able to go golf, but there's other things like the West Valley Family Fitness Center, public events, parks that can be available to everyone, not just to a select few. So that's my comment.

Um I probably won't ask Mr. Peely to address the 3% credit card because I don't want to mess it up. Yeah, we we've talked about that mayor and um we'll we'll look at that um with our staff and see where that was. For us, it's really just about covering costs. That's why we implemented it. But as we've talked, we talked about our increases that we've had and how we can absorb it otherwise. But yeah, [snorts] we we'll um we'll take a look at it and come up come up with a solution.
Okay. Thank you. And and then I guess while I'm on it too Yeah, sure. Um we can maybe get the staff can get with some of the comments that have been made specifically the area. Um we can um one of our res you talked about we I guess we can look at that area and send [snorts] some photo around there. But um there wasn't there was one more thing that we was mentioning. Oh, the dirt bikes. Yeah, the dirt bikes. They're a problem in my neighborhood. Just just where if we can know where you live that we can It's on here.

Mayor, I was just curious along with that the smoke. I mean, that's something that's been an issue in my neighborhood as well, and I'm curious if maybe that could be a study meeting topic to just understand what the city's legal authority is when it comes to um not just the skunk smell, but other smells that may be um impacting other neighborhoods. Just I don't know what the city's legal right is to restrict that. Maybe a future study item. Okay. Yep. We can move for that to be on a communication. We got it. Okay. Okay. Seeing no other comments, we'll move along to our public hearings. A public hearing is being held in accordance with Utah Code 10-3-818, which requires municipalities to provide notice and allow for public comment before approving compensation changes for executive officers. So, we will move on to the next item. So, we'll go to we'll now consider application Z8205 filed by Wadsworth Development Group requesting a zone change from light industrial to manufacturing for property located at 5750 West 2300 South. The applicant is proposed proposing to
develop a new headquarters for King King Bans on the property. This would include shop space for the upfitting of vans and light commercial vehicles within the facility as well as secure outdoor parking for new vans stored on site. I will now open the public hearing. Is there anyone wishing to speak on this matter? Um, I really wanted the development agreement to state that nothing nothing stored in the property could um like supporting equipment could go above the six-foot fence. So, okay, Miss Kamik. Okay, we'll now move to [clears throat] um accept our final public hearing is for application Z92025 filed by Cal Johnson requesting a zone change from agriculture to general commercial for property located at 5459 5477 and 5491 west 4100 South. The property owner would like to build a commercial development that includes a mix of office, medical office, general office, retail, restaurant, and fast food uses within a total of 33,687 square feet of buildings. I will now open the public hearing. Is there anyone here that wishes to speak to this matter? Okay, just come up and give us your name and address.
Hi, I am Chris Vicero. I live at 5443 West 4100 South. Um, I am right next to this development that's happening. Um, between the traffic on 41, the pedestrian of the high school, I have to back out of my driveway to get on to 4100. Yesterday it took me almost 10 minutes just to back up. So if I have all of this extra restaurants, medical center, all of these extra things, the Mountain America Credit Union or whatever I heard I between that I don't know if I'd ever get out. So I'd have to rearrange like that's impossible for me to be able to get out with all of that extra traffic. Also, I am opposed to anything being next to my fence. I have a sun room that is basically glass that if you build anything next to it with any type of neon lighting or anything like that that is going to go right to my house inside my house, it's going to light my house up like a Christmas tree. So, it needs to be higher than a six-foot soundwall in order for that lighting not to come through. And that's all I have.

Hi, my name is Rosa Fiero and I reside in Mina 3591 South 8,000 West, but I'm here because my mom lives at the property which is connected to this development. And we are coming here because we are extremely worried about my mom and her privacy. We haven't had anybody reach out to us regarding offense. We we are not asking them or mandating offense um on that west side of the property and towards the north side. So that L shape. Um my mom doesn't have the funds to build a fence. With all that development and fast food and um medical um clinics, we are uh pretty concerned for her um privacy. Um we have nobody has reached out to us regarding um any plans. Um, we feel like my mom has been attacked by some type of so suddenly animal services were there. Uh, the city um regulations and permits were there. Um, my mom had chicken coops and she does have farm animals. She had to demolish most of it. So, um, it's it's better. The property looks better. But um regarding that privacy fence um we are just you know requesting and please keep in mind that my mom is by herself. She does um live with her you know um partner in crime. Um but we are really concerned for her safety and her um because all that traffic and and people from her backyard into her

Jerry Vic Carol 5443 West 4100 South. Specifically, what I want to point out about the development, our house is right on 41, and they want to put a drive-thru right next to my whole side of my house, right next to the fence with a a menu board. And so, the cars will come around to that menu board, which will be loud, and they'll all line up next to my fence to come to the front window. So, there'll be non-stop cars next to my fence idling. uh between that and the noise that that business is going to provide. We just feel like that's irresponsible to put that building next to us that that business. Thank you.

Good evening, Mayor Council. I'm Cal Johnson uh representing Cory Rush on the project. Uh I just wanted to note to the neighbors that we are doing the 6oot solid fence. So there will be that sixoot solid fence. Um and as well as uh meeting the code with the landscape screening. We did in the study meeting a couple weeks ago um have the ask about an exception for the drive-thru menu board in which case if that were granted we would increase the landscape buffering um larger trees more shrubs larger tr shrubs uh to further screen that. Um but uh our our proposal is to follow the code with the uh installation of the six-foot solid masonry wall along that that whole side there. Also in in relation to concern about traffic, we're going from the four access points that currently exist and going down to two access points that would align with the access uh straight across the street um from the recommendation from public works so that we can make sure that those access points are as safe as they can be uh with the development of this project. My name is Margarita Fierro and I am the owner of 4130 South 5400 West. Um, and I'm also concerned like the Veraros like the privacy, the noise, especially having like the hospital like with like the fence like footage would have to be higher. especially they have a hospital with like higher stories, more stories, more light. If they're going to have parking and stuff, they're going to have higher poles with more light. Not only the sound, the light, the drive-thru. Um, and I'm also concerned for the canal. Uh, you know, the fast food creates a lot of trash and stuff. So, how is that going to work with the community? And I also feel that it's like pushing like the people the four families or that are left there in that um Engle property kind of pushing us out um forcefully with all this development. And I would wish there could be some type of compensation or something from um from that if the case has to be that we would have to relocate. Um as previously um Rosa mentioned, we've already had to relocate our animals, destroy our chicken coops, and it's kind of forcing people to not be selfsufficient. kind of more relying on other type of food. My mom is more like a farm um lady. So, she likes, you know, she could move to somewhere where is more farm, but this is the original plan when she bought it in uh 20 we bought it in 2018. Like she had the property, you know, she had the space, she was not
bothering other people. The property with the barn has almost two acres, so she wanted to be self-sufficient, but all this development is pushing her um like her livelihood out. Okay. Thank you. Appreciate it. Okay. Thank you,
council members and mayor. My name is Adam Watts uh with Riby Watson Company. I'm involved in this project with uh Mr. Russian more on the medical office side and so I wanted to just speak uh quickly to that. Uh the plan here is to have two medical offices. They are not um hospital grade uh by any means but uh think of your medical providers that you all attend and dental providers. That's kind of the idea and the concept here given the hospital that's going in. Um the idea is of course to comply with all city code as it relates to the parking lot. Uh all those lights there will be dark sky compliant per your city standards. Uh the 6oot pre-cast concrete wall will not only of course be on that east side of the property to protect against the residents as the city code requires but we'll also wrap all the way down by the canal as well. Um, as far as trash and things like that, that's our responsibility to take care of on the back side of the property. There won't be retail or drive-thru back there. Um, and both of the buildings that we have conceived of here for this kind of back portion of the project, uh, will be over 100 ft removed from property lines for further privacy, noise, and and light pollution. So, um, just wanted to kind of lay out, uh, some of those items for for all of you and appreciate your time. Thank you.

Good evening, council. Cory Rushton, uh, 5491 West, 4100 South. Um, appreciate Steve pasturing the council's time as we've worked on different iterations of this over the years. Um, phase one's underway with the Mountain America Credit Union going over there. And I think um, you know, the only thing that I'll add and maybe even uh, to to Caling here and Adam on meeting all the city ordinances is that we're actually planning on exceeding all the city ordinances on all this with, you know, we have update extra parking on this. We're going to have upgraded extra standards of walls. We're going to have updated kind of landscaping and top-notch tenants on this. And said, we live in the neighborhood. It's a special place. It's It's tough to see it go to from a nice serene farm to uh um you know, progress, but it you know meets the city's general plan. It's what's going on in the other corners and and uh it's it's progress and we're going to do a good job. So, thanks for your time.

I am Tiffany Anderson at 5015 West Valley View Drive, West Valley City, Utah. I live a short distance from this. Um, my concern is mostly as I go through West Valley, I will see big developments come in and they take up spaces that could be residential housings. And we always talk about housing issues. We need more residential housing. We need more open space and park space within our cities. Uh my concern here is as you develop these areas, we drive through the rest of West Valley and other areas where they've brought in development, you see for lease signs, for sale signs, buildings going empty. My concern is that we would bring in a development project that would boom for five, 10 years and then suddenly have these empty buildings. I would encourage looking for other spaces that are already created to house these same things within our city limits, but to further develop these areas into neighborhoods and uh park plans and things that will beautify the residential spaces of our our city. Oh, sorry. Suzanne Anderson, 4640 West, 4,400 South in West Valley there. I've grown up here in this neighbor in this general area, not far from this location here. And um when I first see this, I appreciate and understand what Corey is trying to do. I understand that they own that land. I believe um is my understanding. I understand they're trying to make a profit on it. I get that. But I think that there could go to other uses where they could still profit from it, give more space, maybe housing, something else. But I think space is critical also. I see a problem here [snorts] besides the neighbors and what they're going through. I think that definitely needs to be addressed. And the traffic, it is an issue, but I also see more problems because of the continual traffic on that back canal road. I think that there's going to be more traffic, more teenagers using that, creating more problems, more trash. They say they'll clean up the trash. I'd like to see them do that. Um, that's a that's going to be pretty tough, I think, back there. I also think that that would be just nice to have more space. Um, not so many buildings anymore, not so much traffic. I I do not think this is a good idea at all. I feel for the neighbors around. I would be really upset if I was living near there and they were making plans to do this as well. Ordinance 26-04 for the zone change and resolution 26-09 for the development agreement to the council. I have a comment where you had a question. Mayor, I just uh Mr. Rston mentioned standard that exceeds city ordinance on the wall. Do can staff or the applicant address that? I
do you want Mr. Pastrick to come up and answer some questions? if he Yeah. If he has that or Yeah. I don't Or whoever has that. Yeah.
So the the code requires whenever you have a commercial development, a new commercial development going in next to residential that there be a a six foot tall masonry wall be constructed. Uh right now the development agreement doesn't require anything beyond that. So, um if they wanted to enhance that, um they certainly could, but there's no right now there's no requirement that they do anything above what's in the code. Okay? So, they're not exceeding standards of what's required.
The there's no there's nothing in the development agreement that would hold them to that. Now, they may they may be planning to do that. It's just not spelled out in the development agreement. We have um fencing height in our code that would prohibit them to do anything higher than six feet. So it's there's a section of the code that talks about going taller u through the zoning administrator. So the zoning administrator being allowed to grant a taller height. But in a development agreement, the council could also do that. So, one example would be um just down the street from here, there's the Chick-fil-A and Leashwab that's going in on 27th. The wall there in the develop agreement was 8 feet tall. So, that was a requirement in that case given the joining homes.

Um, you all know the the saying that change is the only thing that's constant in our lives. And I mean, I live in this area as well, and it's hard to see things change. The other thing that we have to realize is that a property owner has a right within the the zoning ordinances of the city to do with what they want to do with their property. And this is a zone that's available for this property. So, um I think there's some good things here. I do like that. Um right now we have four places in and out of that property. that's going to be limited down to two and it's going to be right along right across. So, Ivana is going to be there and can't remember the other road. Um, so so that access in and out is going to be eliminated. I I wouldn't be opposed to adding to the development agreement on the west side or on the east side where it's next to residential to potentially require a higher fence. We did that over here with the Chick-fil-A and Lewab because those neighbors were concerned about the sixfoot wasn't going to give them the privacy that they needed. So, um that might be something that we want to consider with that. But I I think as you look at the overall map, if you want to go back to the one where it's it's commercial around there and the other thing that and I mentioned this earlier that as I always say, what's the right thing to do for this property? And yes, we need single family housing, but is this the right place for single family? Is it the wrong place for single h family? So, you can see there's a Mountain America, there's CVS, there's
America First, there's, you know, it's all commercial. So, you know, I I think that kind of flows with that. So, I would like to propose that on that east side next to the residences that we increase the height of the fence. They said that they're going to exceed it, but I think it'd be better if we put it in the development agreement. So, that's what I would propose, but that the development agreement's the second item there.
